 நக்கீரன்

இந்திய – இலங்கை நாடுகளுக்கு இடையில் யூலை, 29 1987 இல்  ஓர் உடன்படிக்கை கைச்சாத்திடப்பட்டது. அதன் அடிப்படையில் 1978 இல் இயற்றப்பட்ட யாப்புக்கு 13 ஏ  சட்ட திருத்தம் 14 நொவெம்பர், 1987  இல் நிறைவேற்றப்பட்டது. மாகாண சபைகள் சட்டம் 42 (1987)  மாகாண சபைகளை உருவாக்க வழிகோலியது.  அரச ஆணை மூலம் பெப்ரவரி 03, 1988 இல் 9 மாகாணசபைகள் உருவாக்கப்பட்டன. 02 யூன், 1988 இல் 7 மாகாண சபைகளுக்கு தேர்தல் நடந்தது. தற்காலிகமாக இணைக்கப்பட்ட வட – கிழக்குக்கு 19 நொவெம்பர், 1988 இல் தேர்தல் நடந்தது. யூலை 1990  இல் அது கலைக்கப்பட்டது. 31 டிசெம்பர்,2006 அது கலைக்கப்பட்டு மத்திய அரசின் நேரடி ஆட்சிக்குள் கொண்டு வரப்பட்டது.

இந்த மாகாண சபை முறையின் ஊடாக, காணி மற்றும் போலீஸ் அதிகாரங்கள் மாகாண சபை வசமாகின. மாகாணங்களில் உயர் நீதி மன்றங்களை உருவாக்கவும் சட்டத்தில் இடம் இருந்தது. எனினும், மத்திய அரசாங்கம் இன்று வரை மாகாண சபைகளுக்கு அந்த அதிகாரங்களை வழங்க மறுத்து வருகிறது.

வட- கிழக்கு மாகாணசபையின்   நிருவாக மொழியாக தமிழுக்கும், ஏனைய மாகாணங்களில் நிருவாக மொழியாக சிங்களத்துக்கு

 முன்னுரிமை வழங்கப்பட்டது.

இப்போது 35 ஆண்டுகளுக்குப் பின்னர் 13 சட்ட திருத்தத்தை முழுமையாக  நடைமுறைப்படுத்தப்பட வேண்டும் என ஒரு தரப்பும் அதனை ஒழிக்க வேண்டும் என இன்னொரு தரப்பும் இரண்டுக்கும் இடையில் காரசாரமான விவாதம் நடந்து கொண்டிருக்கிறது. இதற்கு இரண்டு காரணங்களைக் குறிப்பிடலாம்.

(1) சென்ற ஆண்டுக் கடைசியில் ஏழு கட்சிகள் கூடி 13 சட்ட திருத்தத்தை இலங்கை அரசு முழுமையாக நடைமுறைப்படுத்த வேண்டும் என்று இந்தியப் பிரதமர் மோடிக்கு அனுப்ப இருந்த கடிதம்.

(2)  ஒற்றையாட்சிக்குள் கொண்டுவரப்பட்ட  13 ஏ ஆவது திருத்தத்தை ஒழிக்க வேண்டும் எனக் கூறி தமிழ்த் தேசிய மக்கள் ஆர்ப்பாட்ட பேரணி நடத்தியுள்ளது.

இது தொடர்பாக தமிழ்த் தேசியக்  கூட்டமைப்பின் தலைவர் இரா சம்பந்தன், நா.உ கொழும்பு தமிழ்ச்  செய்தித்தாள் ஒன்றுக்கு அளித்த செவ்வியில் தமிழ் மக்களின் அபிலாசைகளைப் பூர்த்தி செய்யும் தீர்வாக 13 ஆவது திருத்தச் சட்டத்தை  என்றும் தமிழர் தேசியத் தரப்பு ஏற்றுக் கொள்ளவில்லை எனக் கூறியுள்ளார்.

அத்துடன், ததேமமுயினர்  இட்டுக்கட்டப்பட்ட கதைகளைக் கூறிப் பொய்யான பிரசாரங்களை முன்னெடுத்து வருகின்றனர் என்றும் அவர் குறிப்பிட்டுள்ளார். இது தொடர்பில் அவர்  தெரிவித்தவை வருமாறு:-

13 ஆவது திருத்தச் சட்டத்தை தமிழ் மக்களின் அபிலாசைகளைப் பூர்த்தி செய்வதற்கான தீர்வாக எந்தவொரு சந்தர்ப்பத்திலும் நாம் கூறியது கிடையாது.

தமிழர் விடுதலைக் கூட்டணியாக இருந்தாலும் சரி, தமிழ்த் தேசியக் கூட்டமைப்பாக இருந்தாலும் சரி, தமிழரசுக் கட்சியாக இருந்தாலும் சரி, இந்த நிலைப் பாட்டில் மாற்றங்கள் காணப்பட்டிருக்கவில்லை.

இந்தப் பின்னணியில் தற்போது இந்தியப் பிரதமர் நரேந்திர மோடிக்கு அனுப்பிய ஆவணத்திலும் அவ்விடயங்கள் மிகத் தெளிவாகக் கூறப்பட்டுள்ளன. இது சம்பந்தமான ஆவணத்தில் கையொப்பமிட்ட தலைவர்களும் மிகத் தெளிவாக அந்த விடயத்தைக் கூறியுள்ளனர்.

இருப்பினும் தமிழ்த் தேசிய மக்கள் முன்னணியினர் இந்த ஆவணத்தைத் திரிவுபடுத்தி, இட்டுக்கட்டப்பட்ட விடங்களை வெளிப்படுத்திப் பொய்யான பிரசாரத்தை முன்னெடுத்து வருகின்றார்கள்.

எம்மைப்பொறுத்தவரையில், பிரிக்க முடியாத, பிளவுபடுத்த முடியாத ஐக்கிய இலங்கைக்குள் தமிழ் மக்கள் பூர்வீகமாக வாழ்ந்து வரும் இணைந்த வடக்கு, கிழக்கில், தங்களைத் தாங்களே ஆட்சி செய்யக் கூடிய வகையிலும், தங்களின் தலைவிதியை தீர்மானிக்க கூடிய வகையிலும், மீளப்பெறமுடியாத அதிகாரப் பகிர்வு செய்யப்பட்டு, சுயநிர்ணய அடிப்படையிலான சமஷ்டித் தீர்வொன்று வழங்கப்பட வேண்டும். அதுவே தமிழ் மக்களின் அபிலாசைகளைப் பூர்த்தி செய்வதாக இருக்கும்.

ஆனால், 13 ஆவது திருத்தச்சட்டமானது, தற்போதைய அரசமைப்பில் ஏற்றுக்கொள்ளப்பட்ட விடயமாகும். அத் திருத்தச்சட்டமானது அதிகாரப்பகிர்வின் ஒரு வடிவமாக அரசமைப்பில் காணப் படுகின்றது. ஆகவே அதனை முழுமையாக நடைமுறைப்படுத்த வேண்டியது அரசாங்கத்தின் கடமையாகும்.

இலங்கையின் ஆட்சி அதிகாரத்தில் மாறிமாறி இருந்த தலைவர்கள் அனைவரும் 13 ஆவது திருத்தச்சட்டத்திற்கு அப்பால் சென்றே வாக்குறுதிகளை வழங்கியுள்ளார்கள்.

பிரேமதாச காலத்தில் மங்கள முனசிங்க ஆணைக்குழு நியமிக்கப்பட்டது. சந்திரிகாவின் காலத்தில் பிராந்தியங்களின் ஒன்றியம் என்ற தலைப்பில் தீர்வுப்பொதி தயாரிக்கப்பட்டது.

பின்னர் இரணில் விக்கிரமசிங்க காலத்தில் ஒஸ்லோ பேச்சுக்கள் முன்னெடுக்கப்பட்டன. மஹிந்த ராஜபக்ச 13 + என்று குறிப்பிட்டமையோடு சர்வகட்சி அறிக்கையும் தயாரிக்கப் பட்டது. அதன் பின்னர் மைத்திரி – இரணில் கூட்டாட்சியில் புதிய அரசியலமைப்புக்கான நகர்வுகள் முன்னெடுக்கப்பட்டன.

இவற்றில் கோட்டாபய கூட அரசியல் தீர்வு பற்றி இந்தியப் பிரதமருக்கு வாக்குறுதி அளித்துள்ளார். இவ்வாறான பின்னணியில் தமிழ் மக்களுக்கான அரசியல் தீர்வொன்று வழங்கப்பட வேண்டும். அளிக்கப்பட்ட வாக்குறுதிகள் நிறைவேற்றப்பட வேண்டும். அதற்காகவே நாம் எமது நிலைப்பாட்டைத் தொடர்ச்சியாக வெளிப்படுத்தி வருகின்றோம்.

விசேடமாக இந்தியா தமிழர்களின் விடயத்துடன் நீண்டகாலமாகத் தொடர்பு பட்டுள்ளது என்ற அடிப்படையில் அவர்களுக்குள்ள தார்மீகக் கடமையை முன்னெடுக்குமாறு நாம் கோரியுள்ளோம்.

நாம் எமது மக்கள் வழங்கிய ஆணையை மீறாது, சரியான திசையில் பயணிக்கின்றோம். இதனை சில தரப்புக்கள் அரசியலுக்காக குழப்புவதற்கு முனைகின்றன என்றார்.

இன்று தமிழ்த் தேசியப் பரப்பில் அகில இலங்கைத் தமிழ்க் காங்கிரஸ் தலைவர் கஜேந்திரகுமார் பொன்னம்பலமும் அவரது கட்சியும் மக்கள் மத்தியியில் தனிமைப் படுத்தப்பட்டுள்ளனர். அதனால் அந்தப் பிம்பத்தை உடைக்க வேண்டிய தேவை அவருக்கு ஏற்பட்டுள்ளது.

ஒற்றையாட்சி கேட்ட தமிழ்க் காங்கிரஸ் கட்சியும் அதன் பினாமியான தமிழ்த் தேசிய மக்கள் முன்னணியும் இன்று இணைப்பாட்சி கேட்பது நல்ல முன்னேற்றம். ஆனால் 13 ஆவது சட்ட திருத்தம் தமிழ்மக்களது அரசியல் தீர்வுக்கான ஒரு சட்டம் இல்லை என்று தமிழ்க் காங்கிஸ் கட்சி வாதாடுவது புத்திசாலித்தனமான அரசியலாக இல்லை. 13 ஆவது சட்ட திருத்தம் மாகாணசபைகளுக்கு மட்டுப்படுத்தப்பட்ட அதிகாரப் பகிர்வை வழங்குகிறது. அது மட்டுமல்ல அதிகாரப் பகிர்வுக்கான அலகு மாகாணம் என்பது முதன்முறையாக ஏற்றுக் கொள்ளப்பட்டது.  1965 ஆம் ஆண்டு எழுதப்பட்ட  டட்லி – செல்வா உடன்பாட்டில் அதிகாரப் பரவலாக்குக்கான அலகு மாவட்டம் என்றிருந்தது.

13 இன் கீழ் நிறைவேற்று அதிகாரம் ஆளுநர் கையில் இருக்கிறது என்பதும் ஆளுநர் சனாதிபதியின் முகவர் என்பதும் உண்மையே. ஆளுநர் நினைத்தால் மகாண சபையைக் கலைக்குமாறு சனாதிபதியை கேட்கலாம்.

ஆனால் நடைமுறையில் மாகாண சபையை முதலமைச்சர் உட்பட 5 பேர் கொண்ட ஒரு அமைச்சர் வாரியம் நிருவாகிக்கிறது. அமைச்சர்களது நியமனம் முதலமைச்சரின் ஆலோசனைப்படியே இடம்பெறும். அமைச்சர்களை விலக்குவதாக இருந்தாலும் முதலமைச்சரின் ஆலோசனையின் அடிப்படையிலேயே செய்ய முடியும். அமைச்சரவை மட்டுமல்ல ஏனைய விடயங்களிலும் முதலமைச்சரின் ஆலோசனைப் படியே பெரும்பாலும் ஆளுநர் வினை செய்ய வேண்டும்.

2013 -2018 வரை இயங்கிய வட மாகாண சபையில் முதலமைச்சரின் ஆட்சிக்கு ஆளுநர்கள் முட்டுக் கட்டையாகவோ தடையாகவோ இருந்ததில்லை. முதலமைச்சர் குடைச்சல் கொடுக்கிறார் அவரோடு  சேர்ந்து பணிபுரிய முடியாது எனக் கூறி ஆளுநர் எச்.எம்.எஸ். பலிகக்கார (27-01-2015 தொடக்கம் 16-09-2016 வரை)  தனது பதவியைத் துறந்திருந்தார்.

13 திருத்தத் சட்டத்தில் மாகாணங்களுக்கு வழங்கப்பட்ட காணி அதிகாரங்கள், பொலீஸ் மற்றும் சட்டம் ஒழுங்கு அதிகாரங்கள் நடைமுறைப் படுத்தப்பட்டால் மாகாண சபை முறைமையில் இணைப்பாட்சிக்குரிய  பல அம்சங்கள் காணப்படும்.

எனவேதான் இனச் சிக்கலைத் தீர்த்து வைக்க இணைப்பாட்சிதான் சரியான தீர்வாக இருந்தாலும் அது கிடைக்கும் வரை குறைபாடுடைய 13 சட்ட திருத்தத்தை ஒரு தொடக்கப் புள்ளியாக வைத்துக் கொள்ள வேண்டும் என தமிழ் அரசுக் கட்சி கூறுகிறது. ததேகூ இன் தலைவர் இரா சம்பந்தர் கூறுவது போல தமிழ்மக்களது வேட்கை இணைப்பாட்சிதான். அதில் மாற்றம் இல்லை. தமிழ் அரசுக் கட்சி தொடங்கிய காலம் தொட்டு இணைப்பாட்சி அரசியல் அமைப்புக்கு போராடி வருகிறது. அதனால் அதன் பெயர்கூட ஆங்கிலத்தில் Federal Party என மற்றவர்களால் அழைக்கப்படுகிறது.

கஜேந்திரகுமார் 13 சட்ட திருத்தத்தை எதிர்ப்பது – அதனை முற்றாக ஒழிக்க வேண்டும் எனக் கங்கணம் கட்டி நிற்கும் சிங்கள – பவுத்த பேரினவாதிகளுக்கு அவல் கொடுத்த மாதிரி இருக்கும். சனாதிபதி கோட்டாபய அரசு புதிதாகக் கொண்டுவர இருக்கும் யாப்பில் 13 முற்றாக கைவிடப்பட்டுள்ளதாக ஒரு சிங்கள செய்தித்தாள் செய்தி வெளியிட்டுள்ளது.

கஜேந்திரகுமார் எப்போதும் எதிர்ப்பு அரசியலை நடத்தி வருபவர். இது அந்தக் குடும்பத்தின் பரவணி. பண்டா – செல்வா உடன்பாட்டை அன்றைய தமிழ்க் காங்கிரஸ் தலைவர் ஜிஜி பொன்னம்பலம் சிங்கள – பவுத்த பேரினவாதிகளை விட மிகவும் மூர்க்கத்தனமாக எதிர்த்தார். தமிழ் அரசுக் கட்சி தமிழ்மக்களை வட – கிழக்கு மாகாணங்களுக்குள் முடக்கப் பார்க்கிறது எனக் கடுமையாக விமர்ச்சித்தார். தமிழர்கள் பருத்தித்துறை தொடக்கம் தேவேந்திரமுனை வரை சுதந்திரமாக வாழும் உரிமை வேண்டும் என்றார். வெளிநாடுகளில் இருந்து கொண்டு கஜேந்திரகுமாரின் கட்சிக்கு பணம் கொடுக்கும் போலிப் புலி ஆதரவாளர்கள் தமிழ்க் காங்கிரஸ் கட்சியின் பழைய வரலாற்றைக் கவனத்தில் கொள்ள வேண்டும். 

13 திருத்தச் சட்டத்தை யாரும் முழுதாக ஏற்றுக் கொள்ளவில்லை. அது சட்டமான போது அதில் இருந்த குறைபாடுகளைச்  சுட்டிக்காட்டி  தமிழர் விடுதலைக் கூட்டணி சார்பாக அதன் பொதுச் செயலாளர் அ. அமிர்தலிங்கம், தலைவர் மு.சிவசிதம்பரம் மற்றும் இரா. சம்பந்தன் அன்றைய இந்தியப் பிரதமர் இராஜீவ் காந்திக்கு ஒக்தோபர் 28, 1987 அன்று ஒரு நீண்ட கடிதம் எழுதியிருந்தார்கள் (https://sangam.org/letter-pm-rajiv-gandhi-tulf-13th-amendment/). அதையிட்டுக்  கவனம் எடுப்பதாக இராசீவ்காந்தி சொல்லியிருந்தார். ஜே.ஆர். ஜெயவர்த்தனாவை தில்லிக்கு அழைத்து பேச்சு வார்த்தையும் நடத்தினார். ஓரு குறிப்பிட்ட காலத்துக்குள் இலங்கை அரசு மாகாண சபைகளுக்கு மேலதிக அதிகாரப் பகிர்வை வழங்க வேண்டும் என்ற உறுதிமொழியை தில்லி பெற்றுக் கொண்டது. ஆனால் அது நடைமுறைப் படுத்தப்படவில்லை.

2013 -2018 வரை இயங்கிய வட மாகாண சபையில் முதலமைச்சரின் ஆட்சிக்கு ஆளுநர்கள் முட்டுக் கட்டையாகவோ தடையாகவோ  இருந்ததில்லை.

13 திருத்தத் சட்டத்தில் மாகாணங்களுக்கு வழங்கப்பட்ட காணி அதிகாரங்கள், பொலீஸ் மற்றும் சட்டம் ஒழுங்கு அதிகாரங்கள் முழுமையாக நடைமுறைப் படுத்தி  ஆளுநருக்குப் பாரப்படுத்தியுள்ள நிறைவேற்று அதிகாரத்தை மாகாண சபையின் அமைச்சு வாரியத்துக்கு பாரப்படுத்தி, பொதுப் பட்டியலை இல்லாது செய்து, மாகாண சபைகளுக்கு வழங்கப்பட்ட அதிகாரங்கள் மத்திய அரசால் திரும்பப் பெறமுடியாது என்ற உத்தரவாதம் இருக்குமேயானால் மகாண சபை இணைப்பாட்சி அம்சங்கள் கொண்ட ஒரு அமைப்பாக இருக்கும்.

நொவெம்பர் 1987 இல் 13 திருத்தச் சட்டம் செல்லுபடியாகுமா இல்லையா என உயர் நீதிமன்றம் விசாரணை நடத்தியது. நீதியரசர் ஆர்.எஸ். வனசுந்தர 13 ஆவது திருத்தம் 1978 ஒற்றையாட்சி அரசியலமைப்பிற்கு முரணானது ஆகையால் அது பொதுமக்கள் அபிப்பிராய வாக்கெடுப்பிற்கு விடப்பட வேண்டுமென்று தீர்ப்பளித்திருந்தார். அவரது நிலைப்பாட்டை ஏற்றுக் கொண்டு நீதியரசர்கள் ஓ.எஸ்.எம். செனவிரத்ன, எல்.எச்.டீ. அல்விஸ், எச்.ஏ.ஜீ.டீ. சில்வா ஆகியோர் தீர்ப்பளித்தனர். பிரதம நீதியரசர் எஸ். சர்வானந்தா,  அரசியலமைப்பிற்கு நேரடியாகவோ மறைமுகமாகவோ 13 ஏ முரண்பாடாக இல்லை என்பதால் அதனை சட்டமாக்குவதற்கு நாடாளுமன்றத்தின் மூன்றில் இரண்டு பெரும்பான்மை வாக்குகளால் நிறைவேற்றப்படுவது போதுமானதால் பொதுமக்கள்  அபிப்பிராய வாக்கெடுப்பு அவசியமில்லை என்று பிரதம நீதியரசர் எஸ். சர்வானந்தா, நீதியரசர்கள் பி. கொலின் தோமி, ஈ.ஏ.டி. அத்துகோரள, எச்.டி. தம்பையா ஆகியோர் தீர்ப்பளித்திருந்தனர். 

இதன்போது 13 சட்ட திருத்தம் நிறைவேறப் பொதுமக்கள் வாக்கெடுப்பு வேண்டுமா வேண்டாமா என்பதைத் தீர்மானிக்கும் இடத்தில் ஒன்பதாவது நீதியரசர்  K.A.P. இரணசிங்கி இருந்தார்.  அவரும்  தனது தீர்ப்பில் பொதுமக்கள் அபிப்பிராய வாக்கெடுப்பிற்கு விடப்பட வேண்டுமென்று தீர்ப்பளித்திருந்தார். ஆனால்  சட்ட வரைவிலுள்ள சில சரத்துக்கள் நீக்கப்பட்டால் 13 ஆவது சட்ட திருத்தத்தைத் தான் ஆதரிப்பதாகத்  தீர்ப்பளித்தார். இதன் காரணமாக 13 சட்ட திருத்தத்துக்கு ஆதரவாக 5 நீதியரசர்களும் எதிர்த்து 4 நீதியரசர்களும் தீர்ப்பளித்ததால் அது நாடாளுமன்றத்தில் நிறைவேறியது. 

எனவே 13 சட்ட திருத்தம்  ஒற்றையாட்சி அரசியல் அமைப்பை மீறவில்லை என்ற தீர்ப்பு அரும்பொட்டில்தான் நிறைவேறியது. இந்தத் திருத்தத்தில் தமிழ்மொழியும் ஒரு உத்தியோக மொழி, ஆங்கிலம் இணைப்பு மொழி என்ற சரத்தும் உள்ளடக்கபட்டது குறிப்பிடத்தக்கது. எனவே 13 ஏ திருத்தச் சட்டம்தான் தமிழ்மக்களது சிக்கலுக்கு நாட்டின் அரசியலமைப்பில் இன்று உள்ள ஒரே பாதுகாப்பாகும். அதிகாரப் பகிர்வை (devolution) வழங்கும் ஒரே சட்ட திருத்தம் 13 மட்டுமே.

13 சட்ட திருத்தச் சட்டம் நாடாளுமன்றத்தில் வாக்கெடுப்பு விட்டபோது ஐக்கிய தேசியக் கட்சி உறுப்பினர்களில் இருவரைத் தவிரப் பிற உறுப்பினர்களின் வாக்குகளால் சட்டமாக்கப் பட்டது. பிரதமர் பிரேமதாச முரண்பாடுகள் இருப்பதாகக் கூறினாலும் எதிர்க்காமல் ஆதரித்துப் பேசி ஆதரவாக வாக்களித்தார். விவசாய உணவு அமைச்சராக இருந்த காமினி ஜயசூரிய நாடாளுமன்ற உறுப்புரிமையை இராஜினாமா செய்தார். சிறில் மத்யூ எதிராக வாக்களித்தார். அவ் வேளை பாராளுமன்றத்திற் தமிழர் விடுதலைக் கூட்டணியை பிரதிநிதித்துவப்படுத்த எவரும் இருக்கவில்லை. (நாட்டுப் பிரிவினைக்கு ஆதரவளிப்பதில்லை என 6வது திருத்தச் சட்டத்திற்கு இணங்கச் சத்தியம் செய்து மீண்டும் பதவிப் பிரமாணம் செய்யாதபடியால் பாராளுமன்ற உறுப்புரிமையைப் 17 உறுப்பினர்கள் இழந்திருந்தனர்.

ஸ்ரீ லங்கா சுதந்திரக் கட்சி அதை முழுமையாக எதிர்த்தது. மக்கள் ஐக்கிய முன்னணி உறுப்பினர் தினேஷ் குணவர்த்தனவும் எதிர்த்தார். பாராளுமன்றத்திற்கு வெளியில் ஜே.வி.பி. எதிர்த்தது. செல்லையா இராஜதுரை ஏற்கனவே கட்சிமாறி ஐக்கிய தேசிய அரசில்  அமைச்சராக இணைந்திருந்தார்.

ததேகூ இன் தலைவர் சம்பந்தர் தமிழ்மக்களது இலட்சியம்  ஐக்கிய இலங்கைக்குள் தமிழ் மக்கள் பூர்வீகமாக வாழ்ந்து வரும் இணைந்த வடக்கு, கிழக்கில், தங்களைத் தாங்களே ஆட்சி செய்யக் கூடிய வகையிலும், தங்களின் தலைவிதியை தீர்மானிக்க கூடிய வகையிலும், மீளப்பெறமுடியாத அதிகாரப் பகிர்வு செய்யப்பட்டு, சுயநிர்ணய அடிப்படையிலான சமஷ்டித் தீர்வொன்று வழங்கப்பட வேண்டும் என்பதாகும். இதில் மாற்றமில்லை.

13 ஏ ஒரு கோவணம் என்று வைத்துக் கொண்டாலும் பட்டுவேட்டிக்கு ஆசைப்பட்டு இருக்கிற  கோவணத்தை பறிபோகவிட முடியாது. அரசியல் என்பது ஒரு தெரிவு  சரிவராவிட்டால் இரண்டாவது தெரிவைக் கைக்கொள்ளும் இராசதந்திரமாகும்.  இணைப்பாட்சி தெரிவு இன்று சாத்தியம் இல்லை என்றால்  அடுத்த தெரிவான அதிகாரப் பரவலாக்கலை (13ஏ) முழுமையாக நடைமுறைப்படுத்துமாறு கேட்பதாகும்.

இந்தியப் பிரதமர் மோடி  மார்ச் 13, 2015 அன்று இலங்கை நாடாளுமன்றத்தில் உரையாற்றும் போது    “கூட்டுறவு கூட்டாட்சியில் உறுதியான நம்பிக்கை கொண்டவன்” என்று கூறியிருந்தார். இந்தியாவிலும் இதே கோட்பாட்டை – ஒன்றிய அரசும் மாநில அரசுகளும் கடைப்பிடித்து  வருவதாக –  பேசி வருகிறார். 13 ஆவது திருத்தம் பற்றிக் குறிப்பிடுகையில் “13 ஆவது திருத்தத்தை விரைவாகவும் முழுமையாகவும் அமுல்படுத்துவதும் அதற்கு அப்பால் செல்வதும் இந்தச் செயல்முறைக்கு பங்களிக்கும் என்று நாங்கள் நம்புகிறோம்” என்று பிரதமர் மோடி கூறியுள்ளார்.

13ஏ பற்றிய குழப்பத்துக்குக் காரணம் ரெலோ அடைக்கலநாதன், புளட் சித்தார்த்தன், தமிழ் மக்கள் கூட்டணித் தலைவர் விக்னேஸ்வரன், தமிழ்த் தேசியக் கட்சித் தலைவர் சிறிகாந்தா போன்றோர் தொடக்கத்தில் பிரதமர் மோடிக்கு அனுப்ப இருந்த கடிதம் ஆகும். அந்த வரைவைத்  தாங்களே தங்களுக்குள் பேசி தயாரித்துவிட்டு அதில் இரா.சம்பந்தன் ஐயா கையெழுத்து இடவேண்டும் என்ற கேட்ட பொழுதுதான் “கட்சியைக் கேளாமல் கையெழுத்துப் போட மாட்டேன்” என்று அவர் மறுத்தார்.

இதன் பின்னர்தான் தமிழ்மக்களது வேட்கை, அவர்கள் கொடுத்த ஆணை சுயநிர்ணய அடிப்படையிலான சமஷ்டித் தீர்வு என முன்னைய  கடிதம் திருத்தி அமைக்கப்பட்டது. அந்தக் கடிதம்தான் சென்ற மாதம் பிரதமர் மோடிக்கு இலங்கைக்கான இந்தியத் தூதர் மூலம் அனுப்பி வைக்கப்பட்டுள்ள கடிதம்  ஆகும். 

இது தெரிந்தும் தனது அரசியல் இலாபத்துக்கு ஆக அந்தக் கடிதம் 13 ஏ திருத்த சட்டத்தை முழுமையாக நடைமுறைப்படுத்த வேண்டும் என தமிழ்த் தலைவர்கள் இந்தியாவிடம் கேட்கிறார்கள் எனக் கஜேந்திரகுமார் பரப்புரை செய்கிறார்.

அதே நேரம் அதே 13 சட்டத்தின் கீழ் உருவாகிய மாகாண சபைத் தேர்தலில் தனது கட்சி போட்டியிடும் எனத் திருவாய் மலர்ந்துள்ளார். 2013 இல் நடந்த மாகாணசபைத் தேர்தலை புறக்கணித்த கஜேந்திரகுமார் இரவோடு இரவாக தனது நிலைப்பாட்டை மாற்றியுள்ளார். அது வரவேற்கத்தக்கது. ஆனால்  ஒருபுறம் ஒற்றையாட்சி அரசமைப்பின் கீழ் இயற்றப்பட்ட  13 ஆவது சட்ட திருத்தத்தை  கடுமையாக எதிர்த்துக் கொண்டு மறுபுறம் அதே 13 ஏ உருவாக்கிய மாகாணசபைத் தேர்தலில் போட்டி போட முடிவு செய்திருப்பது முரண்பாடாகும். 

தமிழ் அரசுக் கட்சியைப் பொறுத்தளவில் 13 ஏ ஒரு தொடக்கப் புள்ளி எனக் கருதுகிறது. பசிக்கிறவனுக்கு “அமாவாசைக்கு வா,  பத்துவகைக் கறியோடு சோறு போடுகிறேன்” என்று சொல்லாமல் பழைய சோறும் பச்சடியும் இருக்குது சாப்பிடு எனக் கொடுப்பதே அவனது பசியைப் போக்க ஒரே வழி.

13 ஆவது திருத்தத்தை  தமிழ் அரசுக் கட்சி நிராகரிக்கவில்லை. ஆனால் 13 க்கு அப்பால் சென்று 13+ தருவேன் என்று மகிந்த இராசபக்ச பல இடங்களில்,  பான் கீ மூன் உட்பட பலருக்குக் கொடுத்த  வாக்குறுதியை நிறைவேற்றுமாறு வற்புறுத்துகிறது.

அகில இலங்கைத் தமிழ்க் காங்கிரஸ் கட்சி எப்போதும் எதிர்மறை அரசியல் செய்து பழக்கப்பட்ட கட்சி. அந்தப் பரவணியில்  ஊறிய கட்சி.  பண்டா – செல்வா உடன்படிக்கையை சிங்கள – பவுத்த கடும்போக்காளர்களை விட மூர்க்கத்தனமாக எதிர்த்த கட்சி. தமிழர்களுக்கு ஒரு பல்கலைக் கழகம் திருகோணமலையில் அமைய வேண்டும் எனத் தமிழ் அரசுக் கட்சி கேட்டபோது, இல்லை யாழ்ப்பாணத்தில் இந்துப் பல்கலைக் கழகம் வேண்டும் எனக் கேட்டவர் ஜிஜி பொன்னம்பலம் அவர்கள். கடைசியில் பல்கலைக் கழகம் திருகோணமலையிலும் இல்லை யாழ்ப்பாணத்திலும் இல்லை என்று ஆனது.

சோல்பரி ஆணைக்குழு முன் தோன்றிய ஜிஜி பொன்னம்பலம் ஐம்பதுக்கு ஐப்பது கேட்டு 9 மணித்தியாலங்கள் வாதாடினார். அவரது கோரிக்கை நிராகரிக்கப்பட்டது. பெரும்பான்மை 68% சிங்களவர்களை சிறுபான்மை ஆக்குவது மக்களாட்சி முறைமைக்கு எதிரானது என சோல்பரி ஆணைக்குழு தெரிவித்தது. ஜிஜி பொன்னம்பலம் நாட்டின் குடிமக்கள் தொகை அடிப்படையில் நாடாளுமன்றத்தில் தமிழர்களுக்கு 23% (1946) பிரதிநித்துவம் கேட்டிருக்கலாம். அது கிடைத்திருந்தால் குடியுரிமைச் சட்டம், வாக்குரிமைச் சட்டம், தனிச் சிங்களச் சட்டம் போன்ற சட்டங்களை நிறைவேற்றுவதற்கு மூன்றில் இரண்டு பெரும்பான்மை சிங்களக் கட்சிகளுக்குக் கிடைத்திருக்க வாய்ப்பில்லை.

பிரதம நீதியரசர், நீதியரசர்கள் கொலின் தோமி, ஈ.ஏ.டி. அத்துகோரளை, எச்.டி. தம்பையாவுடன் கே.ஏ.பி. இரணசிங்ஹவும் ஏறக் குறைய ஒரே நிலைப்பாட்டை எடுத்திருந்தனர் என்ற அடிப்படையிலேயே, 13 ஆவது திருத்தச் சட்டத்திற்கு பொதுசன அபிப்பிராய வாக்கெடுப்புத் தேவை இல்லையென்ற நிலைப்பாட்டிற் பாராளுமன்றத்தில் விவாதிக்கப்பட்டு ஐக்கிய தேசியக் கட்சி உறுப்பினர்களில் இருவரைத் தவிரப் பிற உறுப்பினர்களின் வாக்குகளாற் சட்டமாக்கப் பட்டது. பிரதமர் பிரேமதாஸ முரண்பாடுகள் இருப்பதாகக் கூறினாலும் எதிர்க்காமல் ஆதரித்துப் பேசி ஆதரவாக வாக்களித்தார். விவசாய உணவு அமைச்சராக இருந்த காமினி ஜயசூரிய பாராளுமன்ற உறுப்புரிமையை இராஜினாமா செய்தார். சிறில் மத்யூ எதிராக வாக்களித்தார். அவ் வேளை பாராளுமன்றத்திற் தமிழர் விடுதலைக் கூட்டணியை பிரதிநிதித்துவப்படுத்த எவரும் இருக்கவில்லை. (நாட்டுப் பிரிவினைக்கு ஆதரவளிப்பதில்லை என 6 ஆவது திருத்தச் சட்டத்திற்கு இணங்கச் சத்தியம் செய்து மீண்டும் பதவிப் பிரமாணம் செய்யாதபடியால் பாராளுமன்ற உறுப்புரிமையைப் 17 உறுப்பினர்கள் இழந்திருந்தனர். செல்லையா இராஜதுரை ஏற்கனவே ஐக்கிய தேசியக் கட்சியில் அமைச்சராக இணைந்திருந்தார்).
இவ்வாறான பின்னணியிலேயே 13 ஆவது திருத்தச் சட்டம் பாராளுமன்றத்திற் சட்டமானது. ஸ்ரீ லங்கா சுதந்திரக் கட்சி அதை முழுமையாக எதிர்த்தது. மக்கள் ஐக்கிய முன்னணி உறுப்பினர் தினேஷ் குணவர்த்தனவும் எதிர்த்தார். பாராளுமன்றத்திற்கு வெளியில் ஜே.வி.பி. எதிர்த்தது.

13 திருத்தச் சட்டத்தை யாரும் முழுதாக ஏற்றுக் கொள்ளவில்லை. அது சட்டமான போது அதில் இருந்த குறைபாடுகளை தமிழர் விடுதலைக் கூட்டணி சார்பாக அதன் பொதுச் செயலாளர் அ. அமிர்தலிங்கம், தலைவர் மு.சிவசிதம்பரம் மற்றும் இரா. சம்பந்தன் அன்றைய இந்தியப் பிரதமர் இராஜீவ் காந்திக்கு ஒரு நீண்ட கடிதம் எழுதியிருந்தார்கள். அதையிட்டு கவனம் எடுப்பதாக இராசீவ்காந்தி சொல்லியிருந்தார். தே.ஆர். ஜெயவர்த்தனாவை தில்லிக்கு அழைத்து பேச்சு வார்த்தை நடத்தினார்.

13 சட்ட திருத்தம் தமிழ்மக்களது அரசியல் வேட்கைக்கு ஒரு சிறந்த தீர்வு என யாரும் சொல்லவில்லை. ஆனால் இலங்கையின் வரலாற்றில் 13 சட்ட திருத்தம் மகாணசபைகளுக்கு ஓரளவு அரசியல் பங்கீட்டை அளிக்கிறது. முதல்முறையாக மாகாண சபை அதிகாரப் பங்கீட்டுக்கு உகந்த அலகாக ஏற்றுக் கொள்ளப்பட்டது. இந்தியாவின் தலையீடு காரணமாகவே அது சாத்தியப்பட்டது.

ஆனால் மாகாண சபைக்கு ஒரு அமைச்சரவை இருக்கிறது. அமைச்சர்களது நியமனம் முதலமைச்சரின் ஆலோசனைப்படியே நடக்கிறது. அமைச்சரவை மட்டுமல்ல ஏனைய விடயங்களிலும் முதலமைச்சரின் ஆலோசனைப் படியே ஆளுநர் நடந்து கொள்ள வேண்டும். 2013 -2018 வரை இயங்கிய வட மாகாண சபையில் முதலமைச்சரின் ஆட்சிக்கு ஆளுநர்கள் முட்டுக் கட்டையாகவோ தடையாகவோ இருந்ததில்லை. 13 திருத்தத் சட்டத்தில் மாகாணங்களுக்கு வழங்கப்பட்ட காணி அதிகாரங்கள், பொலீஸ் மற்றும் சட்டம் ஒழுங்கு அதிகாரங்கள் நடைமுறைப் படுத்தப்பட்டால் மாகாண முறைமையில் இணைப்பாட்சிக்கு உரிய பல அம்சங்கள் காணப்படும். எனவேதான் இனச் சிக்கலைத் தீர்த்து வைக்க இணைப்பாட்சிதான் சரியான தீர்வாக இருந்தாலும் அது கிடைக்கும் வரை குறைபாடுடைய 13 சட்ட திருத்தத்தை ஒரு தொடக்கப் புள்ளியாக நாம் வைத்துக் கொள்ள வேண்டும். ஆன காரணத்தினால்தான் தமிழ் அரசுக் கட்சி வட கிழக்கு மாகாண சபைத் தேர்தல்களில் போட்டியிட்டது.

13 திருத்தத்தில் ஆளுநருக்கு பாரப்படுத்தியுள்ள நிறைவேற்ற அதிகாரத்தை மாகாண சபையின் அமைச்சு வாரியத்துக்கு கையளித்து, காணி, சட்டம் ஒழுங்கை முழுதாக நடைமுறைப்படுத்தி, பொதுப் பட்டியலை இல்லாது செய்து, மாகாண சபைகளுக்கு வழங்கப்பட்ட அதிகாரங்கள் மத்திய அரசால் திரும்பப் பெறமாட்டாது என்ற உத்தரவாதத்தை தந்தால் மகாண சபை இணைப்பாட்சி அம்சங்கள் கொண்ட ஒரு அமைப்பாக இருக்கும்.

தமிழ்மக்களது இலட்சியம்  ஐக்கிய இலங்கைக்குள் தமிழ் மக்கள் பூர்வீகமாக வாழ்ந்து வரும் இணைந்த வடக்கு, கிழக்கில், தங்களைத் தாங்களே ஆட்சி செய்யக் கூடிய வகையிலும், தங்களின் தலைவிதியை தீர்மானிக்க கூடிய வகையிலும், மீளப்பெறமுடியாத அதிகாரப் பகிர்வு செய்யப்பட்டு, சுயநிர்ணய அடிப்படையிலான சமஷ்டித் தீர்வொன்று வழங்கப்பட வேண்டும் என்பதாகும்.

13 ஒரு கோவணம் என்று வைத்துக் கொண்டாலும் பட்டுவேட்டிக்கு ஆசைப்பட்டு இருக்கிற  கோவணத்தை கைவிட முடியாது. அரசியல் என்பது ஒரு தெரிவு  சரிவராவிட்டால் இரண்டா ஆவது தெரிவை கைப்பிடிப்பதாகும்.  இணைப்பாட்சி தெரிவு சரிவராவிட்டால் அடுத்த தெரிவான 13 யை கையில் எடுப்பதாகும்.

“ஏற்கனவே இந்தியப் பிரதமர் மோடி கூட்டு சமஷ்டி வேண்டும் எனத் தெரிவித்துள்ளார்” என்கிறார் சிறிதரன். அப்படி அவர் சொல்லவில்லை. அவர், “கூட்டுறவு கூட்டாட்சியில் உறுதியான நம்பிக்கை கொண்டவர்” என்றுதான் இலங்கை நாடாளுமன்றத்தில் (13-03-2015)  கூறினார். இந்தியாவிலும் இதே கருத்தை வலியுறுத்தி பிரதமர் மோடி  பேசி வருகிறார்.

ஆனால் 13 ஆவது திருத்தம் பற்றிக் குறிப்பிடுகையில் “13 ஆவது திருத்தத்தை விரைவாகவும் முழுமையாகவும் அமுல்படுத்துவதும் அதற்கு அப்பால் செல்வதும் இந்த செயல்முறைக்கு பங்களிக்கும் என்று நாங்கள் நம்புகிறோம்” என்று பிரதமர் மோடி கூறினார். “அதே போன்று இம்முறை நடைபெற்ற சட்டமன்றத் தேர்தலின் போது ஈழத்திற்கான வாக்கெடுப்பு நடத்த வேண்டும் எனதி.மு.கவின் தேர்தல் விஞ்ஞாபனத்தில் தெரிவிக்கப்பட்டுள்ளதுடன் ஏற்கனவே ஜெயலலிதாவால் சட்டமன்றத்தில் கொண்டு வரப்பட்டிருந்தது” என்கிறார் சிறிதரன். உண்மைதான். ஆனால் இதற்கான கனதி என்ன? ஒரு மாநிலக் கட்சியும் ஒரு மாநில முதலமைச்சரும் பேசுவது அல்லது கூறுவது  நடைமுறையில் மாற்றத்தை ஏற்படுத்துமா? அரசியலுக்கு ஒத்து வருமா? தமிழீழத்துக்கு  ஆதரவாகக் கூட ஜெயலலிதா சட்டசபையில் தீர்மானம் நிறைவேற்றின தீர்மானம்  தன்னுடைய அரசியல் எதிரியான கருணாநிதியை வாய்மூடச் செய்வதற்கான ஒரு உபாயம். இது கூட சிறிதரனுக்குத் தெரிவதில்லை.

ஆங்கிலத்தில் ஒரு பழமொழி இருக்கிறது. ஆசைகள் குதிரைகளாக இருந்தால் பிச்சைக்காரர்கள் சவாரி செய்வார்கள் (If wishes were horses, beggars would ride).

தீர்மானங்கள் மூலம் தமிழீழத்தை உருவாக்க முடியுமென்றால் தமிழீழத்தின் அகவை இன்று 47 யை எட்டியிருக்கம்.

13 பற்றிய குழப்பத்துக்குக் காரணம் ரெலோ அடைக்கலநாதன், புளட் சித்தார்த்தன், தமிழ் மக்கள் கூட்டணித் தலைவர் விக்னேஸ்வரன், சிறிகாந்தா போன்றோர் பிரதமருக்கு எழுதிய வரைவு கடிதம் ஆகும். அந்த வரைவை தாங்களே தங்களுக்குள் பேசி வரைந்துவிட்டு அதில் இரா.சம்பந்தன் ஐயா கையெழுத்து இடவேண்டும் என்ற கேட்ட பொழுதுதான் “கட்சியைக் கேளாமல் கையெழுத்து போட மாட்டேன்” என்று சொன்னார்.

இதன் பின்தான் தமிழ்மக்களது இலட்சியம், அவர்கள் கொடுத்த ஆணை சுயநிர்ணய அடிப்படையிலான சமஷ்டித் தீர்வு என வரைவுக் கடிதம் திருத்தி அமைக்கப்பட்டது. பிரதமர் மோடிக்கு அனுப்பி வைக்கப்பட்டுள்ள கடிதம்  அதன் அடைப்படையிலேயே அமைந்துள்ளது. இந்த மாற்றத்தைக் கொண்டுவந்தவர் நநா.உ சுமந்திரன் ஆவர். இது தெரிந்தும் தனது அரசியல் இலாபத்துக்கு ஆக அந்தக் கடிதம் 13 ஏ திருத்த சட்டத்தை முழுமையாக நடைமுறைப்படுத்த வேண்டும் என தமிழ்த் தலைவர்கள் இந்தியாவிடம் கேட்கிறார்கள் எனப் பரப்புரை செய்கிறார். அதே நேரம் அதே 13 சட்டத்தின் கீழ் உருவாகிய மாகாண சபைத் தேர்தலில் தனது கட்சி போட்டியிடும் எனத் திருவாய் மலர்ந்துள்ளார். இவ்வளவு காலமும் மாகாணசபைத் தேர்தலை புறக்கணித்த கஜேந்திரகுமார் இரவோடு இரவாக தனது நிலைப்பாட்டை மாற்றியுள்ளார்.

தமிழ் அரசுக் கட்சியைப் பொறுத்தளவில் 13 ஏ ஒரு தொடக்கப் புள்ளி ஆகும். பசிக்கிறவனுக்கு “நாளைக்கு வா  பத்துவகை கறியோடு சோறு போடுகிறேன்” என்று சொல்லாமல் பழைய சோறும் பச்சடியும் இருக்குது சாப்பிடு எனக் கொடுப்பதே அவனது பசியை ஆற்றும். 13 திருத்தத்தை  தமிழ் அரசுக் கட்சி நிராகரிக்கவில்லை. ஆனால் 13 க்க அப்பால் சென்று 13+ தருவேன் என்று மகிந்த இராசபக்ச பல இடங்களில்,  பான் கீ மூன் உட்பட பலருக்குக் கொடுத்த  வாக்குறுதியை நிறைவேற்றுமாறு வற்புறுத்துகிறது.

அகில இலங்கை தமிழ்க் காங்கிரஸ் கட்சி எப்போதும் எதிர்மறை அரசியல் செய்து பழக்கப்பட்ட கட்சி. பண்டா – செல்வா உடன்படிக்கையை சிங்கள – பவுத்த கடும்போக்காளர்களை விட மூர்க்கத்தனமா எதிர்த்த கட்சி. தமிழர்களுக்கு ஆன பல்கலைக் கழகம் திருகோணமலையில் அமைய வேண்டும் எனத் தமிழ் அரசுக் கட்சி கேட்க, இல்லை யாழ்ப்பாத்தில் இந்துப் பல்கலைக் கழகம் வேண்டும் எனக் கேட்டவர் ஜிஜி பொன்னம்பலம் அவர்கள்.

கஜேந்திரகுமார் புதரில் இருக்கும் இரண்டு பறவைகளைப் (இணைப்பாட்சி)  பிடிக்கும் ஆசையில் கையில் உள்ள ஒரு பறவையைப் (13 ஏ) பறக்க விடச் சொல்கிறார்.   ஆனால் கையில் இருப்பதை வைத்துக் கொண்டு புதரில் இருக்கும்  இரண்டு பறவைகளைப் பிடிக்க முயற்சிப்பதுதான் அரசியல் சாணக்கியம் ஆகும். (பாகம் 01)

13 ஆவது திருத்தச் சட்டத்தில் பல குறைபாடுகள் உண்டென்பதை மறுப்பதற்கில்லை.  ஒற்றையாட்சி அரசியலமைப்பின் கீழ்  நிறைவேற்று அதிகாரம் ஆளுநர் கையில் என்பதும் ஆளுநர் சனாதிபதியின் முகவர் என்பதும் உண்மையே. ஒற்றையாட்சி அரசியலமைப்பின் கீழ் அதிகாரப் பரவலாக்கல் செய்ய முடியாது. செய்வதாக இருந்தால் ஒரு பொது வாக்கெடுப்பு நடத்தப்பட வேண்டும். இதன் காரணமாகவே உயர்நீதி மன்ற நீதியரசர் K.A.P. இரணசிங்கி ஒற்றையாட்சி முறைமையை மீறும் சரத்துக்களை நீக்கினால் தான் 13 சட்ட திருத்த அரிசயலமைப்பு வரைவுக்குத் தான் ஒப்புதல் தர அணியமாக இருப்பதாகத் தெரிவித்தார்.  

ஆனால் மாகாண சபைக்கு ஓர் அமைச்சர் வாரியம் இருக்கிறது. அமைச்சர்களது நியமனம் முதலமைச்சரின் ஆலோசனைப்படியே நடக்கிறது. அமைச்சரவை மட்டுமல்ல ஏனைய விடயங்களிலும் முதலமைச்சரரின் ஆலோசனைப் படியே ஆளுநர் நடந்து கொள்ள வேண்டும். 2013 -2018 வரை இயங்கிய வட மாகாண சபையில் முதலமைச்சரின் ஆட்சிக்கு ஆளுநர்கள் முட்டுக் கட்டையாகவோ தடையாகவோ இருந்ததில்லை. 13 ஆவது  திருத்தத் சட்டத்தில் மாகாணங்களுக்கு வழங்கப்பட்ட காணி அதிகாரங்கள், பொலீஸ் மற்றும் சட்டம் ஒழுங்கு அதிகாரங்கள் நடைமுறைப் படுத்தப்பட்டால் மாகாண முறைமையில் இணைப்பாட்சிக்கு உரிய பல அம்சங்கள்அதில் இருக்கும்.

எனவேதான் முன்னர் கூறியவாறு இனச் சிக்கலைத் தீர்த்து வைக்க இணைப்பாட்சி சரியான தீர்வாக இருந்தாலும் அது கிடைக்கும் வரை குறைபாடுடைய 13 ஆவது  சட்ட திருத்தத்தை ஒரு தொடக்கப் புள்ளியாக  வைத்துக் கொள்ள வேண்டும். அதுதே  அரசியல் சாணக்கியமாகும்.  

இது தொடர்பாக  மனித உரிமை சட்டத்தரணியும் சட்ட விரிவுரையாருமான கலாநிதி நிர்மலா சந்திரகாசன் அவர்கள் 13 ஆவது சட்ட திருத்தத்தத்தை ஆதரித்து ஆங்கிலத்தில் The Island  நாளேட்டில்  எழுதிய கட்டுரையின் தமிழாக்கம் கிழே கொடுக்கப்பட்டுள்ளது. 

மாகாண சபை முறையை  ஆதரிக்கும் சந்திரகாசன்

மாகாண சபைகள், Miguel de Cervantes  என்ற இசுப்பானிய எழுத்தாளர் எழுதிய ஒரு நாவலில் வரும் Don Quixote பாத்திரம் காற்றாலைகளை இராட்சதகர்கள் எனக் கற்பனை செய்துகொண்டு அவற்றோடு மோதுவதைப் போல  மாகாண சபைகளுக்கு எதிராக முன்வைக்கப்படும் சில விமர்சனங்களுக்கு இந்தக் கட்டுரையில் பதிலளிக்க விரும்புகிறேன். ஆனால் நான் அவ்வாறு செய்வதற்கு முன்னர், அதற்கான கள நிலவரங்கள் அநுகூலமானதும் மாகாண சபைத் தேர்தல் நடத்தப்படும் என பிரதமர்  (மகிந்த இராசபக்ச) அறிவித்துள்ளார் என்பதைக் கவனத்தில் கொள்கின்றேன். பிரதமர் ஒரு அனுபவமிக்க மற்றும் முழுமையான அரசியல்வாதியாக நாட்டின் அரசியல் சூழலை அறிந்து அதற்கேற்ப செயல்படுவார் என்பது பொதுவாக ஒப்புக் கொள்ளப்படுகிறது.

மாகாண சபைகள் இந்திய அரசால் இலங்கை அரசின்  மீது திணிக்கப்பட்டது என்பது அடிக்கடி சொல்லப்படும் விமர்சனங்களில் ஒன்றாகும். நாட்டின் தமிழ்க் குடிமக்களுக்கு எதிரான யூலை 1983 படுகொலை (கலவரம்) மற்றும் இலங்கையில் உள்நாட்டு அமைதியின்மை வெடித்ததைத் தொடர்ந்து, நிகழ்வுகளின் வரிசையை மறுபரிசீலனை செய்ய, அப்போதைய இந்தியப் பிரதமர் திருமதி இந்திரா காந்தி ஒரு தூதரை அனுப்பினார். இது நாட்டை இயல்பு நிலைக்கு கொண்டு வருவதற்கான வழிகளைக் கண்டறிய மேற்கொள்ளப்பட்ட  இராசதந்திர முயற்சியாகும்.

தமிழ்க் கட்சிகளையும் இலங்கை அரசாங்கத்தையும் பேச்சுவார்த்தை மேசைக்குக் கொண்டுவரும்  பாத்திரத்தை இந்தியா வகித்தது.  இடம் பெறும்  தமிழ்த் தீவிரவாதிகளின் கிளர்ச்சிக்கும் மற்றும் இனச் சிக்கலுக்கும்  ஒரு தீர்வைக் காண இந்தியா மற்றும் இலங்கை அரசாங்கங்களுக்கிடையில் பேச்சுவார்த்தை தொடங்கியது. அரசியலமைப்பு முன்மொழிவுகள் மூலம் அவற்றைத் தீர்க்கலாம் எனக் கருதப்பட்டது.

இந்த பேச்சுவார்த்தைகளின் விளைவாக இலங்கையில் அமைதி மற்றும் இயல்பு நிலையை நிலைநாட்டுவதற்கான உடன்படிக்கை  கைச்சாத்தானது.  அதாவது. 1987 இந்திய – இலங்கை   சமாதான உடன்படிக்கை, மற்றும் அரசியலமைப்பின் 13 ஆவது திருத்தம் மற்றும் நவம்பர் 1987 இன் மாகாண சபைகள் சட்டம் எண்: 42. என இந்த இரண்டு சட்டங்களின் அடிப்படையில், மாகாண சபைகள் உருவாக்கப்பட்டன. மாகாண சபைகளின் எதிர்ப்பாளர்கள் இது உள்நாட்டில் உருவாக்கப்பட்ட நிறுவனமல்ல, வெளிநாட்டு சக்தியால் திணிக்கப்பட்ட ஒன்று என்று வாதிடுகின்றனர்.

இது தொடர்பாக, பேராசிரியர் காமினி கீரவெல்ல அவர்கள் 16 செப்தெம்பர் 2020 இன் Island  செய்தித்தாளில் “13 ஆவது திருத்தத்தின் வம்சாவளி மற்றும் 13 ஆவது திருத்தத்தின் ஆதியாகமம்” என்ற தலைப்பில் எழுதிய அதிக தகவல் மற்றும் நன்கு ஆய்வு செய்யப்பட்ட கட்டுரையை வாசகர்களுக்கு பரிந்துரைக்கிறேன். 1931 ஆம் ஆண்டு டொனமோர் ஆணைக்குழுவின் பரிந்துரைகள், 1956 ஆம் ஆண்டு பண்டாரநாயக்கா – செல்வநாயகம் உடன்படிக்கை, டட்லி சேனநாயக்கா – செல்வநாயகம் உடன்படிக்கையின் பிராந்திய சபைகள் மற்றும் சிறிமாவோ பண்டாரநாயக்கா அரசாங்கத்தால் வாக்குறுதியளிக்கப்பட்ட ஆனால் வரவிருக்கும் அதிகாரப் பகிர்வு முன்மொழிவுகள் – 1974 இல் காங்கேசன்துறை. அதிகாரப்பகிர்வு மற்றும் மாகாணசபை விவகாரம் இந்த நாட்டில் நீண்டகாலமாக அரசியல் சாணக்கியமாக இருந்து வந்துள்ளது என்பதும் அது வெளிநாட்டுத் திணிப்பு அல்ல, உள்நாட்டு விவகாரம் என்பதை  எண்பிக்கிறது.

உண்மையில், 13 ஆவது திருத்தம் யூலை – ஓகஸ்ட், 1966 காலப்பகுதியில் ஜே. ஆர். ஜெயவர்த்தன அரசுக்கும் திரு அமிர்தலிங்கம் தலைமையிலான தமிழர் விடுதலைக் கூட்டணிக்கும்  இடையிலான விரிவான விவாதங்களில் ஓய்வுபெற்ற தேர்தல் ஆணையாளர் பீலிக்ஸ் டயஸ் அபேசிங்க செயலாளராக இருந்தார்.  ஒரு ஆண்டு கழித்து இந்திய – இலங்கை ஒப்பந்தம் யூலை 1987 இல் கையெழுத்தானது. 13 ஆவது திருத்தம் மற்றும் மாகாண சபைகள் சட்டம் நொவெம்பர் 1987 இல் நிறைவேற்றப்பட்டது. 13 ஆவது திருத்தத்தை நிறைவேற்றுவதற்கான காரணம் இந்தியாவிற்கும் இலங்கைக்கும் இடையிலான உடன்படிக்கை  ஆகும் எனக்  கூறலாம். 13 ஏ  அதிகாரப் பகிர்வை வழங்கியது.

பேச்சுவார்த்தையில், தமிழர் விடுதலைக் கூட்டணி சார்பாக இடம் பெற்றவர்கள் தந்திரசாலியும் புத்திசாலியுமான திரு ஜெயவர்த்தனவுக்கு ஈடுகொடுக்க முடியவில்லை. அவர்,  அவர்களை இலகுவாக உச்சிப்போட்டார். அதன்பிறகுதான் ஜெயவர்த்தனா அவர்களால்   தயாரிக்கப்பட்ட மசோதாக்கள் தங்கள் எதிர்பார்ப்புகளுக்குக் குறைவாக இருப்பதை உணர்ந்த கொண்டனர். இதன் காரணமாக நடந்து முடிந்த முறைமையோடு தங்களைத் தூர விலக்கிக் கொண்டனர்.

திரு அமிர்தலிங்கம் 1987 ஒக்டோபரில்  திரு இராஜீவ் காந்திக்கு எழுதிய கடிதத்தில், இரண்டு சட்டமூலங்கள் மீதான தனது ஏமாற்றத்தை வெளிப் படுத்தினார்.  மாகாண சபைகள் தொடர்பான அத்தியாயம் மாகாணங்களுக்கு நம்பகமான சுயாட்சியை வழங்கும் என்ற நம்பிக்கைக்கு மாறாக, தற்போதைய சட்டமூலங்கள் காணப்படுகின்றன. மாகாணத்திற்கு வழங்கப்பட்டுள்ள அதிகாரங்களைப் பொறுத்த மட்டில் கூட நாடாளுமன்றமும் மத்திய அமைச்சரவையும் அவற்றின் அதிகாரத்தை தொடர்ந்து வைத்துக் கொண்டுள்ளன.

எனது பார்வையில், 13 ஆவது திருத்தச் சட்டத்தின் கீழ் வழங்கப்பட்டுள்ள பல அதிகாரங்களை  மாகாண சபைகள் சட்டத்தின் கீழ் கொடுக்கப்பட்டுள்ள அதிகாரங்கள் மறுக்கிறது.  மாகாண சபைகள் சட்டத்தில்  சில திருத்தங்களைச் செய்வதன் மூலம்  இவற்றைச் சரிசெய்யப்படலாம். இது பற்றி பின்னர் கூறுவேன்.

மாகாண சபைகள் மற்றும் அதிகாரப்பகிர்வு முன்மொழிவுகள்  நாட்டின் ஒரு பகுதியாக இருக்கும்  வடக்கு – கிழக்கை நோக்கமாகக் கொண்டிருந்தாலும், தற்போது நடைபெற்றுவரும் ஆயுத மோதலைத் தீர்க்கும் நோக்கத்தில் இருந்த போதிலும், ஜெயவர்த்தன அரசாங்கம்

 நாட்டின் அனைத்து மாகாணங்களுக்கும் மாகாண சபை முறையை

எனவே தற்போதைய மாகாண சபை முறையானது எந்தவொரு குறிப்பிட்ட பிராந்திய அல்லது இன அளவுகோல்களின் அடிப்படையிலும் இல்லாமல் நாட்டின் அனைத்து மக்களையும் நோக்கியதாக உள்ளது. யாழ்ப் பாணத் திலோ அல்லது மாத்தறையிலோ அவர்களின் சொந்த பிரதேசங்களில் உள்ள மக்களுக்கு அதிகாரம் அளிக்க முயல்கிறது. கொழும்பில் உள்ள அரசியல் வாதிகள் மற்றும் அதிகாரிகளால் மட்டுமன்றி உள்ளூர் மக்களுக்கும் சமூகங்களுக்கும் நெருக்கமாக மாகாணங்கள் தொடர்பான முடிவுகளை எடுக்க இந்த அமைப்பு அனுமதிக்கிறது. 

பின்னோக்கிப் பார்க்கையில், இது ஒரு நல்ல நடவடிக்கையாகும், ஏனெனில் இது  முழுத் தீவுகான அமைப்பாகும்.   எனவே, இந்தியாவின்  தலையீடு நாட்டிற்கும் அனைத்து சமூகங்களுக்கும் நன்மை பயக்கும் ஒன்றைக் கொண்டு வந்தது என்று நாம் கூறலாம். இருப்பினும், வெளிநாட்டு தலையீடு எப்போதும் நல்ல பலனைத் தராது.

இந்த நிகழ்வில் இருந்து கற்றுக் கொள்ள வேண்டிய பாடம் என்னவென்றால், நீங்கள் உங்கள் வீட்டை ஒழுங்காக வைத்திருக்காதபோது, கருத்து வேறுபாடு மற்றும் வெறுப்பு ஏற்படும் போது, அண்டை வீட்டாரும், அருகில் இல்லாத அண்டை வீட்டாரும் நிச்சயமாக உங்கள் விவகாரங்களில் தலையிட விரும்புவார்கள். பொதுவாக அது அவர்களின் சொந்த நலனுக்காகவே இருக்கும்.

ஒரு சிலரின் விருப்பப்படி, அதாவது  தீவிர தேசியவாதிகள் மற்றும் எதேச்சாதிகாரம் சார்ந்தவர்கள்  தற்போதுள்ள அரசியல் அமைப்பைச் சீர்குலைத்து சிறுபான்மை சமூகங்களைப் பாதுகாப்பற்ற உணர்வையும் கிளர்ச்சியையும் ஏற்படுத்துவது மீண்டும் மூன்றாம் தரப்பினர் தலையிடும் சூழ்நிலைக்கு வழிவகுக்கும்.

சில தரப்பினரால் பரிந்துரைக்கப்படுவதைப் போன்று மாகாண சபைகளை இல்லாதொழித்து அரசியல் கட்டமைப்பைச்  சீர்குலைக்காமல், குறிப்பாக மோசமான பொருளாதார நிலைமையின் பின்னணியில் கப்பலை (அரசாங்கத்தை) மிதக்க வைப்பதே சிறந்த கொள்கையாகும். 

மற்றொரு விமர்சனம் என்னவென்றால், மாகாணம் என்பது அதிகாரப் பகிர்வின் பொருத்தமான அலகு அல்ல என்பதாகும். இதற்குப் பதிலடியாக 2006 ஆம் ஆண்டு சனாதிபதி மகிந்த இராசபக்சவினால் அரசியலமைப்பு மாற்றங்கள் குறித்து ஆலோசனை வழங்குவதற்காக நியமிக்கப்பட்ட நிபுணர்கள் குழுவின் பெரும்பான்மை அறிக்கையை குறிப்பிடுவேன்.  அந்த அறிக்கையிலிருந்து பின்வருமாறு மேற்கோள் காட்டுகிறேன்.

அதிகாரப் பகிர்வுகான அலகு

அதிகாரப் பகிர்வுக் குழு பல்வேறு விருப்பங்கள் மற்றும் விருப்பங்களின் பல்வேறு அம்சங்கள் குறித்து விரிவான விவாதங்களை நடத்தியது.

 “அதிகாரப்பகிர்வுக்கான ஒரு அலகு நடைமுறைக்கு இயன்றவரை புவியியல் ரீதியில் இணைந்த பிரதேசத்தை உள்ளடக்கியதாகவும், சமச்சீர் பிராந்திய மேம்பாட்டுக்கு உகந்ததாகவும் நிர்வாகத் திறனை மேம்படுத்தும் வகையிலும் வடிவமைக்கப்பட வேண்டும் என்றும் நாங்கள் கருதுகிறோம். ஒவ்வொரு அணிகளுக்கு இடையே வெவ்வேறான வேறுபாடுகள் எதிர்பார்க்கப் படுகின்றன. இந்தச் சூழலில்  அதிகாரப் பகிர்வுக்கான பொருத்தமான அலகு மாகாணமாக இருக்கும் என்ற கருத்தில் உள்ளது.

இலங்கை மாகாண சபைத் தேர்தல்கள், 2012

வழக்கறிஞர்கள், கல்வியாளர்கள் மற்றும் நீதித்துறை மற்றும் நிர்வாகத் துறையில் அனுபவம் வாய்ந்த உறுப்பினர்கள்  அடங்கிய நிபுணர் குழுவில் எந்தவொரு அரசியல் கட்சியையும் சேர்ந்தவர்கள் இருக்கவில்லை என்பதையும், விவாதங்கள் உண்மை மற்றும் இடஞ்சார்ந்த கருத்தாக்கங்களை அடிப்படையாகக் கொண்டவை என்பதையும் நான் குறிப்பிட விரும்புகிறேன்.

மாகாண சபைகள் வெள்ளை யானைகளைப் போன்றது என்றும், அவற்றை இயங்க வைப்பதில் அரசு கூடுதல் செலவினங்களைச் செய்யும் போது மக்களுக்குச் சேவைகளை வழங்குவதில் அவை திறம்படச்  செயல்படவில்லை என மற்றொரு விமர்சனம் எழுந்துள்ளது.

இந்த விமர்சனத்தில்  சிறிது பொருள் உண்டு.  அதை வழங்க இயலாமைக்கான காரணங்களை மற்ற நாடுகளில் உள்ள ஒத்த அமைப்புகளுடன் ஒப்பிட்டு ஆராய வேண்டும். ஐக்கிய இராச்சியம் ஒரு ஒற்றையாட்சி முறைமை நாடு. அதில் இதே போன்ற அதிகாரங்கள் வெவ்வேறு இனப் பிராந்திய அலகுகளுக்குப் பகிர்ந்தளிக்கப்பட்டுள்ளன, அதாவது.  ஸ்கொட்லாந்து, வேல்ஸ் மற்றும் வடக்கு அயர்லாந்து, (இது அல்ஸ்டர் மாகாணம்).

இந்த அலகுகள் அனைத்தும் அவற்றின் சொந்த சட்டமன்றங்களைக் கொண்டுள்ளதுடன், ஸ்கொட்லாந்து நாட்டைப் பொறுத்தவரை ஒரு  நாடாளுமன்றம் உள்ளது, அதே நேரத்தில் அவை West Minster இல் உள்ள நாடாளுமன்றத்தில் பிரதிநிதித்துவம் பெற்றிருக்கின்றன. அரை – கூட்டாட்சி (quasi-federal) அரசியலமைப்பைக் கொண்ட இந்தியாவிலும், மாநிலங்களுக்கு ஆளுநர் மற்றும் சட்டப் பேரவைகள் இருக்கின்றன. இவற்றின் அதிகாரங்கள் 13 ஆவது திருத்தத்தில்  குறிப்பிடப்பட்டுள்ள அதிகாரங்களிலிருந்து மிகவும் வேறுபட்டதல்ல.

மேற்கூறிய அனைத்து நிகழ்வுகளிலும் அதிகாரப்பகிர்வு மிகவும் திறமையாகச் செயல்பட்டுள்ளதோடு பிராந்திய/மாகாண அலகுகள் திறமையாகச் செயல்பட்டு மக்களுக்குத் தேவையான சேவைகளை வழங்க முடிந்துள்ளது. அப்படியானால் இலங்கையில்  மாகாணசபைகள் ஏன் இந்தளவு சிறப்பாக செயல்படவில்லை என்பதை நாம் பார்க்க வேண்டும்.

முதலில் திறமையாக வினை செய்ய போதுமான நிதி தேவைப்படுகிறது. மாகாண சபையின் சட்டத்தின் விதிகளின் கீழ், மாகாண ஆளுநருக்கு  ஒரு மாகாணத்தின் நிதி மீதான கட்டுப்பாட்டு அதிகாரம் வழங்கப்பட்டுள்ளது. ஆளுநரின் சம்மதமின்றி எந்தவொரு வரி விதிக்கும் அல்லது ஒழிக்கும்  சட்டத்தையும் மாகாண சபை நிறைவேற்ற முடியாது. இது தொடர்பாக ஆளுநர்கள் ஒத்துழைக்கவில்லை.

இதனால் சபைகள் பெருமளவில் மத்திய மானியங்களிலேயே தங்கியிருக்க வேண்டியுள்ளது. நொவம்பர் 2016, மத்திய – சுற்றியல் உறவுகளுக்கான நாடாளுமன்றத் துணைக் குழுவின் அறிக்கை, மாகாணங்களுக்கு வழங்கப்படும் மட்டுப்படுத்தப்பட்ட வரி உயர்த்தும் அதிகாரத்திற்குக் கூடுதலாக கடன்கள் மற்றும் முதலீடுகளைப் பெறுவதற்கும், தேடுவதற்கும் அல்லது குறைந்த பட்சம் நிர்வகிப்பதற்கும் விதிக்கப்பட்டுள்ள வரையறைகளாகும். வெளிநாட்டு உதவி மற்றும் முதலீடுகள் மூலம் நிதியளிக்கப்படும் திட்டங்கள். “போதிய அல்லது கொள்கையற்ற நிதி ஏற்பாடுகளின் அரிக்கும் விளைவு என்னவென்றால், அவை மாகாண மற்றும் உள்ளூர் சேவை வழங்குதலை இடை நிறுத்துவதுடன்  அரசியலமைப்பு ரீதியாக நிறுவப்பட்ட சனநாயக நிறுவனங்களின் மீதான நம்பிக்கை இழப்புக்கு வழிவகுக்கிறது” என்று குழு முடிவுரையாகக் கூறியுள்ளது.

மாகாணச் சபைகள் சட்டம் மாகாண  அரச சேவை மற்றும் மாகாண அரச சேவை ஆணைக்குழுவின் கட்டுப்பாட்டை ஆளுநருக்கு வழங்குகிறது.  இந்த அதிகாரங்கள் தேசிய அரச சேவையின் மீது சனாதிபதி கூட பயன்படுத்தாத அதிகாரங்கள் ஆகும். மத்திய அரசும்   மாகாண சபையும்  ஆளும் கட்சியின்  கட்டுப்பாட்டில் இருக்கும் நிலையில், ஆளுநர்கள் தங்கள்  தனிச் சிறப்புரிமைகளை குறைவாகவே வலியுறுத்தும் நிலையில் இருப்பதோடு முதலமைச்சர்கள்  சிறந்த முறையில் செயல்பட முடியும். எவ்வாறாயினும், வடக்கு மற்றும் கிழக்கு மாகாண சபைகள் மிகவும் குறைவாகவே செயல்படுகின்றன. மறுபுறம் இந்தியாவில் மாநிலங்களின் ஆளுநர்கள் அரசியலமைப்புத் தலைவர்கள் போல் செயல்படுகின்றார்கள்.   நிறைவேற்று  செயல்பாடுகளையும் அவர்கள் எடுத்துக் கொள்வதில்லை.

Chandrahasan defends the Provincial Council System

The Provincial Councils, like the windmills in Cervante’s Don Quixote, are having brickbats thrown at, and cantankerous knights tilting at them. In this piece, I would like to answer some of the criticisms made against the Provincial Councils. But before I do so I note that the Prime Minister has announced that the Provincial Council elections will be held once the ground situation is ready for it. This welcome statement puts paid to all the critics, it being generally acknowledged that the Prime Minister as an experienced and consummate politician would know the political climate in the country and act accordingly.

One of the frequent criticisms is that the Provincial Councils were imposed upon the Sri Lankan polity by the Government of India. To recapitulate the sequence of events, following up on the July 1983 pogrom (riots) against the Tamil citizens of the Country and the outbreak of civil unrest in Sri Lanka, the then Prime minister of India, Shrimathi Indhira Gandhi sent an envoy as part of a diplomatic initiative to find ways of bringing the country back to normalcy. A process of negotiations was begun between the Governments of India and Sri Lanka with India playing the role of an interlocutor bringing the Tamil parties and the Government of Sri Lanka to the negotiating table, in order to solve the ongoing insurgency by Tamil militants and the ethnic problem in the island through Constitutional proposals.

The outcome of these negotiations was the India –Sri Lanka: Agreement to Establish Peace and Normalcy in Sri Lanka, i. e. the Indo-Sri Lanka Peace Accord in July 1987, and the drawing up of the 13th Amendment to the Constitution and the Provincial Councils Act no: 42 of November 1987. By virtue of these two Acts, Provincial Councils were set up. The opponents of the Provincial Councils argue that it is not a homegrown institution but one imposed by a foreign power.

In this connection, I would refer the readers to a very informative and well-researched article by Professor Gamini Keerawella in The Island newspaper of 16th September 2020 titled “Genealogy of Concept and Genesis of 13th Amendment”, in which he traces the genesis of Provincial Councils from the Donoughmore Commission Recommendations in 1931, through the Regional Councils of the Bandaranaike –Chelvanayakam pact 1956, the Dudley Senanayake –Chelvanayakam agreement, and even the promised but not forthcoming Devolution proposals made by the Sirimavo Bandaranaike Government before the 1974 bye-elections in Kankesanthurai. This proves that the matter of devolution and provincial councils has been on the political anvil in this country for a long time and is not a foreign imposition but a homegrown one.

In fact, the 13th Amendment came out of extensive discussions between the J. R . Jayewardene government and the TULF the Tamil party led by Mr Amithalingam, in July- August 1986. Secretary to the discussion was Felix Dias Abeysinghe retired Commissioner of Elections. The indo-Sri Lanka treaty was signed one year later in July 1987. The 13th Amendment and the Provincial Councils Act were passed in November 1987. One might say that the leverage for the passing of the 13th Amendment was the Treaty between India and Sri Lanka which provided for devolution. In the negotiations, the TULF negotiating team were no match for the astute Mr Jayewardene who outmanoeuvred them. It was only subsequently that they came to realise that the Bills as framed were below their expectations and they distanced themselves from the whole exercise.

Mr Amirthalingam in a letter to Shri Rajiv Gandhi in October 1987, set out his disappointment with the two Bills, saying that contrary to the belief that the Chapter pertaining to Provincial Councils would confer on the Provinces a measure of credible autonomy, the present Bills enabled Parliament and the Central Executive to continue to exercise its authority even in respect of those powers conferred on the Province. In my view, the problem lay with the Provincial Councils Act which negates many of the powers given under the 13th Amendment. This could have been, and can still be remedied by a few amendments to the Provincial Councils Act. I will return to this later.

Although the Provincial Councils and the devolution proposals were meant for the North East which was the Tamil speaking part of the country and intended to settle the ongoing armed conflict, the Jayewardene government extended the Provincial Council system to all the provinces of the country. Hence the present Provincial Council system is based not on any specific regional or ethnic criteria but is directed to all the people of the country and seeks to empower the people in their own localities be it in Jaffna or Matara. This system allows for decisions pertaining to the Provinces to be taken closer to the local people and communities and not only by politicians and bureaucrats in Colombo, i. e. the ‘Colombites’ to use a phrase coined by Gomin Jayasri. In hindsight, this was a good move as it made it an all-island system. Thus, we might say that the Indian intervention brought something that was beneficial to the country and to all the communities. However, foreign intervention may not always bring good results.

A lesson to be learnt from this episode is that when you do not keep your house in order and there is dissension and disaffection, the neighbours and not so near neighbours will certainly want to look in, seeking to interfere and usually it is for their own benefit. If at the behest of a few people, i. e. ultranationalists and authoritarian oriented elements, we start to upset the existing political system and cause the minority communities to feel insecure and agitated it can once again lead to a situation where third parties intervene. The best policy is to keep the ship afloat, particularly in the context of the grim economic situation without destabilising the political structure by abolishing the Provincial Councils, as is being suggested in some quarters.

Another criticism made is that the province is not the appropriate unit of devolution. As a counter to this, I would refer to the Majority Report of the Experts Committee appointed by President Mahinda Rajapaksa in 2006 to advise on the constitutional changes, and of which I was myself a member. I cite from the Report as follows, “Unit of Devolution. The group held extensive discussions on the various options and the different aspects of the options. We are of the view that a unit of devolution should as far as practicable consist of geographically contiguous territory, be conducive to balanced regional development and be designed to enhance administrative efficiency. Differences in endowments are to be expected among units.

In this context, the group is of the view that the appropriate Unit of Devolution would be the Province”. I might mention that there were no members of any political party in the Experts panel which included lawyers, academics and experienced members of the judicial and administrative services and the discussions were based on factual and spatial considerations.

Another criticism made is that the Provincial Councils are like white elephants and have not been effective in delivering any services to the people while the State incurs additional expenses in keeping them running. This criticism has some substance to it and the reasons for its inability to deliver have to be examined while comparing it to similar bodies in other countries. In the United Kingdom which is a Unitary state similar powers have been devolved into the different ethnic regional units, i. e. Scotland, Wales and Northern Ireland, (which is the Province of Ulster). All these units have their own legislative assemblies, and in the case of Scotland a Parliament while at the same time they are represented in the Parliament in West Minster. In India too which has a quasi-federal Constitution, the States have a Governor and Legislative Assemblies exercising powers not very different from those set out in the 13th Amendment. In all the above instances devolution has worked efficiently and the regional/ provincial units have been able to work efficiently and deliver the required services to the people. So we have to see why Provincial Councils in Lanka have not worked so well.

To begin with, in order to work efficiently adequate financial funding is required. Under the provisions of the Provincial Councils Act, the Governor of the Province is given a controlling power over the finances of the province. The Provincial Council cannot pass any Statue imposing or abolishing any taxes without the consent of the Governor. Governors have not been cooperative in this regard. Hence the Councils have to depend largely on Central grants.

The report of the Parliamentary Sub – Committee on Centre –Periphery Relations, November 2016, points out that in addition to the limited tax-raising power vested in the Provinces are the limitations placed on obtaining loans and investments, and on seeking or at least administering projects financed by foreign aid and investments. The Committee concluded that “the corrosive effect of inadequate or unprincipled financing arrangements is that they impair Provincial and local service delivery, leading to an erosion of confidence in what are constitutionally established democratic institutions”.

The Provincial Councils Act gives the Governor control of the Provincial Public service and the provincial Public Service Commission. These are powers that even the President does not exercise over the National Public service. In Provinces where the ruling party at the Centre is also the party in control of a Provincial Council, Governors have been less assertive of their prerogatives and the Chief Ministers have been better able to operate efficiently. However, the Provincial Councils of the North and the East have had less leeway. In India on the other hand the Governors of the States act like constitutional heads and do not take over executive functions.

Another area that needs re-organization is the administrative service in the Province. The Majority Report of the Experts Committee 2006, recommended that for devolution of power to be effective it should be devoid of duality and hence there should be a restructuring of the administration in the Provincial. Another matter of concern is that of the allocation of subjects. Although the 13th Amendment sets out the allocation of subjects between the Province and the Centre in two lists and a third concurrent list, there are overlapping powers and the Provincial area of competence has come to be circumscribed. In order to function efficiently, there has to be clarity in the allocation of subjects and this too is a matter which has to be looked into.

I have outlined the shortcomings of the Provincial Council system which have impeded their efficient functioning. Most of these stem from the Provincial Councils Act. This Act can be amended by a simple majority in Parliament. The administrative changes and restructuring of the administrative services in the Province can be done by gazette notifications by the President as provided for in the 13th Amendment itself. This will not need any major constitutional changes.

Despite its shortcomings and the restrictions and encroachments by the Central Government, the Provincial Council system has taken root in the Country. It provides for people to enter into and engage in political activity at the Provincial level. Persons who have gained experience of political issues at the local level can thereafter gravitate to the national level. The minorities Tamil and Muslim are able to feel that they have some say in the management of their own affairs and within their localities. This is a safety valve that is necessary for any multi-ethnic state, as we see in the United Kingdom (UK) where the ethnic Scots, Welsh and Northern Irish have devolution of powers in respect of their local areas. Without attempting to do away with the Provincial Council System it should be implemented in full while making the necessary changes through amendments and administrative action, so as to make them more efficient in the delivery of services to the people in their localities.

Provincial Councils have been part of the Sri Lankan Constitution for over 30 years. It is time the bureaucrats in Colombo and the government ministers stopped viewing them with suspicion or antipathy, and saw them as supportive institutions in the governance of the country, making for a more efficient administration and a more democratic form of governance for the whole country.

The Tamil parties could, by working towards meaningful devolution and further empowered systems of Provincial Councils and Local Authorities, become engaged in a process that is in the national interest while promoting the aspirations and interests of the Tamil speaking people. It is to be hoped that the Provincial Council elections will be held early in the coming year and the continuity of the existing political system maintained.

Chandrahasan broaches ‘Pragmatic Amendments’ in Sri Lanka’s Political Framework

There is much speculation in the Tamil political circles as to the usefulness or otherwise of the 13th Amendment to the Constitution and whether the Provincial Council system set up under its aegis gives a measure of power-sharing or devolution of powers to the Tamil speaking provinces, or whether it is an ineffective institution which blocks out any greater devolution under the exercise of internal self-determination. This debate has been sparked by the decision of Tamil speaking parties including the TNA, to send a letter to the Prime Minister of India Narendra Modi, requesting him to use his good offices to induce the Government of Sri Lanka to implement the 13th Amendment fully, in the context that the 13th Amendment arose out of the provisions of the Indo -Sri Lanka Peace Accord of July 1987, to which treaty India and Sir Lanka are signatories.

The letter was duly signed by six Tamil party leaders and handed over to the Indian High Commissioner, triggering some protests by those opposing the 13th Amendment. This debate takes on even greater urgency in the context of the impending new constitutional proposals of the Experts Committee appointed by the Gotabaya Government to be tabled in Parliament shortly.

In order to determine which is the better view, we have to take a look at the provisions of the 13th Amendment and the workings of the Provincial Councils set up under them, which have been in operation from 1988 onwards in most parts of the Country. Although the PCs as originally envisaged were intended to be set up for the amalgamated Northern and Eastern provinces, to give expression to the long-standing demand of the Tamil speaking people since independence, for devolution and power-sharing within a Federal framework, it was extended to the Sinhala majority provinces as well although there had been no demand for them in these provinces.

The first Provincial Council elections were held in April 1988 for the North Central, North Western, Sabragamuwa and Uva Provinces, and subsequently for the other provinces. In September 1988 the Northern and Eastern provinces were made one administrative unit in accordance with the provisions of the Indo -Sri Lanka Treaty, and in November 1988 elections were held for the North East Provincial Council. In 1990 the PC was dissolved.

Thereafter the North-East Province was directly administered by the Central government. During the civil war, it was not possible to hold PC elections In the northern and eastern parts of the Country. In 2006 pursuant to a Court decision the two provinces were separated. It was only in May 2008 that the Eastern Province’ Provincial Council election was held. Subsequently, after the termination of the war in the north, the Northern Province, Provincial Council election was held on 21st September 2013. We can see that this institution has been operating over a long period of time but during this long period certain sections of the 13th Amendment dealing with the powers conferred on the Provincial Councils set out in the 3 Appendixes to the 9th Schedule of List 1 Provincial Council List, are yet to be activated and are in abeyance. These Appendixes deal with the following subjects; in Appendix 1, law and order which has to do mainly with Police powers and the institution of a Provincial Division of the Police Force alongside the National Division of the Force. Appendix 11 Land and land settlement, and Appendix 111 Education.

Apart from the above, the Provincial Council exercises powers in respect of the subjects assigned to it, over which it has both legislative and executive powers. The subjects assigned to the Province and set out in the provincial List, List 1 include inter alia Provincial housing and construction, agriculture and agrarian services, rural development, health, land, Irrigation, roads bridges and ferries within the province, planning, and plan the implementation of provincial economic plans, educational services, and supervision and administration of local government authorities. The list even includes ancient and historical monuments other than those declared to be of national importance.

I mention this in the context of the Archaeological explorations being made in the northern and eastern provinces by the recently appointed task force on archaeology without any representation from the Tamil and Muslim communities. There is also a concurrent list, List 111, over which both the Provincial Council and the Centre can exercise powers, these include planning and appraisal of plan implementation strategies at the provincial level, education and educational services, higher education, agriculture and agrarian services, health, irrigation, tourism, etc. In these areas, there can be overlapping powers and hence disputes arise. The Provincial Council can pass statutes and exercise executive powers in respect of the subjects set out in the Provincial and Concurrent lists.

These powers are largely based on the powers conferred on the States in the Indian constitution part VI. The States in India are running efficiently and providing the people with the services that they need. Tamil Nadu for example is recognised as having a very efficient administration presently under Chief Minister M. K Stalin. The question is why the Provincial Council system in Sri Lanka is generally regarded a white elephant and as not effective in providing services to the people. For this, we must examine the roadblocks in the system and make the necessary adjustments, rather than just dismantling the entire system, and throwing the baby away with the bathwater so to speak.

An appraisal of the workings shows that most of the stumbling blocks to the smooth functioning of the Provincial Councils are as a result of the provisions of the Provincial Councils Act no 42 of 1987, which was passed alongside the 13th Amendment

Under this Act, the Governor is given powers over the finances of the PCs and is given control of the Provincial Public service as well as the Provincial Public Service Commission. The 13th Amendment provides that the executive power of the Provincial Council is vested in the Governor and he acts through the Board of ministers or through members of the provincial public service. The Chief Minister and the Board of Ministers aid and advise the Governor in the exercise of his functions and the Governor Shall act in accordance with the advice except where he is required under the Constitution to exercise his discretion. In the Indian Constitution similarly, in respect of the Stateschandrahas, the executive power is vested in the Governor but as in the Westminster scheme of governance, the Governor acts on the advice of the Chief Ministers and is a nominal head.

On the other hand, in Sri Lanka we find many instances of Governors exercising these powers like executive heads and not as nominal heads, particularly in the Tamil majority provinces and not so much in the Sinhalese majority provinces. The Governor’s stranglehold over the functioning of the PCs is most clearly demonstrated in his power over the finances of the province. To run the PCs money is required and this is where the Councils have been most hamstrung as the Provincial Councils Act gives the Governor controlling power over the finances of the Province. The custody of the Provincial Fund is with the Governor. The PC cannot pass any statute imposing or abolishing taxes without the consent of the Governor. Moreover, the constitutional framework severely limits the revenue-raising capacity of the PCS, as pointed out in the Report of the Parliamentary subcommittee on Centre-Periphery relations of November 2016. Hence the PCs have to depend largely on Central grants for their funds.

Another area which needs to be redesigned is the Administrative system. To run the Provincial Councils effectively the Council requires control not only over its funds but also an effective administrative system and defined areas of competence. At present the District Secretary and the Divisional Secretary, as well as the Grama Niladaris, come under the Central Government These officers perform administrative functions within the territory of the province but without any control from the provincial administration. Also, although the Local Authorities are under the supervisory control of the Provincial Councils as per the devolved List, most of the power at the local level remains with the Central Government.

For efficient administration of the province, there have to be defined areas of competence. But in effect, the Centre has been encroaching on the areas assigned to the provincial administration. The reserved List of the Centre List 11, starts with the Rubric” National policy on all subjects”. This has enabled the Centre to take over subjects which it designates as National.

To remedy this, what is National policy or National standards should be laid down through a participatory process with the involvement of the Provinces culminating in framework legislation passed by Parliament to which both centres and Provinces should adhere. This has been proposed in the Report of the Experts Committee on the Constitution,2006. Another matter which has to be amended is the Concurrent List. Here too it has been recommended that the List be eliminated and the relevant subjects are divided between the Centre and the Province so that they each have defined areas.

In an article of this nature, it is not possible to do a more in-depth study but I have outlined what are the important issues to be addressed if the Provincial Councils are to provide meaningful Devolution. Some of the areas which need amendment are as follows. The Governor’s role has so far tended to be an obstruction to the functioning of the PCs. The Governor should continue as a nominal head and leave the running of PC to the elected representatives. This is also a recommendation of the Parliamentary subcommittee in its 2016 report.

Hence the Governor’s powers have to be pruned and the Provincial Councils Act suitably amended. The revenue-raising capacity of the PCs must be enhanced. It is suggested that they be given the power to obtain loans from foreign sources or at least have the power to administer projects financed by foreign aid. Another important issue is to put in place an administrative structure that can carry out the functions of the Provincial Council in services delivery to the people and for this, the administration has to be redesigned so as to bring the District Secretary, the Divisional Secretary and the Grama Niladaris, under the Provincial administration while they still carry out agency services for the Centre.

Furthermore, although local Authorities are under the Authority of the PC, as per the devolved List, this provision is being undermined by the Centre using the Urban Development Authority (UDA), Mahaweli Authority and other Central bodies operating within the Province. Hence it must be mandated that such bodies operate within the Province only with the consent and in conjunction with the Provincial and Local Government Authorities. As for the powers in respect of Law and Order and Police powers contained in Appendix 1 of List 1 the 9th schedule, they could be transferred to those PCs which request them as for example in the case of the Northern Ireland Assembly in the UK, where these powers were initially with the Centre, but there was a provision that allowed them to be released on request.

In 2010 they were transferred to the Assembly under the Hillsborough Agreement. Until such time as Appendix 1, comes to be activated other provisions can be put in place, such as a policy of recruiting a percentage of the Police cadre stationed in the northern and eastern provinces from these provinces and mandating that they have an O level pass in the Tamil language so that they could operate efficiently in the Tamil speaking areas. I would suggest some similar provision in respect of some areas in the Central provinces so that the upcountry Malayaha Tamils, are also benefited.

It is submitted that Appendix 11 on land be fully implemented as it is essential for the land security of these provinces that the utilization of state land, as well as the alienation of such land under Presidential order, be done in consultation with, or advice of the Provincial Council. The provision in Appendix 11 on the constitution of a National Land Commission with members being appointed from all 3 communities should be carried out forthwith.

I would suggest that the Tamil parties take up the proposed reforms with the Government of Sri Lanka in a negotiated process. As the Government of India was the other party to the Indo Sri Lanka Treaty, India can legitimately demand that the obligations are undertaken in the treaty be carried out and the provisions of 13 A be implemented fully so that meaningful devolution is assured to the Tamil speaking people whom the Treaty specifically denotes as the historical inhabitants of the northern and eastern provinces of Sri Lanka. In line with the UNHCR resolution, the Sri Lankan Government should also hold the Provincial Council elections so that these institutions can be functioning and not in abeyance as they have been for some years. The Provincial Councils in the South will also benefit from the reforms proposed as it will provide the citizens of the entire Country a streamlined system that is a service provider to the people.

I note that the President in his Budget speech has advised the Tamil parties to look to their peoples’ needs and concentrate on the economic development of their areas. This can best be done when there is true democracy and the people are taken into the process of consultation as to the strategies for economic development and this is best done at the local level through the Provincial Councils, and local Government Authorities, rather than through bureaucrats sitting in Colombo who have no knowledge of the local conditions or the needs of the people. In my view, the Province remains the best unit of devolution at present to serve the needs of the Tamil speaking people. It gives them some measure of autonomy in their traditional areas of inhabitancy. Similarly, in the United Kingdom which is a Unitary State, Scotland, Wales and Northern Ireland which are ethnically distinct have their own Legislative Assemblies, in the case of Scotland it is called a Parliament, and exercise similar powers to those set out in the 13th Amendment.

I would like to point out that all the major changes suggested in this article respecting the Governor’s powers, Financing of the Provincial Councils and the Re-designing of the Administrative system in the Provinces have been recommended in the following Reports: Report of the Experts Committee advising the APRC on Constitutional matters and resolution of the National Question 2006, the Report of the APRC( All party Representative Committee) on a new Homegrown Constitution 2010,

Report of the Parliamentary sub-committee on Centre-Periphery relations 2016, presented to the Steering Committee of the Constitutional Assembly which was engaged in producing a new Constitution during the tenure of the previous government. In the circumstances, the proposed new Constitution could incorporate these features and there is no need to reinvent the wheel.

I would submit that the Provincial Council system can be an efficient and successful system if all the shortcomings referred to above are eliminated and the necessary amendments made. These changes will not require any major constitutional procedures and can be accomplished by legislation in Parliament with a simple majority, and the administrative changes by Presidential gazette notification under the provisions of the 13th Amendment itself.
