ஐக்கிய நாடுகள் சபையின் மனித உரிமை பேரவையில் நிறைவேற்றப்பட்ட 30/1 தீர்மானத்திலிருந்து விலகுவதற்கு இலங்கை அரசாங்கம் தீர்மானித்துள்ளது.

பிரதமர் மஹிந்த ராஜபக்ஷ கடந்த 19ஆம் தேதி சிறப்பு அறிக்கையொன்றின் ஊடாக இந்த அறிவித்தலை வெளியிட்டிருந்தார்.

இதையடுத்து, மனித உரிமை பேரவையின் 30/1 தீர்மானத்திலிருந்து விலகும் அரசாங்கத்தின் தீர்மானத்திற்கு கடந்த 19ஆம் தேதி அமைச்சரவை அங்கீகாரம் வழங்கியது.

அமைச்சரவை அங்கீகாரம் வழங்கியமை தொடர்பில் அமைச்சரவை இணை பேச்சாளர் பந்துல குணவர்தன நேற்றைய தினம் (பிப்ரவரி 20)தெரிவித்திருந்தார்.

30/1 தீர்மானம்

பிரித்தானியா, அமெரிக்கா ஆகிய நாடுகளுடன் இலங்கையின் இணை அனுசரணையில் ஐநா மனித உரிமை பேரவையில் முன்வைக்கப்பட்ட பிரேரணையே 30/1 தீர்மானமாகும்.

2015ஆம் ஆண்டு அக்டோபர் மாதம் இந்த தீர்மானம் ஐநா மனித உரிமை பேரவையில் நிறைவேற்றப்பட்டது.

இந்த தீர்மானத்தில் பல முக்கிய விடயங்கள் உள்ளடக்கப்பட்டுள்ளன.

இலங்கை படை

இலங்கையில் யுத்தக் காலத்தில் இடம்பெற்றதாக கூறப்படும் மனித உரிமை மீறல்கள் மற்றும் படுகொலைகள் தொடர்பில் விசாரணைகளை நடத்த தீர்மானிக்கப்பட்டது.

இதற்காக சர்வதேச நீதிபதிகளின் பங்குப்பற்றுதலுடன் விசாரணைகளை நடத்த வேண்டும் என அதில் கூறப்பட்டது.

  • காணாமல் போனோர் தொடர்பான அலுவலகத்தை நிறுவுதல்.
  • நட்டஈடு வழங்கும் அலுவலகத்தை ஸ்தாபித்தல்.
  • விசேட நீதிமன்ற கட்டமைப்பொன்றை உருவாக்குவதற்கு தேசிய ஆலோசனைகளை பெற்றுக்கொள்ளுதல்.
  • தமிழீழ விடுதலைப் புலிகளினால் முன்னெடுக்கப்பட்டதாக கூறப்படும் வன்முறைகள் மற்றும் முறைகேடுகள் தொடர்பில் விசாரணைகளை நடத்துதல்.
  • விசேட ஆலோசனையின் அடிப்படையில் நடைமுறைப்படுத்தப்படும் நீதிமன்ற கட்டமைப்பொன்றை உருவாக்குதல்.
  • நீதிமன்றம் மற்றும் சட்ட நிறுவனங்களை முன்னெடுத்து செல்வதற்கான நபர்களை நியமித்தல்.
  • கலப்பு நீதிமன்ற கட்டமைப்பை உருவாக்குவதற்கு சர்வதேச தரப்பின் நிதியுதவிகள், பொருட்கள் மற்றும் தொழில்நுட்ப ஒத்துழைப்புக்களை பெற்றுக் கொள்ளுதல்.

இவ்வாறு ஐநா மனித உரிமை பேரவையினால் நிறைவேற்றப்பட்ட தீர்மானத்தில் உள்ளடக்கப்பட்ட சில விடயங்கள் இலங்கை அரசாங்கத்தினால் நடைமுறைப்படுத்தப்பட்டுள்ள போதிலும், முக்கிய சில தீர்மானங்கள் இதுவரை நடைமுறைப்படுத்தப்படவில்லை.

43ஆவது மனித உரிமை பேரவை கூட்டத் தொடரில் இலங்கை பங்குப்பற்ற தீர்மானம்

எதிர்வரும் மனித உரிமை பேரவையின் 43 ஆவது கூட்டத் தொடருக்கு இலங்கையின் பிரசன்னம் தொடர்பில் இலங்கை அரசாங்கம் நடவடிக்கைகளை மேற்கொண்டு வருவதாக அரசாங்கம் குறிப்பிடுகின்றது.

இந்த கூட்டத் தொடரில் பங்குப்பற்றுவது தொடர்பில் இலங்கை வெளிவிவகார அமைச்சு இராஜாதந்திர ரீதியிலான நடவடிக்கைகளை மேற்கொண்டு வருவதாக கடந்த அமைச்சரவை கூட்டத்தில் கருத்துக்கள் தெரிவிக்கப்பட்டுள்ளன.

இதன்படி, 2015 ஆக்டோபர் மாதம் இலக்கம் 30/1 மற்றும் 2017ஆம் ஆண்டு மார்ச் மாதம் இலக்கம் 34/1 ஆகிய தீர்மானங்கள் நிறைவேற்றப்பட்டுள்ளதை இலங்கை அரசாங்கம் சுட்டிக்காட்டியுள்ளது.

இலங்கை நல்லிணக்கம், பொறுப்பு கூறல் மற்றும் மனித உரிமை முன்னேற்றம் குறித்து 2019 மார்ச் மாதம் இலக்கம் 40/1 தீர்மானத்திற்கும் இலங்கை இணை அனுசரணை வழங்கியுள்ள நிலையில், இந்த அனைத்து தீர்மானங்களிலும் இருந்து வெளியேற தீர்மானிக்கப்பட்டுள்ளதாக அமைச்சரவை இணை பேச்சாளர் பந்துல குணவர்தன கூறுகின்றார்.

ஐக்கிய நாடுகள் மனித உரிமை பேரவையில் அங்கம் வகித்த நிலையில், இலங்கைக்கு எதிராக குறித்த தீர்மானத்தை கொண்டு வர முன்னின்று செயற்பட்ட அமெரிக்கா தற்போது மனித உரிமை பேரவையிலிருந்து விலகியுள்ளது.

2018ஆம் ஆண்டு ஜுன் மாதம் அமெரிக்கா மனித உரிமை பேரவையிலிருந்து விலகுவதாக அறிவித்தது.

ஐக்கிய நாடுகளின் மனித உரிமை பேரவையில் அரசியல் பாகுபாடுகள் உள்ளதாக தெரிவித்தே அமெரிக்கா அங்கத்துவத்திலிருந்து விலகுவதாக அறிவித்தது.

30/1 தீர்மானத்தை கொண்டு வந்த அமெரிக்கா தற்போது மனித உரிமை பேரவையில் அங்கம் வகிக்கவில்லை.

தீர்மானத்திற்கு ஆதரவு தெரிவித்த ஐக்கிய தேசியக் கட்சியின் பதில்

ஐக்கிய நாடுகளின் மனித உரிமை பேரவையில் நிறைவேற்றப்பட்டு இலங்கை அரசாங்கத்தினால் இணை அனுசரணை வழங்கப்பட்ட 30/1 தீர்மானத்தினாலேயே, முன்னாள் ஜனாதிபதி மஹிந்த ராஜபக்ஷ உள்ளிட்ட தரப்பினர் காப்பாற்றப்பட்டதாக ஐக்கிய தேசியக் கட்சி நாடாளுமன்ற உறுப்பினர் மங்கள சமரவீர தெரிவிக்கின்றார்.

இலங்கை இராணுவத்திற்கும், நாட்டின் தலைவர்களுக்கும் தண்டனை வழங்க சர்வதேச விசாரணைகள் முன்னெடுக்கப்பட்ட காலத்தில், தமது அரசாங்கத்தினால் ஜெனிவாவில் இணை அனுசரணை வழங்கப்பட்ட குறித்த தீர்மானத்தினாலேயே அனைவரும் காப்பாற்றப்பட்டதாக அவர் குறிப்பிட்டுள்ளார்.

முன்னாள் வெளிவிவகார அமைச்சர் என்ற விதத்திலும், 30/1 தீர்மானத்திற்கு ஆதரவு வழங்கிய அமைச்சர் என்ற விதத்திலுமே மங்கள சமரவீர இந்த தெளிவூட்டலை விடுத்துள்ளார்.

ஐநாவின் குறித்த தீர்மானத்திற்கு இணை அனுசரணை வழங்கி ஆதரவு தெரிவித்தமையினாலேயே மஹிந்த ராஜபக்ஷ உள்ளிட்ட தரப்பினருக்கு எதிரான நடவடிக்கைகள் நிறுத்தப்பட்டதாகவும் அவர் கூறினார்.

முன்னாள் ஜனாதிபதி மஹிந்த ராஜபக்ஷவை மின்சார கதிரைக்கு கொண்டு செல்ல வேண்டும் என்று கூறப்பட்ட தருணத்தில், குறித்த தீர்மானத்தின் ஊடாகவே மின்சார கதிரைக்கு செல்வதை தமது அரசாங்கம் தடுத்து நிறுத்தியதாக அவர் சுட்டிக்காட்டியுள்ளார்.

சர்வதேச விசாரணை நடத்தப்படுவதற்கான அவசியம் கிடையாது என்பதை தாம் ஜெனிவாவிற்கு எடுத்துரைத்ததாக கூறிய மங்கள சமரவீர, உள்நாட்டிற்குள்ளேயே தாம் விசாரணைகளை நடத்துவதாக உறுதியளித்திருந்ததாகவும் குறிப்பிட்டார்.

யுத்தக் குற்றம் தொடர்பிலான பிரச்சினைகளிலிருந்து சர்வதேசத்தைச் சற்று தள்ளி வைக்க முடிந்ததாகவும், அதனூடாகவே தாம் மஹிந்த ராஜபக்ஷ உள்ளிட்ட தரப்பினரை காப்பாற்றியுள்ளதாகவும் நாடாளுமன்ற உறுப்பினர் மங்கள சமரவீர தெரிவித்தார்.

ஐநாவின் தீர்மானத்திலிருந்து விலகுவதான அறிவிப்பு தொடர்பில் சட்டத்தரணியின் பார்வை

ஐக்கிய நாடுகளின் மனித உரிமை பேரவையில் நிறைவேற்றப்பட்ட தீர்மானத்திலிருந்து வெளியேறுவதற்கான நடைமுறைகளை பின்பற்றியே இலங்கை அதிலிருந்து வெளியேற வேண்டும் என சிரேஷ்ட சட்டத்தரணி பேராசிரியர் பிரதீபா மஹானாமஹேவா பிபிசி தமிழுக்கு தெரிவித்தார்.

இந்த தீர்மானத்திற்கு இணை அனுசரணை வழங்கிய பிரதான நாடான அமெரிக்கா, மனித உரிமை பேரவையில் தற்போது அங்கம் பெறாமையினால் உரிய நடைமுறைகளை பின்பற்றி வெளியேற முடியும் என அவர் குறிப்பிட்டார்.

அமெரிக்கா, மனித உரிமை பேரவையில் இல்லாத போதிலும், அந்த தீர்மானம் நிறைவேற்றப்பட்டுள்ளமையினால் உரிய நடைமுறைகளின் பிரகாரமே வெளியேற வேண்டும் என அவர் கூறுகின்றார்.

அவ்வாறு உரிய நடைமுறைகளை பின்பற்றி வெளியேறாத பட்சத்தில், பாரிய பின்விளைவுகளை இலங்கை சந்திக்க நேரிடும் என பிரதீபா மஹானாமஹேவா எச்சரிக்கை விடுக்கின்றார்.

இந்த தீர்மானத்திலிருந்து வெளியேறுவதற்கான சரியான காரணங்களை சுட்டிக்காட்டியே அதிலிருந்து விலக அரசாங்கம் நடவடிக்கை எடுக்க வேண்டும் என அவர் குறிப்பிடுகின்றார்.

அவ்வாறு இல்லாத பட்சத்தில், ஐக்கிய நாடுகளின் பாதுகாப்பு பேரவையின் ஊடாக, மனித உரிமை பேரவை பல்வேறு தடைகளை ஏற்படுத்துவதற்கான சாத்தியம் காணப்படுவதாகவும் அவர் கூறுகின்றார்.

யுத்தக் காலத்தில் இடம்பெற்றதாக கூறப்படும் மனித உரிமை மீறல்களுக்கு இலங்கை தண்டனை வழங்கவில்லை என்பதை வலியுறுத்தி வெளிநாட்டு நீதிபதிகள் அடங்கிய கலப்பு நீதிமன்றமொன்றை உருவாக்க வேண்டும் என்ற பாரதூரமான சரத்து அதில் உள்ளடக்கப்பட்டுள்ளதாக அவர் சுட்டிக்காட்டினார்.

கலப்பு நீதிமன்றத்திற்கு கொமன்வெல்த் அல்லது ஐக்கிய நாடுகள் சபையின் சட்டத்தரணிகளே ஈடுபடுத்தப்படுவதாகவும் அவர் குறிப்பிட்டார்.

ஐநா மனித உரிமை பேரவையில் அங்கம் வகிக்கும் இலங்கையின் நட்பு நாடுகளின் ஒத்துழைப்புக்களை பெற்று, இந்த தீர்மானத்திலிருந்து வெளியேறுவதே சிறந்ததொரு நடைமுறை எனவும் அவர் கூறுகின்றார்.

இலங்கையுடன் நட்புறவாக செயற்படும் பல நாடுகள் பாதுகாப்பு பேரவையில் இருப்பதனால், அமெரிக்காவிற்கு இலங்கைக்கு எதிராக ஐநாவில் தடையை விதிக்க முடியாதமையினாலேயே, இலங்கை இராணுவ தளபதி லெப்டினன் ஜெனரல் ஷவேந்திர சில்வாவிற்கு எதிராக அமெரிக்க இராஜாங்க திணைக்களம் தடையை விதித்துள்ளதாகவும் அவர் சுட்டிக்காட்டினார்.

எவ்வாறாயினும், உரிய நடைமுறைகளை பின்பற்றி, இலங்கை குறித்த தீர்மானத்திலிருந்து வெளியேற நடவடிக்கை எடுக்க வேண்டும் என சிரேஷ்ட சட்டத்தரணி பிரதீபா மஹானாமஹேவா குறிப்பிடுகின்றார்.

இந்த சபை அறிந்திருக்கும் வகையில், 2019 நவம்பர் மாதத்தில், ‘திறன்மிக்க குடிமக்கள், திருப்திகரமான குடும்பம், ஒழுக்கமானதும் நியாயமானதுமான சமூகம் மற்றும் வளமான நாடொன்றின் நான்மடங்கு விளைவை’ அடைவதை நோக்காகக் கொண்ட கொள்கைக் கட்டமைப்பை அடைந்து கொள்வதற்கானதொரு மகத்தான ஆணையை ஜனாதிபதி கோட்டாபய ராஜபக்ஷவுக்கு இலங்கை மக்கள் வழங்கினர்[1]. ‘எமது மக்களுக்கு கிடைக்கக்கூடிய ஜனநாயக எல்லையை சமரசம் செய்யாமல் தேசியப் பாதுகாப்பை’ பாதுகாப்பதில் உறுதியாக நங்கூரமிட்டுள்ள வகையில் நாட்டில் நிலையான வளர்ச்சி மற்றும் அமைதியை உறுதி செய்வதற்காக இது திட்டமிடப்பட்டுள்ளது[2].

ஒரு தசாப்தத்திற்கு முன்னர், 18 மே 2009 அன்று, எல்.ரீ.ரீ.ஈ. பயங்கரவாதத்தை இலங்கை, இராணுவ ரீதியாக தோற்கடித்து, மூன்று தசாப்த கால மோதல்களையும் துன்பங்களையும் முடிவுக்குக் கொண்டுவந்தது. மிருகத்தனமான மோதலின் நிறைவானது, அடிப்படை மனித உரிமைகளில் ஒன்றான, சிங்களவர்கள், தமிழர்கள், முஸ்லிம்கள் மற்றும் ஏனைய அனைத்து இலங்கையர்களினதும் ‘உயிர் வாழ்வதற்கான உரிமையை’ மேம்படுத்தி, பாதுகாத்தது. இலங்கையில் பிரிவினைவாத பயங்கரவாதத்தின் பெயரில் 2009 மே மாதம் முதல் ஒரு துப்பாக்கி வேட்டேனும் சுடப்படவில்லை என்பதை நான் பெருமையுடன் கூற விரும்புகின்றேன்.

எல்.ரீ.ரீ.ஈ. பயங்கரவாதிகளுக்கு எதிரான மோதலின் நிறைவானது ஒரே இரவில் நீடித்த அமைதியை தோற்றுவிக்கும் என்ற மாயை இலங்கைக்கு ஒருபோதும் இருந்ததில்லை. இந்த சபை கையாளும் பல மோதல் சூழ்நிலைகளைப் போலவே, இலங்கையும் தேசத்தைக் கட்டியெழுப்புவதற்கானதொரு விடயப்பொருள் அல்ல என்றாலும், நிலையான அமைதி மற்றும் நல்லிணக்கத் திட்டத்தின் ஒரு பகுதியாக, சில மதிப்புரைகள் மற்றும் இருக்கும் கட்டமைப்புகளை வலுப்படுத்துவதற்கான தேவை இலங்கைக்கு உள்ளது என்பதை நாங்கள் கவனத்தில் கொண்டிருந்தோம்.

தற்போதைய ஜனாதிபதி கோட்டாபய ராஜபக்ஷ பாதுகாப்பு அமைச்சின் செயலாளராக இருந்த, அப்போதைய ஜனாதிபதி மஹிந்த ராஜபக்ஷ அவர்களின் தலைமையிலான அரசாங்கம், அந்த நேரத்தில் காணப்பட்ட உண்மைகளை அறிந்து, இலங்கையில் ‘குணப்படுத்துதல் மற்றும் சமாதானத்தைக் கட்டியெழுப்புதலைக்’ கொண்டுவருவதற்காக நிலையானதொரு நல்லிணக்கச் செயற்பாட்டை ஆரம்பித்தது. மிகவும் சிறந்த வளமுள்ள நாடுகள் நிவர்த்தி செய்து, சாதிப்பதற்கு பல தசாப்தங்களை எடுத்துள்ளமையினால், இது மேம்பட்ட மற்றும் உள்ளடக்கமிகு செயன்முறையொன்றாகக் கருதப்பட்டது.

டிசம்பர் 2014 நிலவரப்படி, நான் உறுப்பினராக இருந்த மஹிந்த ராஜபக்ஷ அரசாங்கம் தனது பதவிக்காலத்தை நிறைவு செய்த போது, பின்வருவனவற்றில் நாங்கள் கணிசமான முன்னேற்றத்தைக் கண்டிருந்தோம்;.

  • பாதுகாப்புப் படையினர் பயன்படுத்திய நிலத்தை விடுவித்தல்
  • முந்தைய மோதல் இடம்பெற்ற பகுதிகளில் இராணுவ இருப்பைக் குறைத்தல்
  • சிறுவர் போராளிகள் உட்பட முன்னாள் எல்.ரீ.ரீ.ஈ. போராளிகளுக்கு புனர்வாழ்வளித்து, மீள சமூகத்துடன் ஒருங்கிணைத்தல்
  • விரைவான உள்கட்டமைப்பு அபிவிருத்தி
  • முந்தைய மோதலால் பாதிக்கப்பட்ட பகுதிகளில் வாக்குரிமையை மீள நிறுவுதல், மற்றும்
  • பொறுப்புக்கூறல், சட்டத்தின் ஆட்சி மற்றும் மனித உரிமைகள் தொடர்பான பிரச்சினைகளுக்கு தீர்வு காண்பதற்காக உள்நாட்டு வழிமுறைகளை நிறுவுதல்

இலங்கை மக்கள் அனைவரையும் கருதிய வகையிலான இந்த அனைத்தையும் உள்ளடக்கிய மற்றும் உள்நாட்டில் வடிவமைக்கப்பட்ட அளவீடுகள் இருந்தபோதிலும், பயங்கரவாதத்தை தோற்கடிப்பதிலும், சீரான நல்லிணக்க செயன்முறை மூலம் ஸ்திரத்தன்மை, மனிதாபிமான நிவாரணம் மற்றும் நீடித்த அமைதியைக் கொண்டுவருவதற்குமான இலங்கை அரசாங்கத்தின் முயற்சிகளை அங்கீகரிக்கத் தவறிய ஐ.நா. மனித உரிமைகள் பேரவையின் உறுப்பினர்களின் குழுவொன்று, 2012, 2013 மற்றும் 2014 ஆம் ஆண்டுகளில் இலங்கை மீதான தொடர்ச்சியான நாடு சார்ந்த தீர்மானங்களை ஐ.நா. மனித உரிமைகள் பேரவையில் அமுல்படுத்தியது.

முந்தைய அரசாங்கமானது, 2015 ஜனவரியில், நல்ல பலன்களையளித்த இந்த உள்நாட்டு நல்லிணக்க செயன்முறையின் பாரத்தைக் குறைத்தது. மனித உரிமைகள் பேரவையின் வரலாற்றில் முன்னெப்போதும் இல்லாதவாறும் நாட்டின் குறிப்பிட்ட தீர்மானங்கள் குறித்த இலங்கையின் நிலைப்பாட்டிற்கு மாறாகவும், இந்த அரசாங்கம் ஐக்கிய நாடுகள் மனித உரிமைகள் கழகத்தின் தீர்மானம் 30/1 இற்கு இணை அனுசரணையை வழங்கியது.

பிரத்தியேகமாக, முன்னைய அரசாங்கமானது; 30/1 தீர்மானத்திற்கு மட்டுமன்றி, அண்மைக்காலங்களில் பயங்கரவாதத்தைத் தோற்கடித்த ஒரே தேசிய பாதுகாப்பு அமைப்பான இலங்கை பாதுகாப்பு படையினரின் வீரத்தை நியாயமில்லாமல் அவதூறுக்குள்ளாக்குவதற்கும் அடிப்படையான ஐக்கிய நாடுகள் மனித உரிமைகள் கழகத்தின் இலங்கை பற்றியதிலான மிகவும் குறைபாடுள்ள புலன்விசாரணை அறிக்கையை ‘பாராட்டுதலுடன் குறிப்பிட்டது’. இதற்கு மாறாக, பின்வருவனவற்றில் ஏராளமான ஆதாரங்கள் இருந்தன.

அரசியலமைப்பு ரீதியாக இத்தீர்மானமானது, இலங்கையின் அரசியலமைப்பு கட்டமைப்பிற்குள் நிறைவேற்ற முடியாத கடமைகளைச் சுமத்த முற்படுவதுடன், இலங்கை மக்களின் இறையாண்மையையும் அரசியலமைப்பின் அடிப்படைக் கட்டமைப்பையும் மீறுகிறது. இணை அனுசரணை தொடர்பில் தனது நிலையை மறுபரிசீலனை செய்ய இலங்கையைத் தூண்டிய இன்னொரு காரணி இதுவாகும்.

நடைமுறையின்படி, முன்னைய அரசாங்கமானது, 30/1 தீர்மானத்திற்கு இணை அனுசரணை வழங்கியதன் மூலம் அனைத்து ஜனநாயகக் கொள்கைகளையும் மீறியது.

  • வரைவு உரை வழங்கப்படுவதற்கு முன்பே, தீர்மானத்திற்கான ஆதரவை அது அறிவித்தது.
  • சர்வதேச அமைப்பொன்றின் ஆணைகளை நிறைவேற்றுவதற்காக நாட்டை பிணைப்பதற்கு எந்தவித அமைச்சரவை அங்கீகாரத்தையும் அது கோரவில்லை.
  • அத்தகைய இணை அனுசரணையின் செயன்முறை, நடவடிக்கைகள் மற்றும் விளைவுகள் குறித்து பாராளுமன்றத்தில் எந்தக் குறிப்புகளும் இல்லை.
  • மிக முக்கியமாக, நாட்டின் உயர் சட்டமான அரசியலமைப்பை மீறும் வகையில் காணப்படும் தீர்மானத்தின் உள்ளார்ந்த சட்டத்திற்கு முரணான தன்மை காரணமாக, அதில் வழங்க முடியாத விதிமுறைகள் அடங்கியுள்ளன.
  • மேலும், இது தொழில்முறை இராஜதந்திரிகள், கல்வியியலாளர்கள், ஊடகங்கள் மற்றும் பொது மக்களால் வெளிப்படுத்தப்பட்ட கருத்துக்களை மீறியது.
  • அந்த நேரத்தில் இந்த விடயம் குறித்து தன்னுடன் ஆலோசிக்கப்படவில்லை என அப்போதைய ஜனாதிபதி மைத்திரிபால சிறிசேனவும் குறிப்பிட்டுள்ளார்.
  • இது இலங்கையின் இறையாண்மை மற்றும் கௌரவத்திற்கு ஒரு களங்கமாக உள்ளது.

ஒரு சில நாடுகளை மகிழ்விப்பதற்காக பல முயற்சிகளை மேற்கொள்ள முடியாது என்பதற்கான வலுவான எதிர்ப்பும் ஆதாரங்களும் இருந்தபோதிலும், இப்பரிசோதனையை மேற்கொள்வதற்காக இந்த நாட்டைக் கட்டுப்படுத்திய கடமைகள் நடைமுறைக்கு மாறானவை, அரசியலமைப்பிற்கு அப்பாற்பட்டவை மற்றும் நம்பமுடியாதவை.

பாதிக்கப்பட்ட எமது கௌரவத்தைப் பொறுத்தவரையில், இது சர்வதேச அமைப்பின் மீதான இலங்கையர்களின் நம்பிக்கையையும், சர்வதேச சமூகத்தின் பார்வையில் இலங்கையின் ஒட்டுமொத்த நம்பகத்தன்மை யையும் படிப்படியாக அழித்துவிட்டது. பொறுப்பற்ற இந்த நடவடிக்கையானது நீண்டகாலமாக வளர்க்கப்பட்ட பிராந்திய உறவுகள் மற்றும் அணிசேரா மற்றும் தெற்காசிய ஒற்றுமையையும் சேதப்படுத்தியது. இலங்கையின் வெளியுறவுக் கொள்கையானது ஒரு ‘ஆதாயம் அல்லது இழப்பு என்ற விளையாட்டாக’ குறைக்கப்பட்டு, எனது நாட்டை உலக அரசியல் சதுரங்கத்தில் ஒரு ‘பகடைக்காய்’ ஆக்கியதுடன், தேவையில்லாமல் இலங்கையை அதன் பாரம்பரியமான நடுநிலைமையிலிருந்து அப்புறப்படுத்தியது.

மிக முக்கியமாக, 30/1 இற்கிணங்க நாட்டில் கட்டளையிடப்பட்ட மாற்றங்கள், தேசிய நலனைக் குறைத்து மதிப்பிட்டதுடன், தேவாலயங்கள் மற்றும் ஹோட்டல்களை இலக்காகக் கொண்ட ஈஸ்டர் ஞாயிறு தாக்குதல்கள் தேசிய உளவுத்துறை நடவடிக்கைகள் பலவீனமடைந்து, அது தொடர்பான பாதுகாப்புகள் உள்ளிட்ட தேசிய பாதுகாப்பு சமரசம் செய்யப்பட்டதன் விளைவாக ஏற்பட்ட குறைபாடுகளுக்குப் பங்களித்ததாகக் கருதப்படுகின்றன. இதன் விளைவாக வெளிநாட்டுப் பிரஜைகள் உட்பட உயிர் இழப்புகள் ஏற்பட்டதுடன், தேசிய பாதுகாப்பை மீட்டெடுப்பதில் அரசாங்கம் சவால்களை எதிர்கொள்கிறது.

2015 அக்டோபரில் 30/1 தீர்மானத்திற்கு இணை அனுசரணை வழங்கிய முந்தைய அரசாங்கமானது, எனக்கு முந்தைய அமைச்சர் இந்த கழகத்தில் அளித்த அறிக்கையின் மூலம் அதன் கட்டளைகளை அகற்றும் செயன்முறையைத் தொடங்கியது முரண்பாடாகவுள்ளது. இதே அறிக்கை, 4 ஆண்டுகளுக்கு முன்னர் இந்த தீர்மானத்திற்கு இணை அனுசரணை செய்யும்போதிருந்த உண்மையான தடைகளை ஏற்றுக்கொண்டது. அந்த அறிக்கை இத்தீர்மானத்தின் இணை அனுசரணையின் சார்விதிகளைத் தகுதியானதாக்க முயன்றது.

  • இது 30/1 தீர்மானம் பிரச்சனையின் தன்மையின் பண்புருக்களையும் மதிப்பிடப்பட்ட இறப்புகளின் எண்ணிக்கையையும் கேள்விக்குள்ளாக்கியது,
  • பாதுகாப்புப் படையினரின் குற்றச்சாட்டுக்களைப் புறந்தள்ளியது,
  • கோரப்பட்ட பாதுகாப்புத் துறை சீர்திருத்தத்தின் விளைவைக் குறைத்தது,
  • முன்வைக்கப்பட்ட நீதித்துறை பொறிமுறையில் வெளிநாட்டு நீதிபதிகள் மற்றும் வழக்குரைஞர்களின் ஈடுபாட்டை இலங்கை அரசியலமைப்பு தடுக்கிறது என வலியுறுத்தியது.
  • இதை ஒப்புக்கொண்டபோதிலும், முந்தைய அரசாங்கம், 30/1 தீர்மானத்தைச் செயற்படுத்துவதற்கு முழுமையான ஆதரவளிக்கும் அதன் இணை அனுசரணையைத் தொடர்ந்தது.

தேர்தலில் ஜனாதிபதி கோட்டாபய ராஜபக்ஷ பெரும்பான்மையுடன் தேர்ந்தெடுக்கப்பட்டதன் மூலம், இலங்கை மக்கள் நாடு முன்னோக்கிச் செல்வதற்கான வேறு பாதை வேண்டும் என்ற விருப்பத்திற்கு தெளிவான சமிக்ஞையை வழங்கியுள்ளனர். இலங்கையின் 72 ஆவது சுதந்திர தினத்தில் ஜனாதிபதி தனது உரையில் கூறியது போல், “ஒவ்வொரு இலங்கை குடிமகனும் தனது தேர்ந்தெடுக்கப்பட்ட பிரதிநிதிகள் மூலம் அரசியல் மற்றும் நிர்வாக செயல்முறைகளில் பங்கேற்கும் உரிமையை நாங்கள் எப்போதும் பாதுகாப்போம்”.

இலங்கை மக்களின் விருப்பத்திற்கேற்ப எமது அரசாங்கமானது; அணிசேரா, நடுநிலை வெளியுறவுக் கொள்கையைப் பின்பற்றும் அதேநேரம், பிரச்சனைகளைப் புதிதாக ஆராய்வதற்கும், ‘பாதுகாப்பு மற்றும் மேம்பாட்டின் மூலம் செழிப்பு’ என்ற அதன் நிகழ்ச்சி நிரலை முன்னெடுப்பதற்கும், சகல இலங்கையர்களின் நலனுக்காக சமகால சவால்களைச் சமாளிப்பதற்கான தீர்வுகளை உள்நாட்டிலேயே காண்பதற்கும் தன்னை அர்ப்பணித்துள்ளது.

இக்கருத்தின் அடிப்படையில்;  ‘இலங்கையில் நல்லிணக்கம், பொறுப்புக்கூறல் மற்றும் மனித உரிமைகளை ஊக்குவித்தல்’ என்ற தலைப்பில், அக்டோபர் 2015/30/1 மற்றும் மார்ச் 2017 இன் 34/1 ஆகிய முந்தைய தீர்மானங்களையும் இணைத்து உருவாக்கப்பட்ட 40/1 தீர்மானத்தின் இணை அனுசரணையிலிருந்து விலகுவதற்கான இலங்கையின் முடிவைப் பதிவு செய்ய விரும்புகிறேன்.

இந்தத் தீர்மானத்தின் இணை அனுசரணையிலிருந்து விலகியபோதும் நிலையான அமைதி மற்றும் நல்லிணக்கத்தை நோக்கி இலங்கை மக்கள் பொறுப்புக்கூறல் மற்றும் மனித உரிமைகள் குறித்து நிர்ணயித்த இலக்குகளை அடைவதில் இலங்கை உறுதிகொண்டுள்ளது. இந்த முடிவுக்கு;

முதலாவதாக, அரசாங்கத்தின் கொள்கைக் கட்டமைப்பிற்கமைவாக, தற்போதுள்ள பொறிமுறைகளை பொருத்தமான முறையில் பின்பற்றுதல் உட்பட, உள்ளடக்கப்பட்டதும், உள்நாட்டில் வடிவமைக்கப்பட்டுச் செயற்படுத்தப்பட்டதுமான நல்லிணக்கம் மற்றும் பொறுப்புக்கூறல் செயன்முறை மூலம் நிலையான அமைதியை அடைவதற்கான தனது உறுதிப்பாட்டை இலங்கை அரசாங்கம் வெளிப்படுத்துகிறது. இது; மனித உரிமைகள் மற்றும் சர்வதேச மனித நேயச் சட்ட மீறல்களைப் புலன் விசாரணை செய்த முந்தைய விசாரணை ஆணைக்குழுக்களின் அறிக்கைகளை மீளாய்வு செய்யவும் அவர்களின் பரிந்துரைகளை அமல்படுத்துவதற்கான நிலையை மதிப்பிடுவதற்கும், புதிய அரசாங்கத்தின் கொள்கைக்கு இணங்க அவற்றை செயல்படுத்துவதற்கான நடவடிக்கைகளை முன்மொழியவும்   உச்சநீதிமன்ற நீதிபதி தலைமையிலான விசாரணை ஆணைக்குழுவை நியமிப்பதை உள்ளடக்கியது.

இரண்டாவதாக, 2030 நிலையான அபிவிருத்தி நிகழ்ச்சி நிரல் உட்பட்ட இலங்கையின் கடமைகளுக்கு இணங்க, நிலுவையில் உள்ள பிற அக்கறைகளையும் தேவையான இடங்களில் நிறுவன சீர்திருத்தங்களையும் அறிமுகப்படுத்தும். சட்டத்தின் கீழ் தனிநபர் மற்றும் கூட்டு உரிமைகள் மற்றும் பாதுகாப்புகளை முன்னெடுப்பதன் மூலமும், நீதி மற்றும் நல்லிணக்கத்தை உறுதி செய்வதன் மூலமும், சமூகத்தின் பாதிக்கப்படக் கூடிய பிரிவுகளைச் சேர்ந்தோரின் கவலைகளை நிவர்த்தி செய்வதன் மூலமும் அரசாங்கத்தின் உறுதிப்பாட்டில் வேரூன்றிய கொள்கைகளை நாங்கள் செயற்படுத்துவோம். அரசாங்கத்தின் கொள்கைகளை வகுத்தல் மற்றும் செயன்முறைப்படுத்துவதில் சுற்றுச்சூழல் பாதுகாப்பு குறித்து சிறப்புக் கவனம் செலுத்தப்படும். இலங்கையின் 8 வது நாடாளுமன்றத்தின் நான்காவது அமர்வின் தொடக்க விழாவில் தனது கொள்கை அறிக்கையில், “ஐக்கிய நாடுகள் சபையின் நிலையான அபிவிருத்தி இலக்குகளை அடைவதில் இலங்கையை உலகின் முன்னணி நாடுகளில் ஒன்றாக மாற்றுவதற்கான தனது பார்வையை ஜனாதிபதி மீண்டும் வலியுறுத்தினார். ஜனாதிபதிக்கும் ஐக்கிய நாடுகள் வதிவிட ஒருங்கிணைப்பாளருக்கும் இடையில் ஏற்கனவே ஒரு கலந்துரையாடல் இடம்பெற்றபோது, அங்கு நிலையான அபிவிருத்தி நிகழ்ச்சி நிரல்களைச் செயற்படுத்துவதில் இலங்கை அரசுக்கு உதவ தொடர்புடைய ஐ.நா. முகவராண்மைகளை இணைப்பதற்கு ஒப்புக்கொள்ளப்பட்டது.

மூன்றாவதாக, வழக்கமான மனித உரிமை ஆணைகள் / அமைப்புக்கள் மற்றும் பொறிமுறைகள் உட்பட ஐ.நா. மற்றும் அதன் நிறுவனங்களுடன் இலங்கை தொடர்ந்தும் பணியாற்றி, உள்நாட்டு முக்கியத்துவமிக்க விடயங்கள் மற்றும் கொள்கைகளுக்கு அமைய திறன் அபிவிருத்தி மற்றும் தொழினுட்ப உதவியை தேவைக்கேற்ப எதிர்பார்க்கும்.

இறுதியாக, ஐ.நா. வின் அனைத்து உறுப்பினர்களுடனும் இணைந்து, தீர்மானத்தை முடிவுறுத்துவதற்காக பணியாற்றுவதற்கு இலங்கை எதிர்பார்க்கின்றது.

கௌரவ தலைவர் அவர்களே!இலங்கையின் பல இன, பல மொழி, பல மத மற்றும் பல கலாச்சார மக்களின் நல்வாழ்வானது, இலங்கை அரசாங்கத்தை விட வேறு யாருக்கும் இல்லை. இந்த உந்துதல்களே எமது உறுதிப்பாட்டை வழிநடத்துவதுடன், விரிவான நல்லிணக்கம் மற்றும் எமது மக்களுக்கான நிலையான அமைதி மற்றும் செழிப்பு மிகுந்த சகாப்தத்தை நோக்கி செல்வதற்கு தீர்மானிக்கின்றது. ஆகவே, இலங்கையின் உள்நாட்டு முன்னுரிமைகள் மற்றும் கொள்கைகளின் கட்டமைப்பிற்குள் மேற்கூறிய நடவடிக்கைகள் யதார்த்தமானவையாக மட்டுமன்றி, வழங்கக் கூடியவையாகவும் இருக்கின்றன என்பது எமது வலுவான நம்பிக்கையாகும்.இந்த முயற்சியில் இலங்கையுடன் ஒத்துழைப்பதற்காக இந்த அமைப்பிற்கு உள்ளேயும் வெளியேயும் உள்ள அனைத்து பங்குதாரர்களுக்கும் நாம் அழைப்பு விடுக்கின்றோம்.புத்த பகவானின் வார்த்தைகளை மேற்கோள் காட்டி இந்த உரையை நிறைவு செய்கின்றேன்,‘சியலு சத்வயோ நிதுக் வெத்வா, நிரோகீ வெத்வா, சுவபத் வெத்வா’எல்லா உயிர்களும் பாதுகாப்பாக இருக்கட்டும்,எல்லா உயிர்களும் துன்பத்திலிருந்து விடுபடட்டும்,எல்லா உயிர்களும் நன்றாகவும் மகிழ்ச்சியாகவும் இருக்கட்டும்.நன்றி.

இந்த சபை அறிந்திருக்கும் வகையில், 2019 நவம்பர் மாதத்தில், ‘திறன்மிக்க குடிமக்கள், திருப்திகரமான குடும்பம், ஒழுக்கமானதும் நியாயமானதுமான சமூகம் மற்றும் வளமான நாடொன்றின் நான்மடங்கு விளைவை’ அடைவதை நோக்காகக் கொண்ட கொள்கைக் கட்டமைப்பை அடைந்து கொள்வதற்கானதொரு மகத்தான ஆணையை ஜனாதிபதி கோட்டாபய ராஜபக்ஷவுக்கு இலங்கை மக்கள் வழங்கினர்[1]. ‘எமது மக்களுக்கு கிடைக்கக்கூடிய ஜனநாயக எல்லையை சமரசம் செய்யாமல் தேசியப் பாதுகாப்பை’ பாதுகாப்பதில் உறுதியாக நங்கூரமிட்டுள்ள வகையில் நாட்டில் நிலையான வளர்ச்சி மற்றும் அமைதியை உறுதி செய்வதற்காக இது திட்டமிடப்பட்டுள்ளது[2].

ஒரு தசாப்தத்திற்கு முன்னர், 18 மே 2009 அன்று, எல்.ரீ.ரீ.ஈ. பயங்கரவாதத்தை இலங்கை, இராணுவ ரீதியாக தோற்கடித்து, மூன்று தசாப்த கால மோதல்களையும் துன்பங்களையும் முடிவுக்குக் கொண்டுவந்தது. மிருகத்தனமான மோதலின் நிறைவானது, அடிப்படை மனித உரிமைகளில் ஒன்றான, சிங்களவர்கள், தமிழர்கள், முஸ்லிம்கள் மற்றும் ஏனைய அனைத்து இலங்கையர்களினதும் ‘உயிர் வாழ்வதற்கான உரிமையை’ மேம்படுத்தி, பாதுகாத்தது. இலங்கையில் பிரிவினைவாத பயங்கரவாதத்தின் பெயரில் 2009 மே மாதம் முதல் ஒரு துப்பாக்கி வேட்டேனும் சுடப்படவில்லை என்பதை நான் பெருமையுடன் கூற விரும்புகின்றேன்.

எல்.ரீ.ரீ.ஈ. பயங்கரவாதிகளுக்கு எதிரான மோதலின் நிறைவானது ஒரே இரவில் நீடித்த அமைதியை தோற்றுவிக்கும் என்ற மாயை இலங்கைக்கு ஒருபோதும் இருந்ததில்லை. இந்த சபை கையாளும் பல மோதல் சூழ்நிலைகளைப் போலவே, இலங்கையும் தேசத்தைக் கட்டியெழுப்புவதற்கானதொரு விடயப்பொருள் அல்ல என்றாலும், நிலையான அமைதி மற்றும் நல்லிணக்கத் திட்டத்தின் ஒரு பகுதியாக, சில மதிப்புரைகள் மற்றும் இருக்கும் கட்டமைப்புகளை வலுப்படுத்துவதற்கான தேவை இலங்கைக்கு உள்ளது என்பதை நாங்கள் கவனத்தில் கொண்டிருந்தோம்.

தற்போதைய ஜனாதிபதி கோட்டாபய ராஜபக்ஷ பாதுகாப்பு அமைச்சின் செயலாளராக இருந்த, அப்போதைய ஜனாதிபதி மஹிந்த ராஜபக்ஷ அவர்களின் தலைமையிலான அரசாங்கம், அந்த நேரத்தில் காணப்பட்ட உண்மைகளை அறிந்து, இலங்கையில் ‘குணப்படுத்துதல் மற்றும் சமாதானத்தைக் கட்டியெழுப்புதலைக்’ கொண்டுவருவதற்காக நிலையானதொரு நல்லிணக்கச் செயற்பாட்டை ஆரம்பித்தது. மிகவும் சிறந்த வளமுள்ள நாடுகள் நிவர்த்தி செய்து, சாதிப்பதற்கு பல தசாப்தங்களை எடுத்துள்ளமையினால், இது மேம்பட்ட மற்றும் உள்ளடக்கமிகு செயன்முறையொன்றாகக் கருதப்பட்டது.

டிசம்பர் 2014 நிலவரப்படி, நான் உறுப்பினராக இருந்த மஹிந்த ராஜபக்ஷ அரசாங்கம் தனது பதவிக்காலத்தை நிறைவு செய்த போது, பின்வருவனவற்றில் நாங்கள் கணிசமான முன்னேற்றத்தைக் கண்டிருந்தோம்;.

  • பாதுகாப்புப் படையினர் பயன்படுத்திய நிலத்தை விடுவித்தல்
  • முந்தைய மோதல் இடம்பெற்ற பகுதிகளில் இராணுவ இருப்பைக் குறைத்தல்
  • சிறுவர் போராளிகள் உட்பட முன்னாள் எல்.ரீ.ரீ.ஈ. போராளிகளுக்கு புனர்வாழ்வளித்து, மீள சமூகத்துடன் ஒருங்கிணைத்தல்
  • விரைவான உள்கட்டமைப்பு அபிவிருத்தி
  • முந்தைய மோதலால் பாதிக்கப்பட்ட பகுதிகளில் வாக்குரிமையை மீள நிறுவுதல், மற்றும்
  • பொறுப்புக்கூறல், சட்டத்தின் ஆட்சி மற்றும் மனித உரிமைகள் தொடர்பான பிரச்சினைகளுக்கு தீர்வு காண்பதற்காக உள்நாட்டு வழிமுறைகளை நிறுவுதல்

இலங்கை மக்கள் அனைவரையும் கருதிய வகையிலான இந்த அனைத்தையும் உள்ளடக்கிய மற்றும் உள்நாட்டில் வடிவமைக்கப்பட்ட அளவீடுகள் இருந்தபோதிலும், பயங்கரவாதத்தை தோற்கடிப்பதிலும், சீரான நல்லிணக்க செயன்முறை மூலம் ஸ்திரத்தன்மை, மனிதாபிமான நிவாரணம் மற்றும் நீடித்த அமைதியைக் கொண்டுவருவதற்குமான இலங்கை அரசாங்கத்தின் முயற்சிகளை அங்கீகரிக்கத் தவறிய ஐ.நா. மனித உரிமைகள் பேரவையின் உறுப்பினர்களின் குழுவொன்று, 2012, 2013 மற்றும் 2014 ஆம் ஆண்டுகளில் இலங்கை மீதான தொடர்ச்சியான நாடு சார்ந்த தீர்மானங்களை ஐ.நா. மனித உரிமைகள் பேரவையில் அமுல்படுத்தியது.

கௌரவ தலைவர் அவர்களே!

முந்தைய அரசாங்கமானது, 2015 ஜனவரியில், நல்ல பலன்களையளித்த இந்த உள்நாட்டு நல்லிணக்க செயன்முறையின் பாரத்தைக் குறைத்தது. மனித உரிமைகள் பேரவையின் வரலாற்றில் முன்னெப்போதும் இல்லாதவாறும் நாட்டின் குறிப்பிட்ட தீர்மானங்கள் குறித்த இலங்கையின் நிலைப்பாட்டிற்கு மாறாகவும், இந்த அரசாங்கம் ஐக்கிய நாடுகள் மனித உரிமைகள் கழகத்தின் தீர்மானம் 30/1 இற்கு இணை அனுசரணையை வழங்கியது.

பிரத்தியேகமாக, முன்னைய அரசாங்கமானது; 30/1 தீர்மானத்திற்கு மட்டுமன்றி, அண்மைக்காலங்களில் பயங்கரவாதத்தைத் தோற்கடித்த ஒரே தேசிய பாதுகாப்பு அமைப்பான இலங்கை பாதுகாப்பு படையினரின் வீரத்தை நியாயமில்லாமல் அவதூறுக்குள்ளாக்குவதற்கும் அடிப்படையான ஐக்கிய நாடுகள் மனித உரிமைகள் கழகத்தின் இலங்கை பற்றியதிலான மிகவும் குறைபாடுள்ள புலன்விசாரணை அறிக்கையை ‘பாராட்டுதலுடன் குறிப்பிட்டது’. இதற்கு மாறாக, பின்வருவனவற்றில் ஏராளமான ஆதாரங்கள் இருந்தன.

  • கற்றறிந்த பாடங்கள் மற்றும் நல்லிணக்க ஆணைக்குழு மற்றும் ‘பரணகம ஆணைக்குழு’ போன்ற உள்நாட்டு அறிக்கைகள்,
  • நேஸ்பி பிரபுவால் ஐக்கிய இராச்சியத்தின் பிரபுக்கள் சபையில் சமர்ப்பிக்கப்பட்ட, ஏனைய விடயங்களுக்கு மத்தியில், மிகைப்படுத்தப்பட்ட பொதுமக்கள் இடர் புள்ளிவிவரங்களை சவாலுக்குட்படுத்தும் தகவல்,[3]
  • ஐக்கிய நாடுகள் மற்றும் சர்வதேச செஞ்சிலுவைச் சங்கம் உள்ளிட்ட சர்வதேச நிறுவனங்களின் ஏனைய அறிக்கைகள்,
  • மற்றும் வெளிப்படுத்தப்பட்ட பிற இராஜதந்திர தந்திகள்.

அரசியலமைப்பு ரீதியாக இத்தீர்மானமானது, இலங்கையின் அரசியலமைப்பு கட்டமைப்பிற்குள் நிறைவேற்ற முடியாத கடமைகளைச் சுமத்த முற்படுவதுடன், இலங்கை மக்களின் இறையாண்மையையும் அரசியலமைப்பின் அடிப்படைக் கட்டமைப்பையும் மீறுகிறது. இணை அனுசரணை தொடர்பில் தனது நிலையை மறுபரிசீலனை செய்ய இலங்கையைத் தூண்டிய இன்னொரு காரணி இதுவாகும்.

நடைமுறையின்படி, முன்னைய அரசாங்கமானது, 30/1 தீர்மானத்திற்கு இணை அனுசரணை வழங்கியதன் மூலம் அனைத்து ஜனநாயகக் கொள்கைகளையும் மீறியது.

  • வரைவு உரை வழங்கப்படுவதற்கு முன்பே, தீர்மானத்திற்கான ஆதரவை அது அறிவித்தது.
  • சர்வதேச அமைப்பொன்றின் ஆணைகளை நிறைவேற்றுவதற்காக நாட்டை பிணைப்பதற்கு எந்தவித அமைச்சரவை அங்கீகாரத்தையும் அது கோரவில்லை.
  • அத்தகைய இணை அனுசரணையின் செயன்முறை, நடவடிக்கைகள் மற்றும் விளைவுகள் குறித்து பாராளுமன்றத்தில் எந்தக் குறிப்புகளும் இல்லை.
  • மிக முக்கியமாக, நாட்டின் உயர் சட்டமான அரசியலமைப்பை மீறும் வகையில் காணப்படும் தீர்மானத்தின் உள்ளார்ந்த சட்டத்திற்கு முரணான தன்மை காரணமாக, அதில் வழங்க முடியாத விதிமுறைகள் அடங்கியுள்ளன.
  • மேலும், இது தொழில்முறை இராஜதந்திரிகள், கல்வியியலாளர்கள், ஊடகங்கள் மற்றும் பொது மக்களால் வெளிப்படுத்தப்பட்ட கருத்துக்களை மீறியது.
  • அந்த நேரத்தில் இந்த விடயம் குறித்து தன்னுடன் ஆலோசிக்கப்படவில்லை என அப்போதைய ஜனாதிபதி மைத்திரிபால சிறிசேனவும் குறிப்பிட்டுள்ளார்.
  • இது இலங்கையின் இறையாண்மை மற்றும் கௌரவத்திற்கு ஒரு களங்கமாக உள்ளது.

ஒரு சில நாடுகளை மகிழ்விப்பதற்காக பல முயற்சிகளை மேற்கொள்ள முடியாது என்பதற்கான வலுவான எதிர்ப்பும் ஆதாரங்களும் இருந்தபோதிலும், இப்பரிசோதனையை மேற்கொள்வதற்காக இந்த நாட்டைக் கட்டுப்படுத்திய கடமைகள் நடைமுறைக்கு மாறானவை, அரசியலமைப்பிற்கு அப்பாற்பட்டவை மற்றும் நம்பமுடியாதவை.

பாதிக்கப்பட்ட எமது கௌரவத்தைப் பொறுத்தவரையில், இது சர்வதேச அமைப்பின் மீதான இலங்கையர்களின் நம்பிக்கையையும், சர்வதேச சமூகத்தின் பார்வையில் இலங்கையின் ஒட்டுமொத்த நம்பகத் தன்மையையும் படிப்படியாக அழித்துவிட்டது. பொறுப்பற்ற இந்த நடவடிக்கையானது நீண்டகாலமாக வளர்க்கப்பட்ட பிராந்திய உறவுகள் மற்றும் அணிசேரா மற்றும் தெற்காசிய ஒற்றுமையையும் சேதப்படுத்தியது. இலங்கையின் வெளியுறவுக் கொள்கையானது ஒரு ‘ஆதாயம் அல்லது இழப்பு என்ற விளையாட்டாக’ குறைக்கப்பட்டு, எனது நாட்டை உலக அரசியல் சதுரங்கத்தில் ஒரு ‘பகடைக்காய்’ ஆக்கியதுடன், தேவையில்லாமல் இலங்கையை அதன் பாரம்பரியமான நடுநிலைமையிலிருந்து அப்புறப்படுத்தியது.

மிக முக்கியமாக, 30/1 இற்கிணங்க நாட்டில் கட்டளையிடப்பட்ட மாற்றங்கள், தேசிய நலனைக் குறைத்து மதிப்பிட்டதுடன், தேவாலயங்கள் மற்றும் ஹோட்டல்களை இலக்காகக் கொண்ட ஈஸ்டர் ஞாயிறு தாக்குதல்கள் தேசிய உளவுத்துறை நடவடிக்கைகள் பலவீனமடைந்து, அது தொடர்பான பாதுகாப்புகள் உள்ளிட்ட தேசிய பாதுகாப்பு சமரசம் செய்யப்பட்டதன் விளைவாக ஏற்பட்ட குறைபாடுகளுக்குப் பங்களித்ததாகக் கருதப்படுகின்றன. இதன் விளைவாக வெளிநாட்டுப் பிரஜைகள் உட்பட உயிர் இழப்புகள் ஏற்பட்டதுடன், தேசிய பாதுகாப்பை மீட்டெடுப்பதில் அரசாங்கம் சவால்களை எதிர்கொள்கிறது.

2015 அக்டோபரில் 30/1 தீர்மானத்திற்கு இணை அனுசரணை வழங்கிய முந்தைய அரசாங்கமானது, எனக்கு முந்தைய அமைச்சர் இந்த கழகத்தில் அளித்த அறிக்கையின் மூலம் அதன் கட்டளைகளை அகற்றும் செயன்முறையைத் தொடங்கியது முரண்பாடாகவுள்ளது. இதே அறிக்கை, 4 ஆண்டுகளுக்கு முன்னர் இந்த தீர்மானத்திற்கு இணை அனுசரணை செய்யும்போதிருந்த உண்மையான தடைகளை ஏற்றுக்கொண்டது. அந்த அறிக்கை இத்தீர்மானத்தின் இணை அனுசரணையின் சார்விதிகளைத் தகுதியானதாக்க முயன்றது.

  • இது 30/1 தீர்மானம் பிரச்சனையின் தன்மையின் பண்புருக்களையும் மதிப்பிடப்பட்ட இறப்புகளின் எண்ணிக்கையையும் கேள்விக்குள்ளாக்கியது,
  • பாதுகாப்புப் படையினரின் குற்றச்சாட்டுக்களைப் புறந்தள்ளியது,
  • கோரப்பட்ட பாதுகாப்புத் துறை சீர்திருத்தத்தின் விளைவைக் குறைத்தது,
  • முன்வைக்கப்பட்ட நீதித்துறை பொறிமுறையில் வெளிநாட்டு நீதிபதிகள் மற்றும் வழக்குரைஞர்களின் ஈடுபாட்டை இலங்கை அரசியலமைப்பு தடுக்கிறது என வலியுறுத்தியது.
  • இதை ஒப்புக்கொண்டபோதிலும், முந்தைய அரசாங்கம், 30/1 தீர்மானத்தைச் செயற்படுத்துவதற்கு முழுமையான ஆதரவளிக்கும் அதன் இணை அனுசரணையைத் தொடர்ந்தது.

தேர்தலில் ஜனாதிபதி கோட்டாபய ராஜபக்ஷ பெரும்பான்மையுடன் தேர்ந்தெடுக்கப்பட்டதன் மூலம், இலங்கை மக்கள் நாடு முன்னோக்கிச் செல்வதற்கான வேறு பாதை வேண்டும் என்ற விருப்பத்திற்கு தெளிவான சமிக்ஞையை வழங்கியுள்ளனர். இலங்கையின் 72 ஆவது சுதந்திர தினத்தில் ஜனாதிபதி தனது உரையில் கூறியது போல், “ஒவ்வொரு இலங்கை குடிமகனும் தனது தேர்ந்தெடுக்கப்பட்ட பிரதிநிதிகள் மூலம் அரசியல் மற்றும் நிர்வாக செயல்முறைகளில் பங்கேற்கும் உரிமையை நாங்கள் எப்போதும் பாதுகாப்போம்”.

இலங்கை மக்களின் விருப்பத்திற்கேற்ப எமது அரசாங்கமானது; அணிசேரா, நடுநிலை வெளியுறவுக் கொள்கையைப் பின்பற்றும் அதேநேரம், பிரச்சனைகளைப் புதிதாக ஆராய்வதற்கும், ‘பாதுகாப்பு மற்றும் மேம்பாட்டின் மூலம் செழிப்பு’ என்ற அதன் நிகழ்ச்சி நிரலை முன்னெடுப்பதற்கும், சகல இலங்கையர்களின் நலனுக்காக சமகால சவால்களைச் சமாளிப்பதற்கான தீர்வுகளை உள்நாட்டிலேயே காண்பதற்கும் தன்னை அர்ப்பணித்துள்ளது.

இக்கருத்தின் அடிப்படையில்;  ‘இலங்கையில் நல்லிணக்கம், பொறுப்புக்கூறல் மற்றும் மனித உரிமைகளை ஊக்குவித்தல்’ என்ற தலைப்பில், அக்டோபர் 2015/30/1 மற்றும் மார்ச் 2017 இன் 34/1 ஆகிய முந்தைய தீர்மானங்களையும் இணைத்து உருவாக்கப்பட்ட 40/1 தீர்மானத்தின் இணை அனுசரணையிலிருந்து விலகுவதற்கான இலங்கையின் முடிவைப் பதிவு செய்ய விரும்புகிறேன்.

இந்தத் தீர்மானத்தின் இணை அனுசரணையிலிருந்து விலகியபோதும் நிலையான அமைதி மற்றும் நல்லிணக்கத்தை நோக்கி இலங்கை மக்கள் பொறுப்புக்கூறல் மற்றும் மனித உரிமைகள் குறித்து நிர்ணயித்த இலக்குகளை அடைவதில் இலங்கை உறுதிகொண்டுள்ளது. இந்த முடிவுக்கு;

முதலாவதாக, அரசாங்கத்தின் கொள்கைக் கட்டமைப்பிற்கமைவாக, தற்போதுள்ள பொறிமுறைகளை பொருத்தமான முறையில் பின்பற்றுதல் உட்பட, உள்ளடக்கப்பட்டதும், உள்நாட்டில் வடிவமைக்கப்பட்டுச் செயற்படுத்தப்பட்டதுமான நல்லிணக்கம் மற்றும் பொறுப்புக்கூறல் செயன்முறை மூலம் நிலையான அமைதியை அடைவதற்கான தனது உறுதிப்பாட்டை இலங்கை அரசாங்கம் வெளிப்படுத்துகிறது. இது; மனித உரிமைகள் மற்றும் சர்வதேச மனித நேயச் சட்ட மீறல்களைப் புலன் விசாரணை செய்த முந்தைய விசாரணை ஆணைக்குழுக்களின் அறிக்கைகளை மீளாய்வு செய்யவும் அவர்களின் பரிந்துரைகளை அமல்படுத்துவதற்கான நிலையை மதிப்பிடுவதற்கும், புதிய அரசாங்கத்தின் கொள்கைக்கு இணங்க அவற்றை செயல்படுத்துவதற்கான நடவடிக்கைகளை முன்மொழியவும்   உச்சநீதிமன்ற நீதிபதி தலைமையிலான விசாரணை ஆணைக்குழுவை நியமிப்பதை உள்ளடக்கியது.

இரண்டாவதாக, 2030 நிலையான அபிவிருத்தி நிகழ்ச்சி நிரல் உட்பட்ட இலங்கையின் கடமைகளுக்கு இணங்க, நிலுவையில் உள்ள பிற அக்கறைகளையும் தேவையான இடங்களில் நிறுவன சீர்திருத்தங்களையும் அறிமுகப்படுத்தும். சட்டத்தின் கீழ் தனிநபர் மற்றும் கூட்டு உரிமைகள் மற்றும் பாதுகாப்புகளை முன்னெடுப்பதன் மூலமும், நீதி மற்றும் நல்லிணக்கத்தை உறுதி செய்வதன் மூலமும், சமூகத்தின் பாதிக்கப்படக்கூடிய பிரிவுகளைச் சேர்ந்தோரின் கவலைகளை நிவர்த்தி செய்வதன் மூலமும் அரசாங்கத்தின் உறுதிப்பாட்டில் வேரூன்றிய கொள்கைகளை நாங்கள் செயற்படுத்துவோம்.

அரசாங்கத்தின் கொள்கைகளை வகுத்தல் மற்றும் செயன்முறைப் படுத்துவதில் சுற்றுச்சூழல் பாதுகாப்பு குறித்து சிறப்புக் கவனம் செலுத்தப்படும். இலங்கையின் 8 வது நாடாளுமன்றத்தின் நான்காவது அமர்வின் தொடக்க விழாவில் தனது கொள்கை அறிக்கையில், “ஐக்கிய நாடுகள் சபையின் நிலையான அபிவிருத்தி இலக்குகளை அடைவதில் இலங்கையை உலகின் முன்னணி நாடுகளில் ஒன்றாக மாற்றுவதற்கான தனது பார்வையை ஜனாதிபதி மீண்டும் வலியுறுத்தினார். ஜனாதிபதிக்கும் ஐக்கிய நாடுகள் வதிவிட ஒருங்கிணைப்பாளருக்கும் இடையில் ஏற்கனவே ஒரு கலந்துரையாடல் இடம்பெற்றபோது, அங்கு நிலையான அபிவிருத்தி நிகழ்ச்சி நிரல்களைச் செயற்படுத்துவதில் இலங்கை அரசுக்கு உதவ தொடர்புடைய ஐ.நா. முகவராண்மைகளை இணைப்பதற்கு ஒப்புக்கொள்ளப்பட்டது.

மூன்றாவதாக, வழக்கமான மனித உரிமை ஆணைகள் / அமைப்புக்கள் மற்றும் பொறிமுறைகள் உட்பட ஐ.நா. மற்றும் அதன் நிறுவனங்களுடன் இலங்கை தொடர்ந்தும் பணியாற்றி, உள்நாட்டு முக்கியத்துவமிக்க விடயங்கள் மற்றும் கொள்கைகளுக்கு அமைய திறன் அபிவிருத்தி மற்றும் தொழினுட்ப உதவியை தேவைக்கேற்ப எதிர்பார்க்கும்.

இறுதியாக, ஐ.நா. வின் அனைத்து உறுப்பினர்களுடனும் இணைந்து, தீர்மானத்தை முடிவுறுத்துவதற்காக பணியாற்றுவதற்கு இலங்கை எதிர்பார்க்கின்றது.

கௌரவ தலைவர் அவர்களே! இலங்கையின் பல இன, பல மொழி, பல மத மற்றும் பல கலாச்சார மக்களின் நல்வாழ்வானது, இலங்கை அரசாங்கத்தை விட வேறு யாருக்கும் இல்லை. இந்த உந்துதல்களே எமது உறுதிப்பாட்டை வழிநடத்துவதுடன், விரிவான நல்லிணக்கம் மற்றும் எமது மக்களுக்கான நிலையான அமைதி மற்றும் செழிப்பு மிகுந்த சகாப்தத்தை நோக்கி செல்வதற்கு தீர்மானிக்கின்றது. ஆகவே, இலங்கையின் உள்நாட்டு முன்னுரிமைகள் மற்றும் கொள்கைகளின் கட்டமைப்பிற்குள் மேற்கூறிய நடவடிக்கைகள் யதார்த்தமானவையாக மட்டுமன்றி, வழங்கக் கூடியவையாகவும் இருக்கின்றன என்பது எமது வலுவான நம்பிக்கையாகும். இந்த முயற்சியில் இலங்கையுடன் ஒத்துழைப்பதற்காக இந்த அமைப்பிற்கு உள்ளேயும் வெளியேயும் உள்ள அனைத்து பங்குதாரர்களுக்கும் நாம் அழைப்பு விடுக்கின்றோம்.புத்த பகவானின் வார்த்தைகளை மேற்கோள் காட்டி இந்த உரையை நிறைவு செய்கின்றேன்,‘சியலு சத்வயோ நிதுக் வெத்வா, நிரோகீ வெத்வா, சுவபத் வெத்வா’எல்லா உயிர்களும் பாதுகாப்பாக இருக்கட்டும்,எல்லா உயிர்களும் துன்பத்திலிருந்து விடுபடட்டும்,எல்லா உயிர்களும் நன்றாகவும் மகிழ்ச்சியாகவும் இருக்கட்டும்.நன்றி.

UNHRC Sessions In March 2021: Duty To Ensure Accountability & Justice

The UNHRC Sessions in March 2021 assume greater political importance for the war victims of Sri Lanka and above all for the relevant roles of United Nations and UN Human Rights Council regarding their commitments to uphold Human Rights, Accountability Justice and Rule of Law in countries which have been subjected to UN and UNHRC Resolutions like Sri Lanka which is facing four UNHRC Resolutions commencing from 2012, the most important being the Resolutions 30/1 of 2015 and 40/1 of 2019 which were co-sponsored by Sri Lanka and the United States of America which sponsored the 30/1 of 2015 Resolution. The present Co-Group members of the UNHRC Resolution 40/1 of 2019 are United Kingdom, Canada, Germany, Montenegro and North Macedonia who shoulder the prime duty and obligations to ensure the compliance and implementation of the core recommendations in those Resolutions which number 25.

More than five years have elapsed since the 30/1 of 2015 Resolution which Sri Lanka pledged to implement. Up to now, Sri Lankan Governments have been adopting the usual delaying tactics and the present Rajapaksa’s Government is run by the accused war criminals as revealed by the United Nations Rapporteurs and other Human Rights Organizations. Sri Lanka, however, has now nailed the death coffins for those Resolutions along with their Recommendations.

President Gotabaya Rajapaksa‘s speech on 18th November 2019 at the Ruwanwelisaya Buddhist Temple in Anuradapura has sealed the fate of Tamils lock, stock and barrel without any room for reconciliation, accountability and justice, As he stated, he has reinforced his power and position as a President by his Sinhala Buddhist people to serve the interests of the Sinhala Buddhists as a Sinhala Buddhist President while deserting and allowing the Tamils and Muslims to live as citizens outside the mainstream and distinctively with their own identities. The President has thus entrenched the polarization and unofficial division of country based on religion, race and language.

His following forthright statement without any iota of the doubt more than confirms his intention. He also further stated that “Majority of Sinhalese voted for me to prevent the threats of extinction of Sinhalese race, our religion, natural resources and the traditional rights by forces within and outside Sri Lanka”.

On the contrary, while the Buddhists and Sinhalese are well secured and protected by the State, which is accelerating its agenda to make Sri Lanka a PURE SINHALA BUDDHIST NATION. Therefore the extinction threatened communities with their religions; language and tradition are the Tamils and Muslims who are continuing to be the victims of genocide including structural genocide.

The United Nations failure to act during the genocidal war has been admitted by the former UN Secretary-General Ban-ki-Moon in 2016 when he said: “Something more horrible seems happened in the past in 1994, in Rwanda, there was a massacre, more than one million people were massacred, United Nations felt responsible for that”. We said repeatedly ‘NEVER AGAIN NEVER AGAIN”. It happened just one year after Srebrenica; we did again in Sri Lanka.

Former US President Barack Obama in his book “Promised Land” released on November 20th 2020 has stated that “UN member states lacked either the means or the collective will to reconstruct failed states like Rwanda or prevent the ethnic slaughter in places like Sri Lanka”.

There is not an inch of doubt that the Sri Lankan Tamils who are the victims of genocide are carrying the war scars and continuing to be victims of structural genocide openly being committed and pursued by the present dictatorial Government. The present Government by Rajapaksa clan has taken a stand defying the United Nations, UNHRC including their Resolutions while pouring scorn at attempts and suggestions of the International Community.

Even the basic rights of a citizen to pay homage to his killed family member have been snatched by this Government when it banned memorial services by relatives for those who were killed during the genocidal war in 2009. Being left in the lurch, the patience of brutalized and traumatized Tamils is wearing out and reaching its limits, the saying “JUSTICE DELAYED IS JUSTICE DENIED’. Is closer to reality and could make way for the rise of militancy. However, there is still a lingering hope for the victims who are anxiously pinning hopes on the UNHRC’s 46th Session in March 2021 when a final Resolution is expected to be presented on Sri Lanka’s progress towards the implementation of the Recommendations passed in 30/1 of 2015 and 40/1 of 2019.Resolutions. As Sri Lanka has withdrawn its commitments and rejected those Resolutions, UNHRC is expected to deal with Sri Lanka’s defiance and non-compliance of these recommendations after a lapse of five years. It is fully hoped that UNHRC will rise to the occasion to vindicate and entrench its credibility and standing by adopting a fitting Resolution with mandatory Recommendations including the imposition of political, economic and diplomatic sanctions. A Recommendation with referral to the International Criminal Court and enforcing sanctions under MAGNITSKY clause by countries the United Kingdom, Germany, USA and Canada are what is needed to ensure accountability for those accused of war crimes.

It is suggested that UNHRC consider the following recommendations:-

1. An independent international investigation into the war crimes and crimes against humanity amounting to genocide.

2. Refer Sri Lanka to the International Criminal Court

3. Impose diplomatic, political and economic sanctions.

4. A referendum in the North and East including the Diaspora Tamils living all over the world to decide the question of right of self-determination as allowed in the UN Charter.

5. Establish United Nations Offices to monitor the human rights situation and actions of the security forces in the North and East to oversee acts of Sinhalisizaton and Buddhisization in the traditional and historical homeland of the Tamils.

It has to be stated that while Australia is prosecuting the 19 soldiers accused of unlawfully killing 39 unarmed civilians and prisoners in Afghanistan after holding a Commission of Inquiry, Sri Lanka is busy releasing accused criminals from prisons on bail like the Presidential Pardon to Sunil Ratnayake on March 26, 2020, a former Sri Lankan surgent of Sri Lankan Army convicted for the brutal murder of eight Tamil civilians including three children. By the granting of bail to Pilliyan alias Sivanesathurai Chandrakanthan on November 24, 2020 [accused for the killing former MP Joseph Pararajasingam] Sri Lanka is exhibiting its own brand of tainted accountability and justice.

It would be like chasing a mirage in the desert as water if anyone can obtain justice from Sri Lanka for the plethora of crimes committed including war crimes, crimes against humanity etc. from the perpetrators of those crimes when most of them are in the control of the present Government with a judiciary which is now subservient to the President after the passing of the 20th Amendment,

The last hope for the victims of war lies with the United Nations and UNHRC who should rise up to the occasion and enforce their commitments detailed in their Charters failing which United Nations and UNHRC will remain as emaciated organs and as talking shops without any blood and teeth to function as protectors of human rights and rule of law among the world community. While Sri Lanka can withdraw from the Resolutions, it can never withdraw from accountability and justice enforced by UNHRC and the United Nations.

UNHRC Sessions In March 2021: Duty To Ensure Accountability & Justice

The UNHRC Sessions in March 2021 assume a greater political importance for the war victims of Sri Lanka and above all for the relevant roles of United Nations and UN Human Rights Council regarding their commitments to uphold Human Rights, Accountability Justice and Rule of Law in countries which have been subjected to UN and UNHRC Resolutions like Sri Lanka which is facing four UNHRC Resolutions commencing from 2012, the most important being the Resolutions 30/1 of 2015 and 40/1 of 2019 which were co-sponsored by Sri Lanka and the United States of America which sponsored the 30/1 of 2015 Resolution. The present Co-Group members of the UNHRC Resolution 40/1 of 2019 are United Kingdom, Canada, Germany, Montenegro and North Macedonia who shoulder the prime duty and obligations to ensure the compliance and implementation of the core recommendations in those Resolutions which number 25.

More than five years have elapsed since the 30/1 of 2015 Resolution which Sri Lanka pledged to implement. Up to now, Sri Lankan Governments have been adopting the usual delaying tactics and the present Rajapaksa’s Government is run by the accused war criminals as revealed by the United Nations Rapporteurs and other Human Rights Organizations. Sri Lanka however has now nailed the death coffins for those Resolutions along with their Recommendations.

President Gotabaya Rajapaksa‘s speech on 18th November 2019 at the Ruwanwelisaya Buddhist Temple in Anuradapura has sealed the fate of Tamils lock, stock and barrel without any room for reconciliation, accountability and justice, As he stated, he has reinforced his power and position as a President by his Sinhala Buddhist people to serve the interests of the Sinhala Buddhists as a Sinhala Buddhist President while deserting and allowing the Tamils and Muslims to live as citizens outside the mainstream and distinctively with their own identities. The President has thus entrenched the polarization and unofficial division of country based on religion, race and language.

His following forthright statement without any iota of the doubt more than confirms his intention. He also further stated that “Majority of Sinhalese voted for me to prevent the threats of extinction of Sinhalese race, our religion, natural resources and the traditional rights by forces within and outside Sri Lanka”.

On the contrary, while the Buddhists and Sinhalese are well secured and protected by the State, which is accelerating its agenda to make Sri Lanka a PURE SINHALA BUDDHIST NATION. Therefore the extinction threatened communities with their religions; language and tradition are the Tamils and Muslims who are continuing to be the victims of genocide including structural genocide.

The United Nations failure to act during the genocidal war has been admitted by the former UN Secretary-General Ban-ki-Moon in 2016 when he said: “Something more horrible seems happened in the past in 1994, in Rwanda, there was a massacre, more than one million people were massacred, United Nations felt responsible for that”. We said repeatedly ‘NEVER AGAIN NEVER AGAIN”. It happened just one year after Srebrenica; we did again in Sri Lanka.

Former US President Barack Obama in his book “Promised Land” released on November 20th 2020 has stated that “UN member states lacked either the means or the collective will to reconstruct failed states like Rwanda or prevent the ethnic slaughter in places like Sri Lanka”.

There is not an inch of doubt that the Sri Lankan Tamils who are the victims of genocide are carrying the war scars and continuing to be victims of structural genocide openly being committed and pursued by the present dictatorial Government. The present Government by Rajapaksa clan has taken a stand defying the United Nations, UNHRC including their Resolutions while pouring scorn at attempts and suggestions of the International Community.

Even the basic rights of a citizen to pay homage to his killed family member have been snatched by this Government when it banned memorial services by relatives for those who were killed during the genocidal war in 2009. Being left in the lurch, the patience of brutalized and traumatized Tamils is wearing out and reaching its limits, the saying “JUSTICE DELAYED IS JUSTICE DENIED’. Is closer to reality and could make way for the rise of militancy. However, there is still a lingering hope for the victims who are anxiously pinning hopes on the UNHRC’s 46th Session in March 2021 when a final Resolution is expected to be presented on Sri Lanka’s progress towards the implementation of the Recommendations passed in 30/1 of 2015 and 40/1 of 2019.Resolutions. As Sri Lanka has withdrawn its commitments and rejected those Resolutions, UNHRC is expected to deal with Sri Lanka’s defiance and non-compliance of these recommendations after a lapse of five years. Core-group working on SL seeks consensual resolution at UNHRC – Foreign Secretary Admiral Prof. Jayanath Colombage

The United Nations Human Rights Council (UNHRC) will have its 46th session between February 22 and March 19. Sri Lanka is on the agenda this time and will come under review based on the resolutions 30/1 adopted in 2015 and two other subsequent rollover resolutions. Sri Lanka co-sponsored these resolutions under the previous government. However, the new government led by President Gotabaya Rajapaksa withdrew from co-sponsorship in March, last year. Against the backdrop, Foreign Secretary Admiral Prof. Jayanath Colombage shares his views with Daily Mirror on the preparation for it. Excerpts of the interview with him: 
Excerpts:-

   Q     How do you brace for the upcoming 46th session of the UNHRC between February 22 and March 19?

Sri Lanka is under scrutiny.  The resolution which Sri Lanka cosponsored in 2015 and the subsequent rollover resolutions are coming up for annual review during the session. We have been sincerely, genuinely working to meet whatever the pledges we made in Geneva, and the commitments made to the international community after the end of the war with the LTTE. However, we feel that the UNHRC is not talking much about what happened during the war, but what happened during the past year. We feel this is unfair and unjust. Therefore, we want to make our representations. We want to make our case at the UNHRC and with the like-minded countries that such country-specific resolutions are not very good. Through the UN system, some powerful countries may try to coax smaller countries to toe their line using human rights as a tool. If you take 2021, Sri Lanka is one of the most peaceful countries in the world. We know what is happening in the highly developed countries – vandalism, attacks against the institutions, seats of democracies and fellow citizens. In such a context, Sri Lanka is a very peaceful country. We fought the war 12 years ago. It should be considered a just war. Sri Lanka had to engage in battle with LTTE terrorism for 30 years. During that period, the LTTE grew from a small group of fighters to a large conventional military force with a small navy and a mini –airforce. It evolved into the most ruthless terrorist organization in the world in 2008 by the Federal Bureau of Investigations of the United States. In the same document, the LTTE was identified with pioneering suicide terrorism, suicide jackets, using suicide woman cadres and killing two world leaders – Sri Lankan President and the Indian Prime Minister. The LTTE is accused of large scale child soldiering and ethnic cleansing. 

“This is very important because the Indian Ocean has become the key ocean in maritime trade, security and economic prosperity. Sri Lanka is positioned in an important location geo-strategically. To stay away from this competition, we have indicated that we want to maintain a neutral policy while technically being a non-aligned country. Many countries do not like to see Sri Lanka as a neutral country”

They asked Muslims to leave the north within 24 hours. There were a large number of Sinhalese living in the north and it became zero soon after the war. That means ethnic cleansing. They have attacked every possible target in the country, mostly civilian targets. Then, successive governments starting from 1985 tried to find a solution to the Tamil militancy. There were several peace initiatives, and every time, the LTTE misused, abused and exploited ceasefire agreements to regroup, retrain and re-equip and to launch fights more devastatingly. The government that came to power in 2005 also went to negotiate with the LTTE under the ceasefire agreement which was monitored by the Sri Lanka Monitoring Mission comprising Scandinavian monitors. They had recorded a large number of violations by the LTTE and the military. The government honoured the ceasefire agreement but the LTTE continued with its atrocities. Finally, when the LTTE closed Mavilaru sluice gates depriving water for 25,000 villages, the government was compelled to launch a counter-attack. The LTTE used civilians as a human shield. 

From 1970 till May 2009, Sri Lanka was losing 250 lives per day – Tamils, Sinhalese, Muslims, the military or the LTTE. After May 2009, it is zero. The government has ensured the right to life for people. Now, 12 years later, we are being accused of human rights violations. We feel it is very unfair. 

   Q     How do you assess the strength of the Tamil diaspora groups?

The LTTE diaspora is a numerically large group in the Western capitals. They have lots of money because they were part of terrorist- financing, money-laundering and criminal syndicates. Now, they use such moment and their population to lobby political parties in those countries to become a constituency-based buildup. Last November, we saw large scale events were conducted in Canada, America, the United Kingdom and Europe. They were glorifying terrorism, suicide attacks, child-soldiers, woman suicide cadres. They were collecting money. They were showing the pictures of Tamil Eelam and depicting the flag of Tamil Eelam which is nothing but a picture of a tiger head with two guns and bullets. That is the symbol of the deadliest terrorist outfit of the world. These were displayed in Western capitals abusing liberties given to them. They even projected the deadly Niyagala flower, the LTTE symbol, at the British Parliamentary building without taking any approval. This is the campaign which the diaspora is carrying out. They are trying to influence the international bodies to target Sri Lanka.”

We have given the copies to every country where celebrations were done by them. We shared it with the embassies here and with our embassies in their capitals. Some of the countries admitted that what the Diaspora activists did was illegal”

   Q     You mentioned that they had gained political clout in those countries. What are the countermeasures Sri Lanka has taken?

In the democratic political system, votes matter- no matter what we say. A politician is not in power as long as he or she does not get enough number of votes. The vote is the most important thing. We have compiled a dossier containing details about the atrocities committed by the LTTE and given copies of it to the relevant countries. We have given the copies to every country where celebrations were done by them. We shared it with the embassies here and with our embassies in their capitals. Some of the countries admitted that what the Diaspora activists did was illegal. The projection of Niyagala flower on the Westminster Parliamentary building was an illegal act. 
Displaying paraphernalia of the terrorist outfit is an illegal act. But, they are doing it. We have requested those governments to take note of it. 

   Q     At the UNHRC, the vote of each member State matters. What is the plan in this regard?

It has 47 members. When you look at the composition of it, it is global Political North dominated. We belong to the Political South. We have the north-south divide of the world. We fear whether they will hijack the agenda of the UNHRC to target Sri Lanka this time. This is very important because the Indian Ocean has become the key ocean in maritime trade, security and economic prosperity. Sri Lanka is positioned in an important location geo-strategically. In this case, international bodies could be used as a platform to pressurize Sri Lanka. 

   Q     What are the measures that the government has taken to face it?

We have appointed a core-group consisting of senior officials. We keep briefing the president, the prime minister and the foreign minister. We take guidance from them. We are in touch with our Permanent Secretary in Geneva, the Permanent Secretary in New York and our embassies. We are discussing what we should do now.

Right now what we know is that the core group in Geneva- the UK, Canada, Macedonia, Germany and Montenegro- is working on a consensual resolution. We are awaiting the draft. This is the only thing on the table at the moment. We agreed that the text of such a consensual resolution will be decided by both sides- the core group and Sri Lanka”

   Q     What are the ministries involved here?

They are the Foreign Ministry, the Justice Ministry, the Chief of National Intelligence, the Presidential Secretariat, the Presidential Media Division, the Attorney General’s Department and the Treasury. We have been studying this. We have been getting a lot of feedback from many people, likeminded people. 

   Q     What about the support from the like-minded countries?

We are going to canvass for it. 
We want to tell them our narrative. We want to tell you that today it is us and it will be them tomorrow. Therefore, we need to have a unified stand against this bullying tactic of supranational organizations. 

   Q     You mentioned that there is a discussion in the international arena on what happened during the last one year. What do they say as you noticed?

They say there is a dangerous trend in Sri Lanka. We don’t understand any dangerous trend. We see this as a peaceful country struggling to overcome the impact of Covid-19 and the resultant economic downturn. There is no violence in this country. It is unfair to paint Sri Lanka as a dangerous country. They talk about a majoritarian discourse. 
The majoritarian discourse started with the co-sponsoring of the resolution 30/1 in 2015. Until then, we did not talk about a majoritarian discourse. We are a democratic country with people exercising their democratic rights and freedom of thought. When the country’s integrity is attacked, people feel nationalistic about it. That leads to majoritarian discourse. We don’t have majorities discourse. In our Parliament, we have Tamils and Muslims serving as key ministers. 

   Q     Today, we notice Muslim organizations tying up with the Tamil groups internationally to lobby for support against Sri Lanka. They are against the government over the burial issue. How do you view this situation?

It is an unfortunate thing as far as the Muslim burial issue is concerned. It is a matter based on scientific and health regulations. It is not a political issue. It is not an ethnic issue. I see the LTTE Diaspora group trying to use this to see that there is discrimination in the country.  I don’t see any discrimination. It is a matter of science. I wish that a solution to this issue will be found soon. 

   Q     The UN High Commissioner for Human Rights is expected to submit a report this time. Are we planning to move a counter resolution?

We have not decided on our course of action this time yet.    Q     How do you see the political change in the United States on this matter?

Right now, I don’t think any bearing on Sri Lanka. The US is not a member state of the UNHRC. It left the UNHRC calling it a cesspool of political bias. Yet, they influence through their proxies. I guess the US needs a lot of time to rebuild its image of America, to rebuild the democratic institutions, to bring back law and order and to battle Covid-19. I think they will be focusing on making corrections and things better for America.

K must spearhead the international push for justice against SL following damning UN report: AI

The UN Human Rights Council (UNHRC) must take urgent steps to address the worsening human rights situation in Sri Lanka, the Amnesty International (AI) said yesterday and urged the UK Government to follow through on its commitment to work with partners to present a strong resolution when the Human Rights Council meets next month.
Almost 12 years on from the end of Sri Lanka’s civil war, the report, from the Office of the High Commissioner for Human Rights (OHCHR), warns that the Sri Lanka’s persistent failure to address historic crimes is giving way to ‘clear early warning signs of a deteriorating human rights situation and a significantly heightened risk of future violations.’  
In February 2020, the Sri Lankan government announced that it would no longer cooperate with the UNHRC’s landmark resolution 30/1, which promotes reconciliation, accountability, and human rights in the country, and would instead pursue its own reconciliation and accountability process. 
David Griffiths, Director of the Office of the Secretary-General at Amnesty, said:  
“This report lays bare Sri Lanka’s abject record on delivering justice and accountability and the decaying effect this has had on human rights in the country. The seriousness of these findings highlights the urgent need for the UN Human Rights Council to step up its efforts in Sri Lanka.
“For more than a decade, domestic processes have manifestly failed thousands of victims and their families. Given the government’s decision to walk away from resolution 30/1, and regression on the limited progress that had been made, the Human Rights Council must send a clear message that accountability will be pursued with or without the cooperation of the government.” 
Amnesty is calling on the UN Human Rights Council to implement the report’s key recommendations to put in place more stringent oversight on Sri Lanka, including more robust monitoring and reporting on the human rights situation, and the collection and preservation of evidence for future prosecutions. 
Amnesty is particularly urging the UK Government to follow through on its commitment to work with partners to present a strong resolution when the Human Rights Council meets next month, putting in place more robust monitoring and reporting on the situation, and mandating the collection and preservation of evidence for future prosecutions.
The report, which accuses Sri Lanka of being in a ‘state of denial about the past’, details how the failure of domestic mechanisms has further entrenched impunity, exacerbating victims’ distrust in the system. Among a litany of failures, the report addresses the rollback of 2015 reforms that offered more checks and balances on executive power, the erosion of judicial and institutional independence, and the failure to reform the security sector and remove and hold to account those responsible for alleged grave crimes and human rights violations. 
The report also offers a withering assessment of regression in other human rights areas, including the increasing marginalisation of Tamil and Muslim minorities, fuelled by divisive and discriminatory rhetoric from state officials, and a shrinking space for civil society, including independent media.
