Court strikes down Almrei security certificate

Dear editor,

Human Rights advocates who value democracy, transparency and  the rule of law will welcome this landmark judgment. If not for the like of    Federal Court Justice Richard Mosley, many Ministers who dream of becoming  tin-pot  Hitlers would have succeeded in their venture.

The security certificate process is fundamentally unjust and flawed. There is a complete disregard for human rights and the presumption of innocence under  our justice system.  It is palpably wrong to  compromise human rights and civil liberties under the guise of safeguarding  national security.

Past  and present governments, notably the Liberal government,  is guilty of using national security certificates with gay abundance to arrest, harass and deport non-citizens - the most vulnerable group of people who  seek political  asylum.  The Liberal Ministers and MPs should hang their heads in shame for resorting to this process while paying lip service to democracy and justice. Even Bill Graham,  the former Minister of External Affairs who is also a lawyer by profession, is guilty of  mis-using this process.  The court-assigned special advocate lawyers who can  hear and challenge the secret evidence  is small consolation and definitely  no substitute  to  the constitution, the Charter, the International Covenant on Civil and Political Rights, and the UN Convention against Torture.

Canada's claims to democratic credentials will be highly laughable as long as national security process remains in force. The CSIS and the RCMP have  a vested interest in peddling  the terrorism bogey to justify their fat payroll! The CSIS has become the depository of retired RCMP officers. This because the chief of the CSIS exaggerate the danger of terrorism to seek more funds, more vehicles, more equipment and other resources to fight in most cases imaginary  threats to national security. The  Maher Arar fiasco is a fine example which costs the taxpayers $ 12.5 million.

Spineless Ministers simply sign the certificates without  studying the case and  follow the path of least resistance. It is a  typical case of play for the fat  cat, but life and death struggle  for the litte  mouse!

Suresh's case highlighted the serious human rights abuses inherent in the security certificate process. These include:

     * detaining a person for an extended indefinite time without meaningful access to a court to review the need to detain.

     * sanctioning detention and deportation of a person whose only 'offence' has been to exercise in an entirely lawful manner his/her constitutionally protected right to engage in political expression and association.

     * failing to provide a fair and meaningful opportunity for a person to know the case against him/her and to challenge this case on all grounds, including a challenge to the constitutionality of the provisions of the Immigration Act

When Suresh Manickavasagar was charged under the national security process the Thamil Community was forced spent over $300,000 in lawyers fees and arraigning  expert witnesses  on his behalt  around the globe.

Section 40.1 of the Immigration Act under which Suresh was  detained, provides for automatic mandatory and indefinite detention of non citizens subject to security certificates.  In Al Yamini Vs Solicitor General case the Federal Court of Canada has held, "that section 19(1)(g) of the (Immigration Act)… contravenes freedom of association assured to everyone by paragraph 2(d) of the Charter of rights and Freedoms in a manner that is not justified in a free and democratic society, and to that extent paragraph 19(1) (g) is of no force and effect.”

It is time the Conservative government to immediately revoke all current security certificates and allow detainees to fight charges, if any, in a fair and independent trial; guarantee that they will not be deported; cease using Security Certificates and re-write the security provisions   in compliance with the constitution and the Charter of Rights and Freedoms.

The national security process is a blot on the fair name of my country. It is targeted against the most vulnerable and the weak in the society.  In the light of the latest judgment the government must use the ordinary criminal  to deal with any threat of terrorism.

Yours truly

Hassan Almrei was detained in 2001 on a national security certificate and held until this year. Now a federal court judge has ruled a security certificate reissued in February, 2008 is not valid and there is no longer reasonable grounds to believe he poses a threat.

OTTAWA – A Federal Court judge has thrown out the federal government's deportation case against Syrian-born Hassan Almrei, a man that CSIS accused of connections to the "Bin Laden network."

In a 185-page landmark ruling, Justice Richard Mosley found the evidence, both secret and public, cited to justify deporting Almrei does not hold up to scrutiny, and declared "unreasonable" the deportation certificate that deemed him a threat to national security.

Almrei, who was first arrested more than seven years ago but was released earlier this year under strict conditions, got the news in his lawyer's Toronto office.

"He's very excited and so am I," said Almrei's lawyer Lorne Waldman, in a telephone interview from Montreal, where he was setting to board a plane en route to meet with Almrei.

"After seven years, this man is now cleared. The story here is how does this decision reflect on CSIS's understanding of these organizations."

The tight conditions currently governing Almrei's release have not formally yet been lifted, said Waldman, but the court's decision will mean he will soon have his freedom.

"The court is satisfied that Almrei is not and was not a member of an organization that there are reasonable grounds to believe has engaged in terrorism," wrote Mosley.

Mosley, a former assistant deputy justice minister appointed to the Federal Court bench in 2003, said he recognized that there were "reasonable grounds to believe that Hassan Almrei was a danger to the security of Canada when he was detained in 2001 but finds that there are no longer reasonable grounds to believe that he is a security risk today."

Mosley was critical of Canadian Security Intelligence Service and the federal public safety and immigration ministers who signed a new certificate in 2008 against Almrei, after the Supreme Court of Canada had forced the government to overhaul its law to provide more protection in cases where secret evidence was cited.

Mosley said the CSIS and the ministers "breached their duties of utmost good faith and candour to the court by not thoroughly reviewing the information in their possession, prior to the issuance of the February 2008 certificate."

The judge said the government's case against Almrei "was assembled with information that could only be construed as unfavourable to Almrei without any serious attempt to include information to the contrary, or to update their assessment."

CSIS was forced to admit earlier this year, as it did in a separate deportation certificate case, that it failed to disclose evidence that a confidential informant was "deceptive" when answering questions in the Almrei matter. A second source cited in the government's case against Hassan Almrei was not subjected to a lie-detector test, contrary to what the agency had claimed in court documents.

The federal ministers involved, Peter Van Loan and Jason Kenney, had no immediate comment today.

Certificates, though rarely used, allow the government to rely on evidence that is secret, and the standard of proof in the deportation case is lower than in a criminal case.

Waldman said while there is no doubt that in Almrei's case the court-assigned special advocate lawyers who were able to hear and challenge the secret evidence — without communicating it to Almrei or Waldman — "played an extremely important role," he said it "is not the complete solution" to the problems presented when the government uses secret evidence.

The ruling throws further doubt on the federal government's regime for trying to deport foreign nationals it deems a national security threat. An earlier court threw out a certificate against Adil Charkaoui, after CSIS withdrew evidence it feared would jeopardize its human sources.

Mosley wrote today: "In arriving at this conclusion, I am taking into consideration that Hassan Almrei lied and engaged in criminal activities prior to and following his entry to Canada. He maintained contacts with other Afghan Arab veterans, associated with persons who were believed to be Islamic extremists and made contact with others who were involved in human smuggling and the false document trade. He was prepared to assist others in obtaining those services and himself procured a false passport and other travel documents."

But Mosley also said "the Hassan Almrei of 2001 is not the same person that I heard and observed in the courtroom."

"As he acknowledged in his testimony, he has been changed by the experience, by the people who have befriended and supported him in the years in which he was in custody and through the reading he has done on a broad range of subjects. One constant in his life over the course of the past eight years has been his religious devotion. I do not believe that he will now proceed to violate the principles of his faith."

"I am also persuaded by the evidence that if he is the person that the Ministers believe him to be, it is unlikely that after such a prolonged period of detention that he could re-enter the life that he had and reactivate his contacts in the false document trade. Given the notoriety that he has acquired, that would be foolhardy for him and for anyone inclined to do business with him."

He said that CSIS, in their most recent assessment of Almrei, "considers that the risk that he poses a threat to the security of Canada, if released without conditions, was reduced as a result of a number of factors. They had no new information to indicate that he was engaged in threat-related activities, his original network of contacts has been disrupted and his high public profile and lack of anonymity would render him less effective."

TamilNet

I came across the following assertion in an article that appeared in the TamilNet [TamilNet, Saturday, 19 September 2009, 13:04 GMT] on the subject Vaddukkoaddai and Thimphu.

“Self-determination, as it is understood in contemporary times is a vague term when applied to people or ethnicities. According to UN charter 1(2), self-determination is interpreted as existing only in state-to-state relationship. Legally, it protects only states. “

In this connection the  Quebec sovereignty movement (French: Mouvement souverainiste du Québec)

  1. Has agitated and continue to agitate  to  achieve  sovereignty for the Quebec state.

  2. The creation of a political and economic association between this new independent state and Canada.

Quebec is 80% French. There have been two referendums in 1980 and 1995. In the 1995 referendum the sovereignists lost in a very close vote: 50.6 percent to 49.4 percent.

In this connection it is interesting to review the judgment delivered by the Supreme Court of Canada whether the Quebec people could secede from the 129-year-old confederation.  A case was filed by the Federal Government asking the Supreme Court for a ruling.

  • does Quebec have the right to unilaterally declare independence under Canadian law?

  • does it have the right to do it under international law?

  • if there is a conflict between Canadian law and international law, which takes precedence?

Canada's Supreme Court ruled that a unilateral declaration of independence by Quebec would be illegal under the Canadian constitution and international law. At the same time, it said that the Canadian federal government and Canada's nine other provinces would be legally obligated to negotiate the terms of secession if a “clear majority” of Quebecers voted in favor of separation in a provincial referendum with a “clear question.”

The Supreme Court also found that there is no right to unilateral secession in international law except for colonies and oppressed people, which it said does not apply to Quebec. This is because although Quebecois constitute a “people” they are not subject oppression and therefore not entitled to secede from rest of Canada. The Supreme Court in its judgment answered the second question thus:

Rights to secede under international law and self-determination

The answer to the second question, which concerned Quebec's right under international law to secede, gave the opinion that the international law on secession was not applicable to the situation of Quebec. The court pointed out that international law "does not specifically grant component parts of sovereign states the legal right to secede unilaterally from their 'parent' state."

The Supreme Court of Canada's decision stated that the right of a people to self determination was expected to be exercised within the framework of existing states, by negotiation, for example. Such a right could only be exercised unilaterally under certain circumstances, under current international law. The court held that:

The various international documents that support the existence of a people's right to self-determination also contain parallel statements supportive of the conclusion that the exercise of such a right must be sufficiently limited to prevent threats to an existing state's territorial integrity or the stability of relations between sovereign states.

and that

A state whose government represents the whole of the people or peoples resident within its territory, on a basis of equality and without discrimination, and respects the principles of self-determination in its own internal arrangements, is entitled to the protection under international law of its territorial integrity.

The court stated in its decision that under international law, the right to secede was meant for peoples under a colonial rule or foreign occupation. Otherwise, so long as a people have the meaningful exercise of its right to self-determination within an existing nation state, there is no right to secede unilaterally.

The corollary of this ruling is that since Thamils in Sri Lanka are oppressed they have the right to exercise their right to self-determination. In other words self-determination is not only applicable to people subjugated by colonial powers, but others as well if they are oppressed.

This line of argument must be advanced to support the right of self-determination of the people of Thamil Eelam.

Subject: Tamil rebels face doubtful future

The write up of Anbarasan Ethirajan on LTTE is biased and borders on speculation. That he should quote DBS Jeyaraj, a rabid anti-LTTE baiter,  to back his story shows the game plan of Ethirajan. The claim that LTTE has assets worth to 500 million to 1 billion is a figment of his fertile imagination. Is he so dumb and imbecile to belief such stories? LTTE still enjoys popular support inside and outside Sri Lanka. The forthcoming Maveerar Nal celebrations and birth day celebrations of LTTE leader Prabhakaran will show the world that the  struggle of Thamils  to restore and reconstitute the  independent and sovereign state of Thamil Eelam based on their entitlement of a traditional Homeland, nationhood and the right of Self-Determination will get further galvanized.

Tamil rebels face doubtful future

By Anbarasan Ethirajan
BBC News

It is six months since the end of the conflict in Sri Lanka but Tamil Tiger rebels and their supporters are yet to recover from the dramatic military defeat by security forces earlier this year.

The recent attempts by remnants of the Liberation Tigers of Tamil Eelam (LTTE) abroad to revive the movement have not succeeded so far.

Now questions are being raised over the future of its international network and millions of dollars worth of assets spread across continents.

It is a dramatic reversal of fortune for the LTTE, once described as one of the most powerful guerrilla movements in the world which almost had a de facto state and its own naval and air wings.

More than 10,000 suspected Tamil Tigers and their supporters, arrested in the aftermath of the offensive, are detained in military-run camps in the island's north.

The Sri Lankan government says it wants to hold special trials for LTTE fighters, especially for the leaders, now under detention.

Tamil hopes

In the absence of an active presence inside Sri Lanka, many Tamils believe rebel leaders living abroad can play a role in reinvigorating the group. But their hopes seem to be fading away.

"The LTTE's overseas network is in a state of flux. The structures remain but it no longer appears cohesive or centrally controlled," says Canada-based Sri Lankan analyst DBS Jeyaraj.

The group's leader, Velupillai Prabhakaran, and his senior aides were killed in the final military assault on their stronghold in north-eastern Sri Lanka in May this year.

Under the present circumstances, very few people believe that the group can revive militarily within Sri Lanka in the near future.

Although the Tamil Tigers suffered a crushing blow within Sri Lanka their international network has largely remained intact. Until May, the structure was directly controlled by senior leaders based in northern Sri Lanka.

Tamil Tiger supporters hoped that rebels living abroad could revive the organisation and continue with their activities, at least in foreign countries.

But the dramatic arrest of their new leader, Selvarasa Pathmanathan, from a south-east Asian nation in August dealt a severe blow to their hopes.

Soon after his arrest, the Sri Lankan defence ministry said intelligence agencies in several countries were looking for a number of high-profile Tamil Tiger operatives.

Fearing that Mr Pathmanathan may reveal their names, many senior leaders of the LTTE living abroad have either gone underground or are lying low for fear of being arrested and taken to Sri Lanka.

Transnational government

On the other hand, a section of the LTTE leaders and supporters based in North America and western Europe have been trying to form a government in exile to press for their political demands.

For any such effort to succeed, the support of the LTTE's overseas network is considered crucial. For years, it provided much needed financial resources and carried its propaganda through well-oiled media machinery.

This overseas network was instrumental in collecting funds, managing investments, buying sophisticated arms and clandestinely transporting them to Tamil Tiger-held areas in north-eastern Sri Lanka.

Tamil Tiger investments overseas are said to range from grocery shops to real estate, from petrol stations to Hindu temples, from commercial shipping to financing movies in India.

Tamil Tigers are also believed to own commercial centres in many cities including Toronto, London and Paris.

We can see that a lot of divisive tendencies are growing amongst the LTTE leaders overseas
Sri Lankan analyst DBS Jeyaraj

In addition, they were collecting money every month from their supporters and sympathisers abroad, many of whom paid through direct debit from their bank accounts.

But most of these activities were carried out under false names, as the rebels were banned in many countries around the world.

The estimates about the LTTE's assets and investments range from $500m to $1bn.

Infighting

Now there are reports of intra-factional rivalry within the LTTE to wrest control of the organisation as well its assets. This has led to disenchantment and confusion among LTTE supporters.

"When the rebels were collecting money earlier they had a purpose. Now Tamils are questioning what they will do with the money. They also want the two competing groups to come together to highlight the Tamil cause," says Shan Thavaraja, an exiled Tamil journalist based in Switzerland.

Also, there have been reports that some LTTE sympathisers and activists living abroad whose names were used to own businesses and buildings for the movement are slowly taking control of those businesses for their own benefit.

Many Tamils living abroad are worried this trend is likely to increase as overall knowledge about rebel assets was restricted to very few leaders, most of whom were killed during the conflict.

Although regular monthly contributions from ordinary individuals have decreased, many die-hard supporters are still willing to make donations.

Some LTTE sympathisers say prominent rebel supporters, who are lying low at the moment, will not hesitate to revive the organisation if the conditions become viable. They say it all depends on developments back in Sri Lanka.

Tamils living abroad believe that only a concerted global campaign can put pressure on the Sri Lankan government to allow the hundreds of thousands of civilians displaced during the war to return to their homes. The civilians are now confined in government-run camps in northern Sri Lanka.

They want the LTTE to regroup if only to launch massive campaigns in Western capitals highlighting the plight of war-displaced Tamil civilians. But the in-fighting seems to have dented their hopes.

"We can see that a lot of divisive tendencies are growing among LTTE leaders overseas. As a result, the chances of the LTTE gradually disintegrating are high," says Mr Jeyaraj.

Dear  ps

The electoral process in regard to holding a referendum on Vaddukkodai Resolution is already underway. Volunteers beloning to  Canadian Youth Organization and Canaddian Thamil Community are knocking at doors to take a census of people eligible to vote,  whether they require transport on voting day etc. Just like the way Elections Canada conducts poll for parliamentary elections.

We are also getting  as many endorsements possible  from MPs, MMPs, City Councillers, buisnessmen, academics, trade unionists, professionals etc. to this electoral process. We are holding meetings to explain to the people the necessity and reasons  to  have a referendum  33 years after the actual passage of the resolution. We are not canvasssing the people to say yes or no to the referendum. Wee are leving that to the people to decide.

As you may be aware there is no political space in Sri Lanka to secure a mandate from the people for the Vaddukkoddai Resolution as the Tamil United Liberation Front (TULF)  did in the 1977 general elections. In that elections 68.9% of voters in the North and 39 % in the Eastern province voted for TULF candidates and it   won 17  of the 19 seats it contested. Likewise in the 2001 elections the TULF won 18 out of 21 seats it contested on the basis that LTTE is the sole representatives of the Thamil people.  In the 2004 elections TNA won 21 of the 22 seats it contested.

The 6th Amendment   to Sri Lanka's constitution  prohibits that -

. (1) No person shall, directly or indirectly, in or outside Sri Lanka, support, espouse, promote, finance, encourage or advocate the establishment of a separate State within the territory of Sri Lanka.

(2) No political party or other association or organisation shall have as one of its aims or objects the establishment of a separate State within the territory of Sri Lanka.

(3) Any person who acts in contravention of the provisions of paragraph (1) shall, on conviction by the Court of Appeal, after trial on indictment and according to such procedure as may be prescribed by law,—

(a) be subject to civic disability for such period not exceeding seven years as may be determined by such Court;

(b) forfeit his movable and immovable property other than such property as is determined try an order of such Court as being necessary for the sustenance of such person and his family ;

(c) not be entitled to civic rights for such period not exceeding seven years as may be determined by such Court, and

(d) if he is a Member of Parliament or a person in such service or holding such office as is referred to in paragraph (1) of Article 165, cease to be such Member or to be in such service or to hold such office

This electoral process will also serve as a springboard  to  hold the elections for the TGTE and Country Councils. The TGTE will be the authentic and legitimate voince of the Thamils globally. The Country Council will be the authentic and legitimate voince of Thamil Canadians. This way we want to nullify   the charge that a 'mafia' style outfit is  controlling and directing the Thamil Canadians.

I don't know how well I did at the interview. This is a first for me.  Refflecting back I missed some key words like political space. Aslo the distinction between terrorits and freedom fighters. That George Washington and in recent times Nelson Mandela were  labelled  as  terrorits till they  metorphosed  as  heads of states. There is a long list of terrorits metomohrphosing as Presidents and  Prime MInisters.  The current President of East Timor  Xanana Gusmao was   languishing in prison charged with treason after capture by the Indonesian army! What more he too was dubbed a “terrorist” by none other than the US and UK. But when his guerrilla army won the war he became the darling of the same people who earlier branded him as a terrorist.

Israel Prime Ministers Menachem Begin and Yitzhak Shamir were both wanted terrorists by the British?  Menachem Begin  as leader of the illegal Irgun Zvai Leumi underground movement was  responsible for blowing up the King David Hotel in Jerusalem, resulting in 91 deaths and countless wounded.   Yizhak Shamir as part of the ruling triumvirate of the Stern Gang authorized the 1944 assassination of Britain’s Lord Moyne and the 1948 murder of the United nations mediator Count Bernadotte.

TNA satisfied with pace of resettlement: Sri Kantha

(N.Sri Kantha who lost the elections and  managed to squeeze in  through the National list is singing praise of the racist Mahinda Rajapakse

government lately. He is praising the government sky high when the incarceration of the IDPs was completely  an illegal act of the government. A denial of the fundamental freedom of movement! Sri Kantha is  shamelessly picking up the crumbs that falss  from his master's table!   He gives  certificate of good conduct to the government  when human rights groups like the AI and HRW are passing harsh strictures on the government  saying the IDPs  are languishing in squalid camps without basic necessities. Even his colleague P. Ariyenthiran is  painting a sordid  picture! At the next election   cheer leaders like Sri Kantha will be booted out by the good  people of Jaffna.  That is a certainty and  Thamil Diaspora will ensure his defeat  without fail. Not only Sri Kantha but others like Sivanathan Kishor who is marching to a different drum awaits similar fate! )

Basic facilities have been provided   IDPs need financial assistance

By Kelum Bandara

After visiting the IDP camps for the first time since they were set up after the end of the war the Tamil National Alliance (TNA), said yesterday government appeared to be serious about the resettlement of these displaced persons.  TNA members said there was a sense of commitment by the military and civil officials in this respect.

A seven–member team of TNA members visited the IDP camps and the newly resettled areas yesterday. The visit was organised by Government.

TNA MP for the Jaffna district N. Sri Kantha told the Daily Mirror basic facilities had been provided to displaced persons housed in welfare camps and villages in Chettikulam, Vavuniya. The MP added the people however yearned to return to their original homes.

He said the people raised their grievances and the TNA promised to take them up with Government and relevant authorities.  The MP said there was a need for a regulated system to issue passes to IDPs to enable them to visit relatives in other camps.

The TNA identified cases where the LTTE suspects and persons who surrendered were separated from their families and kept in reservation camps.

Mr. Sri Kantha said his team brought these issues to the notice of the officials   concerned, who responded positively.

The IDPs pointed out the need for financial assistance to purchase requirements, apart from dry rations provided by Government. “Basic facilities have been provided and people have understood the situation. They are bravely facing it. We must appreciate the role played by Government and military officers in attending to the needs of the IDPs. We have to approach the whole problem in a positive manner” he said.

The MPs also visited resettled areas of Mannar and Thunukkai and interacted with the people. Mr. Sri Kantha said the resettled people were relieved to have eventually returned to their homes.

“We are satisfied with the pace at which the resettlement process has been progressing. In fact this visit was very useful,” he said.

The TNA MPs also visited areas where de-mining was taking place and observed progress of the task.

The TNA delegation comprised MPs N. Sri Kantha, P. Ariyanethran, Sivanathan Kishor, Vino Noharathalingam, Selvan Adaikkalanathan, R.M. Imam and Thomas William Thangathurai.

The pitiful plight of  250,000 Thamil civilians illegally detained in concentration camps

Dear Mr. Lee,

We wish to bring to your attention the pitiful plight of 250,000 Thamil civilians’ illegally held  in concentration camps  by the Sinhala armed forces. As you may be aware, although the war was officially over on May, 19  these people have been deprived of their fundamental rights holding them  under any law of the land and in clear violation of international human rights norms and standards. They have been deprived of their liberty and freedom of movement.  The displaced people, including at least 50,000 children, are being accommodated in 41 camps spread over four districts, including Vavuniya.

Mr. Managala Samaraweera, a Sinhalese Opposition   M.P.  speaking in parliament referred to the novel 1984 written by George Orwell and stated “Had Orwell been alive today, he would have been relieved and happy that most of the world has moved away from fascist/communist forms of government to firmly entrenched forms of democratic governance – including Germany and Russia. However I am sure he would have been shocked to see the little island paradise called Ceylon which gained Independence from the British Empire in 1948, only a year before he released his novel, would become the setting for a true to life Orwellian nightmare 59 years later.” (http://transcurrents.com/tc/2009/09/chinthana_lanka_under_maha_raj.html)

In  the same novel a Ministry for Peace is installed to wage war like what President Mahinda Rajapakse did when he created his own Peace Secretariat to wage war against the LTTE. The military operations were called “Humanitarian Operations” tasked to “Liberate the Thamil people from the clutches of the LTTE.”  And in Orwellian fashion he calls the internment camps as “Welfare Centres!”  Unfortunately, the Western powers, including Canada whether under the Liberals or the Conservatives fell victims  to the  grand Orwellian style deception practiced by President Mahinda Rajapakse hook, line and sinker!

On October,  2009  Amnesty International (AI) in a statement claimed “A quarter of a million Sri Lankans now being held in de facto detention camps are facing a humanitarian disaster as monsoon rains threaten to flood camps. Camps remain overcrowded and lack basic sanitation facilities and heavy rains in September saw rivers of water cascading through tents with camp residents wading through overflowing sewage.”

"People living in these camps are desperate to leave. The government must ensure that the displaced are treated with dignity. They have a right to protection and must be consulted on whether they wish to return to their homes or resettle. The provision of protection, assistance and return is not an act of charity but a basic right,"
said Yolanda Foster, AI’s Sri Lanka expert. Amnesty International also claims   that the military is blocking release attempts by the civilian administration. Since the war ended in May 2009, thousands of people detained in camps have been subjected to 'screening' processes by the security forces.

Despite calls from AI and Human Rights Watch to free the people before the threat of monsoon rains and flooding, the Sri Lankan government continues to hold them in what are basically open-air prisons. This is the same Sri Lanka from where we were forced to flee persecution twenty five years ago but which continues till today!

Additionally, Sri Lanka is facing calls by the United Nations Human Rights Chief Ms. Navi Pillay for possible war crimes committed during the final stages of the war where more than 20,000 Thamils were reported to have been perished due to heavy artillery shelling and aerial bombing.

Furthermore, a climate of oppression remains widespread in the country, making targets out of the Thamil national minority, journalists and anyone who dares to question or contradict the government version of events. This suppression led to Human Rights Watch releasing a statement that the Sri Lankan government appears to be preparing to take action against individuals and organizations that criticized it during the war.

This crackdown on free speech and independent media led to Reporters Without Borders (RSF) to rank Sri Lanka 162 nd out of 175 countries in the world for press freedom in 2009. In this year alone, a UNICEF worker was expelled from the country, the Red Cross was forced to scale down its operations and a journalist was imprisoned for 20 years. Meanwhile, disappearances remain commonplace.

Brad Adams, Asia director at Human Rights Watch has said "Enough is enough, it is well past time to release civilians detained in the camps. Sri Lanka's international friends should tell the government that they will not accept any more broken promises." The Sri Lankan government has used its promises of rapid return (usually called "resettlement" by the government) to stave off international criticism over its treatment of Thamil civilians displaced by war.

There is good news that the EU may withdraw the GSP+ trade concessions because of Sri Lanka’s abysmal human rights record. The EU has claimed that the protracted detention of internally displaced people was disproportionate and was in conflict with key provisions of the International Covenant on Civil and Political Rights.

We appeal to you to present a petition to the parliament calling for the  closure of the internment camps and release of detainees forthwith to avoid the humanitarian crisis looming over Vavuniya camps. The irony is these concentration camps are run with money provided by countries like Canada.

Yours truly

Do you expect the 13th Amendment or the 13th plus to redress the Tamil question in Sri Lanka?

A:  The 13th Amendment is too little and too late. If the Sri Lankan government wants to address the real issues, they need to go beyond the 13th Amendment.

Even a moderate party leader like R.Sampanthan has said TNA will not touch the 13th Amendment with a long barge. It was rejected by
the TULF in 1983.

Even Mahinda Rajapakse has said it will be 13+ meaning he will have a second chamber which will be nothing sort of an eye wash.  Sinhalese politicians are past masters in stacking worthless unelected senate with Thamil Quislings! D.S.Senanayake began it during State Council days. His wife and others followed him faithfully.

The answer to the question should have read thus:

Twenty two years of negotiations from Thimbu to Oslo failed even after LTTE   agreeing to ‘explore’ solutions under ‘internal self-determination’, a specific reference to a  united Sri Lanka. Today, Thamil people will only accept a solution based on Vaddukkoddai (1976) and Thimbu principles (1985) viz recognition of Thamil Homeland, Nationhood and Right to self-determination that will restore and reconstitute a sovereign and independent Thamil Eelam.  Though the de facto state Eezham Tamils created has been militarily crushed under the guise of fighting ‘terrorism’ an independent and sovereign nation-state for Thamils in the island remains our goal.

I don't understand why TamilNet should give publicity to this event. Barring Puthuvai Rathnathurai, the other two poets have contributed nothing towards the growth of Thamil nationalism. In fact they were stumbling blocks to the Eelam armed struggle.  Cheran has never appeared in any political event sponsored by Thamil nationalists.  Of course he has muted his criticism of the LTTE lately, but he still keeps respectable distance. There was a time he accused the LTTE of having used Theleepan whom he alleged had already half his colon as a sacrificial lamb to gain propaganda mileage. Even at a seminar recently he spoke on transnational politics, but not on Transnational government of Thamil Eelam. I have not read the works of VIS Jeyapalan, but his name is not one among pro-Thamil Nationalists.  The name of Thamil nationalist bard Puthuvai Ratnathurai should not have been included in this book along with the other two. That is an insult to Puthuvai.

Scholarship alone should not be the criteria to accept people who don’t take a bold stand on Thamil nationalism.

A well argued and well researched article. This is one of the best piece by Prof. Peter Schalk I have read. He says "Mahinda Rajapakse completes what Duththagamani has started more than 2000 years ago. Just-war-theory is, however, an aberration of the teaching of the Buddha. He grieves today at his lost Lankan disciples" but the fact of the matteris  modern day Rajapakses have bettered Duththagamni's feat. It is on record that Duththagamani erected a tomb for Ellaalan and decreed people to pass the tomb alight from their vehicles and walk the distance in silence. Modern day Buddhists have destroyed the tomb erected and put Duththagamini to shame!

Buddhism or better  Sinhala Buddhism, is a faith which  has  perverted  the teachings of Gautama Buddha.  Buddhism is a religion premised on ahimsa towards not just humans but all living beings, a religion that tells its adherents not to kill because, `All beings tremble before violence. All fear death. All love life. See yourself in others` (Dhammapada), is used to justify the `slaughter of a great host numbering millions` simply because they happened to be `unbelievers`, then that use is an abuse, and its outcome a perversion which is the antithesis of the original teaching. According to Mahavamsa when a conscience stricken King Dutugemunu was lamenting over `the slaughter of a great host numbering millions` in his war against ELara, a group of monks arrived to console the King: `From this deed arises no hindrance in thy way to heaven. Only one and a half human beings have been slain here by thee, OF lord of men. The one had come unto the (three) refuges, the other had taken on himself the give precepts. Unbelievers and men of evil life were the rest, not more to be esteemed than beasts. But as for thee, thou wilt bring glory to the doctrine of the Buddha in manifold ways therefore cast away care from thy heart, O ruler of men!` (Mahavamsa). And this promise of heavenly bliss was duly realised. The king upon his death was reborn in the highest of heavens, Tusita where awaiting the time when he shall become a Buddha, the compassionate Bodhisatta Metteyya dwells (ibid). Furthermore the king will be the First disciple of the next Buddha, according to the Mahavamsa.

But to be charitable to Buddhism other  major  religions are equally guilty of preaching virtue of  peace but  waging  "Just War" or Holy War!

King Constantine and his heirs had to remake Jesus from a man of peace to a prince of war. They were aided in this remake by the vengeful Jewish God in the Old Testament.

In Bhagavat Geetha the Supreme  Lord Krishna is found coaxing Arjuna to wage war in the name of  Suya Dharma, that is the duty of a Shatriya to wage war.

Krishna promises:

‘Sarva dharmam, parityajya, maamekam sharanam vraja,
Aham twaa sarva paapebhyo, moksha yishyaami maa shuchah’

Which means:

Resign all duties and take refuge only in Me.
Grieve not, for I shall absolve you from all sins!

Plainly Supreme Lord  Krishna wants Arjuna to wage the war, Krishna does not wish that Arjuna ‘escape’ the situation. Krishna advises Arjuna to fight to the best of his capacity and surrender the results to the Lord. Then he promises Arjuna in the event he gets killed in the battle field he will go straight to heaven. If fortunately he wins the war  then the throne is his reward in this world! Either way he is a winner!

Islam  declares  Holy War against the infidels of the world and, that by killing an infidel, (which is a command to all Muslims) they are assured of a place in heaven.Who is by  definition  an infidel? All  'Non-believers!'

So Prof.Schalk,  it is a question of going round and round the mulberry bush! With regards

Sinhala speakers socially fail in moral responsibility: Peter Schalk

[TamilNet, Sunday, 15 November 2009, 13:05 GMT]
“We all know there will be no apologizing. It may come only when Lanka’s intellectual and political elite among Sinhala speakers faces its judges in an international war tribunal after an international (military) intervention by the UN or a cluster of states, or when the Lankan economy suffers a breakdown. We should not delay any effort to bring these criminals to justice. If they do not acknowledge any moral responsibility we can teach them legal accountability,” writes Professor Peter Schalk opining futility in expecting change and improvement for the Tamil people to come from the Sinhala society that is structurally not prepared by its mindset to accept responsibility and tactically considers pleading guilty is costly.

“What is the moral responsibility – not legal accountability - of Sinhala speakers for the Tamil speakers in the ongoing conflict” asking the question the academic says, “many – not all - firmly believe that the Government of Sri Lanka and its supporters among the people have no responsibility for the well documented disaster of civilians among Tamil speakers.”

“Questions of responsibilities of intellectuals have been put before in several other conflicts in this world and have to be put again, now with special reference to present intellectuals among Sinhala speakers,”

But Peter Schalk is sceptical justice would come from them: “Having this attitude of denial of guilt we cannot expect from these intellectuals an insight or recognition of failure, especially not at present when the leadership of the country still celebrates its triumph over terrorism (…) consequently there will be no change and improvement for the Tamil speakers.

Peter Schalk, professor of religious history whose areas of specialisation include Buddhism in Sri Lanka, considers the crisis is structural, shaped by “Mahavamsa mindset” and says “its most negative aspect, the evaluation that a war fought with the blessing of Buddhist monks in the name of the Buddha, is just, has to be highlighted by us again and again”

“We read on 19 October that the Sri Lanka President lays foundation for first of nine stupas to mark war victory, accompanied by a picture,” Peter Schalk writes, continuing, “The Buddha’s name is here exploited to justify the war in the island whose nine provinces shall be sealed as parts of the island of the dhamma. Mahinda Rajapakse completes what Dutthagamani has started more than 2000 years ago. Just-war-theory is, however, an aberration of the teaching of the Buddha. He grieves today at his lost Lankan disciples.”

The academic in his article also draws attention to a shrewd and tactical stand of the Sinhala nation: “There is an important obstacle to plead guilty of specified crimes: It is regularly followed by demands of compensation by the victims. To plead guilty is costly.”

Full text of the article by Prof. Peter Schalk follows:

On the Moral Responsibility of Sinhala Speakers

What is the moral responsibility – not legal accountability - of Sinhala speakers for the Tamil speakers in the ongoing conflict? I am aware that this question is provocative and incomprehensible to leading intellectuals among Sinhala speakers. Many – not all - firmly believe that the Government of Sri Lanka and its supporters among the people have no responsibility for the well documented disaster of civilians among Tamil speakers. All responsibility lies with the LTTE. The Government’s use of violence is allegedly justified being a war for peace.

Questions of responsibilities of intellectuals have been put before in several other conflicts in this world and have to be put again, now with special reference to present intellectuals among Sinhala speakers. The same question has to be put to intellectuals among Tamil speakers and to Western intellectuals, diplomats and politicians who have been involved in the conflict in Sri Lanka. Here I only focus on intellectuals among Sinhala speakers.

We cannot expect to find a Jean Paul Sartre, a Noam Chomsky or a Karl Popper among them, but are there at least smaller copies of these within the island? Where do find among Sinhala speakers a courageous intellectual of the calibre of a Willy Brand, one who repeats Willy Brandt’s Warsaw genuflection from 1970? Has any religious body among Sinhala speakers confessed complicity with the war crimes of the Lankan Governments? In 1945 the Confessing Church of Germany pleaded guilty of complicity with the war crimes of the Nazi Government (=”Stuttgarter Schuldbekenntnis”).

True, among Sinhala speakers we find a small group of dissidents. There is the dissident who has gone into internal emigration: he is oppositional, but keeps his criticism for himself out of fear. His fear is justified facing the iron fist of the Government. There are also those who stand up for human rights and therefore are persecuted, imprisoned, tortured and murdered. Their names fill a long list. Many of them have to choose outer emigration, away from their beloved Lanka where they cannot continue their opposition. I want to mention especially journalists having given convincing evidence of the human rights violations and war crimes of the Sri Lankan Armed Forces. Their fate is well-documented by ) Journalists for Democracy in Sri Lanka. They deserve all our support during their stay in exile.

Dissidence in Lanka has emigrated, internally or externally. There is in the island among some Sinhala intellectuals a strong and long tradition of ideological historiography that functions as an interpretative device on actual events, as a guiding lamp on the history of the island. Much has been written on the Mahavamsa “mind-set” expressing itself today in haughtiness and obstinacy by intellectuals and politicians as response to criticism. This mindset is of course not an autonomous actor, a Hegelian Geist that creates and maintains itself by its own force. It is constructed, upheld, developed, manipulated and transmitted from generation to generation by intellectuals and politicians whenever they considered the interests of the Sinhala speakers to be endangered. Its most negative aspect, the evaluation that a war fought with the blessing of Buddhist monks in the name of the Buddha, is just, has to be highlighted by us again and again. Just-war-theory dominates the mind-set of intellectuals and politicians among Sinhala speakers. It appears in a traditional Sinhala-Buddhist form retrieved continuously from the Mahavamsa, chapter 25, but also in a contemporary modern form that links the present war with the preceding pax americana of the Bush administration. It justified war as a war against terrorism, as a kind of crusade for peace. Both forms alternate or appear together in the process and context of war mongering.

Having this attitude of denial of guilt we cannot expect from these intellectuals an insight or recognition of failure, especially not at present when the leadership of the country still celebrates its triumph over terrorism. Without insight of guilt there will be no shame. There will be no politics of regret. Consequently there will be no change and improvement for the Tamil speakers. Reconciliation is based on an insight of guilt, shame, and regret. How often have I heard violations of human rights being excused by reference to the other side that also violates human rights! German human rights activist today criticising the Lankan Government are reminded of the Nazi past of their grandfathers as if that would pardon Lankan perpetrators’ war crimes.

In the case of Germany and Japan, a military defeat was needed, also the summoning of an international court of war crimes, and an intensive re-education of civilians to make German and Japanese civilians conscious of their war crimes. Without the support of civilians the German and Japanese Governments’ regular armed forces would not have been able to perform mass murders on civilian Jews and Chinese. The same is the case in Lanka where civilians cannot blame politicians and intellectuals only for their crimes against humanity. These politicians and intellectuals are elected by a majority of civilians and they acted in concord with their voters. They demonstrated in open and democratic elections their just-war-theory as motive and legitimisation for their actions.

One SLFP-leader has admitted complicity in the burning of the library in Yalppanam, but only to blame the UNP as perpetrator. Some politicians among Sinhala speakers have admitted that Tamil speakers have just grievances, but these are cleverly never specified. This confessing is of course no genuine realisation of guilt. There is an important obstacle to plead guilty of specified crimes: It is regularly followed by demands of compensation by the victims. To plead guilty is costly.

The patience of the world with the present Lankan regime is cooping out, but knowing its constructed, re-constructed and modernised mindset I do not expect a public performance by the President apologizing and admitting guilt of violations of human rights and of war crimes against Tamil speakers. If it happens it would be a new way of demonstrating Sinhala-Buddhist heroism including of course the preparedness to pay compensation to the victims.

We all know there will be no apologizing. It may come only when Lanka’s intellectual and political elite among Sinhala speakers faces its judges in an international war tribunal after an international (military) intervention by the UN or a cluster of states, or when the Lankan economy suffers a break-down. We should not delay any effort to bring these criminals to justice. If they do not acknowledge any moral responsibility we can teach them legal accountability. All they have said and done in public is recorded and can be used against them. A Government that lets children rotten away in concentration camps has lost its moral integrity. A de-sinhalatva-fication on all social levels is needful starting with teachers in day care centres and elementary schools. It should be made clear on all stages that just-war-theory which is brought to dominate the mindset of the present Sri Lankan Government is part of war mongering.

We read on 19 October: “Sri Lanka President lays foundation for first of nine stupas to mark war victory”, accompanied by a picture (see below). The Buddha’s name is here exploited to justify the war in the island whose nine provinces shall be sealed as parts of the island of the dhamma. Mahinda Rajapakse completes what Dutthagamani has started more than 2000 years ago. Just-war-theory is, however, an aberration of the teaching of the Buddha. He grieves today at his lost Lankan disciples.

Dear Stewart Bell

I am not surprised at all that National Post, the flagship of rightwing Conservatives and anti-Thamil crusader is in trouble financially. What is surprising is that it survived all these years despite losing millions of dollars annually.

The National Post  displayed extreme manifestation of antipathy  in demonizing the Thamil Canadian Thamils as terrorists and carried out a ceaseless and virulent campaign calling for the ban of the LTTE/WTM. The editorial board committed singular stupidity by going to the extent of meeting the Minister of Justice to press for punitive action against the LTTE/WTM.   You went to the extent of accusing the LTTE of raising funds through prostitution – an all time low in yellow journalism.

Our repeated pleas that we are not terrorists, we are victims of state terrorism and the war unleashed by the racist Sri Lankan government against the Thamils under the charade of fighting "terrorism" was a subterfuge fell on deaf ears.

If you had even an ounce of milk of kindness, a fair sense of justice, you would have stood with the oppressed and not collaborated with the oppressor! You would have taken to task Sri Lankan regime’s imperviousness to human rights violations and the culture of impunity!

Today's turn of events - the imprisonment of 300,000 Thamils behind barbed wires like cattle - is clear proof that the war was not against the LTTE, but against the Thamil people. The Sri Lankan government while holding 300,000 people (50, 000 children) is hell bent on settling Sinhalese in Thamil's traditional homeland. The government wants to colonize the North with 30% Sinhalese, a move to nullify Thamil people’s claim to homeland and force Sinhalese hegemony down their throats!

Steward Bell was rewarded for his crusade against the LTTE by the Sri Lankan government with red carpet welcome and VIP status. He was allowed to visit "prohibited zones" in army occupied North Ceylon, a privilege denied to other media personnel.

To be charitable there was some change of  heart and a change of mind there was no fundemental course correction.   The damage has been done beyond repairs.  The right-wing ideology and arrogance of the newspaper got the better of it.

More than 50% of the GTA population being Non-English, it makes business sense not to make enemies of them.  But the National Post driven by ultra- conservatism just did that. With regards.

Yours truly,

V.Thangavelu

Global TV, National Post seek creditor protection

Madhavi Acharya-Tom Yew Business Reporter

nwest Global Communications Corp. is seeking creditor protection for some of its business units. A woman is seen leaving the National Post building on Tuesday, Oct. 6, 2009.

CARLOS OSARIO/TORONTO STAR

Canwest Global Communications Corp. said this morning that it would seek court protection from creditors for the National Post newspaper and Global Television as it attempts to restructure its debt.

The Winnipeg-based broadcaster and publisher said its voluntarily filing under the Companies' Creditors Arrangement Act would give it four to six months of "stability" as it reorganizes.

"Throughout this process, all our operations will continue uninterrupted, including a strong programming lineup on Global and our specialty channels," president and chief executive officer Leonard Asper said in a statement posted on the company website.

"Our business operations remain strong and our stable of media brands continue to lead their markets."

The filing does not include the specialty TV channels Canwest bought from Alliance Atlantis in 2007, or its other daily newspapers and websites.

During the restructuring, Canwest will have access to about $65 million in cash, following the recent sale of some assets, as well as debtor-in-possession financing of up to $100 million "to enable its business units to meet their obligations to employees and suppliers of goods and services provided after the filing date," the company said.

Under the proposal, a small group of bondholders would receive common shares of the restructured Canwest, and current shareholders would own just 2.3 per cent of the shares of the new company.

Asper and other members of Canwest's founding family have agreed to invest up to $15 million in the restructured company, which would also need at least $65 million in new equity financing.

Canwest didn't say how much voting control or operational involvement the Aspers would have after the restructuring.

The company will seek its creditors' approval for the restructuring deal at a meeting to be held this year.

The deal would also need approval of the Canadian Radio-television and Telecommunications Commission and the Toronto Stock Exchange, as well as the court.

"The creditor protection clearly signifies that the capital structure was inappropriate for the company," said Chris Diceman, a senior vice-president at the credit rating agency DBRS.

"This is the first step to recapitalizing the company and if they get a recapitalization agreement, say, at Canwest LP (the newspaper division), you could see those businesses held by new owners."

Canwest has been selling assets to show lenders that it's making progress on reworking its operations. Most recently, it sold its majority stake in Australian broadcaster Ten Network Holdings.

"Along that same theme, you're starting to see possibly some unbundling...of this media conglomerate," Diceman said.

In response to the announcement, which came before markets opened this morning, Canwest's shares were suspended from trading today by the Toronto Stock Exchange, which has placed the stock under review for possible delisting.

Dear All

The greatest obstacle to the mobilization of the Thamil Canadians politically is the listing of both the LTTE and the WTM.  While the Liberal Party successfully resisted the temptation to list the LTTE, Harper's government went ahead to list the LTTE within 4 months of assuming office. It also listed the WTM which is a community based organization. These listings have demonized the Thamil Canadian community to the extent of even the new leader of the Liberal Party Mr. Michael Ignatieff  refused to address rallies organized by the Thamil community on the pretext that protesters were holding the Tiger national flag. This is all the more regrettable when the RCMP after consulting their lawyers stated that the holding of the flags is "not illegal."

Harper's government obsessed with fighting "terrorism" banned the LTTE/WTM not knowing that they are not like the religiously fanatical  Al Qaeda styled armed group fighting a reactionary war.

Harper's government fight against terrorism was ruthlessly exploited by the Sri Lankan government to wage a genocidal war against  the Thamils under the guise of fighting Thamil "terrorism." Rajapakse used the listing of the LTTE and the WTM  with deadly effect  in describing the war against the LTTE as war against terrorism.  Harper's government little realised that the Sri Lankan government fought a genocidal war against the Thamils taking cover under the "terrorist" slogan.

Only now it appears that Conservative Ministers and MPs are unashamedly complaining that "dealing with the often stubborn, Colombo government, has not been an easy task"   after literally feeding a poisonous snake with milk.   After all Sri Lanka is not a mini super power. It is a banana republic going with begging bowl around the globe. Ironically, Harper’s government voted in favour of a whopping 2.6 billion IMF loan to Sri Lanka. In sanctioning the loan the government broke ranks with US, France and UK which abstained from voting.

Aiyah

A cruel, unfair and unreasonable comment – undignified, disrespectful, callous, judgmental and absolutely uncalled for.

I have desisted from writing or for that matter responding to comments of any nature connected to our struggle ever since the earth shattering events in Thamil Eelam but feel a compulsion to comment on this nasty one by a so called ‘Illam Paravai’ .

Why is this person unwontedly chastising a group of devotees and belittling their faith in God?

Shouldn’t he be taking some responsibility for our sorry plight rather than pass judgment on others? Notwithstanding the exploitation of the faithful and the marketing of religion I do not agree with him when he seems to insinuate and blame all ills on God! God hasn’t harmed our people – what happened since ’56 and what is happening now is a case of man’s inhumanity to man – God is neutral or for that matter apolitical – it’s our actions past and present that have got us into this mess.

In fact to tell you the truth I have lost faith in human beings whether black or white to resolve our issues and emancipate our motherland…..

Please pass this comment to the author.

Free the over 280,000 Thamil civilians are locked up in open prisons-Appeal to Mrs. Nirupama Rao by Thamil Creative Writers Association, Cananda : As you are aware the Rajapakse government claimed that the war against the LTTE is not a war against the Thamil people. The dominant feeling of insecurity has multiple origins and arises partly from the collapse of responsible and accountable governance and the undermining rule of law. For example, the lawyers who appeared for the late Lasantha Wickrematunga, Chief Editor of Sunday Leader, were described as "black coated terrorists" and their photographs published in the Defence Ministry web site to put firght into  them!

The international community, including India for geo-political interests, fell for Mahinda Rajapakse’s Goebbelsian style propaganda hook, line and sinker. India has spoon fed a poisonous snake in the form of  Mahinda Rajapakse.  Very soon the chickens will return home to roost. The Indian government is guilty of aiding and abetting the military invasion and occupation of Thamil Homeland.

Meanwhile, India is going ahead with the construction of a coal fired Thermal plant in Sampur after chasing villagers out of their homes. Sampur has been declared a High Security Zone, out of bounds for civilians. The SEZ consists of a land area of 675 sq. kms (260.5 sq.mls) that would effectively prevent Thamils who fled Muthur East and Sampur in 2006 returning to their homes. Over 6000 Thamils are affected as a result of the HSZ. This is ethnic cleansing by decree!

It is morally and  ethically wrong for India to build the  coal power plant in Sampur, the site originally proposed by Sri Lanka , in joint venture  with  Ceylon Electricy Board.  In May this year the Ceylon Electricity Board (CEB) and India ’s National Thermal Power Corporation (NTPC) have signed an agreement to build the coal power plant.  The proposed 500MW plant, estimated to cost US$500 million, is expected to be completed in 2012. Apparently, India is placing profits before human rights of Thamils.

The cruel fate of these people of Sampur, who are still waiting to claim their right to return and re-build their lives, makes clear that the Tamil people will not find the security and justice they seek under this current administration which has blatantly disregarded their rights, wishes and needs.

I am appealing to you to address the concerns of the IDPs and take concrete action to free them from the torture camps and settle them in their original homes.

Members of the Thamil-Canadian Community Met with Conservative Ministers and MPs

Dear Hon. Paul Calandra,

Thanks for sending the  press release dated 14th September, 2009 to our attention.

We welcome your initiative to talk to Members of the Thamil Community to facilitate an open dialogue between Thamil-Canadians and their MPs regarding the humanitarian situation in the aftermath of the war in Sri Lanka.

Hon. Minister Oda after observing that “the living conditions in the camps were poor, and that there was a general lack of sensitivity towards the people living in them has said “there is a genuine effort from management within the camps as well as the distribution of basic necessities, such as food and water.” Unfortunately the reality on the ground does not confirm the rosy picture painted by the  Hon. Minister.

According to an eyewitness report in the Groundviews. org of July 02, 2009 “Water queue were seen everywhere. We saw a child scooping water from a filthy muddy drain and take it to their tent. Small buckets, hundreds would be kept in a line near a water source waiting for the water to arrive. There was dirty water running on both sides of the road where drains have been freshly cut. Flies are rampant and hygiene is a life-threatening issue. The flies are so infinite we saw merchants sitting inside make shift nets and selling things. Toilets were inadequate. In one camp we saw some of the tents having been removed and this area was being used as open defecating areas. On both sides of the road you could see human waste. We stopped the vehicle to take photographs but the stench was too overpowering for us to stay long. This was in close proximity to where people were staying but in a vacant area.

Unquestionably there is no freedom of movement at all to these IDPs. They are being kept like prisoners. Many of them have well to do children and relatives in other parts of the country with whom they can stay. Access is not given to NGOs to talk to the IDPs. You go in, give the food and get out. You are not even supposed to take your mobiles in or give the IDPs the use of it. There is an epidemic of chickenpox and hepatitis and other diseases in the camps.

Three of our colleagues who walked with open shoes working in the camps had various foot diseases. One had to have both his toe nails removed. The other had holes in his sole and is being treated. The third has a rash and infection which makes him walk with a limp. If this is the case with volunteers working in Manik farm you should be able to imagine the plight of the IDPs who don’t even have a pair of bathroom slippers to wear.

The other issue is the Militarisation of the camps. Camp management need to be handed over to the civil administration. When cutting of trees, moving tents or relocating tents the soldiers are standing with their guns and making the IDPs do the hard labour. This should be done voluntarily by the IDPs rather than making it look like bonded labour.

IDPs are in desperate need for change of clothes. People kept asking us especially girls for clothes. There has been distribution of clothes but hardly adequate. Children, pregnant mothers, lactating mothers, infants and the elderly need special care.  (Read the full report at http://www.groundviews.org/2009/07/02/an-eye-witness-account-of-idp-camp-conditions-in-sri-lanka/)

Daily  5 – 10  people are dying,  mostly children and elderly. This is due to disease, malnourishment etc. There are 35,000 children in the camps and out of which around 1,800 are orphans.

The legitimate aspirations of Tamils in Sri Lanka have been suppressed and their cry  has not been heard by the international community. You will agree that empowering the community is an important step towards achieving sustainable peace.

According to Amnesty International (AI) “these internally displaced persons’ camps remain overcrowded and unsanitary. Management of the camps is supervised

by the military..... “ AI has called for the unlocking of the camps and the release of all displaced people wishing to leave the camps and for the immediate cessation of arbitrary detention of internally displaced people.

There are still over 250,000 Thamil refugees arbitrarily  locked up behind barbed wires. The Northeast monsoon rains have commenced  and very soon the camps are going to be flooded. Sadly, the Sri Lankan government has no plans for any such eventuality.

Fears of inflammatory and inaccurate journalism, as defined and seen by the government, debar independent media from access to these camps even after the end of war.

There are  serious allegations of corruption and IDPs who cough out millions of rupees are let out by the Sinhala Army and the Police.

Under Secretary General for Political Affairs B Lynn Pascoe told a press conference in Colombo that the UN had not observed the progress expected in rehabilitating the IDPs after the end of the civil war between the Sri Lankan army and the Liberation Tigers of Tamil Eelam.

He said he was very concerned about the lack of freedom of movement for the inhabitants and the ‘closed nature’ of the camps and lack the basic right of freedom of movement.

Lynn Pascoe urged the Sri Lankan government to allow those IDPs, who have completed the screening process, to leave the camps. For the remaining IDPs, the UN official suggested that they be allowed to move out of the camps during the day and freely meet with family and friends in other sites.

On a cautionary note, the UN official added, 'As the situation currently stands in the camps, there is a real risk of breeding resentment that will undermine the prospects for political reconciliation in the future".

We also like to remind you that Sri Lanka has been under emergency rule for the entire length of the war, with only one five-month gap.  It is under these draconian regulations veteran journalist and columnist J.S. Tissainayagam was sentenced to 20 years of rigorous imprisonment. The court made a determination that his column, which was a mere expression of opinion on the government strategy in the war against terror was intended to cause racial or communal disharmony. This is a highly ridiculous claim which has raised concerns across the world on the state of  media freedom in the country.

Therefore, we are not surprised  when  you say that “The Government of Canada acknowledges that the events which have unfolded this past year were extremely tragic. However,  the Canadian Government has admitted that dealing with the often stubborn, Colombo has not been an easy task.” This is because Government of Canada is partly responsible for this “tragic” end of colossal proportions.  And unashamedly,  your government  voted in favour of  2.6 billion IMF loan to Sri Lanka after breaking  ranks with US, France and UK which abstained from voting.

The Government  by banning the LTTE in April, 2006 and the WTM in June, 2008 gave a free hand to the Sinhala-Buddhist extremist government to escalate its military operations taking refuge under the subterfuge of fighting “terrorism.”  In this respect the Western democracies failed miserably to understand the nature of the armed struggle and the genocidal intention of a government which believed  in  Sinhala-Buddhist  superiority and xenophobia. The international community was taken for a ride by the racist Sri Lankan government and their hands are now soaked with the blood of the innocent Thamil civilians.  They are  clueless how to put the rogue  genie back into the bottle.

Unless the Government of Canada delist the LTTE/WTM there is no political space  for any meaningful dialogue between the Thamil Community and the Government. The listing of LTTE/WTM has demonized the Thamil community and had alienated them from the current  regime.

The de-listing the LTTE/WTM is a condition for any rapprochement with the Government. This exercise should not pose any problem since the LTTE has been militarily defeated and  has given up  the armed struggle.

“No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.”

— Article 5, The Universal Declaration of Human Rights “Your worst humiliation is only someone else’s momentary entertainment.”

Yours truly,

The Arrest, Trial and Conviction Of J.S. Tissanayagam Is A Racially Motivated Revenge Act

(Nakkeeran)

THE  sentencing of J.S.Tissanayagam, editor of the North Eastern  Monthly,  for 20 years hard labour by a Sinhala judge  after being convicted for  using racially divisive language under the country’s tough anti-terrorism laws comes as little or no surprise to us. He was further charged of having taken money from the LTTE to operate a website providing the Thamil version of facts about the civil war, His main crime was to write 2 articles in the now-defunct Northeastern  journal  in 2006 and 2007 criticizing the Sri Lankan persecution of the Thamils who were seeking an independent homeland.

In fact Tissanayagam is extremely lucky he is still alive unlike many of his colleagues who have paid the price of media freedom with their own lives.

The arrest, trial and conviction of Tissanayagam is racially a racially motivated revenge act and confirms the widely held belief that Sri Lanka is one of the world’s most dangerous countries for independent journalists.

According to Amnesty International and the Asian Human Rights Commission Tissanayagam’s evidence that he purportedly co-operated with the LTTE was fabricated and that the criminal charges against him were trumped up in order to silence his anti-government views.

Sri Lanka has an abysmal record regarding press freedom. The International Committee to Protect Journalists (ICPJ) ranks only Iran, Sierra Leone, Somalia and Colombia as worse in their mistreatment of reporters.

Since Mahinda Rajapakse’s elevation as president 27 journalists and media workers have been killed in cold blood.  Out of those three were Sinhalese, one Muslim and 23 Thamils.

Well known Defence Analyst Dharmaratnam Sivaram was abducted by 4 men in a white van in front of the Bambalapitya police station in Colombo on April 29, 2005. Later his body was found near the parliamentary complex within a high security zone.

The Editor in Chief of the Sunday Leader and one of Sri Lanka’s best known journalists Lasantha Wickremetunge was murdered by gunmen on motorcycles in broad daylight on January 09, 2009 en route to work. The murder of Lasantha came just two days after the arson attack against private TV broadcaster MBC / MTV networks that destroyed their Main Control Room and studios worth millions.

In all these murders there were few arrests and no convictions in a court of law. Understandably the accused fingers were pointed towards top elite of the government, especially Defence Secretary Gotabhaya.

However, Rajapakse government points to some mysterious armed force hell bent on discrediting the government. It has done what it does best – expressed outrage, ordered a full investigation and appointed a committee to investigate the attacks.

If there are mysterious armed groups on the loose wantonly murdering journalists and vandalising private and independent media establishments, one must ask why the Government has done to protect the freedom of expression and media freedom from such armed groups?

The Rajapakse brothers are virtual dictators who have displayed scant   regard or tolerance for criticism against their policies, practices, statements and beliefs. The conviction of Tissanayagam confirms fears of planned terror campaign against critical voices, conducted without pause and in complete impunity.

If Tissanayagam is  sentenced for 20 years hard labour  for using racially divisive language under the country’s Anti-Terrorism law,  how many years should  a racist and brutish Lt. General Sarath Fonseka  should be put behind the bars  for saying  publically  that Sri Lanka ‘belongs’ to the majority Sinhalese?

Sarath Fonseka told the National Post “I strongly believe that this country belongs to the Sinhalese but there are minority communities and we treat them like our people...We being the majority of the country, 75%, we will never give in and we have the right to protect this country...We are also a strong nation ... They can live in this country with us. But they must not try to, under the pretext of being a minority, demand undue things." His interview to the National Post of Canada on September 23, 2008 remains un-contradicted.

To be charitable to Sarath Fonseka, J.R. Jayewardene referring to the 1983 racial pogrom vomited undisguised racism. He said -

“But I cannot see, and my Government cannot see, any other way by which we can appease the natural desire and request of the Sinhala people to prevent the country being divided, and to see that those who speak for division are not able to do so legally." (Quoted in Lawasia Report 'Democracy in Peril - Sri Lanka, a Country in Crisis' by Patricia Hyndman, 7 June 1985)

Tissanayagam conviction is not the beginning but the culmination of years of racist discrimination, ethnic cleansing, suppression and a brutal war that claimed the lives of over 100,000 Thamils.

Those who claim they are fighting “War against Terrorism” should themselves scrupulously respect the norms and values of democracy, human rights of which the tolerance of criticism is a fundamental facet. Those who resort to egregious violence are enemies of democracy and become terrorists themselves.

The International media rights groups have rightly accused the government has used emergency laws to silence public criticism of its conduct and has failed to investigate violent attacks – and killings – of journalists. They have opined that we may as well write the obituary for media freedom and the freedom of expression in Sri Lanka.

"The imposition of this extremely severe sentence on Tissainayagam suggests that some Sri Lanka judges confuse justice with revenge," says Reporters Without Borders, adding that it is “appalled" by the sentence.

As reported by  The Economist “Sri Lanka has failed to honour important human-rights commitments, and is ineligible for GSP Plus. Widespread police torture, abductions of journalists, politicised courts and un-investigated disappearances have all played a part in creating a state of “complete or virtually complete impunity in Sri Lanka.”

This is why we say the conviction of Tissanayagam on some ludicrous charges under the Prevention of Terrorism Act (PTA) was no surprise.

Tissanayagam criticized Mahinda Rajapakse’s government of using food, medicine and other essential items as weapons of war.  He also accused the Sinhala armed forces of carrying out extrajudicial executions -- murdering civilian Thamils as a warning to Thamils not to support the LTTE.

The Sri Lankan government stoked fears of terrorism to provide a pretext for draconian anti-terrorism laws and regulations. It uses  the  PREVENTION OF  TERRORISM ACT  (PTA) and the armed forces  as  instruments  of  STATE TERROR to cow down the Thamils at the point of  the gun and keep them  in chains. Even after the recent military victory - abduction, detention, disappearances, collective punishment, extra-judicial executions and the systematic use of torture by the armed forces continues unabated.

The political system of Sri Lanka since 1948 has failed the Thamil people and is rotten to the core. It has been infected by the virus of racism. Now the virus has spread to the judicial system as well.

The judgment by the Supreme Court on the demerger of North and East provinces was a classic case where racism got the better of jurisprudence.  Addressing a gathering in Trincomalee on   June 07, 2009   the former Chief Justice Sarath N.  Silva claimed   he carefully studied the Sinhala heritage in the provinces before delivering the judgment.

We blame the Western countries, notably US which by banning the LTTE and providing arms, intelligence, surveillance etc gave the Rajapakse government green light to decimate the Thamils guilty of aiding and abetting a rogue state. Rajapakse simply exploited the cynical cry of “War against terrorism” to defeat the LTTE, impose Sinhala hegemony and subjugate the Thamil race.

Canadian government voted to give a whopping US2.6 billion (690 million more than the amount asked) to a government that is accused of committing war crimes and crimes against humanity.

Hitherto the international community demonized the LTTE which fought a liberation war that mirrored Thamil aspiration as a “terrorist organization” engaged in suicide bombings, child soldiers, human shields and "terrorism". Such conditions no longer exist according to the Sri Lankan government's own proclamations. Now the international community has no excuses to stand by and watch the continuing   violence of genocidal proportions against an entire people. The New York Times in an editorial said "The time for silence is over. The best way to help the Thamils is by demanding their freedom and an end to their long ordeal.”

The vanity, avarice and arrogance demonstrated by the Sinhala rulers with a servile media are mind boggling.

We repeat the charge that the arrest, detention, trial and conviction of Tissanayagam are racially motivated.  Based on our past experience we realise the futility of appealing or pleading with the international community and lame duck UNO, UNHRC for justice and fairness.

Unless the international community displays political will to see the true nature of the Sri Lankan polity where racism has infected the entire political and judicial system there is no hope for peace, stability and security.

The Declaration of US Independence states rather pompously “We hold these truths to be as self-evident that all men are created equal” but who is listening? Karl Marx put it, perhaps, not very differently: "Philosophers have interpreted the world, the point however, is to change it.”  (Thamil Samkam)

The editor
Toronto Star
Toronto

Dear Sir,

This refers to your editorial "Ottawa's shameful `imposter'" that appeared in today's Tor Star.

The   conduct of the Minister for Foreign Affairs Lawrence Cannon and Canadian diplomatic staff in Nairobi is not only "a national scandal" it is also outrageous and malicious.  This is a reflection of  majority of Canadian bureaucrats’ mindset that non-Whites are liars, terrorists, criminals and imposters per se! It reveals that unelected bureaucrats can make outrageous decisions against hapless and defenseless Canadian citizens born to lesser gods and who happened to be blacks. These bureaucrats function with complete contempt for the law, the constitution and the courts. Given the track record of the Canadian government the daunting reality is racism stares every Non-White in the face.

This was why Maher Arar was framed by the CSIS as a terrorist suspect, arrested in New York and sent to Syrian prison where he was tortured for 9 months till his release. Thereafter,  the CSIS tried its best to block the re-entry of  Arar on the grounds he posed a threat to national security.

The Arar affair ended in a fiasco and the government was forced to cough out 10.5 million dollars as damages and another 2 million as legal costs!

Apparently the Canadian government has learnt no lesson from Arar's fiasco. In Suaad Hagi Mohamud's case the Canadian diplomats  has not only  the temerity to tear her  passport, but added insult to injury by sending  her voided passport to Kenyan immigration authorities to help them prosecute her, which could have led to prison or expulsion to her native, war-torn Somalia. On the other hand a call to Immigration department in Canada would have cleared the air in no time. But the stone-headed bureaucrats had other ideas.

I accuse the Minister and his bureaucrats in Ottawa and Nairobi of practicing maked racism! Whether one likes it or not ugly racism has permeated most bureaucrats and politicians at all levels of government.

Yours truly,

Ottawa's shameful `imposter' case

August 12, 2009

After months of stonewalling, the Canadian government is finally bringing Suaad Hagi Mohamud's needless exile in Kenya to a close by preparing travel documents for her return home. For family and friends in Toronto's Somali community, that is a relief.

But it hardly lets Prime Minister Stephen Harper's government off the hook. The shameful handling of Mohamud's case by Ottawa is a national scandal. Canadians are wondering whether they face the same rough treatment if they run into trouble abroad.

Beginning with Foreign Affairs Minister Lawrence Cannon and Canadian High Commissioner to Kenya Ross Hynes, the authorities have some explaining to do.

This is a government, after all, that has proven only too willing to abandon citizens. Omar Khadr still faces trial before a tainted Guantanamo tribunal. Ottawa had to be ordered by the courts to repatriate Abousfian Abdelrazik from Sudan. And to seek clemency for Ronald Smith, a murderer who faces execution in the United States.

In Mohamud's case, she ran into trouble trying to return to Toronto on May 17, after visiting her mother. A Kenyan airport official stopped her for not looking like her four-year-old passport photo. That snag should have been easy enough to clear up.

Mohamud quickly presented a credible batch of documents to Canadian diplomats in Nairobi attesting to her Canadian citizenship and residency. They included an Ontario driver's licence, an Ontario Health Insurance Plan card, a citizenship certificate, a social insurance card, credit card, bank cards, a Humber River Regional Hospital card, a Shoppers Drug Mart card, a note from her Toronto employer, and a recent Toronto dry cleaning receipt. Given all this, Ottawa should have been able to confirm her citizenship within days at most.

Yet officials in the high commission rejected the documents, branding her an imposter. They sent her voided passport to Kenyan immigration authorities to help them prosecute her, which could have led to prison or expulsion to her native, wartorn Somalia.

Mohamud was forced to launch a legal battle to establish her citizenship, with support from the Somali community. Even then, it took Ottawa two months to finally agree, on July 22, to give her a conclusive DNA test, after it was found that her fingerprints weren't on record.

To the very end, officials seemed indifferent, if not hostile, as she languished abroad. "The individual has to be straightforward, has to let us know whether or not she is a Canadian citizen," Cannon said on July 24. "She's saying so, but there is no tangible proof ..." By that point Mohamud had produced documents and offered fingerprints, launched court action, filed affidavits and had lobbied for a DNA test. What more could Cannon expect from someone stranded abroad?

Yesterday the DNA results came in: a 99.99 per cent match with her young son Mohamed Hussein in Toronto. She is who she said she is. Once again, Ottawa looks callous, indifferent, inept.

On what "conclusive investigations" and hard evidence did Canada's diplomats in Nairobi base their judgment that Mohamud was an imposter? Why didn't she get the benefit of the doubt? Why did it take so long to establish her citizenship?

Instead of blaming the victim, Cannon should shoulder responsibility for this mess. And the Harper government owes it to all Canadians to spell out what will be done to ensure this doesn't happen again.

(Viduthalai editorial - August 05,2009)

Subject: Re-arming of the Disarmed?
Date: Sun, 19 Jul 2009 18:19:21 -0400

Dear Sathyamoorthy,

Since you have offered unsolicited advice to the Thamil Diaspora about "There can be no denying the ‘contributions’ that the Diaspora had made towards the war and the ‘contribution’ that the Diaspora can make towards peace " I just want to make a brief response.

All what the Thamil Diaspora wants is for the Thamil people to live in peace, security and dignity in their traditional areas of habitat. This has not been the case since independence.  A series of discriminatory laws  have reduced the Thamils to second class citizenship status. Therefore, your claim  "and return to the good old days of education and employment, peace and prosperity" is highly exaggerated!

You are out of touch with reality and lead a life like the frog in the well. The Sinhalese have  a  MASTER PLAN  to turn the country into a Sinhala - Buddhist  only state by eliminating the minority communities. This they are doing systematically through government sponsored Sinhala colonization and pogroms. They have succeeded in changing the demography of the east. Today the Thamils are a minority in the east. At the dawn of independence 68% of the population of the eastern province were Thamils as  compared to 4% Sinhalese. A near -majority Sinhalese district called Ampara was created in 1961. Two electoral districts (Seruwila and Digamaduwa) were created in the sixties and the seventies.

Now  the Sinhala racists have set their eyes on the North. No sooner the war is over, 2,000 Sinhalese are to be settled in Nedunkerny under the Manal Aru (Weli Oya) colonization scheme. This scheme was created right under the nose of the IPKF. It was one of the 6 demands by Thileepan when he went  on a death fast. (http://www.nakkeran.com/colonization3AA.htm)

Mahinda Rajapakse says there are no minorities in Sri Lanka. There are only patriots and traitors. He has also said that will be no asymmetrical devolution of power. What is given to the Thamils will also be given to the Sinhalese.

Mahinda Rajapakse has always reminded his constituency that he got elected by Sinhala -Buddhists and he will do only what the Sinhala - Buddhists want him to do! This is quite the opposite to what the situation is in India. In India the BJP which advocates Hindutuwa got a drubbing at the recent polls!

I live in Canada which as you know is a confederation. The understanding and amity  between the major communities English and French are beyond belief. Even the recent immigrant communities like Chinese, Blacks, Sikhs, Italians, Vietnamese, Thamils live in abolute equality and peace. If there is discrimination, it is not official. Laws don't discriminate people of any one ethnicity or religion.  The use of both the languages for official purposes is not a privilege. It is mandatory and a right. Recently I went by train to Montreal in Quebec province. When the train entered the Quebec province the announcements were made first in French and second in English. Just the reverse before the train entered Quebec. This shows the pains taken by the government to afford equal status to both official languages English and French at levels of government.

Of course a section of  the Quebec (French)  people wants separation. But the separatists lost the referendum not once but twice.

In 1998, Canada's Supreme Court ruled that a UNILATERAL  declaration of independence by Quebec would be illegal under the Canadian constitution and international law. At the same time, it said that the Canadian federal government and Canada's nine other provinces would be legally obligated to negotiate the terms of secession if a “clear majority” of Quebecers voted in favor of separation in a provincial referendum with a “clear question.”

All what the Thamils, both inside and outside Ceylon ask is the right of self-determination to decide their political destiny. This can be ascertained through a referendum.

After all  Kosovo  was carved out of Serbia for the minority Kosovo Muslims. Likewise, let the international community carve out Thamil Eelam out of Ceylon. Such a solution is good for the Thamils, but still better for the Sinhalese.

 Re-arming of the Disarmed?

APRC Chairman, Minister Tissa Vitharana’s caution against the possibility of the once-disarmed Tamil groups taking to militancy all over again if the Thirteenth Amendment was not implemented should be read in perspective. Of equal importance is his indication that the implementation of the Thirteenth Amendment was only an ‘interim solution’ for finding a political solution to the ethnic issue. Minister Vitharana is not the only one who has been talking about a theoretical possibility of revived Tamil militancy – though he may be the first senior Minister to say so. From the other side of the spectrum, pro-LTTE groups have been talking in a similar vein, about the immortality of the militant/terrorist organisation. Such talks are mostly in private, at least thus far since the end of the ethnic war.

There are also those who claim – and want the world to share their belief – that LTTE leader Prabhakaran, and/or his aide(s) are alive still, and are waiting to hit back at the Sri Lankan Government at an opportune moment. Post-war, however, LTTE remnants headed by the ubiquitous Kumaran Pathmanathan, better known as ‘KP’, and US-based lawyer Viswanathan Rudrakumaran have disavowed militant methods to achieve their ‘Tamil Eelam’ goal. This goal however seems to remain unaltered, though in the final stages of the war, ‘KP’ too had talked about a negotiated settlement, time and again.

Independent of this are military analysts and political observers, both from within Sri Lanka and outside, who feel that half-hearted attempts by the Colombo Government to address the genuine and legitimate political concerns and aspirations of the larger Tamil community could help revive militancy – if not in the immediate future. Some Governments, particularly in the West, too seem to share this view, whatever be their motives and whatever be the way in which they word their concern.

It is in this context again that the role of the Tamil polity nearer home and the Sri Lankan Tamil Diaspora the world over assumes equal significance. President Mahinda Rajapaksa is on record that he wants, for instance, the Tamil Nationalist Alliance (TNA) to help find a negotiated settlement.

The logic seems simple. Most other Tamil parties are either with the Government or are sympathetic to the Government, and have been part of the APRC process. Having stayed out of the mainstream national polity and left out of the APRC process, the TNA needs to be heard – and its views accommodated.

President Rajapaksa has also rieterated the need for arriving at a ‘Sinhala consensus’ on the other hand. Translated, it does not stop with the two mainline parties, namely, ruling SLFP and the Opposition UNP. The President has in his mind ‘Sinhala, Buddhist-nationalist’ parties like the JVP and the JHU, as well.

Where do they all get to meet? And is such a consensus of the kind at all possible? There have to be some give-and-take by all sides in any negotiations, if it is the kind of ‘home-grown’ solution that President Rajapaksa and others, including the JVP and JHU, have in mind – independent of external involvement or intervention of any kind.
The TNA needs to agree to such a possibility. So should the JVP and the JHU. For his part, President Rajapaksa should also concede the point that certain contentious issues could still be sorted out through negotiations. ‘Police powers’ for the Provinces under the Thirteenth Amendment is only one of them. Then, there is ‘Land’ and more basic issues, like the ‘unitary State’ and  ‘re-merger’.

Some of these issues may have become non-negotiable with the passage of time and attendant developments on the ground. Among these could also be sub-texts on which a give-and-take approach has to be adopted. That is what a negotiated settlement is all about – and that is what all stake-holders, and not just the Government and the TNA, should accept, for starters.

Having gone through the crises of the late Eighties, the JVP in particular owes to itself honest approach to addressing the genuine concerns of the Tamil community, and in ways the latter would be able to appreciate. It is no different in the case of the JHU. It was not around when a Buddhist monk reportedly shot Prime Minister S W R D Bandaranaike, but among its ranks could be the inheritors of a clergy that suffered a persecution complex not very long ago in the contemporary history of the Sri Lankan nation.

The JVP’s 27-point suggestions for a political solution should have been prima facie welcomed. So should be the recent TNA declaration that they would come up with their own set of proposals. They would have made great sense and greater contribution when the APRC was working on the issues and options.

The APRC, according to Minister Vitharana, is getting ready to submit a summary of its draft proposals to President Rajapaksa, on advice. For counter-proposals to be thrown up at this stage, could only delay the process at best, or deny its benefits to the nation, otherwise. The right course would be for the TNA and the JVP to comment on the APRC scheme and join the negotiations process, now or later.

The TNA needs to acknowledge the changed situation, whatever its arguments. So should the Tamil Diaspora. There can be no denying the ‘contributions’ that the Diaspora had made towards the war and the ‘contribution’ that the Diaspora can make towards peace. They need to relate to the ground realities, and not confer the baggage from their distant past from afar on the future generations left behind in Sri Lanka.

It used to be said – and also felt – about the LTTE that they entered negotiations with the sole aim of breaking it at an opportune time. That cannot be the case any more, not if anyone in his senses wants the larger Tamil community to outlive the horrors of the past years and months – and return to the good old days of education and employment, peace and prosperity!

It needs two to tango – and there is no meaning if either the Government or the TNA, the Sinhala polity or the larger Tamil society keeps complaining against one another. Even for such complaints to sound genuine and reasonable, they need to play out the way the LTTE did. But then the results of the LTTE’s play-way method of problem-solving are there for all to see, and learn from, too.

Please Cancel Sri Lanka's Cricket Tour to New Zealand

Dear Prime Minister,

We are very concerned   that Sri Lanka cricket team has been invited to play in New Zealand.

Though the ethnic war has ended the abyss between the Sinhala – Buddhists and Thamil Hindus has widened as never before.  When Sinhalese danced on the streets celebrating “victory” there was gloom and doom among Thamils. This makes a mockery of the claim by the GoSL that they launched “humanitarian operation” to “liberate” the Thamils from the clutches of the LTTE.

Human Rights violations continue at full force in Sri Lanka. Thousands of people are arbitrarily arrested, often tortured or ill treated. There are continued reports of abduction, detention, systematic use of torture, collective punishment, extra-judicial executions and forced "disappearances". The fate of thousands of disappeared people remains unknown.

Amnesty International has accused Sri Lankan government of never   seriously investigating human rights abuses allegedly committed during 25 years of civil war.  The bloody offensive against the rebels during the last phase of the war  left more than 20,000 civilians dead, according to the United Nations.

The vast majority of human rights violations are never investigated and those that are rarely end in conviction because hearings drag on, witnesses refuse to testify and in some cases even the prosecution does not show up.

The Sri Lankan  government has repeatedly brushed off calls for independent investigation claiming it would interfere with the country’s sovereignty,  in spite of a 23 May joint statement by the Sri Lankan President and United Nations Secretary-General Ban Ki-moon stating that: "The Government will take measures to address those grievances".

Meanwhile, the government has stripped the country’s human rights of its authority, local rights activists have been threatened, the U.N. has been obstructed and the press has been stifled.

The Special Commission appointed to investigate 15 massacres, including the 2006 execution-style slaying of 17 aid workers for the French organization Action against Hunger has been wound up before completion of its investigation. AI has accused   the government of interfering with investigations, by using bribes, threats and even murder to eliminate witnesses.

The most recent figures from the Northeast reveal that there are an astounding 25 IDPs camps in Vavuniya housing over 280,000 people. Jaffna has 12 camps and 11,064 people, Trincomalee has 2 camps and 6,642 people, and Mannar has 3 camps and 845 people.  In  Vavunia camps   IDPs  have been imprisoned behind barbed wire setup for displaced Thamils which are in fact “Internment camps”.

“Internment is the imprisonment or confinement, of people, usually in large groups, without trial.” The difference between an internment camp and jail is that in jail one is detained in lawful custody by the state because he/she is convicted of a crime or awaiting a trial, in contrast in an internment camp one is held in captivity without committing or even being convicted of any crime.

There is no freedom in these camps as the Sri Lankan military holds a tight surveillance on the civilians. They are denied adequate food, water, medical and toilet facilities Mothers are still struggling to obtain enough food for their infants

The constant battle for food and the sense of powerlessness under the military dictatorship have robbed the Thamil people their freedom, dignity and even their lives. There are reports of many deaths due to lack of medical care. Women are abducted and sexually abused by the military and their dignity stripped.

The government has denied or restricted access to these internment camps by journalists, INGOs, diplomats, UN staff and Opposition Members of Parliament.

In these circumstances we kindly urge you to cancel the Sri Lanka Cricket team from playing in New Zealand which will send a powerful message to Sri Lanka that it has to pay a price for violating human rights and rule of law and freedom.

Yours truly,

The Independence of Kosovo is a great threat to the International Community

Dear President and Prime Minister,

We wish to bring to your attention a news item that appeared in the official website of Sri Lankan Broadcasting Corporation (SLBC) claiming that Mahinda Rajapaksa has told President of Serbia “The independence of Kosovo is a great threat to the international community.” The President of Serbia in turn expressed his appreciation for Sri Lanka's support to Serbia on Kosovo issue. The news under the heading "Serbia appreciates Sri Lanka’s action during the Kosovo issue" reads as follows:

Thursday, 16 July 2009 22:16

Serbian President Boris Thatic has expressed his appreciation to Sri Lanka for its stance during the threat to sovereignty caused by the independence of Kosovo. The appreciation was made to President Mahinda Rajapaksa on the sidelines of the NAM summit. President Rajapaksa said Sri Lanka will continue to cooperate with Serbia considering the independence of Kosovo as a threat to international cooperation. He stated that the establishment of a separate state cannot be justified. The two leaders also discussed on trade and commercial activities between Sri Lanka and Serbia. (http://www.slbc.lk/index.php/component/content/article/1-latest-news/618-serbia-appreciates-sri-lankas-action-during-the-kosovo-issue-)

In response President of Serbia told Mahinda Rajapaksa that the issue of separation of Kosovo has been taken to the International Courts and there are 36 countries submitted their arguments to the courts. Both of them agreed that the world community consider the separation of Kosovo and the consequences by the separation. The two leaders also discussed on trade and commercial activities between Sri Lanka and Serbia.

We, therefore, caution both  the President and Prime Minister regarding the conspiracy hatched by Serbia  with Sri Lanka's support to undermine Kosovo's independence.

We are fully supportive of Kosovo's independence since Kosovo has many parallels with our demand for an independent Thamil Eelam. Thamil Eelam with   7,500 sq miles and a population of four million  has a  stronger case for seeking autonomy.

Moreover, the Thamils of the Sri Lanka’s north and east had given a mandate to create a separate state at the general elections held as way back in 1977 and had made that known to the international community.

With a separate language and culture and a distinct territorial homeland, Sri Lankan Thamils had all the attributes to constitute a nation state, but the Sri Lankan state continue to  suppress  and oppress them.

Yours truly

Dear Sir,

Ours is an organization consisting of writers, journalists and editors of print and electronic media in Toronto, Canada. The TCWA has been  registered as a non-profit organization under the laws of the Ontario provincial government.

We have multiple objectives, inter alia, to unite all creative writers  and Thamil activists world-wide:

          1)      To encourage renaissance and innovation in Thamil literature and language.

        2)       To safeguard the purity and tradition of Thamil language, arts, literature, social and culture.

        3)       To promote Thamil nationalism.

        4)       To conduct all Thamil weddings in Thamil.

        5)       To give cash prizes to parents who give their children pure Thamil names.

        6)       To make Thamil the language of worship in temples.

        7)       To observe the first day of the month of Thamil Thai (January) as Pongal Day,   Thamil New Year Day and the Birth Day of Saint Thiruvalluvar.

I am a qualified Accountant by profession, but have since retired from practice. As a Thamil activist myself and President of TCWA I have  known Mr. Nachimuthu Socrates for the last 16 years  as  President of Federation of Thamil Associations of North America (FeTNA).  This  is an umbrella organization consisting of several state based Thamil organizations committed to the advancement of Thamil language, culture and fine arts. Mr. Socrates is one of the pillars  of  FeTNA and was  actively involved for many years in  inviting several well known artists from Thamil Nadu to perform in North America.

Naturally, Mr. Socrates evinced keen interest in the political, social and cultural empowerment of fellow Thamils  living in the North and East of Sri Lanka. He gave moral support to their struggle for equal rights and freedoms. His interest in quite understandable given the fact both  Thamils in Thamil Nadu and Ceylon speak the same language, culture and commom umbilical code.

It is very unfortunate that his enthusiasm and interest for his fellow Thamils in distress  has  wittingly placed him at the wrong side of the law. His trial has caused considerable anguish and anxiety among the Tamil Diaspora. I am pretty sure any illegal behavior  on his part is very uncharacteristic and  not typical of Mr. Socrates given the fact he is a professional and a successful businessman.

It is our  hope that  while justice should takes its course, Mr. Socrates will be spared the ignominy of  a jail sentence that would cause irreparable damage to his reputation, his family, friends, business, employees, vendors and his colleagues.

Yours truly,

Tamil separatists hail Kosovo’s independence declaration

February 21st, 2008 - 11:00 am ICT by admin

(IANS) Separatist Sri Lankan Tamils have hailed the emergence of an independent Kosovo with Western support, saying it augurs well for the liberation of “oppressed” minorities like the Tamils of northeast Sri Lanka. Most Sri Lankans do not relish the prospect of their small island country breaking up on the prodding of powerful Western nations. But while radicals like the Janatha Vimukthi Permuna (JVP) would like the Mahinda Rajapaksa government to take a strong anti-West stance, the liberals are urging restraint on the plea that belligerence will only provoke the West to side with the Tamil separatists when it comes to the crunch.

In its editorial, the Colombo-based radical Tamil daily Sudar Oli said it was not surprising that the Sri Lankan government was the first to condemn Kosovo’s unilateral declaration of independence (UDI) Sunday.

The paper pointed out that not only Sri Lanka but other nations that faced the prospect of oppressed minority groups seceding had also got the jitters and condemned Kosovo’s emergence as an independent state.

It was noteworthy that Kosovo’s UDI had the backing of the US and Europe, the paper said. It then went on to argue that Russia, Serbia and other nations opposed to the emergence of Kosovo as an independent country would not be able to prevent it.

“Kosovo’s independence is a historical necessity, an unavoidable event,” Sudar Oli asserted in the editorial.

Colombo, which dubbed the UDI as a grave threat, was aware that if Kosovo - with 4,200 sq miles and a population of two million - could be independent, ‘Tamil Eelam’ - with 7,500 sq miles and a population of four million - would have a stronger case for seeking autonomy, Sudar Oli said.

Moreover, the Tamils of the Sri Lanka’s north and east had declared independence as their goal way back in 1977 and had made that known to the international community.

With a separate language and culture and a distinct territorial homeland, Sri Lankan Tamils had all the attributes to constitute a nation state, but the Sri Lankan state had suppressed and oppressed them, the daily said.

It was not surprising that the Sri Lankan state was unable to digest the liberation of the people of Kosovo whose attributes and claims were similar to those of the Tamils of Sri Lanka, it added.

“Kosovo shows that the chains of oppression will not last and that some day, they will break,” the Tamil paper said.

Noting that powerful and rich nations like the US, were supporting Kosovo’s UDI, the liberal daily The Morning Leader said Kosovo was a “dangerous parallel” for Sri Lanka, a view shared by most Sri Lankans.

Even though the Western powers unequivocally declare that they stand for a united Sri Lanka with devolutionary powers granted to the minorities, these nations also criticize Sri Lanka severely for not delivering its promises on human rights, the paper said.

The UN too is displeased and has sent a special envoy to Sri Lanka to study the ground situation in the conflict-ridden country, it pointed out.

“Serbia serves as a good precedent on what happens to a country which falls foul of the Western powers, which are called the international community.

“The Western powers have dispensed with the time honoured laws and conventions regarding international relations of the Cold War era and are even willing to bypass the UN Charter if they wish to.

“Recognition of Kosovo, a part of Serbia, as a sovereign state is the latest example,” the Colombo-based weekly paper said.

Not even mighty Russia can prevent the independence of Kosovo short of going to war, the paper warned.

“Thus the Rajapaksa regime should take heed not to take on these nations, however much it might boost the macho Rajapaksa image, with rustic yokels.

“Placed in this situation, very delicate diplomacy is called for - not that of a Hambantota buffalo in a pottery shop variety,” the paper said.

“President Rajapaksa has shown that he is a Dale Carnegie, able to make friends and influence people. The president should exercise these talents in the field of diplomacy which would be enormously beneficial to the country,” The Morning Leader urged.

Sri Lanka dubs Kosovo independence a threat to security

February 18th, 2008 - 2:39 pm ICT by admin

Colombo, Feb 18 (IANS) Sri Lanka has opposed Kosovo’s unilateral declaration of independence from Serbia saying that it has set an unmanageable precedent and posed a grave threat to international security. “We note that the declaration of independence was made without the consent of the majority of the people of Serbia. The unilateral declaration of independence by Kosovo could set an unmanageable precedent in the conduct of international relations, the established global order of sovereign states and could thus pose a grave threat to international peace and security,” the foreign ministry said Sunday in a statement.

It said that the secession was a violation of the UN Charter, which enshrined the sovereignty and territorial integrity of member states. Furthermore, the UN Security Council Resolution 1244 of June 10, 1999 had reaffirmed the world body’s commitment to the sovereignty and territorial integrity of all states in the region.

“This action is particularly regrettable since all efforts at reaching a negotiated political settlement on the future status of Kosovo as envisaged by Resolution 1244 have not been exhausted,” the ministry said.

Russia and Serbia oppose Kosovo’s independence. The US, EU and France have come out in support.

Kosovo is an Albanian-Muslim majority enclave in largely Christian Serbia and has been fighting for independence since the former Yugoslavia broke up into ethnic units after the collapse of Communism.

Russia and Serbia are worried about the fate of the more than 100,000 Serbs in Kosovo. But Kosovo and the US say that there is no danger to them.

Sri Lanka is worried that a successful secessionist movement in Kosovo may result in the Liberation Tigers of Tamil Eelam (LTTE) succeeding in getting independence for the Tamil speaking north and east of Sri Lanka which Tamil separatists call “Eelam”. More than 70,000 people have died in the armed conflict over “Eelam” in the last two decades.

The fact that Western powers are supporting Kosovo’s independence is an added cause for Sri Lanka worry, because the West, led by the US, is urging Colombo to go slow on the war and talk peace with the LTTE.

The West has also been criticising Sri Lanka for violating human rights in the guise of fighting Tamil Tigers terrorism.

Sri Lankan political commentators are divided on what Colombo should do post-Kosovo.

Writing in the Sunday Leader, columnist Gamini Weerakoon feared that the anti-West stance of the Mahinda Rajapaksa government could prove to be counterproductive.

But Dayan Jayatilleke, the island’s envoy to the UN, has urged the government to stand firm and not to withdraw the armed forces from the north and east under pressure from the international community on any account.

He recalled that the leaders of Yugoslavia had committed a cardinal error by withdrawing government forces from Kosovo and allowing an international force to be stationed there.

Kosovo was put under a UN mandate. The West put Kosovo under tutelage for sometime and then “encouraged with a nod and a wink, to secede completely”, the diplomat wrote in the Sunday Island.

The silent suffering of Sri Lanka's Tamils

Dear Prime Minister,

I append below a write up by Roy Ratnavel  that appeared in the National Post  Published: Friday, July 17, 2009.

Regrettably,  your government compounded the ordeal of the Thamil people by banning the LTTE and the WTM under the cloak of

fighting "terrorism." But in effect the ban helped a racist and a fascist government to abandon peace talks, tear up the CFA, and launch a genocidal  war against the Thamil people with arms from China, Pakistan, Israel and India.  It is unfortunate that your government failed to understand  the racist nature of the Sri Lankan state and the armed struggle by the Thamils. Canada had no intention of  seeing the ethnic conflict politically resolved.

The rich and powerful nations too failed to come to the rescue of the Thamil people. These powerful nations also  under the charade of fighting terrorism provided arms to Sri Lanka to kill its own citizens.  The armed struggle by Thamils was not to capture state power, but to win back the  rights and freedoms  and dignity the Thamils lost since independence.

Now over 300,000 Thamils are behind barbed wires guarded by Sinhala army. They are begging for food, water, medicine and toilet facilities. Their basic freedom of movement has been denied to them. The internment casmps is still out of bounds for  journalists, NGOs and INGOs to provide relief to the people. It is worse than  life inside Nazi concentration camps.

Canada which rightly recognized Kosovo's independence stabbed the Thamils in the back without batting an eye lid. It is not too late for Canada to right the wrongs inflicted on the Thamil people.

Yours truly,

Veluppillai Thangavelu

Note from Nakkeeran  (15, July 2009)

Over 300,000 Thamils remain imprisoned in Vavuniya internment camps after they were "liberated" by launching a genocidal war under the guise of  "humanitarian operations" These unfortunate people lack adequate food, medicine, water, cloths and secure roof over their heads. Their internment is illegal and their freedom of movement has been denied.

Those food contracters who supplied meaks  have not been paid. They have gone to the courts claiming moneies due for supply food to the refugees. Apparently, the government has no money to settle their dues.

At the same time  Rajapakse government like the proverbial dog in the manger will not allow the NGOs or INGOs to look after the refugees. Their operations, including the ICRC, have been severely restricted. In the east the government has given the marching orders to the ICRC to wind-up operations.

Western countries continue to provide aid  for humanitarian assistance  mostly through INGOs. Canada has given  $7.5 million.  UK has just pledged  3 million pounds. This in addition to earlier funding.   The Kingdom of Saudi Arabia has delivered more than 100000 tons of humanitarian aid to Sri Lanka this week. The British Mercy Mission delivered 884 tons of food and medicine after the ship Captain Ali was sent from one port ot another.

In October 2008 DFID announced £2.5 million humanitarian assistance in Sri Lanka. This funding is broken down as follows:

  • £750,000 (International Committee of the Red Cross) – protection of civilians, emergency medical evacuations, treating wounded, providing shelter, water and sanitation.

  • £500,000 (United Nations High Commission for Refugees) – protection, provision of shelter for internally displaced people.

  • £250,000 (International Organisation of Migration) – providing humanitarian convoys into the Vanni.

  • £250,000 (World Food Programme) – transport and logistics support to transport food and other commodities into the Vanni.

  • £750,000 set aside for rapid response including setting up the UN-managed Sri Lanka Emergency Response Fund.

4. DFID contributes £1.5 million to a joint DFID/Ministry of Defence/Foreign and Commonwealth Office Peace Building Strategy and has provided £1.25 million over 2007-2008 in humanitarian assistance.

In 2009 the Federal Foreign Office, France  made 2.2 million euro  for humanitarian aid in Sri Lanka. The ICRC and German aid organizations have received resources to help internally displaced persons. Additionally, a German aid organization is running a project for flood victims in Jaffna.

In 2008 the Federal Foreign Office provided a total of 2.94 million euro for the protection and assistance of internally displaced persons and returnees. A large portion of these resources was allocated to the ICRC and various UN organizations.

India has pledged  100 million US dollars (500 million rupees) for development of North. US aid  is as follows:

FY 2008 AND FY 2009 USAID AND STATE HUMANITARIAN FUNDING TO DATE

USAID/OFDA Assistance to Sri Lanka ....................................................................$11,009,708

USAID/FFP2 Assistance to Sri Lanka ......................................................................$42,900,000

State/PRM3 Assistance to Sri Lanka4............. ...........................................................$1,990,000

State/PMWRA5Assistance to Sri Lanka......................................................................$2,079,322

Total USAID and State Humanitarian Assistance to Sri Lanka ....................................$57,979,030

On April 02, 2009 the U.S. Agency for International Development (USAID) has donated $15 million (Rs 1.7 billion) worth of vital food aid for Sri Lanka to the United Nations World Food Program (WFP). The food, consisting of wheat, lentils and vegetable oil, will be distributed to a large number of displaced and conflict-affected people in the northern and eastern parts of Sri Lanka. On

Since 1956, USAID/Sri Lanka has invested nearly $2 billion to benefit all the people of Sri Lanka.

On July 15, Colombo the Japanese Government has donated another humanitarian aid package of US $ 7.4 million for the benefit of the Internally Displaced Persons (IDPs) of Sri Lanka. The Japanese Embassy in Colombo announced today that this aid package was handed over to the Senior Presidential Advisor Basil Rajapaksa yesterday by the Japanese Ambassador to Sri Lanka Kunio Takahashi. The aid package comprises 6,300 metric tons of rice and 130 metric tons of canned fish, the Embassy said.

So the question  asked is why should Thamil Diaspora collect funds for the IDPs that also involves valuable foreign exchange needed by Sri Lanka. It will also  run counter to the campaign to boycott SL products. At the same time we should not punish our kith and kin for the stupidity of the Rajapakse's  government.

UK committed to help Sri Lanka: Mike Foster

The UK has committed to help rebuild the lives and livelihoods of the 284,000 Sri Lankans who were forced to flee their homes during the recent fighting.

International Development Minister Mike Foster allocated £3 million to help support the first stages of recovery from the conflict and prepare for displaced civilians to return home from the camps.

Conditions in the camps are improving, but are still basic. As humanitarian access has increased, aid agencies have been able to set up emergency health services and deliver urgently needed medicines and food.

However, there are reports of high levels of malnutrition, overcrowding and inadequate access to decent water and sanitation facilities. Civilians in the camps have still not been granted freedom of movement to leave the camps. When the civilians are able to return home, the UK’s commitment will help provide logistics, transport, emergency shelters and rebuild basic services for families returning home from the camps.

The funds will also help people recover their livelihoods by giving them the tools and training to restart their lives, such as through cash grants, providing seeds and tools and vocational training.

Even though fighting has stopped, there are still considerable risks for the thousands of civilians displaced by the conflict. Many areas were mined and unexploded ordnance and munitions will continue to pose a dangerous threat until they can be safely disposed of.

As part of the UK’s £3 million funding, DFID stands ready to support international humanitarian demining agencies in their work.

Mike Foster said ‘Hundreds of thousands of people still remain in camps two months after fighting stopped. Our funding will help make sure that people can return home as quickly as possible and start to rebuild their lives and livelihoods.

“The camps cannot be a long term solution. The Government of Sri Lanka must stick to its own commitment and return the vast majority of civilians within 180 days, including the interim option of staying with host families where necessary.

“We also encourage the Government of Sri Lanka to continue do everything possible to allow humanitarian agencies to operate effectively by making sure relief workers can access visas and lifting the restrictions imposed on entering the camps and the Medawachchiya checkpoint.”

The silent suffering of Sri Lanka's Tamils

Roy Ratnavel, National Post  Published: Friday, July 17, 2009

In May of this year, during the final stages of a brutal ethnic civil war between the Tamil Tigers and the Sri Lankan government, a so-called "humanitarian rescue" of civilians was undertaken by Sri Lanka's armed forces. More than 20,000 Tamil civilians trapped in the conflict zone were massacred.

Thousands of dead are children, and most of them died before they even knew that they were Tamils. Scores of people died in bunkers, or were burned alive and bombed in open spaces. People were also shot at close range by the Sri Lankan army. Sri Lanka had no qualms about using heavy weapons to bombard the very people it claimed to be rescuing. According to some reports, the army even used illegal chemical weapons.

The survivors -- many of them maimed and malnourished -- were sent to government-run Tamil "welfare villages," which for some proved to be extermination camps. For survivors, it seems there can be no closure, no dignity, no respect. Many remain effectively as prisoners -- cut off from the outside world and, in some cases, subjected to torture, summary execution and starvation. About 1,400 people are believed to be dying every week, and some girls and women have become pregnant due to rape. Even some of the doctors treating the sick and wounded in the conflict zone were not spared.

Through such acts, Sri Lankan President Mahinda Rajapaksa and his brother, Defence Minister Gotabaya Rajapaksa, joined the ranks of infamous national leaders who have resorted to slaughtering their own people. As with Slobodan Milosevic, the evidence demonstrates that they possess a murderous hatred toward a specific ethnic group.

The scale of the humanitarian tragedy in Sri Lanka is hard to fathom for us diaspora Tamils looking on from so many miles away. With the military offensive now over and the Tamils behind barbed wires, we would like to ask just one question: Is the world happy with the outcome?

Despite this grim scenario for Tamils, Sri Lanka's Sinhalese majority celebrated the war's end with fireworks and parties as if they'd just won a cricket championship -- hardly a sign that accommodation and reconciliation toward Tamils is in the offing.

We told the world, contrary to Sri Lankan government claims, that the safe zones would be anything but safe. But the world did not listen. Words uttered by the world in unison -- "never again" -- after similar horrors in Europe and Africa have proven to be mere words . Sri Lanka must be called to account for its actions . If that doesn't happen, then the world is responsible. As Holocaust survivor and Nobel laureate Elie Wiesel recently stated: "Wherever minorities are being persecuted we must raise our voices to protest. According to reliable sources, the Tamil people are being disenfranchised and victimized by the Sri Lanka authorities. This injustice must stop. The Tamil people must be allowed to live in peace and flourish in their homeland."

Tamil people deserve to be heard by the international community as the pendulum of oppression has clearly moved against them. We hope the world won't wait until the Museum of Human Rights curates a history of the persecution of Tamils to tell the their story. roy_ratnavel@ hotmail.com

Nakkeeran makes a lot of valid points. But IMHO "NYT editorial is the result of a
feeling of guilty consciousness," is a bit ???

NYT, simply didn't accept certain LTTE methods.

http://www.sangam.org/2009/07/Tamils_Languish.php?uid=3607

They could have waited much longer to write this editorial, after their recent article above by Lydia Polgreen. But they did it now. I wrote a Thank you note to NYT for that.

Sometimes its skeptical that these newspapers may support us if geo-politics dictate so. But nothing changed from their perspective in April - May to Now, they did recognize Tamil issue as "ethnic" but times are such since 9/11 they didint cant will not certain LTTE tactics..

We need to continue to do awareness and campaign Human rights violations, show the moral necessity that they have to support us....and not to abandon for some other geo political reason down the road.

Dear Editor,

Thank you highlighting the plight of Tamils.

Keeping Tamils in detention for the sake of ‘mine clearing’ is a blatant lie, just like the Government of Sri Lanka’s ‘humanitarian rescue operation’ that never considered any ‘human costs’ of such a mission.

The truth behind camps is that they are designed to destroy the Tamil community, characterized by long term displacement denial of livelihood and colonization to change demographics of their villages,  along with extrajudicial killings and disappearances.

The camps are the ‘brainchild’ of none other than US citizenship holding Senior Sri Lankan Defence official Gothabaya Rajapaksa, who is also a brother of Sri Lanka ’s President.

Not just during the last months of the war, he still decides the fate of Tamils detained in the camps. He has repeatedly given interviews to media justifying attacks on civilian areas and hospitals in violation of international laws.

It is also time to investigate the ‘criminal role’ being played by this Sri Lankan official with American citizenship.

Thank you

AS I SEE IT

News papers like the New York Times wholeheartedly supported the Sri Lankan government in what is popularly termed the "War  on Terror" a slogan credited to George W Bush. The NYT  typical of the mind-set of American ruling  elite saw the armed struggle as terrorism and the LTTE terrorists. They  refused to see the  armed conflict as an ethnic conflict. That Thamils were forced to take up arms to win their language and political rights. The "War on Terror" cry was cleverly exploited by the Sinhala government to justify the genocidal war against the Thamils. Even today the NYT accuses the LTTE saying "Tamil Tigers had no compunctions about using civilians as cannon fodder or forcibly conscripting men and children." But this newspaper does not want to admit the
fact that the people fled to LTTE controlled areas voluntararily when the Sinhala army advanced! Then or now the Thamil people never saw the Sinhala army
as "liberators", but an invading and occupation army.  If this is not the case Thamils who went into government controlled area after the defeat of the
LTTE should have celebrated their liberty. There was no CELEBRATION. No one, including the New York Times, has taken note of this fact.  New York Times and  Human Rights groups who made song and dance about  child soldiers are now  conspicuously silent  about the  children  slaughtered by the Sinhala army using heavy weapons. According to the UN Office for the Coordination of Humanitarian Affairs (OCHA), 279,208 IDPs remain
in 40 camps in the northern districts of Jaffna, Mannar, Trincomalee, and Vavuniya, nearly all of whom are residing in the Vavuniya District camps.
Of those, an approximate 120,000 are children, and an incredible 55,000 are estimated to be under 10 years of age.

NYT editorial claims that "Donor countries — including the United States, the European Union and Japan — as well as international aid organizations are helping provide food, shelter and clothing to the camps." This is an exaggerated claim since the government is not allowing access to most INGOs, including the ICRC to deliver aid.

This is how OCHA describes conditions in the camp. "Conditions in the camps remain poor, despite the commitment of and progress made by many local and international aid & relief agencies. Children in particular remain disproportionately at-risk with an estimated 44% severely malnourished. As many as 5,000 children had limbs amputated during the approximate 5-month ordeal from January through May 2009 on account of shelling and other attacks. As of July 9th, UNICEF had identified more than 2,000 vulnerable IDP children, including orphans, unaccompanied minors, and children separated from families. It is
believed approximately 1,000 of these children are now orphans.

I believe the NYT editorial is the result of a feeling of guilty consciousness. Having supported the Sri Lankan government military campaigns and having advised the people to  leave the LTTE controlled area go into government controlled area, it  now finds Thamil  people are treated shabbily as though they are children of lesser gods! A similar editorial titled "Tamils' plight' appeared in the Toronto Star (Juky 13, 2009) which  while  lamenting the fact that the Sri
Lankan government "has  made few efforts to end discriminatory laws that fuelled the Tigers' cause" and " in camps where food and medicine are in short
supply, and line-ups for water often measured in hours, bitterness is growing, and reconciliation has not begun" it made the tongue in cheek  claim the
same government  defeated  one of the biggest obstacles to peace!

The editor,
Toronto Star
Toronto.

Dear editor

Regarding your editorial “Tamils’ plight”  I wish to thank you for small mercies. However, there is a perception that Sri Lanka is a democracy because it has the trappings of such a political system like parliament, competing political parties, periodical elections  etc. The truth is what  you get in Sri Lanka is the tyranny of the majority Sinhalese against minority Thamils.

Please remember the military defeat of the LTTE is hollow and ephemeral. Any government could defeat terrorism if it ignored the 1949 Geneva Convention that aims to protect civilians caught in war zones. This is what the Sri Lankan government did in fact.

To understand Sri Lankan polity  you should know the mind-set of the Sri Lankan government. This mind-set has been clearly spelt about by no lesser person than army chief  Staff Sarath Fonseka. He told the National Post’s correspondent (September 23, 2008) that “I strongly believe that this country BELONGS TO THE SINHALESE but there are minority communities and we treat them like our people.  We being the majority of the country, 75%, we will never give in and we have the right to protect this country. We are also a strong nation. They can live in this country with us. But they must not try to, under the pretext of being a minority, demand undue things."

This is not the first time he has espoused such dangerous and ultra fascist Sinhala supremacist theory.  In an interview to the Daily News on July 19, 2008 he said "The Sinhala nation has to sacrifice if you want to protect the country and survive... In any democratic country the majority should rule the country. THIS COUNTRY WILL BE RULED BY THE SINHALESE COMMUNITY WHICH IS THE MAJORITY REPRESENTING 74 PERCENT OF THE POPULATION....

Many Sinhalese politicians have also subscribed to Sarath Fonseka’s   ethno-centric paradigm of majority domination of Thamils publicly. Minister of Environment, Champika Ranawaka of the extremist Jathika Hela Urumaya (JHU) opined that "the Sinhalese are the only organic race of Sri Lanka. Other communities are all visitors to the country, whose arrival was never challenged out of the compassion of Buddhists … What is happening today is pure ingratitude on the part of these visitors."

You will agree that no Canadian minister would have survived in his post if he dared to utter even a single word said by the Sinhalese Minister in public.  Or Canadian confederation would have survived if any Canadian Minister spoke the language of Champika Ranawaka. The country would have been broken into pieces long time ago. But in Sri Lanka such communal utterances are the norm and not the exception.

Therefore your insinuation “But after the defeat of one of the biggest obstacles to peace” is gross misrepresentation of the facts. It is the GoSL and not the LTTE that tore the Ceasefire Agreement and launched the all out war.

The Sri Lankan government cleverly exploited the cry of “War against Terrorism” to defeat the Thamil people's  fight for equal rights, dignity  and freedom. Toronto Star’s editor’s hands too are tainted by the blood shed by thousands of Thamils who died during the final phase of war.   It is, therefore,  little comfort that Toronto Star is now expressing concern about Thamils’ plight. In more than one sense you  are the cause of it by demonizing the LTTE as terrorists!

Yours truly,

The Tamils' plight The Star.com - Opinion

July 13, 2009

When Sri Lankan forces broke through Tamil Tiger lines two months ago and defeated the independence-seeking guerrillas, thousands of traumatized Tamils were grateful just to be alive. Trapped by the Tigers in a tiny coastal strip, and besieged by the Sri Lankan military, they had nowhere to run as bullets flew. The Sri Lankan government called the crushing of the Tigers a humanitarian rescue mission.

But after the defeat of one of the biggest obstacles to peace, the government may be creating new ones. Confined in camps with minimal aid and services and no certain date of discharge, some 300,000 Tamils are vulnerable to increasing alienation from Sri Lankan society – as well as violence and disease. While understandable, the Sri Lankan government's determination to weed out militants masquerading as displaced civilians has made it more difficult for innocent Tamils to return to normal life.

Among the Tamils are at least four Canadians with dual citizenship, as well as citizens of other Western countries. Canada has been trying, with limited success, to visit its nationals at the isolated camps, where media and human rights groups are barred.

The government has made it clear that it rules out a separate Tamil state and insists that Sri Lanka – with a mainly Sinhalese population and an 18 per cent Tamil minority – is a united country with citizenship for all. But it has made few efforts to end discriminatory laws that fuelled the Tigers' cause. Nor has it clarified the status of the camp-bound survivors, some of whom believe they are being subjected to collective punishment and fear their confinement will become long term.

In May, Sri Lanka pledged to resettle the majority of the internees within 180 days, a deadline President Mahinda Rajapaksa says is not a "promise" but a "target." He points out that removal of landmines and restoration of basic services must first be done to ensure the survivors' safe return and resettlement. But in camps where food and medicine are in short supply, and line-ups for water often measured in hours, bitterness is growing, and reconciliation has not begun. Will the government that won the war risk losing the peace?

US Ban on LTTE is One Sided and Biased

Dear Sir,

US which illegally invaded Iraq under false pretext and killed millions of Iraqis by bombing should not speak about “terrorism.” US has notoriety for double speak and double talk and sadly things have not changed even after President Barack Obama won the elections on the plank “Change.” Nothing has changed and it is business as usual judging from your web chat.

What you are trying to do as a bureaucrat is to white wash the war crimes committed by the Sri Lankan government because it is a state player but demonize and criminalize the LTTE because it is a non-state player.

You should read Ceylon’s history since independence in 1948 to understand why the LTTE took up arms in the first place. It took to arms as a last resort when peaceful means of protest failed. All non-violent protests by Thamils were met with brutal military force.

The recognition and legitimation of the people's right to resort to rebellion against tyranny is embodied in international human rights instruments. The Universal Declaration of Human Rights adopted by the United Nations General Assembly in 1948, in the third paragraph of the preamble, declares that it is essential that human rights should be protected by the rule of law, "if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression".

On the question of terrorism it is useful to quote  Democratic Presidential candidate Hilary Clinton’s comments  when she was asked by  Michael Tomasky of Britain’s ‘The Guardian’ (October 23, 2008) newspaper which covered Iraq.

When asked “Do you think that the terrorists hate us for our freedoms, or do you think they have specific geopolitical objectives?” she replied:

“The bottom line is, you can't lump all terrorists together. … what the Tamil Tigers are fighting for in Sri Lanka, or the Basque separatists in Spain or the insurgents in al-Anbar province may only be connected by tactics.

Well, I believe that terrorism is a tool that has been utilized throughout history to achieve certain objectives. Some have been ideological, others territorial. There are personality-driven terroristic objectives.

I mean, what the Tamil Tigers are fighting for in Sri Lanka, or the Basque separatists in Spain, or the insurgents in al-Anbar province may only be connected by tactics. They may not share all that much in terms of what is the philosophical or ideological underpinning. And I think one of our mistakes has been painting with such a broad brush, which has not been particularly helpful in understanding what it is we were up against when it comes to those who pursue terrorism for whichever ends they're seeking.”

Characterizing the conflict in Sri Lanka as a "vicious civil war,"  then Senator Barack Obama, contender in America's forth coming 2009 Presidential Elections, said during an interview that, "the problem of the 21st century is the problem of the other.

" He described this phenomenon as the inability of people to accommodate others "who are not like us," and mentioned Sri Lanka as an example, pointing out that war rages even when "everybody there looks exactly the same."

Characterization of conflicts in the 21st century this way, what Obama said is an extension to the American Civil Rights era activist W.E. Dubois' quote "The problem of the 20th century is the problem of the color line."

Obama also criticized the Bush administration's "war on terror" as the cause for suppressing civil liberties, saying: "Part of my job as next president is to break the fever of fear that has been exploited by this administration. We are told to be afraid of terrorists, immigrants, and each other. This becomes the means by which our civil liberties are subverted,[and] our values are distorted," implying policy changes are in order.
Front which pontificates to the rest of the world about the need to resolve conflicts through negotiations and the virtue of unity has suffered a debilitating split.

The plain fact is that the Sri Lankan government took refuge under the subterfuge of fighting “terrorism” to deprive the Thamils of their basic rights to live in freedom and security. The US under George Bush ably aided and abetted the Sri Lankan government by supplying weapons, intelligence, training and military hardware!

I also wish to draw your attention to what the Sinhala army General Sarath Fonseka told Stewart Bell of the National Post newspaper of Canada and published on 23rd September 2008. In this interview, General Fonseka has made some disquieting observations of a highly political nature. Among other things, General Fonseka has stated that,” I strongly believe that this country belongs to the Sinhalese but there are minority communities and we treat them like our people…We being the majority of the country, 75%, we will never give in and we have the right to protect this country…We are also a strong nation … They can live in this country with us. But they must not try to, under the pretext of being a minority, demand undue things.”

The Sri Lankan government cynically in Orwellian style claimed that the war against LTTE is “a humanitarian Operation” “To free the Thamil people from the clutches of Terrorists.”

If this is true, why then there was no celebration by Thamils over the military victory against the LTTE? Only the Sinhalese celebrated the so called “victory” by forcing the Thamils to hoist Lion flags at pain of possible arrest?

Finally, you are living in a fool’s paradise to think that Sinhalese will accommodate the political aspirations of the Thamil people by giving them equal rights so that they could live with self-respect and with dignity. This shows you are living in a phantacy world of your own creation. With regards.

Yours truly,

Dear Sir,

This is the fascist government the international community, including Canada, helped to defeat the LTTE under the cloak of fighting terrorism. At least now the IC should know that there is no dog's chance for the Thamils to live in dignity and peace under Sinhala hegemonic dispensation.  Even barbarians would not have turned away a ship which carryied food and medicine to 300,000 starving Thamil citizens.  This is a disgrace, more so when the Sri Lankan government is begging the IC  for funds to finance the rehabilitation and reconstruction of the North which ironically the government itself destroyed by carpet bombing and firing multi-barrel artillery shells.

Where is Canada and its  much flaunted R2P? Where is UNO? Where in Ban Ki-moon and his highly paid bureaucrats?

Where is US and NATO which bomed Serbia for 99 days to save Albanian Mulims and sliced  Kosovo from  Serbia?

Mahinda Rajapakse delivering his "Victory" speech appealed to Thamil expatriates to return to Sri Lanka to re-build the North.

But his appeal rings hollow and a mockery in the light of this sad episode.

The IC is blind to the fact that Sri Lanka is in control of elected dictators who bully, intimidate, arrest, imprison and kill anyone perceived as "enemies of Sinhala - Buddhist state."

Even Sinhalese journalists are not spared. A total of 14 journalists (12 Thamils and 2 Sinhalese) have been murdered since Rajapakse assumed office in 2006. Twice that number has fled the island to save their lives from blood thirsty murderers.

The latest victim was leading journalist Podala Jayantha, the Secretary of Sri Lanka Working Journalists Association (SLWJA) who was forcibly took away by unidentified persons arriving in a white van and heavily assaulted him, before throwing him out of the van at Ambuldeniya junction in Nugegoda. Inspector General of Police (IGP), in an interview to state television Friday, had accused certain journalists being paid by Liberation Tigers of Tamil Eelam, (LTTE) and Podala Jayantha’s photograph was telecast in the interview along with some other journalists.

Last year, Podala Jayantha and Sanath Balasuriya, the president of SLWJA, were summoned by Defence Secretary, Gothabaya Rajapakse and warned both for campaigning for media freedom and condemning the government’s various actions against journalists. Ironically Gotabhaya is a US citizen!

Podala Jayantha's only "crime" was he actively participated in all the protests demonstrations against the government calling for freedom of the media and media democracy.

He had been warned many times by the police and Sri Lanka Army (SLA) intelligence personnel for his reports condemning the government.

The plethora of  human rights organizations like HRW, AI etc which made a song and dance about the LTTE recruiting child soldiers and suppressing dissent is no where to be seen or heard. But where are these  self-styled champions of human rights now? They have put their tails between their legs out of fear for Mahinda Rajapakse’s regime.

The innocent blood of over 100,000 Thamil civilians is on the hands of those "democratic" countries, including Canada,  that preach but never practice what they preach.

Hungry for blood money countries like UK sold weapons for 13.8 million, Slovakia for 1.1 million and Bulgaria 1.75 million sterling pounds.

Only God knows how many countries like US, Canada and EU made money by selling weapons!

China sent shiploads of military hardware, but that is understandable.  China does not lay claims that it is a blooming democracy!

Yours truly

S Lanka turns away Tamil aid ship

By Charles Haviland
BBC News, Colombo

Sri Lanka has turned away a ship which came from Europe carrying aid for Tamil civilians displaced in the final months of the civil war, officials say.

Late last week the Sri Lankan navy intercepted the vessel, which was sent by Tamil expatriate groups.

But a navy spokesman told the BBC that the vessel, the Captain Ali, had been ordered to clear Sri Lankan waters.

A UK-based spokesman for the group which sent the ship, described the move as "disheartening".

The navy spokesman said the vessel had been ordered to clear Sri Lankan territorial waters and not come to Colombo harbour or unload anything.

Asked whether this was not a waste of the hundreds of tonnes of food and medical aid on board, the navy spokesman said he could not comment as the decision had been made by the defence ministry.

No defence official was immediately available for comment.

The spokesman for the Tamil expatriate group said the government could have used the ship to engage with the Tamil diaspora as a move towards reconciliation.

He said the emergency aid on board was desperately needed by refugees in the north.

The defence ministry here earlier described the Captain Ali as a Tamil Tiger vessel, but the defence secretary said on Sunday that the ship "did not have any dangerous intentions".

Thamils should not be carried away by the recent pronouncement  by Sarath Nanda Silva, CJ who  is retiring at the end of the month.   After   the opening of a new court complex in Vavuniya he lambasted the government for its policy of  interning Tamil civilians. “They live outside the protection of the law of the country,” the country’s top jurist, an ethnic Sinhalese, said of the camp dwellers. “I am saying this in public, and ready to face any consequences. We are doing a great wrong to these people.”  However,  there is another side of his personality. He is a devout Buddhist who  conduct television  shows to propagate Buddhism while presiding over the Supreme Court. It is this "Buddhist heritage" that influenced him to rule against the temporary merger of the North and East.  The judgment gave the final death blow to the 1987 Indo-Sri Lanka peace accord. As CJ he has done whatever courts could do to establish Sinhala  hegemony.

So Thamils cannot get justice even in the highest courts with judges like Sarath Silva sitting on the bench. This is what prompted  Prof.C.Sunderalingam to remark that "if you scratch a Sinhalese you will find him a racist!  (June 07,2009)
