பெண் அடிமைக்கு எதிராகவும் பார்ப்பானாய் பிறந்தும் பார்ப்பனீயத்துக்கு எதிராகவும் குரல் கொடுத்த கவிஞன் பாரதி. 

 

நுனிப்புல் மேயாமல் அவனது முழுக் கவிதைகளையும் அவன் காலத்துக் கண்ணாடியை மாட்டிக் கொண்டு படியும்.

பாரதி வாழ்ந்த காலம் நூறு ஆண்டுகளுக்கு முன்பு. எனவே அவனது கால நடைமுறைகள், சூழல்கள், பழமொழிகள்  அவனைப் பாதித்திருக்கிறது. நீர் எடுத்துக் காட்டும் அவனது பாடல் வரிகள் அந்த வகையைச் சேர்ந்தது.  

 

பாரதியை விமர்ச்சிப்பவர்கள் அவன் தமிழுக்கும் தமிழினத்துக்கும் செய்த தொண்டைப் பார்க்கவேண்டும்.

புலவர்கள் மத்தியில் முடங்கிக் கிடந்த தமிழை அவன்தான் அதன் கையைப் பிடித்துப் பொதுமக்களிடம் கூட்டி வந்து காட்டினான். 

 

தமிழ் இனிமையான மொழி என்பதை அவனது பாடல்களில் இருந்துதான் தெரிந்தது.
 

கம்பன், இளங்கோ, வள்ளுவன் போல் வேறு புலவர்கள் பிறந்ததில்லை என்கிறார் பாரதி. 

 

நான் பாரதியின் பெயரை இவர்களோடு சேர்த்துக் கொள்ள விரும்புகிறேன். 

 

எத்தனை மணிமாறன்கள் தோன்றினாலும் பாரதியின் புகழையோ அவனது கவிதசக்தியையோ யாரும் குறைக்கவோ மறைக்கவோ  முடியாது. 

 

கற்பு நிலையென்று சொல்ல வந்தார், இரு கட்சிக்கும் அஃது பொதுவில் வைப்போம் என்று முழங்கியவன் பாரதி பெண்ணை இழிவு படுத்துகிறானா?

எழுதுவதற்கு எததனையோ செய்திகள் இருக்கின்றன. அதில் உமது கவனத்தைத் திருப்பினால் தமிழ் குமுகாயம் பயன் அடையும்.

என்ற வரிகள் வெறும் புகழ்ச்சி இல்லை. உண்மை. பாரதியின் கவிதை வீச்சைவெல்லத்தக்கதாக வேறு எந்தக் கவிஞனும் கவிதை இயற்றவில்லை.

பாரதிதாசனே பாரதியை உச்சி மீது வைத்து மெச்சுவதொன்றே போதும் அவன் புகழுக்கு. 

 

உணர்ச்சிக் கவிஞர் காசி ஆனந்தன் சொன்னதை உமக்கு நினைவு படுத்த விரும்புகிறேன்.

This piece by Terrence Perera who claims many Thamils as his friends commits the same misjudgment/misreading of the LTTE vis-à-vis the Thamils. Many Sinhalese writers and journalists repeat ad nauseam that LTTE does not enjoy popular support. It is holding the Thamils at gun point. The Thamils have to be saved from the clutches from the LTTE. But, nothing can be further from the truth. LTTE enjoys mass support from the very inception. It is the most principled, disciplined and committed liberation movement.  Its leader has been deified as an exemplary and fearless leader. He lives by example.  Let us take a closer look at some of the outlandish assertions by the writer of this article.

 

Assertion

 

As the years went by and memories of the 1983 riots receded and more and more acts of terrorism were perpetrated, the LTTE lost favour with the Tamil Diaspora.

 

Answer

 

At no time the LTTE lost favour with the Thamil people. In fact after 1983 LTTE emerged as the vanguard force of the liberation struggle. Other armed groups which mushroomed fell on the wayside because of inept and dishonest leadership. Sinhalese chauvinists to hide their own racism and state terrorism falsely label the LTTE as a “terrorist” organization. It is a ruse to cash in the global terrorism identified with religious fanatical organizations like the Al Qaeda. Senator and Democratic presidential hopeful Rodham Clinton drew a distinction between the LTTE and the Al Qaeda.

The LTTE found it more politic, at least temporarily, to have peace and give up its claim for a separate state. But this boomeranged on the LTTE. The people of the north and east were able to lead far better lives without the threat of war and there was almost normal communication between the north and the south. The LTTE was gradually and imperceptibly becoming redundant.

All these claims have no basis at all. It is a total misreading of the Thamil psyche by a Sinhalese writer.  The ceasefire agreement came into force following a unilateral declaration of ceasefire by the LTTE. Many Thamils, especially the Thamil Diaspora, felt the LTTE’s decision was a mistake.  At worse it was felt that the LTTE should have captured Jaffna before opting for peace talks. Anyway, the LTTE during ceasefire established very close relationship with the Thamil Diaspora as never before. Thounsands of Thamils made a pilgrimage to Vanni to see for themselves the nascent state of Thamil Eelam. They felt proud of the LTTE for having established a de facto state despite an ongoing war. It was a source of inspiration as well as hope.

Perhaps a word of explanation may help. The Thamil Diaspora always think the war of liberation is waged by the entire Thamil Nation. The LTTE merely the vanguard force.

This continuous improvement in the lives of the Tamil people was the safety net in which the LTTE was becoming enmeshed and from which they had to seek a way out; they had to seek a way out even if it meant immediate intense suffering for the Tamil people. The LTTE was more concerned with the long-term picture of an independent Tamil state, rather than the short-term suffering of the Tamil people!

The LTTE was aware of the safety net spun by Ranil Wickremesinghe to isolate the LTTE internationally. But the LTTE was not unduly perturbed. It was convinced that Sinhalese politicians buried knee deep in racism will never come up with a just and reasonable solution that will meet the political aspirations of the Thamil people. The South simply lacked the political will and statesmanship to offer a solution to solve the ethnic conflict. UNP government led by Ranil Wickremesinghe never placed any constitutional proposals to solve the political deadlock. If anything, Ranil wickremesinghe enjoys the dubious distinction of derailing the 2005 constitutional proposals. Thamils remember Ranil Wickremesinghe burning the copy of the draft proposals inside the parliament! The two proposals put forward by Ranil Wickreemesinghe during the ceasefire only nibbled at the problem. When LTTE agreed to explore a constitutional model based on right of internal self-determination – a paradigm shift to borrow G.L.Peiris words  - why did Ranil Wickremesinghe failed  to grab the opportunity?

Ranil Wickremesinghe’s political summersault has proved that the LTTE was right in boycotting the presidential elections. Ranil’s UNP has torpedoed the federal model. It has vowed to fight terrorism by supporting Rajapakse’s war against terrorism. UNP ex-Ministers  claim credit for engineering Karuna’s split from the LTTE. It is no surprise that cabinet Ministers who are now pushing the war agenda relentlessly are all UNP pole-vaulters!  The perception by Thamils that there is little to choose between the UNP and the SLFP has been proved right.

What Canada can do to foster peace in   Sri Lanka

 

Dear Mr. Lee,

 

Once again, I wish to thank you for organizing the forum to forge a consensus on what Canada can do to foster peace in   Sri Lanka on December 22, 2007.

 

I think this is the first time a Canadian MP has organized a forum exclusively to discuss this burning issue.  In the context of global politics, Canada is a low profile country, but still it can play a role if all the political parties join hands and form an All Party Parliamentary group just like in Britain.

 

I want to restate what I said at the forum and what I wished to say for lack of time.

 

Democracy is not just about voting.  It is how the state treats citizens.  It is about protection of minorities and about human rights.  The trappings of periodical elections, parliament does not make a state democratic.  Sri Lanka is a state of the Sinhalese Buddhists by the Sinhalese Buddhists and for the Sinhalese Buddhists.  It is not comparable with Canada, which is a shining example of a country that has forged unity in diversity by commitment to fundamental rights and freedoms and constitutional governance. 

 

As I said at the forum, there is a long list of countries that used (revolutionary) violence to gain independence from colonial masters or oppressive majoritarian states.  They are too numerous to mention although Eritrea (182 nd UN Member) and East Timor (192nd UN Member) could be cited as good examples. 

 

In 1991, EPLF rebels captured the Eritrean capital of Asmara and the ports, which essentially gave them full control of Eritrea.  Soon after in a UN scheduled referendum Eritrean independence was approved by an overwhelming margin.  The main leader of the EPLF, Isaias Afwerki, became the new country's first president.

 

Almost all the African countries fought against their colonial masters using violence to gain independence.  South Africa, Algeria, Zimbabwe etc. are examples.  Countries like Bangladesh and Vietnam also fought for their independence by using violence.  Most of the former constituent republic of Yugoslavia fought bloody wars to gain independence.  Kosovo, a province of Serbia where Albanians constitute the majority, has postponed its declaration of UDI.  Across the border US War of Independence, lead by George Washington, American people fought with arms to free itself from British.

 

The armed struggle of the Thamil people is not for a separate state.  It is for the restoration of the Thamil Kingdom status quo ante, which existed for at least 5 centuries before it was conquered by colonial powers.  To be more precise the present-armed conflict is a legacy of British imperialism, which erased the borders between the Thamil Kingdom and the Sinhalese Kingdom(s) for administrative convenience.

 

 

 

 

When UNO was founded, there were only 51 states.  Now it has 192 states, a four-fold increase.  I assure the skies will not fall and the earth will not shake if one more is added to the number!

 

The listing of LTTE as a banned organization by the Conservative Party delivered a blow to the peace talks between the LTTE and the GoSL.  It upset the status quo between the protagonists.  Embolden by the ban the GoSL abandoned peace talks and opted for a military solution under the guise of fighting terrorism.  It has repeatedly declared its intention of an all out war against the LTTE not mindful of the cost.  Two days ago, President Mahinda Rajapakse vowed to finish off the LTTE soon.  His sibling Gotabhaya Rajapakse, Defence Secretary,  added a macabre new twist to the fighting when he publicly declared  that all  the  LTTE leaders will also be killed one by one just like S.P. Thamilchelvan. 

 

Mr. Bob Rae, shadow foreign minister,   observed that both parties to the conflict remain miles apart.  This is a fact, but the onus of resolving the conflict remains with the government.

 

As for the  obsession to  label  the LTTE “terrorists”,  Mr. Jim Karygiannis rightly pointed out  that one man’s terrorist is another man’s freedom fighter or patriot or both.  What distinguishes a terrorist organization and a national liberation movement is mass support and LTTE enjoys mass support.  To deny this is to deny the truth.

 

There are numerous examples of erstwhile terrorists meticulously transformed into today’s Heads of States and received with red carpets and military guard of honour!  The Western world, including Canada,   posturing on terrorism is sanctimonious humbugging and one of double standards.  It is conveniently forgotten that Israel Prime Ministers Menachem Begin and Yitzhak Shamir were both wanted terrorists by the British!  Menachem Begin  as leader of the illegal Irgun Zvai Leumi underground movement was  responsible for blowing up the King David Hotel in Jerusalem, resulting in 91 deaths and countless wounded.  Yitzhak Shamir as part of the ruling triumvirate of the Stern Gang authorized the 1944 assassination of Britain’s Lord Moyne and the 1948 murder of the United nations mediator Count Bernadotte. South of border George Washington was proclaimed a wanted terrorist by British during American War of independence!

 

Some people think that moral arguments against the war might eventually win the day. That is an illusion.  The sole reason behind the Sri Lankan government’s genocidal war against the Thamil people is racism.   Sri Lankan president Mahinda Rajapakse wants to impose and perpetuate hegemonic rule on Thamil people. 

 

Mr. Bob Rae’s obsession with child recruitment is understandable, but what is not comprehensible is his silence when schoolchildren in Vanni are killed by Sri Lankan supersonic bombers.  It is a clear case of self-serving hypocrisy in politics.  Thamils being numerically the   weaker nation   are fighting a war against a numerically stronger nation, which uses military force.  The problem is the weaker and oppressed people are labeled as terrorists while the stronger people often get away with mass murder.

 

Sri Lanka is already flowing with rivers of blood, mostly that of the Thamils, because Sinhala-Buddhist chauvinists want to keep the WHOLE country to themselves. It is called the Mahavamsa mind-set. The only sensible way to stop the hemorrhage and stop the rivers of blood flowing is to revert to the boundaries that existed before 1833. The LTTE is engaged in a national liberation struggle, which is recognized as a legitimate mode of struggle under international law. Equally the Thamil people of Thamil Eelam are entitled to the right of self-determination under the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights, and the two major international human rights treaties (Sri Lanka has ratified these Covenants and Treaties).  The Universal Declaration of Human Rights states,

Whereas it is essential, if mankind is not to be compelled

to have recourse, as a last resort, to rebellion against tyranny

and oppression, that human rights should be protected

by the rule of law ...’ (UDHR 3rd preambular paragraph).

 

I conclude with the hope that the initiative you have taken will bear fruit in the near future.

Like a drowning man clinking to a straw this racist editor (The Island) is citing ad nauseam the case of 2 UN workers supposedly abducted by the LTTE. All this cock and bull stories like  "All the INGOs have been keeping their local staff indoors in the Wanni for fear of LTTE abductions"  is the product of his fertile imagination. Again his lament that "Not even the brave UNICEF personnel who recently joined a protest in Colombo demanding better protection for relief workers dare confront the LTTE" is uncalled for. If the UNICEF or any other INGO fears lack of protection, I am sure they will say so to the LTTE without fear what so ever.  The truth is this racist editor is painting a dark picture about Vanni to serve his petty self interests. He should go to Vanni to see for himself the efficient functioning of LTTE’ s de facto state.  Vanni is the only place in Sri Lanka free of drug trafficking, prostitution and other serious crimes. The administration is entirely free of corruption. Even foreign correspondents admitted to the fact that the Thamil Eelam police cannot be bribed. What is more any woman can walk the streets and lanes of Vanni wearing jewelery in the middle of the night without being robbed or molested! All this propaganda by Sinhala racists like this editor that LTTE is holding the people of Vanni under gun is hogwash! The LTTE is able to fight an enemy far superior in numbers and firepower because of the mass support of the people.  The Sinhala racists must digest this simple but cardinal truth for their own good.  The arrest of  over three thousand Thamils solely  because they are Thamils is reminiscent arrest of Jews  by  Nazi Germany under Hitler!  (December 07, 2007)

Bombing of Voice of Tigers Radio Station that killed 5 staff
Dear Mr.Matsuura 
We wish to congratulate you for condemning without mincing words  the bombing of Voice of Tigers radio station that killed five  of the station staff .  For far too long the GoSL has been let off the hook by the international community for violating with impunity basic human rights and freedoms.  Undoubtedly,  the GoSL under Mahinda Rajapakse is steadily sliding into anarchy and the rule of law is breaking down fast.  Being a rogue state that cares little  for public opinion,  it has launched a vilification campaign against you and the UNESCO. This is not surprising since senior Ministers of the GoSL have vilified high ranking UN diplomats critical of the human rights record of GoSL in recent times. UN diplomats like Allen Rock, Special Advisor to the UN Special Representative for Children and Armed Conflict, were subject to innuendos by Minister Keheliya Rambukwella who questioned un-ashamedly his personal character.  (Transcurrents -November 18th, 2006)

The same fate fell on John Holmes, U.N. Undersecretary-General for humanitarian affairs.  Jeyaraj Fernandopulle, the government's chief whip in Parliament and a senior Cabinet minister branded Holmes a "terrorist" who is in the pocket of the Liberation Tigers of Tamil Eelam (LTTE) rebel group. "I think the LTTE has bribed Holmes. Otherwise he would not have done such a wrong thing," Fernandopulle said. (The Associated Press - Wednesday, August 15, 2007)

A few weeks back Gotabhaya Rajapakse, Defence Secretary and Presidential sibling in an interview to BBC (Sinhala Service) justified the expulsion of over three-hundred North-East Thamils from Colombo. He told the non-Asian world that Sri Lanka can do without it and did his best to sound belligerent and unaccommodating, not only towards the LTTE but also towards Lankan Thamils and the international community. The  outpouring devoid of commonsense and circumspection of a  senior and responsible official  is simply beyond  belief.  

Commenting about abductions for ransom and involuntary disappearances  Defence Secretary Rajapakse dismissively said “I’m talking about terrorists. Anything is fair. When the US does operations, they say covert operations. When something is (done) in Sri Lanka, they call it abductions…This is playing with words” (Khaleej Times – 12.6.2007).  It is indeed true the CIA abducts and incarcerates people illegally in the name of war against terrorism. Guantanamo prison camp and other secret CIA installations hold hundreds of   illegally abducted terror suspects.  CIA arranges secret flights transferring such suspects from one location to another. Such actions are morally wrong and politically counterproductive to win the war against terror. International human rights groups such as the Human Rights Watch and Amnesty International have criticized US human rights violations.

Regrettably   instead of  condemning  violations committed by US,  the Defence Secretary is invoking those very violations to justify GoSL violations. To cite US abductions to justify Sri Lanka’s abductions is simply dim-witted and unfair. Both are abductions; both are illegal and both deserve to be condemned. What is worrying is Rajapakse’s implicit admission of GoSL’s complicity in the abductions by calling them American style covert operations. His comments serve to confirm the charge that the regime is either directly or indirectly responsible for the abductions.

UNESCO should continue to take Sri Lanka to task for gross violations of human rights and freedoms and not whittled down under pressure or threat by the GoSL. As the upholder of universal respect for justice, for the rule of law and for  human rights and fundamental freedoms without distinction of race, sex, language or religion under  the Charter of the United Nations,  the UNESCO is the last hope of victims of STATE TERRORISM. We write in continuation of our letter dated November 22, 2007 on the above subject. 
 
We have since come to know that the actual number of aid workers killed were 61 - NOT 24 – 21 in 2006 and 3 in 2007 - during the years 2006 and 2007. To substantiate this figure we attach herewith a list showing “Abductions and killings of humanitarian workers during 2005-2007 (September)” compiled by the Law & Society Trust (Sri Lanka) and the Tamil Rehabilitation Organization (TRO).
 
This list is an indication of the grave and dangerous situation faced by aid workers operating in the Northeast of the country. The Government of Sri Lanka (GoSL) has failed to take any meaningful steps to halt the spree of killings and abductions of aid workers. And the government continues to drag its feet in investigating and prosecuting those involved in the murder of 17 aid workers attached to the French charity Action Contre le Faim.
 
The government of Mahinda Rajapakse is callously disregarding the appeal by human rights organizations like Amnesty International (AI) Human Rights Watch (HRW) etc. to bring an end to extra-judicial killings and abductions for ransom. The number of people killed by bombing and shelling by the armed forces are on the increase. The Sri Lanka Monitoring Mission (SLMM) in a statement while expressing grave concern said that 49 civilians have been killed and 60 injured in 4 days from 25 to 28 November (The Hindu -  Nov 30).   Alarmed at the escalation of civilian casualties SLMM on Thursday (November 29) said the violence witnessed now was similar to what was seen prior to the signing of the Ceasefire Agreement (CFA) in 2002.
 
To add fuel to fire and in a naked display of political arrogance the hard lined Sinhala – Buddhist Prime Minister Ratnasiri Wickremanayake told parliament the aerial strikes of Vanni will continue unabated! He was responding to minority Tamil parties appeal to the government to stop air raids in rebel-held areas as civilians were getting killed by the strikes. (Reuters - Nov 27, 2007)

Such bellicose statement by a Prime Minister steeped in Sinhala – Buddhist chauvinism is proof that his government wants to  stoke the flames of war irrespective of the serious consequences. A human tragedy of giant proportions will result if a full blown war is to break out any time soon.
 
UN ought to take concrete measures as opposed to pious appeals to halt the horrendous human rights and humanitarian law violations taking place in Sri Lanka in a climate of total impunity.

We write in continuation of our letter dated November 16, 2007 appealing to the UN to “impose economic sanctions even on a limited scale on GoSL.”

 

We are pleased Your Excellency has issued another report that states "In the past 14 months, 24 aid workers were killed in Sri Lanka - 21 in 2006 and 3 in 2007."

To this list we must add the young male worker attached to the demining agency Halo Trust in Jaffna who was shot and killed on November 18, 2007.  As Your Excellency highlighted in your earlier statement there is no   progress in the investigation into the murders of the 17 local aid workers attached to the French charity Action Contre le Faim.

 

The human rights abuses and security far from showing any progress is deteriorating daily. A climate of impunity from prosecution prevails all round. What is worse the perpetrators of human rights violations are none other than the armed forces or those Para military groups operating with them.

 

On November 19, Pillaiyan Paramilitary group in the east abducted S.Sajitharan, son-in-law of Tamil National Alliance (TNA) MP T. Kanagasabai and threatened to kill him if the MP voted against the budget.   The abduction took place despite police security posted to the MP’s house. Family members of  2 more Thamil parliamentarians in Batticaloa were also threatened by the same armed group after their police protection was withdrawn. Government Whip and senior Cabinet Minister Jeyaraj Fernandopulle brazenly told parliament that government will not provide security to families of TNA MPs. (Daily Mirror – Nov 20, 2007)

 

According to ICRC the military incursion into LTTE front lines in Muhamalai south of Jaffna and along the Vavuniya-Mannar line of control has displaced 22,000 Thamils since September, 2007.  Over 100 resettled Thamils in Eachilampathai, Trincomalee district are once again leaving their villages to Batticaloa after the arrest of 30 villagers by the Sinhala army. Apparently they do not feel safe in their villages.

 

Yesterday about 15 armed men carrying T 56 rifles forced themselves into the Sunday Leader printing press situated in Ratmalana and set fire to it after threatening the employees to kneel down.  Ironically, the press was located in a high security zone outside Colombo.   Obviously, the government and the armed forces are complicit in this heinous crime and assault on press freedom.

 

Reporters without Borders has condemned the arson attack on the printing press of the Sunday Leader media group. RWB said the attack must have had support within the security forces. This press was set on fire in 2005 in the run-up to the last Presidential Election but the perpetrators of the crime were never apprehended or brought to justice.

 

Such despicable acts and conduct are an absolute insult to the sublime philosophy of Buddhism which has universal relevance based on the four noble truths and the eightfold path. Buddhism has been afforded foremost place and state patronage by the GoSL.

 

There should be no doubt on anyone’s mind that Sri Lanka under Mahinda Rajapakse is sliding into anarchy and the rule of law is breaking down fast.    

 

We appeal again to the UN to take decisive steps to impose economic sanctions on the rogue state of Sri Lanka which is running riot. Unless the UN takes  GoSL to task the security, law and order situation is bound to turn from  bad to worse,

UN should impose economic sanctions even on a limited scale on GoSL

Dear Hon. Ban Ki-Moon,

We welcome your report to the UN General assembly saying that very little progress has been made  by the Government of Sri Lanka (GoSL) to stem the tide of large scale  human rights violations taking place. You have called  for “greater protection of civilians affected by conflict in Sri Lanka.”  While you have identified the problems plaguing  Sri Lanka,  you have not spelled out any concrete measures to remedy or reverse the deteriorating human rights situation.   

It is more than one year since the appointment of the Commission of Inquiry (CoI) and the Government established commission investigating human rights abuses, including the killing of 17 staff members of Action Contre La Faim in August 2006,  have made little or no progress.  The same goes to other high profile killings that include three prominent parliamentarians of the Tamil National Alliance (TNA)  by the Sri Lankan military intelligence. 

In fact the IIGEP has said it has no confidence on the work of the COI. In the meantime human rights violations that include killings, abductions, forced disappearances etc  have increased by leaps and bounds. A letter written by  Human Right Watch  to members of the U.S. Congress that "there has been a significant jump in abuses by government forces such as indiscriminate shelling, extrajudicial executions and forced disappearances,"

The GoSL while paying lip service to peace talks is engaged in waging total war against the Liberation Tigers of Thamil Eelam (LTTE).  President Mahinda Rajapakse has turned his back on Northeast being the traditional habitat of the Thamil people, merger of Northeast as a single unit, sharing of power under a federal constitution and the right of self-determination of the Thamil people. In short he has put the clock back by 60 years and the ethnic conflict is back to square one.

That the GoSL is hell-bent on a military solution is confirmed by the planned increase in defence expenditure by 20% to 166.4bn rupees ($1.48bn) from 139.6bn ($1.3bn) in 2007.

Despite several reports by high ranking UN diplomats officials critical of the human rights record of GoSL little or nothing has been done to arrest the worsening situation. Instead UN diplomats like Allen Rock, Special Advisor to the UN Special Representative for Children and Armed Conflict, were subject to innuendos by Minister Keheliya  Rambukwella who questioned un-ashamedly his personal character.  (Transcurrents -November 18th, 2006)

The same fate fell on John Holmes — the U.N. undersecretary-general for humanitarian affairs.  Jeyaraj Fernandopulle, the government's chief whip in Parliament and a Cabinet minister branded Holmes a "terrorist" who is in the pocket of the Liberation Tigers of Tamil Eelam rebel group. "I think the LTTE has bribed Holmes. Otherwise he would not have done such a wrong thing," Fernandopulle said.  (The Associated Press Wednesday, August 15, 2007)

Strangely, but not surprisingly this is the same regime  that  protests  loudly about child conscription by the LTTE and urging the international community  to penalise the LTTE.

Even peace envoy and the Norwegian International Development Minister, Erik Solheim, was the focus of Colombo's ire. Dissatisfied with Solheim's approach to peace process, Sinhala nationalists accused him of bias, labelled him a "White Tiger" and called for his ouster.  State-run media accused Solheim of joining LTTE rallies in Norway, of accepting money from Tigers and in turn providing material assistance to Tigers.  

Thamil people continue to face aerial bombardments, artillery shellings, economic sanctions and other   horrors and indignities of the war.

The second submission by the Law and Society Trust (LST) to the Presidential Commission of Inquiry into Serious Human Rights Violations, states that five persons are either killed or disappear each day in Sri Lanka. “14 humanitarian and religious leaders have been killed and nine humanitarian workers have disappeared between January 1 and August 31, 2007. Three media personnel have been killed and five media personnel have disappeared.  662 persons have been killed and 540 persons have disappeared between January 1 and August 31, 2007. Twenty-five children have been killed and 43 have disappeared during this period,” says the report.

Sri Lanka’s Army Commander Sarath Fonseka has admitted to killings and abductions of Thamils in an interview  to British investigative reporters. Asked about human rights abuses in the newly captured Eastern he confessed  to the fact that the abductions and disappearances will go on implying the army (intelligence wing) is responsible for the current spate of abductions and forced disappearances. Defence Secretary (brother of President Mahinda Rajapakse)  Gothabaya Rajapakse  told reporters that abductions and  killings are “fair means” to fight “terrorism” and attacked the international community of practicing double standards.

We, therefore, urge  you to take concrete steps that will compel the GoSL to opt for a negotiated settlement of the conflict instead of a bloody and costly war.  Simply barking at the GoSL will not suffice. The UNO should do some biting as well. Economic sanctions even on a limited scale is the way to knock some sanity into head of President Mahinda Rajapakse to make him see reason.

14,000 Thamils who lived in Sampur and adjoining villages in Mutur east have been displaced by the Sinhala army following the creation of HSZs.  

Sinhalese racists like JRJ gave orders to Bull Weratunga to eliminate all forms of terrorism and report back in 6 months. JRJ is gone but Prabhakaran is still there.

A total of 15,000 families are displaced in Jaffna peninsula because of the HSZ created by the army. In Mutur east 4,000 families consisting of 14,000 people have been ethnically cleansed from their ancestral homes and farmyards!  This is because the Sinhala state has declared a total of 12 villages out of bounds for Thamils. Yet you dare to claim you have liberated the Thamil people? Did you mean liberation from earthly life? 

As a racist editor for a racist newspaper, are you not ashamed of the Sri Lankan government which is corrupt to the hilt? Are you not ashamed of the jumbo cabinet?

Sri Lanka is a failed state ranking 25 out of   177 states (begins with 1 (worst) just below Liberia and the Republic of the Congo.

Sri Lanka scored particularly poorly on rankings titled: ‘Criminalisation or de-legitimisation of the state’ and ‘Security apparatus operating as a state within a state’ and ‘rise of factionalised elites. 

 Sri Lanka is also a corrupt state worse than some of the African countries. 

Berlin  based TI placed China and Sri Lanka at 78th position ranking it least corrupt than India with a score of 3.2 while Afghanistan and Nepal have been jointly placed at 117th with a score of 2.5, Pakistan 144th with a score of 2.1 and Myanmar 155th (1.8).  

The Sinhalese politicians, especially those belonging to the JVP and JHU are a national disgrace. The rabid racist, fascist and downright opportunist JVP thugs  openly advocate  and  instigate  the genocide of Thamil people  by supporting a deadly war, supporting indiscriminate bombing and bombardment by the Sinhala state terrorist security forces and  imposing economic blockade,

Thanks for writing to the National Post. The editorial as you rightly pointed out is an Extreme manifestation of the antipathy towards the Liberals. It is Liberal bashing by the National Post at the expense of Thamil Canadian community.  

The National Post  has vilified  the LTTE before and therefore there is nothing surprising about the current

stanse. The editorial is  grossly inaccurate, if not false and misleading. It  lacks objectivity and even-handedness in dealing with a complex problem that has defied solution for the last fifty years or more.  One should pose to find out the reasons why a docile and peaceful  Thamil community took arms.

As a rightwing neo-conservative mouthpiece one cannot expect anything better. The members of the editorial board of the National Post think they are the exclusive saviours, guardians and godfathers of Canada.    

For your information the civil war today is the direct result of the British handing over power to an
 entrenched majority Sinhalese under a unitary constitution.

When the Portuguese arrived in Ceylon (now Sri Lanka) in 1505 there were three Kingdoms, the Sithawaka Kingdom based in Colombo, the Kandyan kingdom based in Kandy and a Thamil kingdom based in Jaffna. They unified the three territories of the island for easy administration in 1833.

In 1948, Britain should have given independence to the three territories, but it gave independence to the unified country in which the Sinhalese enjoy a permanent and perpetual majority.

All attempts, including Canadian efforts, to model the constitution based on a plural society that recognizes
the multi-racial, multi-faith and  multi-cultural   polity has failed.

The current president of Sri Lanka (Mahinda Rajapakse) has said no to Thamil homeland, no to federalism,

no to the right of self-determination of the Thamil people. He wants to impose at gun point an ex-parta  
solution down the throats   of the Thamils.   His  talk about peace is a veneer to disguise the current military campaign against the LTTE.

In this connection I wish to bring to your notice what Hon. Mrs. Rodham Hillary Clinton
Senator (New York) and Democratic Presidential Candidate told the Guardian newspaper (October 23, 2007) in an interview.

She said "the bottom line is you can't lump all terrorists together.  I mean, what the Tamil Tigers are fighting for in Sri Lanka, or the Basque separatists in Spain, or the insurgents in al-Anbar province may only be connected by tactics. They may not share all that much in terms of what is the philosophical or ideological underpinning.”

Unfortunately the current war against terrorism has lumped liberation movements which fight for basic human rights and rule of law and have clear defined political aspirations.  Philosophically and ideologically the LTTE stands  poles apart from the Al Qaeda. The latter is a fanatical religio- centric out fit and no one knows for certain what they fighting for. All we know is  Al Qaeda wants to fight secular and democratic forces opposed to Islamic fundamentalism.

Thanks again for taking the time to respond to the National Post's editorial board's insidious campaign to discredit the Liberals as well as tarnish the image of the LTTE.

The majority of Buddhist Bhikkus in Sri Lanka are frogs in the well. They can best  be described as political/ religious thugs in saffron robes.  Their brand of Sinhala Buddhism is  not an all inclusive and compassionate religion. They want to create a Buddhist Nation State.
 The JVP monks and the bhikkus who joined the army after the 1995 breakdown of peace talks defiled Buddhism as a philosophy of peace and non-violence. To the Sinhala Buddhist Bhikkus and ideologues violence can be justified in the name of defending the unity of land, race and religion in Sri Lanka. Lord Buddha's teaching of Vassetta Suthra, which rejects all divisions between human beings is observed in the breach. Bhikkus as individuals cannot sanction or support or participate in violence.

Their master spoke against violence  not only to human beings but also against any living being. But these Bhikkus openly trumpet in favour of war.  

An anecdote in Mahavamsa is very relevant and gives the psyche of the political Buddhist Bhikkus.

After his victorious conquest of Anurhadapura and defeat of Ellara the king was reflecting with dismay on the recollection of numerable lives sacrificed in the attainment of his end, eight holy saints (termed Arahats) came to him miraculously and administered spiritual comfort. And the king said, "Lords what peace of mind can there be left to me, when I have been the means of destroying great armies?" And the saints answered "Supreme of men, from the commission of that act there will be no impediment in the road to salvation. Herein no more than two human beings have been sacrificed; the rest are heretics and sinners, who are on a par with wild beasts. And as thou wilt cause the religion of Buddha to shine forth in great splendour, on that account, O ruler of men, subdue thy mental affliction!" (Mahavamsa, chap, 25). Thus was the king consoled.

This Mahavamsa mind-set continues to this day. Let us not make a mistake about it.

After remaining silent when Thamil businessmen were abducted Hussain now writes about abductions and neo-Nazism.
The Muslims are the beneficiaries of the racial conflict between the Thamils and the Sinhalese.
Those Muslims who got elected with Federal Party support jumped boat no sooner the din of hustling died!
Hussain claims that Muslims are not guilty of terrorism. Is it?
What about the killing of hundreds of Thamils in the east and chasing them from their homes? It is the large scale massacre of the Thamils in the east that compelled the LTTE to ask Muslims from the North to leave.
Muslims don't care about losing their land to the Sinhalese. They lost lands in Amparai to the Sinhalese settlers but there was not even a whimper of protest from Muslims. Their preoccupation as elsewhere is their religion.
One day they will pay the price for supporting the Sinhalese racists at the expense of the Thamils.

Abductions and neo-Nazism

For many years I have been convinced that our so-called ethnic problem can best be understood in terms of a paradigm of racism. I will not here spell out all the arguments in favour of that view. I will here set out just one argument, as the point I am making about racism is only a preliminary in an article intended to point to the terrible dangers posed by the possible growth of neo-Nazism in Sri Lanka.

The discourse of ethnicity has a most curious lacuna, which as far as I am aware has not been commented on by any Sri Lankan up to now. Ethnic problems usually arise because of perceptions among minorities that they are subjected to discriminatory treatment by majoritarian governments. According to that view there are people who do the actual discriminating, as ethnic problems are not the consequence of impersonal processes that are beyond the control of anyone. In the discourse of racism such people are called “racists”. But in ethnic discourse there is no such term as “ethnicist”, or any other term to designate the people who do the discriminating. There is a sound case for introducing the term “ethnicist” as a necessary neologism into ethnic discourse. Otherwise ethnic discourse will continue to ignore the root cause of ethnic problems.

Before proceeding further I will indicate what I have in mind when I use the term “racism”. It is accepted that most ethnic groups have a propensity – not an invariant law but a propensity – to view the Other in negative terms. Very probably this is the root-cause of racism, which leads ethnic groups to treat members of other ethnic groups as inferior or dangerous and to discriminate against them, even to the extent of subjecting them to genocide.

A further preliminary point I want to make is that racism should be regarded as one of the defining characteristics of fascism. Certainly the Western democracies are awash with racism, but they are also awash with very vigorous counter-racist movements. In Sri Lanka, on the other hand, racist attitudes flourish, in my view among all the ethnic groups, and there has been blatant discrimination against the minorities. But there are no counter-racist movements here. The problem of racism is not generally acknowledged; in fact it is not even recognized. That is why Sri Lanka can slide into fascism without our understanding what is happening, a fascism so nasty and brutal that it could come to merit the term neo-Nazism.

I come now to the problem of abductions which has been much in the news recently because of the alleged spate of abductions of Muslim businessmen. We have been long accustomed to the abductions for money of Tamil businessmen. Obviously those abductions were not perpetrated by ordinary criminals, who would not be interested in the ethnic background of their victims. Those abductions have certainly had therefore a political and ethnic character In terms of the paradigm of racism those abductions have had racists behind them.

However, it could be argued – though not convincingly – that those abductions need not have racism behind them. The point is that those Tamil businessmen could be aiding the LTTE financially, whether willingly or unwillingly, and abducting them could be a way of weakening the LTTE. But if such indeed is the intention, it makes no sense to release the businessmen after payment of ransom, as they could thereafter continue to aid the LTTE. If that intention is to be fulfilled, all Tamil businessmen will have to be exterminated. I am afraid that we have to conclude that behind the selective abductions of Tamil businessmen there has been a rabid racism.

I come now to the question of the alleged abductions of Muslim businessmen. I will deal with the question of the veracity or otherwise of those allegations later in this article. Here I want to make the point that large-scale abductions of Muslim businessmen is exactly what we have to expect in terms of my paradigm of racism. The racists have with impunity been abducting Tamil businessmen over a long period, but nary has a word been uttered about racism being the underlying problem. So the racists have felt emboldened to extend the field of their operations to cover that other substantial minority, the Muslims, as well. Otherwise our racists – who doubtless regard themselves as super-patriots – may stand accused of discrimination!

The abductions of Muslim businessmen – if they come to be established as true – will point clearly and without any ambiguity whatever to the existence of Sinhalese racists of a neo-Nazi order. At least in the case of the Tamil abductions it might be arguable that understandable hatreds have been provoked by the separatist war and LTTE terrorism, from which the abductions have followed. No such excuse can be made over the Muslim abductions.

From the time of Independence the Muslims have been consistently and unfailingly supporting the Sinhalese in their conflicts of interest against the Tamils, to the extent of seriously alienating the latter. The Muslims were against the fifty-fifty demand of Ponnambalam, the federal demand of Chelvanayagam, and the demand for a separate state in the Vaddukoddai resolution of 1975. They supported the iniquitous Sinhala only policy, and the subsequent University admission policies that were clearly detrimental to Tamil interests. During the State terrorism of 1983 a Muslim Minister disgraced Islam by unleashing his thugs in central Colombo against the Tamils. The Muslims of the Eastern Province were alleged to have got together with the STF in terrorist exploits against the Tamils there. Subsequently the Jaffna Muslims were ethnically cleansed, and the EP Muslims were massacred in their mosques. Furthermore, there is every possibility that the EP Muslims will be ethnically cleansed from there some time in the future. The facts clearly show that it was not humanly possible for the Muslims to have gone further in their support for the Sinhalese against the Tamils.

It is important to note here also the external dimension of the Muslim factor. The South Asian region to which we belong has two of the most important Muslim countries in the world, namely Pakistan and Bangladesh, in addition to the Maldives. The adjacent South East Asian region has another two of the most important Muslim countries, namely Indonesia and Malaysia. To the North and North-West there are Afghanistan, Iran, and the Middle East. The last-mentioned region has a crucial economic importance for Sri Lanka as it provides employment for our housemaids, whose remittances keep our economy afloat. Finally I must emphasize the military importance of Pakistan, symbolized by the fact that its help saved Sri Lanka`s unity after the Elephant Pass debacle in 2000.

The above facts suggest that – if at all – there should be anti-Muslim feelings among the Tamils, not among the Sinhalese. But there are facts suggesting that the contrary is the case. Since 1975 there have been anti-Muslim ructions practically every year for over a quarter century, ranging from the trivial to serious anti-Muslim riots such as the Puttalam mosque massacre of 1975, the Galle riots of 1982, and the Hulftsdorp riots of 1993. Those ructions rose to a crescendo with the Mawanella riots and the Udathalawinna election massacre, after which they practically ceased for mysterious reasons. Perhaps the hog-lazy government of that time at last decided to take action to stop such ructions, or – as I suspect – the Norwegians came to play the scapegoat role hitherto assumed by the Muslims.

There is strong evidence to show that in addition to anti-Muslim violence there has also been anti-Muslim discrimination. The Sinhalese who constitute 74% of our population hold 92% of the State sector jobs, having made gains at the expense of both the Tamils and the Muslims. Most Muslims charge that since the time of D.S.Senanayake successive governments have done everything possible to get hold of Muslim business and put it into Sinhalese hands.

What is the explanation for anti-Muslim violence and discrimination? It certainly cannot be terrorism – which is supposed to explain the Tamil ethnic problem – because the Muslims have been the victims of terrorism, not its perpetrators. This seems to be a case of classic racism in which a dominant ethnic group – or some members of that ethnic group – wants to push down a minority ethnic group. This racism seems more than a little mad, considering all the factors that I have listed above that should make for Sinhalese-Muslim solidarity. It seems appropriate to talk of neo-Nazi racism

The charges of large-scale abductions of Muslim businessmen for money should be seen in relation to a detail that I have mentioned above. Many Muslims believe that since the time of D.S.Senanayake successive governments have followed a policy of transferring Muslim business into Sinhalese hands, a charge that is leveled even against the late Trotskyite Minister, Dr N.M.Perera, in connection with the gem business. The Muslim abductions are seen as a continuation of that policy.

However, the Government claims that there have been only two known cases of Muslim abductions, while there have been stories about other abductions spread by the UNP as part of its propaganda drive. It could be that many victims of the abductions have been too afraid to go to the police with their complaints. But former Mayor Azath Sally has brought out details about some of the victims, and so has Lakbima news of 17 June. It is up to the Government to conduct credible investigations. For the time being we have to suspend judgment, but it seems to me for reasons given in this article that large-scale Muslim abductions are just the sort of thing that we have to expect.

Anyway, it is not disputed that there have been large-scale abductions of Tamil businessmen, apparently with no successful detections taking place. That means that those who are behind the abductions can go about their business enjoying a virtual immunity from the law. What are the implications of these facts?

A state gets its primary legitimation from its ability to maintain law and order, and to secure the lives and property of its citizens. This may not be possible under conditions of civil war in areas outside the control of the state. Here we are talking of abductions taking place in areas that are clearly under the control of the state. Consequently, we cannot evade the conclusion that the Sri Lankan state is to some extent – and in a very fundamental sense – a failed state.

The virtual immunity from the law of the people behind the abductions suggests that they have very powerful backing. Can they try to take over the Government? Serious military setbacks in the civil war and impending economic ruin could point to a systemic collapse, a situation in which neo-Nazi types could get ideas. The notion that some sort of systemic change might be in the offing seems to be in the air these days. What that points to is a need for a radical rethinking about our politics, a rethinking in which an application of the racist paradigm to our so-called ethnic problem could help greatly. Your editorial What Were those MPs Thinking? (Nov 7) over looks the central point of the Markham Vigil for S.P. Tamilselvan: His death was the result of an assassination attempt by the Sri Lanka's government.
The Oslo peace accord negotiations are instructive here. As repugnant as Yasser Arafat was to the Israelis, they knew the only possibility of the ending the conflict was through negotiation, and that Mr. Arafat, for better or worse was the recognised leader of Palestinians.
Regrettably, the Sri Lankan government hasn't taken this approach.
Despite its opinion of Mr. Tamilselvan, he was the chief negotiator for one side in this conflict at the Norwegian mediated peace process.
His assassination sends the signal that the Sri Lankan government has chosen a military solution when none exists. The most likely outcome of this assassination will be the further escalation of violence and the end to the peace process in Sri Lanka.
My attendance at the vigil was intended to urge Canadians on both sides of this conflict to press for a resumption of peace talks. To do this, one cannot take sides. 
I conclude by turning the question around: Why didn't you condemn the Mr. Tamilselvan's assassination and its inevitable disastrous consequences?
Where is your thundering editorial condemning state Sanctioned assassinations of peace negotiators? What were you thinking?

Dear Madam Clinton,
We warmly welcome your response to Michael Tomasky of British Guardian newspaper (October 23, 2007) for a more nuanced approach to armed non-state actors fighting for liberation.  You have rightly observed that “the bottom line is you can't lump all terrorists together. I mean, what the Tamil Tigers are fighting for in Sri Lanka, or the Basque separatists in Spain, or the insurgents in al-Anbar province may only be connected by tactics. They may not share all that much in terms of what is the philosophical or ideological underpinning.”
When asked “do you think that the terrorists hate us for our freedoms, or do you think they have specific geopolitical objectives?” you replied:
“Well, I believe that terrorism is a tool that has been utilized throughout history to achieve certain objectives. Some have been ideological, others territorial. There are personality-driven terroristic objectives.”
We hope with your installation as the next President of United States of America there will be winds of change in the way America fights “terrorism” unleashing equally reprehensible and obnoxious state terrorism.
In Sri Lanka an entrenched majority Sinhalese nation  has deprived the numerically smaller Thamil nation its  basic rights and fundamental freedoms. This they do  by taking refuge under the subterfuge of fighting “terrorism.” The Sinhalese government has dubbed the armed struggle of the Thamils as “terrorism” cashing in President Bush’s skewed logic that there are no good or bad terrorists only terrorists. President Bush’s single point agenda of fighting good and bad terrorists have given a free hand to oppressive governments like the government of Sri Lanka (GoSL) to paint the Liberation Tigers of Thamil Eelam (LTTE) with “the broad brush of “terrorism” and force Sinhala hegemony down Thamils throats.
Unable to free itself from a racially based majoritarian mindset GoSL has adopted Sinhala - Buddhist chauvinistic goals as its dominant national philosophy. The domination of this Sinhala Buddhist chauvinism is preventing the Sinhala nation from undertaking a genuine attempt at resolving the Tamil national question in a civilized and objective manner. Hence, the continued  political subjugation, social oppression and economic deprivation of the Thamil people. Sinhala racism  has resulted in the bloody civil war that is bleeding the country. And US is fuelling the war by selling military hardware, war ships, super-sonic fighter planes  and training to the Sinhala armed forces.
There is no comparison between the secular LTTE which is fighting for the restoration of status quo ante of a state they lost to the Western colonists and the fanatically  religious armed groups like the Al - Qaeda! Philosophically and ideologically they stand poles apart.
When the Portuguese arrived in Ceylon (now Sri Lanka) in 1505 there were three Kingdoms, the Sithawaka Kingdom based in Colombo, the Kandyan kingdom based in Kandy and a Thamil kingdom based in Jaffna. They unified the three territories of the island for easy administration in 1833.
The civil war today is the direct result of this British blunder.  In 1948, Britain should have given independence to the three territories, but it gave independence to the unified country in which the Sinhalese enjoy a permanent and perpetual majority.
We sincerely hope you will right the wrongs President Bush has committed by lumping the LTTE with a religiously fanatical Al - Qaeda.

Mr. M.K.Eelaventhan, Tamil National Alliance M.P. (Sri Lanka) is currently on a private visit to Toronto to meet his sister.
He is making use of the opportunity to meet and share his views on the Tamil struggle for justice with Canadians 
who are concerned about the deteriorating security and  human rights situation in Sri Lanka. Especially he will like to interact with media personnel like you. More than 4,000 Tamils have been killed by the Sri Lankan armed forces and paramilitaries operating
along with it since January, 2006. Over 1,000 people have been abducted for ransom and many missing since. Press freedom is also under increased attack from members of the ruling party. Sri Lanka has been ranked a poor 156 out of 169 countries in the World Press Freedom Index released by Reporters Without Borders (RSF).  
So far he has met  a few Members of Parliament belonging to all the parties. In fact he also had the opportunity to meet Hon. Deepak Obhrai, Parliamentary Secretary to the Minister of Foreign Affairs and shared his thoughts with him.
A few months back he  met the Prime Minister of Australia when he visited that country.
I will be pleased if an opportunity is afforded to him to meet you in person.  
Mr.Eelaventhan has nothing but great admiration for Canada - a country that believes passionately in federalism and multi-culturalism 
which had, beside Switzerland, made Canada a unique country and an example to other multi-ethnic, multi-religious and multi-cultural countries. 
He is also of the view that our Prime Minister's declaration that he will introduce a motion recognizing that Quebecers form
a nation "within a united Canada” is welcome and highly commendable. Canada has nothing to lose but everything to gain as a
civilized country to recognize the nationhood of the Quebec people. This is the same recognition the Tamils in Sri Lanka are fighting for without success so far.

Canadian troops in Afghanistan
Dear sir,
Ideologically both Prime Minister Stephen Harper and President George Bush stand on the extreme right. Both are Conservative politicians who imagine themselves as shining silvery knights in armour  charging around the globe with bombs in their hands fighting what we term “terrorism.” This explains why Harper wants to extend the stay of Canadian forces -which is fighting an un-winnable war in distant Afghanistan - till 2011
Canadians thought the US-led forces would do a quick job in Afghanistan and everything was going to be hunky-dory thereafter. Hence the initial euphoria to support the dirty war in the name of fighting terrorism. But, those who read history  should know  that the US, UK and Canadian forces  are  getting deeper into a politico-military quack mire in Afghanistan, where hostile terrain,  cruel climate and unbearable heat makes life hell  for them. No occupation army can be a formidable challenge to the battle-hardened guerrillas for whom fighting meant rightly or wrongly defending their land of birth. When Iraq was bombed into the Stone Age and Saddam Hussein was captured and ‘judicially assassinated’ after a Kangaroo court trial, it was thought that the democratization of Iraq was on the horizon. But, now it is patently clear that those two countries are hurtling down a spiral of uncontrollable violence. The US led occupation army has only succeeded in destroying Iraq, killing millions of innocent people and forcing a quarter of the population into refugee camps!
The war against “terrorism” has only helped to spawn more terrorism as witnessed yesterday’s  bomb blast targeting Benazir Bhutto who struck an unprincipled alliance  with the military dictator who exiled her in the first place to annul corruption cases against her.  
It is time politicians of all shape and hue realise the folly of fighting terror with terror.

It is for nothing Vaiko, the leader of MDMK described Rajiv Gandhi as the greatest fool on earth. The Indian press and the Brahmin lobby make a song and dance about Rajiv' Ghandi's murder as though only his life is precious and the thousands of Tamils killed by the IPKF are simply expendable. If Rajiv Gandhi ordered his High Commissioner in Colombo to kill Prabhakaran, then there is every justification for the latter to kill the former. Rajiv Gandhi, a civilian pilot propelled to the high post of Prime Minister solely based on his dynastic credentials proved himself too small for a big country like India. He has no business to enter into a pact with J.R.Jayawardena, the butcher of Tamils, to disarm the LTTE. It is none of his business to enter into a pact about people who are not citizens of India. The illiterate IPKF did not know why they are fighting, whom they are fighting and where they were fighting. A majority of them thought that they were in Pakistan. Many of them could not read or write. That was the caliber of the Indian forces. Even today the Congress government supports the Sinhalese government because of the supposed affinity between the North Indians and the Bengali immigrants the Sinhalese. And the spineless leader Karunanidhi simply looks the other way when India supplies both lethal and non-lethal weapons to kill Tamils.
As for the claim that the IPKF let off Prabhakaran off the hook is grandmother's story to hide the beating the IPKF received at the hands of the LTTE. Venkad should tell this story to his grandmother. (Response to Anandavikatan article - October 15, 2007)

Tamil community rallies at civic centre
Dear Mr. Lee,
I write in my capacity as a constituent of your riding and as a member of the Thamil Canadian community.  I am somewhat disappointed with the interview you gave to the Scarborough Mirror.
For your information I append below the letter I wrote to the editor, Scarborough Mirror clarifying the difference between the national flag of Thamil Eelam and the flag of the LTTE. Though both carry the Tiger symbol (Sri Lanka national flag depicts a lion with a sword in its paw) they are not the same. The tiger symbol is historically significant to the Thamil people since it was the flag of the imperial Cholas who ruled Thamil Nadu. They were the first to build and command an imperial Navy which controlled the Indian ocean between 8th and 13 th century.
I also take this opportunity to draw your attention to the ruling given by the Supreme Court on the national certificate process declaring section 40.1 as ultra vires of the Charter of Rights and Freedoms. It was under this section which you ardently supported that Manickavasagam Suresh was arrested and incarcerated for two years in prison. The then Liberal Immigration Minister Sergio Marchi signed the security certificate after opposing the very section 40.1 while sitting in the opposition benches. It was such naked display of ministerial arrogance, insensitiveness, down right opportunism, misuse of state power that drove the Liberal Party to the opposition benches once again!
For your information we displayed Canadian flags and sung the Canadian national anthem as we always do at the commencement of the rally. I hope to hear from you as soon as possible. Thanks.

Tamil community rallies at civic centre

Dear Editor,

I refer to the news story Tamil Community rallies at Civic Centre carried in your issue of June 12, 2007. To begin with I wish to thank you for the wide coverage given to the rally in marked contrast to the so called national newspapers which tucked it in a corner. The reporting overall was fair, although your reporter could not resist the temptation to add some spice to the story by contacting politicians who attended the rally as well as those who did not and ask some embarrassing questions. The questions were meant to scare the politicians away from such rallies in future. However, most politicians stood their ground, although a few developed cold feet and tried to wriggle out.
Scarborough Mirror is a community newspaper. As such it should not indulge in such scare tactics which is the stable diet of tabloid newspapers. In fact a sizeable readership of the Scarborough Mirror are Thamils. Thamils who contested the last City Council elections came close second in three ridings in Scarborough.
 
Your reporter instead of giving prominence to the fact that the “rally was meant to inform Canadians about the plight of Tamils in Sri Lanka, particularly recent human rights violations such as disappearances and mass deportations”, began the news story with the sensational claim “hundreds in the crowd waved symbols of the banned Tamil Tigers”. I think the number of flags displayed amounted to not more than 25 for a capacity crowd of 5,000!  

It is unfortunate he was misinformed about the significance of the symbols displayed at the rally by some enthusiastic youths on their own volition. The symbols, especially the flags bore the tiger symbol alright, but they were not the flags of the banned LTTE. This smatter could have been clarified with the organizers. Since the event was a peace rally, organizers did not want to display or carry any symbols, not because they were illegal but they did not want to mix peace with politics.

Let me thank you for sponsoring the Peace Rally and Cultural event held on June 11, 2007 at Albert Campbell Square, Scarborough. Your presence despite short notice is much appreciated.  The crowd that attended the rally surprised us and went beyond our most optimistic expectations.

 

An innocuous banner that read “Stop Genocide” was asked to be removed by the Events Coordinator,   Parks and Recreation. We complied with her request but we see no rationale behind the request. How can one speak about peace without asking  a state that  targets a specific ethnic Thamil minority to bomb, kill, maim and  expel people?

 

I have had an opportunity to read the Staff Report (Interim) dated March 18, 2004 (see below) and I cannot see any prohibition on articulating human rights,  leave alone politics.

 

You will agree we live in a 5 star democratic country. The public should be encouraged to participate fully in political and civic affairs. Freedom of speech is a sine –quo- non for a healthy and vibrant democracy.

 

In the circumstances we like to meet you and discuss a few concerns of our community vis-à-vis the City. . As a City Councillor who is very close to the Thamil community we count on your help and co-operation. Please inform us when and where we can meet you. We prefer to meet at your constituency office. The majority of Buddhist Bhikkus in Sri Lanka are frogs in the well. They can best  be described as political/ religious thugs in saffron robes.  Their brand of  Sinhala Buddhism is  not an all inclusive and compassionate religion. They want to create a Buddhist Nation State.

 The JVP monks and the bhikkus who joined the army after the 1995 breakdown of peace talks defiled Buddhism as a philosophy of peace and non-violence. To the  Sinhala Buddhist Bhikkus and ideologues violence can be justified in the name of defending the unity of land, race and religion in Sri Lanka. Lord Buddha's teaching of Vassetta Suthra, which rejects all divisions between human beings is observed in the breach. Bhikkus as individuals cannot sanction or support or participate in violence.

Their master spoke against violence  not only  to human beings but also against any living being. But these Bhikkus openly trumpet in favour of war.  

An anecdote in Mahavamsa is very relevant and gives the psyche of the political Buddhist Bhikkus.

After his victorious conquest of Anurhadapura and defeat of Ellara the king was reflecting with dismay on the recollection of numerable lives sacrificed in the attainment of his end, eight holy saints (termed Arahats) came to him miraculously and administered spiritual comfort.

And the king said, "Lords what peace of mind can there be left to me, when I have been the means of destroying great armies?" And the saints answered "Supreme of men, from the commission of that act there will be no impediment in the road to salvation. Herein no more than two human beings have been sacrificed; the rest are heretics and sinners, who are on a par with wild beasts. And as thou wilt cause the religion of Buddha to shine forth in great splendour, on that account, O ruler of men, subdue thy mental affliction!" (Mahavamsa, chap, 25). Thus was the king consoled.

This Mahavamsa mind-set continues to this day. Let us not make a mistake about it.

Canadian MP recommends “Decentralized Federal Model” for Sri Lanka
 
Dear Pierre,
 
We welcome your statement asking the Government of Canada to assist Sri Lanka to move into  a decentralized Federal similar to Canada. Unfortunately the present government headed by President Mahinda Rajapakse has turned its back on federal model. Mahinda Rajapakse’s Sri Lanka Freedom Party has submitted a set of constitutional proposals to the All Party Representative Committee (APRC) advocating a unitary constitution with district as the unit of decentralization. Mahinda Rajapakse has further claimed that his party’s proposals are not negotiable! This has not only put the clock back  by few decades, but also reflects the chauvinistic megalomania of the government.  Even S.W.R.D. the founders of the SLFP as way back in 1957 agreed for decentralization with province as the unit of devolution.
 
The ethnic conflict in Sri Lanka has been festering for well over half-century. The present armed struggle by the Thamils arose after 30 years of peaceful agitation failed to produce results.  The Thamils have lost faith in Sinhalese politicians ever agreeing to decentralization of power to the periphery. Hence, the demand for separation and establishment of a sovereign state of Thamil Eelam.
 
The biggest obstacle to the resolution of the conflict is the Mahavamsa ( a Buddhist Chronicle written in the 6th century AD by a Buddhist Monk for the serene joy and emotion of the pious Buddhists) mind-set of the majority Sinhalese – Buddhists. This Mahavamsa  mind-set drives the Sinhalese – Buddhists to  believe that the Island belongs to Sinhalese –Buddhists only and they are the chosen people of Lord Buddha. The Thamils are simply invaders across the Palk  Strait!  You will agree mixing politics with religion is a lethal cocktail and as long as this extreme manifestation of fascist mentality persists a reasonable political solution to the ethnic conflict will be elusive, if not impossible.
 
The Conservative government ‘s decision to  ban the LTTE while the now collapsed peace talks were in progress has embolden the Sri Lankan government to seek a military solution to the conflict. The designation of LTTE as foreign terrorist organization has also helped to demonize  the entire Thamil Canadian community.
 
If the Conservative government is serious, it should give a deadline to the Sri Lankan government to come up with a federal model constitution that will satisfy the political aspirations of the Thamil people. If the GoSL does not respond positively then the Conservative government should recognise the de  facto state of Thamil Eelam. Since time is running out the Conservative government should act fast. Any failure will result in Thamils who already feel they have been unfairly demonized rejecting the Conservative Party in toto at the next general elections.

The report called for action from the Government of Canada to use its influence to put an end to the tragic fighting, rampant human rights abuses and discrimination in aid distribution throughout Sri Lanka.
The report was released at a press conference held at the Hotel Intercontinental downtown Toronto from 5:45 p.m. to 6:45 p.m. Other Conservative Party members also participated in the press conference.
Mr Poilievre urges immediate aid distribution to the displaced fleeing battle areas, and full audit of Canadian funds contributed to Sri Lanka to ensure that the funds were spent effectively and equitably in reconstruction projects.
"Canada should advocate for, and participate in, an international human rights monitoring mission under the auspices of the UNHCHR. This mission should be completely separate and independent from the Government of Sri Lanka and the LTTE, and should issue public findings," the MP recommends in his report.
Mr Poilievre visited Sri Lanka in the spring of 2005 to view the conditions on the ground, and had met Government officials and members of the civil society.

Thanks for raising Tamil concerns in the House of Commons.

As correctly pointed out by you,  the Canadian government remains deaf and dumb to the blatant human rights violations against Thamils in Sri Lanka by the Sinhala government.

There has been a spate of abductions for ransom by the security forces assisted by the para-military forces operating with the armed forces. Out of more than 90 Thamil and Muslim businessmen abducted 19 have been killed, 9 released and the fate of others not known.

The Secretary of Defence Gothabaya Rajapakse who is also the brother of president Mahinda Rajapakse confessed in his interview to BBC and Reuters that the abductions are part of counter-insurgency operations just like  American CIA's "covert operations." It is a matter of playing with words Gothabaya claimed.

That is  he justifies the  abductions for ransom and subsequent killings. Many Thamil businessmen who feared for their life have escaped to other countries like India and Malaysia. Here is the interview he gave to BBC -

(LeN-2007 June 16, 11.00am) The recent interview by Gotabhaya Rajapaksa is very revealing in that he has made a tacit admission that abductions were taking place but found fault with how it is termed.

He claimed in his interview with the BBC recently that the West practices what he called "double standards". "All the militaries do covert operations," he said. "When the US does operations they say covert operations. When something is in Sri Lanka they call abductions. This is
playing with the words"

So essentially the Defense Secretary, who worked as a petrol pump attendant in the US at one time, admits that abductions are done but they are
justified on the basis that they are covert military operations. He takes exception to the term "abductions" and wants it to be called a covert
military operation.

How similar these activities, taking place in Sri Lanka today, are to those carried out by the American forces are probably best known to American
Citizens like Gotabhaya Rajapaksa. But the accepted definition of abductions given in the Oxford Dictionary; "take (someone) away by force or deception" is what we go by. Furthermore, whatever way we term it, the act of taking someone away by force is morally, legally and ethically wrong - then again the Defense Secretary must be having his own way of defining these words as well. An Opposition MP Lakshman Seneviratne accused Gothabaya Rajapakse  in parliament charging "  that a DIG in the police is involved with the
murders, abductions and ransom takings that take place in Colombo.    He also named those directly involved for the abductions. Among those  accused for direct involvement of abductions, demands for ransom and murders are government spokesman Keheliya Rambukwella, Mervyn Silva, Colombo DIG Rohan Abeywardane, former Air Force squadron leader Nishantha Gajanayake, and defence secretary Gotabhaya Rajapaksa.

He said that DIG 'Rohan Abeywardena' and a Squadron Leader of Air force Nishantha Gajanayake are closely working with the Karuna Fraction to carry out the murders and abductions. The MP said that 'Nishantha Gajanayake' is currently residing in the 'Holiday Inn hotel' and that his bills are being paid by a businessmen called 'Gajadeera' who is a brother of a Minister. The UNP MP went on to say that Nishantha Gajanayake is lodging in room number 706 in the hotel.

The abduction and brutal murder of two Sri Lankan Red Cross Society (SLRCS) employees, both Tamils, on June 1 has further exposed the Colombo government's lie that its security forces have nothing to do with the hundreds of disappearances and killings over the past 18 months.Seneviratne pointed out that the murdered two Sri Lanka Red Cross Society Volunteers were also lodging at the Holiday Inn hotel while they were in Colombo.

    Mr. Speaker, after a year during which the Sri Lankan army killed humanitarian workers and bombed civilians, we learned last week that Tamil civilians had been driven out of the capital at gunpoint.

    When international groups protested these mass expulsions, the Sri Lankan defence secretary accused the international community, especially the U.K. and European nations, of bullying his country over human rights.

    Meanwhile, the Government of Canada has remained relatively silent, and has not followed the lead of Great Britain, Germany and the United states by cutting off aid to Sri Lanka.

    It is time for Canada to finally suspend aid and trade until the Sri Lankan government starts respecting the human rights of Tamil civilians.

Tamil community rallies at civic centre

Dear Editor,

I refer to the news story Tamil community rallies at civic centre carried in your issue of June 12, 2007. To begin with I wish to thank you for the wide coverage given to the rally in marked contrast to the so called national newspapers which tucked it in a corner.  The reporting overall was fair, although your reporter could not resist the temptation to add some spice to the story by contacting politicians who attended the rally as well as those who did not and ask some embarrassing questions.  The questions were meant to scare the politicians away from such rallies in future. However, most politicians stood their ground, although a few developed cold feet and tried to wriggle out.

Scarborough Mirror is a community newspaper. As such it should not indulge in such scare tactics which is the stable diet of tabloid newspapers. In fact a sizeable readership of the Scarborough Mirror are Thamils.  Thamils  who contested the last City Council elections came close second in three ridings in Scarborough.  

Your  reporter instead of giving prominence to the fact that the “rally was meant to inform Canadians about the plight of Tamils in Sri Lanka, particularly recent human rights violations such as disappearances and mass deportations”,  began the news story  with the sensational claim “hundreds in the crowd waved symbols of the banned Tamil Tigers”. I think the number of flags displayed amounted to not more than 25 for a capacity crowd of 5,000!  

It is unfortunate he was misinformed about the significance of the symbols displayed at the rally by some enthusiastic youths on their own volition.  The symbols, especially the flags bore the tiger symbol alright, but they were not the flags of the banned LTTE. This smatter could have been clarified with the organizers.  Since the event was a peace rally,   organizers did not want to display or carry any symbols, not because they were illegal but they did not want to mix peace with politics.  

For your elucidation it is an offence if one provides “material support” to the LTTE. Material support means providing funds or holding membership.  Whether waving even the real tiger flags will constitute an offence is debatable or an issue that has to be tested in a court of law.  The flags your reporter saw at the rally are the national flags of Thamil Eelam. .

No doubt Durand Appuhamy is an old fashioned Sinhalese racist as his name suggests. Pretending to be an expert on political and military affairs he has made some astounding claims. One such claim is "Nevertheless the Tamils in the east recently demonstrated the conditions necessary to make them abandon the LTTE. When the security forces militarily defeated the LTTE and chased them away from their bunkers, the Tamil people abandoned the LTTE walked miles to get to government areas. “This is preposterous claim.  THAMIL PEOPLE WERE FORCED TO FLEE TO ARMY CONTROLLED AREAS NOT BECUASE THEY LOVE THE ARMY AND HATED THE LTTE IT IS SIMPLY SAVE THEIR LIVES. IT IS THE INCESSANT BOMBING AND ARTILLERY FIRE THAT LEFT THE THAMIL PEOPLE WITH NO CHOICE BUT TO FLEE.

Now comes the news that the government by a gazette notification has created a new HSZ. According to the Gazette notification, the new HSZ will bind from East: Eastern Coastal belt, joining the villages of Foul Point, Illankanthai, Kalladichanei and Uppural. South : Uppural, Selvanagar, Thoppur and Pachchanoor: West : Along the Western Bank of the Kalladichanei Aru, joining the villages of Pachchanoor, Kalladichanei South, Mutur and the Kalladichanei Aru Estuary; North : Along the Southern Beach of Koddiyar Bay, joining Kalladichanei Aru Estuary with the villages of Sampur, Shell Bay and Foul Point.

This racist editor who accuses the LTTE of ethnic cleansing of Muslims from the North forgets the large scale ethnic cleansing of Tamils by successive Sinhalese governments in the North and East. He conveniently forgets the fact that Thamil people suffered most under UNP governments than SLFP governments.

The state sponsored Sinhala colonization of Allai, Kantalai, Morawewa, Padaviya in Trincomalee district and Gal Oya and Maduru Oya by   UNP/SLFP regimes have drastically altered the demography of Northeast.  In the Eastern province the Thamils have been reduced to a hopeless minority. Only Batticaloa district. has been spared somewhat. Let me elaborate for the education of this racist editor who sermonizes others about the wholesale ethnic cleansing carried out in Manal Aru by state sponsored Sinhala colonization in the mid eighties. 

It was Gamini Dissanayake who named  Manal Aru  as Weli Oya  by an extra ordinary gazette notification dated 16th April, 1988, Manal Aru area in the Mullaitivu and Vavuniya Districts was proclaimed the 26 th District of Sri Lanka and for administrative purpose brought under the jurisdiction of the Government Agent, Anuradhapura. For election purpose it was included in the Vavuniya Electoral District.

A total of 13,288 Tamil families living in 42 villages for generations including Kokkulai Grama Sevakar Division (1516 Tamil families), Kokku –Thoduvai Grama Sevakar Division (3306 Tamil families), Vavuniya North Grama Sevakar Division (1342 Tamil families), Other Divisions of Mullaitivu District including Naiyaru and Kumulamunai (2011 Tamil families) were asked to vacate their homes and farmlands within 48 hours on pain of eviction by force in case of default. This threat was issued by the army over the public address system.

Simultaneously land given to 14 Tamil entrepreneurs, including Kent Farm and Dollar Farm, on 99 years lease was also cancelled and taken over by the government. Settlements in the Weli Oya began in 1984 as a dry zone farmer colony under the land Commission, but it was later acquired by the Mahaweli Economic Agency in 1988 and declared as the Mahaweli ‘L’ zone.

The Mahaweli ‘L’ zone was established specially for coconut cultivation and each Sinhalese family was given 5 acres of land consisting of ½ acre for residence, one-acre of irrigated land and 3 ½ acres for coconut.

The Mahaweli Economic Agency (MEA) financed all development projects while Mahaweli Engineering and Construction Agency (MECA) handled all the construction works such as roads, electricity, houses etc. In 1998 alone Rs. 72 million was allocated for construction of roads.

The Sinhalese army did translate its threat and used force as promised. Thousands of Tamil villagers, some of them Hill country Tamil refugees victims of earlier Sinhalese violence in 1983, were driven out or they on their own fled in terror. Some were murdered by the army. One night alone 29 Tamil villagers were killed at Othiyamalai, a hamlet situated north of the Weli Oya colony.

The evil-minds and the driving force behind the Weli Oya Sinhalese colonization were Messrs. Gamini Dissanayake, Minister for Mahaweli Development, Lalith Athulathmudali, Minister of National Security, Cyril Mathew, Minister of Industries and Scientific Affairs and N.G.P. Panditaratne, Chairman Mahaweli Development Board.

The ‘gang of four’ openly advocated the colonization of the North and East in general and Weli Oya in particular by Sinhalese settlers after driving the Tamils out by using the Sinhalese army.

Industries Minister Cyril Mathew diverted millions of rupees allocated to various Corporations under his Ministry to finance Weli Oya colonization scheme. In addition institutions like All Ceylon Buddhist Congress, Bhikku Peramuna etc. helped in providing financial and other material aid to the Sinhalese settlers.

From 1988-89 Sinhala colonization of Weli Oya was put on a war-footing. A total of 3364 families, most of them ex-convicts brought straight from prisons, were settled in Weli Oya. A further 35,000 persons comprising 5, 925 families were also settled under the same scheme. It is in recognition of the ‘yeoman services’ rendered by the top elite of the Sinhala army, especially that of Major General Janaka Perera, the Tamil village of Thannimurippu was re-named Janakapura in his honour! This is the same Janaka Perera Ranil Wickremesinghe wants to be appointed the Defence Secretary!

Today, as mentioned earlier, the Thamils have been reduced to a hopeless minority in the East. Batticaloa is the only district that still has Thamil majority.

And what about the ethnic cleansing of Sampur last August? It is nearing a year and still the Thamils forced out of Sampur are languishing in refugee camps.

As usual in your anxiety to demonize the LTTE to please your paymasters, you have deliberately put a spin on the Jordanian ship Farah 111 that drifted off the coast of Mullaithivu.  The ship  was not “hijacked” by the LTTE but  due to engine failure it drifted off  Mullaithivu coast. The LTTE saved the ship crew and promptly handed them over to ICRC (Red Cross). Thereafter, it  was up to the Jordanian authorities or Sri Lankan authorities to salvage the ship with the cargo. This they failed to do. Did the captain of the ship claim his ship and crew was “hijacked” the LTTE as you try to paint? You say the ship was carrying 14,000 tons of rice from India so what?

You are shedding crocodile tears for the 11 fishermen who claim that they were abducted by the LTTE and released by them almost 2 months later. But then where are your tears for the 77 Thamil Nadu fishermen who the Indian Defence Minister told parliament were KILLED  by the Sri Lankan Navy?  When the Sri Lankan navy shoots and kill TN fishermen the Brahmin gang  (N.Ram, B.Raman, Col.R.Hariharan and CO) look the other way. Will not write a word about them. But when there are allegations – mind you for the first time- that LTTE abducted TN fishermen  they all jump from their seats like jackals!

I will also like to know from you  where you got the evidence to claim that  the boat sunk by the Maldivian coast guard was in fact Krishna – the boat allegedly hijacked by the LTTE on March 06, 2007

If you are an analyst you should hold the scales even - presenting both sides of the story. Otherwise the tag that you are a mercenary propagandist for the terrorist state of Sri Lanka will get confirmed twice over!

Not surprisingly the article written by Col. R. Hariharan is not pleasing to the racist editor of The Island. Nothing shall please Sinhala racists who have lost all sense of shame or commitment to truth. Although the editor sermonises others on the virtue of truth, uprightness, honesty etc. he himself is guilty of writing blatant lies. Let us look at the most audacious lies.

The LTTE put the peace process in abeyance in April 2003 citing GOSL’s action in regard to resettlement of refugees and dismantling of High Security Zones created by the SLA On October 31, 2003 the LTTE submitted its Interim Self-Governing Authority (ISGA) proposals. The LTTE focused its attention for nearly six months on the production of its interim administration proposals, holding a wide range of consultations with local and international experts in its capital of Kilinochchi and also in numerous foreign countries, including France, Northern Ireland, Denmark, Norway and Switzerland. The document they have produced was a concise exposition of Tamil thinking subject to negotiation. 

On the following on November 1, the LTTE proposals were released to the media at its headquarters in Kilinochchi, and thereby made known to the general public.

Prof G.L. Peiris though not in with the ISGA in Toto he said that it could form the basis for further talks. Chandrika uses ISGA proposal as evidence of UNF government weakness, and takes over the Defence, Media and Interior Ministries in November, with the intent to dissolve Parliament and call a general election.

On November 27, 2003 Prabhakaran declares on Heroes’ Day that “If the Sinhala chauvinistic ruling elites continue to deny the rights of our people and oppose reconciliation and if the conditions of oppression continue, we have no alternative other than to secede and form an independent state invoking the right to self-determination of our people.”

Little does the racist editor realise that this is an unvarnished lie. He is trying to hide a whole pumpkin inside a plate of rice. At the talks held in Oslo, the Norwegian capital, from December 2 to December 5 2002 the LTTE and the UNF arrived at an agreement to explore the feasibility of a federal structure to resolve the ongoing ethnic crisis. The formal declaration by the LTTE in Oslo to explore a federal solution was only a logical follow-up to Prabhakaran's earlier declaration in the Vanni. On November 27 at the "maaveerar naal" (great heroes day) public rally in Puthukudiyiruppu Prabhakaran said his willingness to seek a federal solution. He said the LTTE was prepared to accept a federal solution that enshrined the principle of internal self-determination. If the Sinhala polity was not prepared to grant that, then the LTTE would have no choice but to exercise the right of external self-determination and pursue the goal of secession, he warned.

The LTTE leader sought to rationalise his changed political approach in the following manner: "As a distinct people the Tamils are entitled to the right to self-determination. The right to self-determination has two aspects — internal and external. Internal self-determination entitles a people to self-rule. The Tamil people want to live in freedom and dignity in their own lands, in their historically constituted traditional lands, without the domination of external forces. They want to protect their national identity, pursuing the development of their language, culture and economy. They want to live in their homeland under a system of self-rule. This is the political aspiration of our people. This constitutes the essential meaning of internal self-determination. We are prepared to consider favourably a political framework that offers substantial regional autonomy and self-government in our homeland on the basis of our right to internal self-determination. But if our people's right to self-determination is denied and our demand for regional self-rule is rejected, we have no alternative other than to secede and form an independent state."

An elated Prof. G.L.Peiris told the delegates as follows:

 "Balasingham is entirely correct when he says a paradigm shift which not more or less that has occurred in Oslo in the last three days of healthy discussions. In Mr. Prabhakaran's hero’s day speech he said that the LTTE is no longer insisting on a separate state. And the LTTE is looking at a separate concept, which is internal self-determination. It was power sharing. Extensive power sharing within the framework of one country. No question of secession, no question of separation. But power sharing within the framework of one country. That is the point of departure. Immediately that provided us with a coherent framework to evolve a negotiated political solution. The position of the government of Sri Lanka is also that it stands for substantial power sharing within one country. The breakthrough yesterday was that the explicit identification of a federal structures the basis on which a political solution will be evolved. Now we have a clear of the nature of the political solution the parties are working towards. It is not separatism, it is not confederation”.

It is the GoSL which failed to honour the Indo-Ceylon agreement. It failed to hold elections for the Northeast since 1989. Varatharaja Perumal, chief minister of Northeast said he did not have even a chair to sit. No wonder he declared unilateral independence!

If the Sri Lanka Navy intercepts an Indian fishing craft straying into the Sri Lanka’s territorial waters, India swings into action, as if her sovereignty were threatened. But, when the LTTE blasts Indian dredgers engaged in the Sethusamudram Project, captures India trawlers and takes Indian fishermen hostage, India looks the other way.

India also keeps mum when TN fishermen are shot and killed by the trigger happy Sinhla Navy. The Defence Minister of India told parliament last Wednesday  (May 12) that 77 Indian fishermen had been killed between 1991 and mid April 2007 by the Sri Lankan Navy. 11 out of 12 TN fishermen supposed to have been abducted by the LTTE have mysteriously appeared at Rameshwaram today.

Thanks to this racist editor Sri Lanka, a failed and corrupt state, is losing the few  friends left at light speed!

In Sri Lankan folklore, there is a bovine king called Kekille, who is well known for his absurd judgments. Here is one: He once found a newly built wall around his palace warped. Furious, he sent for the mason concerned. The poor man pleaded for mercy and made a clean breast of what had really gone wrong. While building the royal wall, he said, he had been distracted by a buxom woman who used to go past him several times a day. He blamed her for the warped wall. The king, true to form, set him free and ordered that woman to be brought forthwith. Hauled up before him, she told the king that she had to make several trips past the palace to meet a goldsmith, who had failed to deliver her jewellery on time. She, too, was allowed to go. Finally, the goldsmith was put to death with no questions asked.

Kekille seems to have been cloned and sent, like Sri Lankan elephants, to those countries that have evinced a keen interest in the conflict here and are proffering solutions.

Today, we reproduce on this page an article, from the Asian Tribune, by Col. R. Hariharan, an intelligence specialist on South Asia and retired military officer who was the head of intelligence of the IPKF in Sri Lanka from 1987 to 1990. The singular achievement of the SLFP’s devolution proposals, he says, will be to ‘bury the peace process along with the concept of federalism that forms the backbone of the Oslo Accord."

The SLFP proposals, he says, ‘cut at the very roots of the present peace process in which both sides [the UNF government and the LTTE] had agreed to find a solution within a federal format’. The SLFP may be faulted for its proposals and its critics are entitled to their views, but the fact remains that the proposals in question are ‘cutting at the roots’ of something that is long dead. For, at present there is no peace process, to begin with. If there is any such process, how could there be war? The peace process is as dead as a dodo in all but name, whether one likes it or not.

Former President Chandrika Kumaratunga, who led the SLFP, says Col. Hariharan, was clearly in favour of a federal solution. He hits the nail on the head! In 2000, she presented a package of constitutional reforms coterminous with a federal solution in the form of Regional Councils, which went beyond the existing Provincial Councils. Her package was shot down by the UNP and the JVP in Parliament. Before that, the LTTE had contemptuously spurned it.

Thus, it could be seen that the separatists have rejected devolution at the district level (District Development Councils 1981); at the provincial level (Provincial Councils 1987); at the regional level (Regional Councils 2000) and at the national level (Oslo Accord). The LTTE is demanding an ISGA, as from there Eelam is only a hop, skip and jump away!

Col. Hariharan says the reaction of the government to the friendly foreign governments’ call for Sri Lanka ‘to show more positive action to put the peace process back on the rails’ has been paranoid. (Emphasis added). It is good to hear Sri Lanka has friends. But, in practice what do those ‘friends’ do? Never mind others. How is India helping Sri Lanka? When her troops were trapped in Jaffna and help was sought desperately, it was not big guns that India offered but ships to ferry the army back to Colombo! If the Sri Lanka Navy intercepts an Indian fishing craft straying into the Sri Lanka’s territorial waters, India swings into action, as if her sovereignty were threatened. But, when the LTTE blasts Indian dredgers engaged in the Sethusamudram Project, captures India trawlers and takes Indian fishermen hostage, India looks the other way. Worse, the Indian Prime Minister receives LTTE proxies despite the Indian ban on the LTTE! India prevents Sri Lanka from acquiring sophisticated radar systems from China to counter LTTE air threats. (Isn’t big India also being paranoid?) Ironically, there are reports that India is going for Israeli radar systems in view of LTTE air threats. Most of all, it is India which created the LTTE as part of her foreign policy to frighten Sri Lanka into submission under the JRJgovernment.

Isn’t it natural that Sri Lanka has become paranoid?

If those countries, which Col. Hariharan refers to, are Sri Lanka’s friends, then she doesn’t need enemies! He says there has been ‘a progressive hardening in the attitude of international players towards Sri Lanka despite their acceptances of the need to control the LTTE violence and safeguard national security.’ The discerning may wonder whether their attitude was ever ‘soft’, as far as Sri Lanka is concerned.

"The peace process and the political issues connected with it," says Col. Hariharan, "have no place in the President’s scheme of things at present." That may be so. But, what about Prabhakaran? Do the peace process and the political issues connected with it have any place on his agenda?

Col. Hariharan ventures some predictions. The LTTE, he says, is likely to step up its commando operations in the Jaffna peninsula. Who doesn’t know that? That is what the LTTE has been preparing for since the day the CFA was signed. It abused the truce to smuggle lethal material into the peninsula. The Colombo port and the airport are likely to continue to figure in the priority list of the targets for sneak air and commando raids, he says. That, too, is no prediction. The LTTE is already trying to attack them. And it will continue to do so.

What we are not told is that Prabhakaran is left with no more rabbits to pull out of his hat. His wheel of terror has turned a full circle. If the LTTE’s conventional war capability is weakened, as Col. Hariharan says, then it will have to begin from the very beginning after twenty years of fighting while the state remains resilient.

A peaceful solution is, no doubt, the best way out as this country has suffered enough. But, peace making is not something that can be achieved by a government alone. The LTTE must also be amenable to a political solution. Else, no amount of pressure on the state is going to help resolve the conflict. Instead, that will lead to the perpetuation of the war.

It is the duty of the ‘friendly’ nations, including India, to stop doing a Kekille and make the LTTE fall in line. Trying to resurrect a mummified peace process is an exercise in futility. Let there be a brand new peace process, free from a bias for either party to the conflict, with a better monitoring mechanism.

There is much more blood letting on the horizon.

US Ambassador says diplomats not LTTE’s target

Dear Mr. Ambassador,

We wish to express our relief over your narrow brush with death when military helicopters carrying foreign diplomats and UN officials to Batticaloa came under mortar attack.

Mahinda Rajapakse’s government true to form  is  exploiting the unfortunate incident to launch a feverish and well orchestrated  campaign to discredit and demonize the LTTE   that it tried to assassinate the diplomats! This, despite your denial   that “I do not believe the LTTE intended to target diplomats and UN officials.”

Sri Lanka`s Defence Secretary has blamed the diplomats saying “they should share the blame for the near-disaster for asking to visit Batticaloa.”  He has slammed as `interference` attempts by foreign dignitaries and NGOs to visit the war torn Northeast.

Iqbal Athas, the defence columnist of The Sunday Times (March 04, 2007) has given a detail account of the sequence of events on the fateful day that would have easily ended in a monumental tragedy.  According to his narration –

Just past 8.30 a.m.  CSS model five-seater Cessna aircraft landed at the air base in (Puthur) Batticaloa.  Amin Awad, representative of the United Nations High Commissioner for Refugees (UNHCR) in Sri Lanka alighted and walked away.  Just then, loud explosions began to render the air. Mortars rained. At least four of them fell near the parking apron. One caused scrapes on a wing of the Beech craft. Sensing danger Captain Izzadeen took off immediately and headed for Amparai.

In the meantime air traffic controllers had radioed the Mi-17, doing its finals for landing, to hold. The Bell 212 was also told to follow suit. The two helicopters that had reached the skies over Batticaloa around 8.30 a.m. were thus circling in a loop. Minister Samarasinghe, who occupied a forward seat asked his next passenger, Governor for North and East, Rear Admiral (retired) Mohan Wijewickrema "have we missed the landing area?" He replied, "There appears to be some confusion. Not sure whether someone had taken pot shots at the Air Force down there." The helicopters were in that holding position for almost 25 minutes. Then the air traffic controllers cleared the Mi-17 to touch down at the Weber Stadium, located two kilometers away from the Air Force base at Puthur.

 

Weber Stadium houses the military head office complex as well as artillery positions.  Same morning the army has fired artillery shells towards LTTE controlled areas. It was, therefore, height of folly on the part of the air traffic controllers to clear the helicopters to land despite shells falling at Puthur airfield just under an hour before.

 

If the fall of shells is a tragedy of errors, then the decision by the diplomats and UN officials to visit the war ravaged areas was a comedy! When Sri Lankan armed forces shelled and bombed LTTE controlled areas for several weeks, these diplomats remained deaf, dumb and blind spectators.  Over 250 people died and 75,000 men. women and children were forced out of their villages and homes. These unfortunate people were damned to starve without proper shelter, food and medicine.  Military refused permission for UNICEF, UNHCR and Red Cross to enter Vaharai to provide humanitarian relief assistance.

After declaring that you do not believe the LTTE intended to target diplomats and UN officials you went on to proclaim “the United States strongly condemns all terrorism and calls on the LTTE to renounce terrorism and violence.”  On this issue Mr. Ambassador, we beg to disagree.  We don’t accept the US concept or definition of “terrorism and violence.”

LTTE is engaged in a liberation struggle just like the ANC during the white apartheid rule. . If you cared to find the reasons why LTTE took up arms in the first place you would not have asked them to “renounce terrorism and violence.”  And if you care to study your own history - the US War of Independence was dubbed by imperial Britain as “terrorism” and George Washington a wanted “terrorist - you would not have asked the LTTE to renounce terrorism and violence. 

A majority of Americans now believe that it is the US which is spawning terrorism and violence by illegally attacking and occupying Iraq.  President George W. Bush openly broke many times international law, Geneva Conventions and violated the UN Charter when he unleashed brutal force and horrible violence against Iraq.  His Shock and Awe bombardment of Baghdad was designed to intimidate and coerce the government as well as the civilian population of that nation to regime change.  Yet, in spite of such tactics with frequent use of such heavy ordnance, US forces have not covered themselves with glory in Iraq or Afghanistan.   US forces have killed over half a million Iraqis and driven 3 million as refugees to other countries!  Mr. Ambassador, if Terrorism is the unlawful use of force or violence against persons or property to intimidate or coerce a government, the civilian population, or any segment thereof, in furtherance of political or social objectives" (US Federal Bureau of Investigation) then US is guilty by its own definition!  Iraq and Afghanistan are symbols of US militarism, unilaterism and abuse of UN Charter.   And US Guantanamo naval base is an affront to contemporary civilisation and to all notions of justice. 

The Thamils are a peaceful and docile people, but unbridled state terrorism has driven them to use revolutionary force to counter state terrorism. Resistance to occupation is a basic human right as well as a moral responsibility of all citizens.  You will agree Mr. Ambassador that no Thamil party is beating the war drums, but every Sinhalese party does under the cloak of fighting terrorism.

Ironically US had readily obliged the war mongers by labeling the LTTE as a terrorist organization. Such labeling has emboldened the racist Rajapakse’s government to seek a military solution at all costs. When the US government provides funds, arms, ammunition, warships, training and intelligence to the Sri Lankan armed forces they become a lethal cocktail for more war and more destruction.

Finally, despite US antagonistic stance, we still wish to thank you for repeatedly asserting that “LTTE cannot be defeated  militarily and that only devolution of powers that satisfy the 'legitimate aspirations' of the Thamil people  could be the basis for any negotiations between the GOSL.”

Dear Mr. Jesudasan

When Kodeeswara's  case came for trial in order to avoid an awkward hearing on the validity of the Sinhala Only Act, the Attorney General raised a preliminary objection, viz., that a public servant was not entitled to sue the Crown (i.e. the State) for arrears of salary.

O.L. de Kretzer who was then district judge, over-ruled the preliminary objection. de Kretzer also ruled in favour of Kodeswaran on the incompatibility of the Sinhala Only Act and Section 29, deeming the Act bad in law. The arguments will become evident in what follows.

Shortly after the judgment was delivered in 1964, the Attorney General appealed against it at the Supreme Court. The case was argued before a bench comprising Chief Justice H.N.G. Fernando and Justice G.P.A. Silva. The team for the Crown (Defendent - Appellant) was led by Walter Jayawardena QC, Acting Attorney General, who was assisted by H. Deheragoda and H.L. de Silva. The team for Kodeswaran (Plaintiff-Respondent) was led by C. Ranganathan QC.

The verdict was delivered in 1967 by H.N.G. Fernando CJ, setting aside the verdict and decree of the District Court (70 NLR 121). The arguments used are instructive and involved which law (Roman Dutch Law or English Law) is applicable. 

As the first stage of the judgement, it was concluded by Fernando CJ that the Proclamation of 1799 under the Governor, Lord North, did not intend to cover relations between the Crown and persons employed by the Crown. It was thus determined that these relations are covered by English common law, rather than Roman-Dutch Law.

The Supreme Court in its judgement in Kodeswaran's case played down previous  conclusion of the Privy Council (in 1884), and used mainly its inability to find conclusive antecedents in Roman-Dutch Law.  Fernando CJ thus concluded that Kodeswaran's right to sue the crown must be determined under English common law.

The Supreme Court thus set aside the District Court's judgement on this preliminary issue. H.N.G. Fernando CJ stated in his judgment that he had not called upon the Acting Attorney General to submit his arguments on the Sinhala Only Act, since the action had been decided on a point of a general law.

Kodeswaran appealed to the Privy Council in 1968 (72 NLR 337) and the case was heard before Lord Hodson, Viscount Dilhorne, Lord Pearson and Lord Diplock. Among those representing Kodeswaran were Sir Dingle Foot QC, Ranganathan QC and S.C. Crossette-Thambiah. Among those representing the Attorney General were E.F.N. Gratiaen QC and H.L. de Silva.

The judgment of the Privy Council was delivered by Lord Dip on 11th December 1969, on the eve of the 1970 general elections, setting aside the Supreme Court judgment on the preliminary issue.

Below is the main thrust of the judgment:

1) It was the intention of the Proclamation of 1799 that the Roman-Dutch Law shall apply to public servants recruited on local terms. The reasons are three-fold:

(i) The Proclamation marked the re-introduction of the system of administration by local officials

     that had prevailed under the Dutch, the abolition of which, after the capture of Colombo and

     Trincomalee by the British East India Company had led to rebellion in 1797.

(ii) The British occupation was then (in 1799) deemed temporary. This was so until Holland ceded Ceylon to Britain under the Treaty of Amiens in 1802.

(iii) The legal character of a contract, which the Roman-Dutch Law ascribed to the relationship  between the Crown and public servants in Ceylon, and recognised long in practice, had no  incompatibility with the rights and dignities of the sovereign.

2.) The current of authority in English public law since early in the 19th century is that the arrears   of salary of a civil servant of the Crown constituted a debt recoverable by Petition of Right. Lall's case on which the Supreme Court relied is not a good example because most of the argument in that case centered around the question of dismissal. Moreover, none of the pertinent earlier authorities on the question of recoverability of arrears was drawn to the attention of the Privy Council in Lall's case. Mulvenna's case of 1926 on which the judgment in Lall's case relied for the question of arrears, has not since been treated as correctly laying down the Law, and Lord Blackburn's judgment in that case did not have the concurrence of the other two judges.

        3.) While 1) and 2) above are interesting in themselves, the crucial question is what does the common law in Ceylon have to say on the subject? The right to sue the Crown upon a contract had long been "sanctioned by the Courts and acquiesced in by the Government". When its propriety was questioned in Jaywardena's case, it was Chief Justice Cayley's contention that it was too late in the day for him to declare the practice bad in law. He added that if the precedents and decisions upon which this Court acts are wrong, it must be left to the Court of Appeal to set them right.

However, when the Privy Council considered the question shortly afterwards in Simon Appu's case in 1884, they declared the practice incorporated into the law of the land.

It is this that is relevant to Kodeswaran's case and not the uncertainty about the derivation of the practice from the Roman-Dutch Law, which the Supreme Court relied upon as a point of departure. Indeed, had the attention of the Privy Council in 1884 been drawn to the passage from the work of the eminent early 17th century Dutch jurist Hugo Grotius, which contains the words that follow, their Lordships may well have ascribed the practice in Ceylon of suing upon a contract, to the Roman-Dutch Law:

"...we say that a true and proper obligation arises from a promise and contract of a king, which he  has entered into with his subjects, and that this obligation confers a right upon his subjects....."

                      -De Jure Belli ac Pacis, Book Three.

However, it may be difficult to trace the evolution of the practice of suing the Crown in Ceylon to the Roman-Dutch Law for a number of reasons. Combined with the paucity of records it had acquired the character of a "taken-for-granted" law. But the Roman-Dutch Law, which was the starting point of the common law in Ceylon, has been used over the years to find solutions to legal problems in Ceylon, resulting in the evolution of an indigenous common law. Thus if precedents for a proposition of law can be found in the decisions of the Ceylon courts themselves that are not inconsistent with the British constitutional concept of sovereign authority of the Crown, there is no need to look for precedents in English common law or to Dutch jurists of the 18th century.

The Privy Council declined to comment on the other issues (e.g. the Sinhala Only Act) since neither they nor the Supreme Court had heard any arguments on these matters, and thought it inappropriate to comment without the considered opinion of the Supreme Court of Ceylon.

It is worth noting the gravity of the Privy Council decision in favour of Kodeswaran. It had rejected the Supreme Court's contention on every key point. Ironically, it took the Privy Council in London to tell our judges, "Look, you have your own indigenous common law. The solution to your problem lies there and is quite unambiguous, having the authority of more than a hundred years!"

Thus by means of a tortuous argument the hearing on the validity of the Sinhala Only Act was circumvented. This was achieved, by the Supreme Court granting to Queen Elizabeth II, a feudal right that had become void in England for more than a century. The ruling, apart from being contrary to natural justice, rendered the Law nebulous rather than transparent.

With the case having been remitted by the Privy Council to the Supreme Court for a hearing on the validity of the Sinhala Only Act and the treasury circular, it should have got listed. We understand that it was not pursued by either side. One reason for it is that the treasury circular stopping the salary increments of those who did not pass the tests in Sinhalese had been amended in the mid-60s and all Tamil public servants received their arrears of salary. That was the time the Federal Party's support was being canvassed by both the SLFP and the UNP.

An important point is that the District Court's ruling the Sinhala Only Act void, had not been challenged by the State whether at the Supreme Court or at the Privy Council. In this sense the Act remained void in law, although the State decided to ignore de Kretzer's ruling at the District Court, giving a moral victory to those who were against the Act. It was left to the State to prove in a higher court that the Act was valid or to put its house in order. It chose to live with anarchy. Such an attitude worked towards debasing all aspects of the legal process.

When we filed the case we were not under any illusion that a court verdict in our favour will result in a political victory of sorts. We filed the case just to expose the Sinhala government's betrayal of solemn promises given to the Thamil people at the eve of independence by Sinhalese leaders like DS Senanayake. Had the case been not heard by de Kretzer, but by a Sinhala judge we would have lost the case at the district court level itself.

You may be aware of the fact that the AES got divided right down the middle between militants who believed that the litigation is only a means to expose the government others who thought the case  be all and end all! I contested for the post of General Secretary (Kodeswaran was elected president unopposed) on behalf of the militant wing and won by 4 votes. The election was keenly and acrimoniously contested and the campaign assumed the proportions of a parliamentary election! . This was in 1965.  

As of now this and other cases are only of historical and academic interest!

Thanks for the dispassionate write up on the killings and abductions of TN fishermen.

It is unusual for the LTTE to open fire on TN fishermen at sea. It has never happened before. There has been a few abductions of TN fishermen by TE (Tamil Eelam) fishermen. In such cases the LTTE intervened and persuaded the captors to release them.

The only problem is the denial by the LTTE coming slowly. And their failure to deny categorically that those arrested do not belong to the Sea Tiger wing and they don't know them. This might be because they don't normally deny responsibility or claim responsibility. There are exceptions.

Hamsa is an intelligent operative. The GoSL uses Muslims for intelligence gatherring and counter-insurgency operations because they too speak the same language. Though their accent is different, a few could speak the way Tamils speak.

The problem with the TN police is it is utterly corrupt like their pay- masters (politicians). Their credibility is a big question mark.

Based on what DIG Mukherjee said Karunanidhi confirmed the arrest and kidnappings. He also said he does not support the LTTE. For that matter he did not support the Indian freedom struggle either. Or the Dravidian separation he took part only on one occasion to lay his head on the railway line after making sure the trains don't run during that time! It was a protest against naming Kalalkudy into Dalmiyapuram  in honour the North Indian industrial magnet Dalmiya. Not surprisingly  the name has not been changed though Karunanidhi has sat on the thrown for the fifth time! He is a timid leader who survives because of the gift of his gab.

You would have read the reminiscences of Jeffrey Lunstead,the former US Ambassador to Sri Lanka. He has said "Direct communication to LTTE would have had concrete benefits." US in its misplaced zeal to fight terrorism good or bad is committing a mistake in regard to Thamil liberation struggle. This we have to tell the US to the face. We should not go along with the US merely because the Sinhalese racists are also attacking it.  With all its faults US is a democracy despite persons like George Bush attempt to subvert it.

Jeffrey Lunstead, former US Ambassador to Sri Lanka, in a report detailing the involvement of his country in Sri Lanka's peace process says "that direct communication with the LTTE would have had concrete benefits including the ability to deliver a clear U.S. message about possible delisting of the LTTE as an FTO [Foreign Terrorist Organization]," but that the Deputy Secretary Armitage believed "such a contact would have been worth trying--but emphasized the difficulty of doing so at that time." The report was published by The Asia Foundation, Sri Lanka.

Commenting on one of the conditions for proscription of an organization as an FTO that "the organization's terrorist activity must threaten the security of U.S nationals or the national security," the Ambassador says "presumably, the LTTE designation was based on a determination that peace and security in South Asia were important to U.S. national security, and that they were threatened by the LTTE."

The Ambassador adds: "It should be noted that there is no legal proscription against meeting with LTTE officials. A decision not to meet with LTTE officials is a policy decision, not a legal one."

The Ambassador admits that "it is fair criticism" that "U.S. seemed ready to criticize the LTTE for terrorist acts and human rights abuses, but was not quite as quick to do the same for the government," but says, "U.S. would not want to create an impression that it takes violations connected to the government less seriously than those connected to the LTTE."

Lunstead sums up US approach to Sri Lanka peace: "The U.S. faces a delicate balancing act as it attempts to act positively in support of Sri Lanka and the peace process. On the one hand, it recognizes that the Tamils of Sri Lanka have legitimate grievances which the government must address. The U.S. sees the LTTE as a terrorist organization, but one which must be engaged if there is to be movement toward peace. The government, by contrast, is seen as a democratically elected government which deserves support."

Dear editor,

The Eelam Nation editorial (Boucher Is Not An Ugly American After All) is a vain attempt to paint Boucher as lily white when in fact he is An Ugly American! Those who support Boucher are in effect accepting his (American) definition of “terrorism.”

The American concept of democracy is selective. When the US trained Bin Laden fought the Russian he was a “freedom fighter” in the eyes of America. US President Ronald Reagan rolled the red carpet for him at the White House. Today the same Bin Laden is a terrorist because he chose to fight US imperialism.

USA is a country that has broken all the rules in the book. It has attacked weaker countries to effect regime change and plunder their economic resources. It has supported the most repressive military dictatorships around the globe over the last 2 centuries. Mr. Boucher is part of this undemocratic and autocratic state machinery.

The trappings of periodical elections, parliament and courts do not make a country democratic. It is the way how that state behaves in the international arena. The illegal invasion of Iraq and Afghanistan on false premises is a rape of democracy and subversion of all international laws and norms.

Mr. Boucher continues to view the armed struggle of the Thamil people as “terrorism.” He has fully endorsed the GoSL war on “terrorism.” He also makes a distinction between the LTTE and the Thamil people.

Consequently he accepts meekly what Mahinda Rajapakse told to his face. The war against “terrorism” will continue till the LTTE is defeated or it lays down arms! He had also told the donor countries to dis-connect economic development from war against “terrorism.” He wants to pursue both war and economic development on parallel tracks!

Boucher in effect wants the Thamil people to live under a unitary state where power is devolved not shared!

The hypocrisy of US double faced and double speak foreign policy could be seen from the fact that it had increased sale of military hardware 40 fold. The Center for Defense Information (CDI), an independent think-tank based in Washington D.C which provides expert analysis on various components of U.S. national security, international security and defense policy has said in a report that Foreign Military Sales (FMS) to Sri Lanka from US increased 40 fold, from $1.4m in 2006 to $60.8m in 2007. It is such military sale that is driving Mahinda Rajapakse to seek a military solution. The same goes to Britain which has approved licenses for arms export worth 7 million to Sri Lanka. That makes nonsense of the withdrawal of the paltry 3 million dollars aid to Sri Lanka for debt relief.

Mr. Boucher’s concern about abductions, killing of civilians and media freedom sounds hypocritical. He visited Jaffna and “sized up the situation” alright but to what effect? The Sri Lankan Kfir bombers (powered by General Electric J-79 engines made under license in Israel) dropped 20 bombs in Puthukkudieruppu. Yesterday the staff and students of Jaffna University have received death threats giving “Final Warning" to those who are involved in "terrorist activities" abetting and aiding the Liberation Tigers. 

If Boucher is really concerned about the escalating civil war and the deteriorating human rights situation in Sri Lanka, he should follow an even-handed approach towards the parties to the conflict.  He should treat the LTTE as non-state actor engaged in armed conflict and not a “terrorist” organization like Al Qaeda! The latter has no clear political goals and kills innocent civilians at will.

I am glad Eelam Nation itself accepts the fact “While however Boucher was in Jaffna, cold blooded killings were going on in both in land and from air in the north east and the east of Sri Lanka to make up for the deficit in the north.”

Let us shift the grain from the chaff and not carried away by empty rhetoric, pious platitudes, symbolic concerns and verbal diarrhea!

                        Surgical military action against terrorism "is inevitable" in Sri Lanka

Your Grace,

 

We write in continuation of our letter dated May 07, 2007 urging your Grace to visit North and East to witness first-hand the suffering of thousands of Thamil people languishing in camps and in open prisons. Apparently our appeal has fallen on deaf years. The only charitable explanation is that GoSL prevented you from visiting the North and East for “security reasons.”  The GoSL tried to resort to the same subterfuge with the visiting Assistant Secretary of US State Department Mr. Richard Boucher without success.

 

Be that as it may be, we are startled by your Grace statement as reported in the BBC (Sinhala Service)  that surgical military action against terrorism "is inevitable" in Sri Lanka.  Your Grace told journalists in Colombo after the conclusion of a 3 day visit that It is undoubtedly inevitable that what you might call surgical military action against terrorism should take place."

 

Even US, the world’s only super power, could not bomb Iraq or Afghanistan with any surgical precision with its arsenal of laser-guided smart bombs, Daisy cutters, Depleted uranium bombs, E-bombs, Moab bomb etc.  In Iraq and Afghanistan they have bombed and killed innocent civilians in their hundreds cynically describing the deaths as ‘collateral damage’ - a word coined to de-humanise life itself. Your reckless statement tantamount to endorsing surgical gas chambers used by the Nazis to kill Jews during WW11. Gas chambers did prove quite surgical at the hands of the Nazis!

 

As a spiritual leader your Grace should know the distinction between terrorism of the Al Qaeda variety and armed liberation struggle of the oppressed Thamils. This war is a defensive war forced on the Thamils by a racist and oppressive state. It is not terrorism but a battle for equality and basic democratic rights.

 

We are more amused than angry that a spiritual leader of the Anglican Church has used language that is the monopoly of   uniformed military commanders who are trained to kill others and not get killed themselves. To say the least your pronouncement is very unchristian from a respected Christian prelate who is expected to provide exemplary moral and spiritual leadership.  Your reckless and irresponsible statement has given a carte blanche license to the racist GoSL to escalate the war against the already battered and brutalised Thamil population. No wonder after your green light to Mahinda Rajapakse  he has promised more war!

 

We refuse to belief you have not been properly briefed by your advisors before your visit.  Suffice to state that since the beginning of December 2005, nearly 5000 Thamil civilians have been killed and 250,000 Thamil civilians made homeless by indiscriminate shelling and bombing of Thamil villages.  Last month alone 78 Thamil civilians were killed and 57 Thamils abducted in Jaffna by the armed forces and the paramilitary groups operating with them.  Two days ago Sri Lankan Kfir bombers (powered by General Electric J-79 engines made under license in Israel) dropped 20 bombs in Puthukkudieruppu. Yesterday the staff and students of Jaffna University received death threats in the form of “Final Warning" to those who are involved in "terrorist activities" - abetting and aiding the Liberation Tigers. 

 

 

It looks though we have to appeal now direct to God by-passing his representative on earth!

The head of the Anglican communion, the Archbishop of Canterbury, Rowan Williams, said surgical military action against terrorism "is inevitable" in Sri Lanka.

 

After a three day visit to the island he told journalists in Colombo that the military solution to the problems of the country "increasingly appears to be no solution".

"It is undoubtedly inevitable that what you might call surgical military action against terrorism should take place", the Archbishop said

Dr. Rowan Williams, said that he hoped and prayed that that would lead to a opening of communication between the government and the Tamil Tigers.

"But we all hope and pray that that will lead not to ...victory for one, defeat for another, but to an opening of communication, a re-establishment of the possibilities for civil society to develop", he said.

People insecure

Meanwhile, the American Assistant Secretary of State, Richard Boucher, says the United States is concerned about the deteriorating human rights situation in Sri Lanka.

Speaking at the end of a three day visit to the island, Mr Boucher said there was a lack of press freedom and people were worried about their security and were afraid of the abductions and the killings.

He pledged support for the government of Sri Lanka, but urged the government and opposition parties to share power with ethnic minority Tamils.

NEW TURN IN BLAME GAME

The Tamil Nadu Police hold the LTTE responsible for the killing of five fishermen off the Kanyakumari coast, but there are holes in the investigation

The killing of five Indian fishermen off the Kanyakumari coast by unidentified assailants on March 29 has taken a new turn with the Tamil Nadu Police blaming the Liberation Tigers of Tamil Eelam (LTTE). The charge has raised many eyebrows as a string of killings before the incident were widely seen as the handiwork of the Lankan Navy. The Q Branch, a special wing of the state police dealing with militancy, claims to have cracked the case based on the confessions of six Lankan Tamils who were on a boat that had allegedly drifted into Indian waters on April 11. Video footage of confessions of two of them was aired on Sun TV on May 3. In the video, the accused claimed they belonged to the Sea Tigers (the naval wing of the LTTE) and confessed that their associates had killed the Kanyakumari fishermen. They also said that the 12 fishermen from Kerala and Kanyakumari who have been missing since March 12 had been abducted by the LTTE and were in the outfit’s custody. The LTTE has denied it has anything to do with the killings and the abduction.

There seem to be several holes in the police version. According to Director General of Police D. Mukherjee, the boat seized on April 11 was the same as the one involved in the March 29 shooting, which had the name ‘Maria’. “But those involved were from another group belonging to the Sea Tigers,” he said. The police claim the alleged LTTE boat was ferrying arms from an LTTE ship to a camp in Sri Lanka when the Tigers shot at the Kanyakumari fishermen suspecting them of spying on the boat’s movement.

Survivors of the attack, however, denied it was the same boat when they were taken to Tuticorin to identify the seized boat. Tuticorin Superintendent of Police John Nicholson confirmed this to Tehelka. He said the three survivors had pointed out three differences between the seized boat and the one from which they were fired at.

Moreover, ‘Maria’ is believed to be a high-speed boat, unlike the one that has been captured. Fishermen say the boat had been in the area since a week before the attack, and had been warning fishermen to stay away by firing in the air. The parish priest of Kurumbanai, A. Churchil, told Tehelka that he had informed the Kanyakumari district collector about the boat and its activities on March 28. Before any action could be taken on the complaint, the assailants shot dead the five fishermen.

Soon after the incident, the Indian Navy and Coast Guard launched search operations to apprehend the boat and this was widely reported in the media. In such a situation it seems unlikely that the LTTE would have been so careless as to let its boat roam in the area. “They are not so foolish,” says a pro-LTTE Sri Lankan mp. Kanyakumari-based A. Frederick, vice president of the National Union of Fishermen, suspects foul play and points to the contradictions in the statements of Tuticorin sp John Nicholson and dgp Mukherjee.

Pro-LTTE leaders in Tamil Nadu view the developments as a conspiracy to undermine the popularity of the Tigers, which is believed to have shot up with the air strikes the group recently carried out in Sri Lanka. mdmk leader Vaiko charged the Q Branch with having forcibly extracted the confession. Thamizhar Desiya Iyakkam leader Pazha Nedumaram said that the charges against the LTTE were intended to malign the group’s reputation in the state. pmk leader GK Mani said in the Assembly that the government should ascertain if any rebel group of the LTTE was involved in the incident.

In the wake of these developments, PM Amza, the Sri Lankan deputy high commissioner in Chennai, has become the focus of criticism. Pro-LTTE groups in the state see Amza as an intelligence officer whose mandate is to foster anti-LTTE sentiments in Tamil Nadu. He took charge at Chennai in July last year and has been courting controversies ever since. There have been reports that Amza was meeting Muslim clerics in Tamil Nadu and asking them to instigate Muslims in the state against the LTTE.

He is in the business of offering  free “advice” to the rulers of Sri Lanka how to defeat the LTTE militarily and politically.  As his name suggests he belongs to the Brahmin gang of N.Ram, Thuklag Cho, and Dr.Subramanian Swamy who are sworn enemies of Thamil nationalism.

The thrust of Raman’s main argument is that attacks by the LTTE on Sri Lankan military targets are "acts of terrorism"  while attacks by  the  racist Sinhala army on Thamil civilians and senior LTTE cadres are “patriotism.” This is the type of twisted logic of all LTTE baiters and Raman is no exception.

Raman has the audacity to suggest “It is in the common interest of India and Sri Lanka to weaken and ultimately destroy the LTTE's maritime and air capabilities. The maritime capability includes its navy and its commercial shipping fleet” but I hope India will not bite this bait! LTTE having a naval force and shipping fleet is none of the business of India. Our kings who ruled over the Jaffna kingdom had naval fleets in the past! I Before them during the 10-11th centuries  the mighty Cholas naval fleet with Tiger flags flying high  dominated the Bay of Bengal and the Indian ocean.  I  hope saner and mature counsel will prevail among Indian political leadership and they will not act rashly as advised by an imbecile.   

After the EU listed the LTTE as a terrorist organization those SLMM members from the Nordic countries Denmark, Finland and Sweden  cannot discharge their duties impartially. There will be conflict of interest. That is the reason why the LTTE has asked they be replaced. No self-respecting Thamil will kiss the leg that tramples him. A spineless Raman may stomach such insults but not Thamils.

Raman has nothing to comment about Mahinda Rajapakse’s unilateral rejection of the Oslo declaration that a solution based on the right of internal self –determination of the Thamil people be explored to find a solution to the ethnic conflict. Even the Co-chairs have taken Mahinda Rajapakse to task over his repudiation of the Oslo declaration. But to Raman who licks the boots of Rajapakse it does not matter a wee bit.

For Raman the killings of Thamil civilians are alright except  as long as they are not "disproportionate." . He does not want to admit that it is part of the genocidal policy of the Sinhala government to kill and maim as many Thamils as possible. Emptying Thamil villages through military cohesion is the covert and not so covert policy of the GOSL.  Trincomalee is a good example. The majority of Thamil refugees who sought refuge in Thamil Nadu came from Trincomalee. To facilitate the expulsion of Thamils from Trincomalee, the GOSL has appointed a Sinhalese retired army major as the government agent.

The present blood letting on both sides is entirely due to the GOSL reneging on the agreement reached at Geneva in February to disarm armed groups, after agreeing to do so.  Mahinda Rajapakse took the illogical and stupid stand that there are no armed groups operating along with the army in the Northeast. But he let the cat out of the bag when he proposed to the LTTE recently that he will rein in the Karuna group if the LTTE agreed to direct talks by-passing Norway. 

Self-appointed and self-styled analysts like Raman may bark at LTTE, but  he cannot  stop the LTTE's  march  to liberate the Thamil people from the yoke of Sinhala imperialist rule. The LTTE will be ever present as long as the Sinhala government bends over backwards to impose hegemonic rule over the Thamils. Let us wait and see who will have the last laugh. 

Finally a 65 million question  to Raman. What is the Sinhala army despised by the Thamil people doing in Tamil heartland? I need an honest reply from him!

Many successful acts of suicide terrorism by the Liberation Tigers of Tamil Eelam, including the assassination of former Indian prime minister Rajiv Gandhi in May 1991 and Sri Lankan President R Premadasa in May 1993 were made possible by weak physical security and poor access control by the security agencies of the State responsible for their protection.

The assassination by the LTTE of Major General Parami Kulatunge, deputy chief of the army and commander of the security forces headquarters - Wanni at Pannipitiya, 15 kms south-east of Colombo on Monday can also be attributed to poor access control.

He was reportedly proceeding to his office in a security convoy when a lone suicide bomber on a motorcycle, apparently coming from behind, caught up with the convoy, drove parallel to it, reached up to his car and dashed against it while detonating the improvised explosive device simultaneously.

Even the LTTE's attempt to kill Lieutenant General Sarath Fonseka, the commander of the Sri Lankan army in April was attributable to poor access control. A woman suicide bomber penetrated the premises of the complex housing the army headquarters and blew herself up as the general was leaving the office in his car. He was seriously injured, but survived.

While the LTTE, in keeping with its usual practice, has not claimed responsibility for its unsuccessful April attempt and its successful act of June 26, there need not be any doubt that it was responsible for both acts of terrorism. It demonstrates its ability to collect precise intelligence about the movements of its targeted victims and operate undetected even in and around Colombo.

A perusal of the detailed biodata of the killed general as disseminated by a web site considered the mouthpiece of the LTTE indicates the probable reasons why the LTTE targeted him. Among the indicators available in the web site report, one could mention the following:

·         He was an expert in intelligence and special operations.

·         In the past, he had advocated 'extra-judicial measures' against the civilian population and supporters of the Tamil Eelam cause.

·         He was a key figure in promoting cooperation between the army and Tamil groups opposed to the LTTE.

·         He was a hardliner and a close associate of General Fonseka.

Shattered peace in Sri Lanka

The assassination is widely perceived as the LTTE's retaliation for the recent assassination of two top ranking LTTE military commanders, Ramanan of Batticaloa and Mahindi of Mannar, for which the LTTE blamed the Sri Lanka army.

Before his posting to Batticaloa, Ramanan was in the intelligence setup of the LTTE. He had reportedly been entrusted by Vellupillai Prabhakaran, the LTTE leader, with the responsibility for neutralising Karuna, who had deserted the LTTE along with some of his followers in March 2004 in protest against Prabhakaran's discriminatory policies towards Tamils in the eastern province.

'Divide in LTTE will weaken it'

The murderous attack on General Kulatunge came shortly after a conciliatory interview given by President Mahinda Rajapakse to the editor of a Tamil daily Uthayan. In the interview Rajapakse expressed his readiness to hold direct talks with the LTTE to find a political solution instead of the Norwegian intermediary, and to stop the activities of the group led by Karuna against the LTTE if the LTTE proved its good faith by refraining from all acts of violence for 15 days, which could strengthen his hand.

Rajapakse was reported to have remarked that he found himself caught between his army and the LTTE, hinting thereby that some of the recent operations of the military, which resulted in civilian casualties, did not have his approval.

Taming the Tamil Tigers

The LTTE apparently did not believe his statement and rejected his offer.

Rajapakse's conciliatory offer came shortly after Sri Lankan Foreign Minister Mangala Samaraweera's visit to New Delhi for talks with Indian leaders. However, there is no evidence to suggest that the conciliatory offer was the outcome of the discussions of his foreign minister in New Delhi.

India's Vietnam: The IPKF in Sri Lanka, 10 Years On

The LTTE action in rejecting the conciliatory offer and assassinating the major general need to be strongly condemned by India and other members of the international community. A careful examination of the LTTE's recent actions and statements indicates certain tactical and strategic objectives of the Tigers.

Among the tactical objectives are the neutralisation of the Karuna group, which is coming in the way of the LTTE re-establishing its political primacy in the eastern province; the continuation of Norway as the facilitator of the peace process; and the re-organisation of the Sri Lanka Monitoring Mission in order to exclude the three European Uion members in the mission.

The LTTE regards the role of the EU members as having become untenable because of their going along with the EU's recent decision to include the LTTE in the Union's list of terrorist organisations.

The LTTE's evident strategic objectives are to seek an ultimate solution to the Tamil problem, which would concede something more than a conventional federal solution by letting the LTTE retain its armed forces and intelligence set-up in any political solution without merging them with those of the federal government.

In the interregnum, before a political solution is reached, to seek the legitimisation of what it asserts as its control over the territorial waters off the northern and eastern provinces and to have the Sri Lanka navy excluded from there.

The LTTE looks upon itself not just as a conventional non-State actor, but as a non-State actor which already has established many attributes of a State such as an army, a police, a judiciary and a tax-collection machinery to enforce its control over the land occupied by it. There is a navy to enforce its control over its territorial waters and an air force to enforce its control over its air space. Whether the LTTE has really an air force or not is still a matter of speculation, but its army and navy are ground realities.

The war in Lanka

Till the time of writing of this article (8 am on June 27), Rajpakse had not ordered any retaliatory attacks against the LTTE similar to the air strikes on LTTE-controlled territory, which he had ordered after the April attempt to kill the army commander.

Retaliatory attacks by the government would be justified under the doctrine of active defence but could be counter-productive unless the government is able to strengthen its physical security in such a manner as to be able to deny spectacular successes to the LTTE if it retaliates again.

For the present, the LTTE seems content to continue with its present policy of retaining the cease-fire and the role of Norway as facilitator on paper, while maintaining its acts of terrorism against selected targets and the operations of its navy.

There are no indictors as yet of the likelihood of large-scale ground operations by the LTTE army despite the recent (June 4) intimidatory statements of Soosai, chief of the LTTE's navy, where he had spoken of the possibility of a coordinated offensive in many areas simultaneously and of its capability to strike at the Sri Lanka navy even in the waters off southern Sri Lanka.

He was reported to have said: 'It will be a blitzkrieg, a sudden and swift simultaneous attack to redeem our entire Tamil homeland in the north and east. We would not adopt the earlier method of fighting to redeem it inch by inch.'

India's Lanka dilemma

The present ground reality of no victories on the ground and no progress towards the table works to the detriment of the Sri Lankan government. Even while continuing with its attempts to persuade the LTTE to return to the table, the government has to, through appropriate proactive measures, prevent the ground from giving way under its feet.

The LTTE is hoping for a battle fatigue among the Sri Lankan armed forces even before a fresh battle is fought. The government should not allow this to happen.

During his visit to New Delhi, the Sri Lankan foreign minister was reported to have stated that the recent air strikes of the government were directed at destroying the LTTE's air capability such as the airstrip reportedly constructed by it. Its planes and helicopter gunships were also recently reported to have acted against the LTTE's navy off the Mannar coast. These are good, well-calibrated actions. Actions like these could be continued despite the warnings of the LTTE to hit back if there are fresh air strikes.

The most important thing is for the government to keep a tight control over its armed forces to prevent disproportionate use of force and targeting of civilians.

It is in the common interest of India and Sri Lanka to weaken and ultimately destroy the LTTE's maritime and air capabilities. The maritime capability includes its navy and its commercial shipping fleet.

There is a need for an Indo-Sri Lankan Joint Working Group on counter-terrorism, which should focus on destroying through appropriate methods the LTTE's maritime and air capabilities.

Dealing with the LTTE's ground capability is the task of the Sri Lanka army. India should not get involved in it.

This refers to your editorial “Dividing Sri Lanka mean rivers of blood, The goal of the Tamil Tigers is illegitimate and unattainable” (Globe and Mail May 29,2000).

The editorial lacked evidence, it lacked depth, it lacked balance and it lacked style and it is very unbecoming of a newspaper like the Globe and Mail.  It is a mystery how the editorial board allowed such a vituperative, invective, blatant and biased editorial to slip through to print.  

The tenor, tone and the style of the editorial easily fits a newspaper practicing yellow journalism!  The mud-slinging against the LTTE bordering on lunacy is unworthy of a newspaper like Globe and mail. All journalistic ethics and propriety have been thrown overboard in your scramble to discredit the LTTE. It is no exaggeration to say that this editorial could have easily emanated from one of the Sinhala racist owned newspapers like The Island, The Times or the government controlled Daily News all published in Colombo. 

Your sweeping and bombastic claim that “The recent military success recorded by Tamil separatist rebels may give the impression that they are on the verge of realizing their dream of an independent Tamil state. That impression is false. The quest for a Tamil homeland is a futile, self-destructive struggle waged by a ruthless terrorist group in pursuit of an unattainable goal” reflects the typical Whiteman’s mindset about armed National liberation struggles of oppressed people against their oppressors. This exactly how the Whiteman opined about the armed national liberation struggle of the black African National Congress (ANC)  against white apartheid! Margaret Thatcher of imperial Britain and Ronald Reagan of capitalist USA refused to join the UN imposed sanctions against the apartheid regime on the spurious grounds such sanctions are counter productive! 

The editor of Globe and Mail may rant, bark like a dog and swear that the quest for an independent Tamil Homeland is “ a dream” “futile”, “self-destructive” “unattainable goal”, but history is replete with many examples of people realizing their dreams of countries and states. Pakistan, Bangladesh, East Timor, Croatia, Bosnia, Eritrea, Slovak, Latvia, Lithuania, Estonia are classic examples of  such dreams blossoming into nation states!   

The armed struggle of the Tamil people is not for a separate state. It is for the restoration of the Tamil Kingdom status quo ante, which existed for centuries before it was conquered by colonial powers like the Portuguese, Dutch and the British.  To be more precise the present armed conflict is a legacy of British imperialism, which erased the borders between the Tamil Kingdom and the Sinhalese Kingdom(s) for administrative convenience. The editor Globe and Mail should do his homework properly before he rushes like a fool into territory even angels will fear to tread.  

You state that “Even if Tiger leader Velupillai Prabhakaran manages to seize the entire north and east and declare independence, the international community is unlikely to recognize a would be country run by terrorists”, but then don’t be too sure!  When UNO was founded there were only about fifty states. Now it has 190 states, a four-fold increase, and I assure you the skies will not fall and the earth will not shake if one more is added to the number! After all a country’s borders are man made and not divine. Throughout history borders have been drawn and redrawn repeatedly.  

As for your obsession to call the LTTE “terrorists”, my answer is one man’s terrorist is another man’s freedom fighter or patriot or both.  What distinguishes a terrorist organization and a national liberation movement is mass support and LTTE enjoys mass support. To deny this is to deny the truth. In any case it is the opinion of the Tamils that count and not that of  the editor of the Globe and Mail.  

There are numerous examples of erstwhile terrorists meticulously transformed into today’s Heads of States and received with red carpets and military guard of honour! The Globe and Mail posturing on terrorism is sanctimonious humbugging and one of double standards.  Has the Globe and Mail conveniently forgotton that Israel Prime Ministers Menachem Begin and Yitzhak Shamir were both wanted terrorists by the British?  Menachem Begin  as leader of the illegal Irgun Zvai Leumi underground movement was  responsible for blowing up the King David Hotel in Jerusalem, resulting in 91 deaths and countless wounded.   Yizhak Shamir as part of the ruling triumvirate of the Stern Gang authorized the 1944 assassination of Britain’s Lord Moyne and the 1948 murder of the United nations mediator Count Bernadotte.   Is Henry Kissinger, Secretary of State who authorized the assassination of Salvador Allende, Socialist President  of Chile a terrorist? Closer home, going back a little bit to past history, George Washington was proclaimed a wanted terrorist by British during American War of independence! 

The editor of Globe and Mail accuses the LTTE of bombing office buildings, but did not US and NATO bombed Serbia’s radio and television stations with smart bombs?  Is their one law for NATO and US and yet another for the LTTE? I can multiply the examples hundred-fold, but unfortunately space will not permit me to do so.  

You seem to be unduly worried about the Tamils living in the south more than those living under the jack-boot of the Sinhala army in the Northeast! As you surmised the Tamils in the south will immigrate to the new state and live with dignity and self-respect unlike now living in fear among the majority Sinhalese. As for Muslims in the Northeast they will enjoy equal rights and privileges with the Tamils in a secular state. They speak the same language as the Tamils and they will preserve their religious identity. About Buddhists – those who were forcibly settled in the Northeast since 1948 by the Sinhala governments to change the demographics have to vacate their illegal homes. These are details, which can be worked out through bilateral or multilateral negotiations between the Tamil and the Sinhala governments. 

Your editorial unwittingly helps to foster the illusion that moral arguments against the war might eventually win the day.  They cannot, because the primary (well-hidden) dynamic behind the Sri Lankan government’s genocidal war against the Tamil people is racism towards Tamils. The Sri Lankan government’s number one priority is to militarily cripple the LTTE so that it can impose

and perpetuate its hegemonic will on the Tamil people and continue to rule them. And the devolution package which you seem to think will give “wide-ranging autonomy to the Tamils” is totally misplaced. since it does not meet the aspirations of the Tamil people. President Kumaratunga’s devolution package is a ploy to hoodwink the donor countries and hide her real intention to defeat the LTTE militarily through her infamous “War for Peace” campaign.  The devolution package strategy is designed to break-up the Tamil homeland and perpetuate Sinhalese domination over the Tamil people.   The editor Globe and Mail fondly hopes President Kumaratunga’s devolution package will provide “security and self-government” to Tamils not knowing that it is a cosmetic exercise to tinker with the present unitary and theocratic constitution.  

Like the Globe and Mail, the Western governments too, led by the US, have vested interest in defending the current status quo in Sri Lanka. There is big money to be made from the Kumaratunga administration’s willingness to sell off Sri Lankan assets at rock-bottom prices. For many western profiteers, the death of Tamils is well worth tolerating while so many goodies are up for grabs. That is one very obvious reason why western diplomats can be seen expressing such confidence in Chandrika’s sincerity, (despite the stark reality that Chandrika’s five years reign is a curse and an unmitigated disaster for the Tamils),  to achieve “Peace through War”.   

Again, the intermittent and the half-hearted calls for talks with the LTTE by diplomats no longer washes with the Tamil community, who know full well they are being treated as expendable pawns in the amoral scramble for economic gains.  No wonder then that a future Tamil state in the Northeast remains a “dream”  “futile” “destructive” and “unattainable goal” to these vested interests.  Meanwhile, morality and high principles are cited and a crusade is launched against the bogey of “terrorism” and “terrorists” to justify their own selfish agendas. To the Globe and mail and the West, true democratic values by themselves, like the right of self-determination,  are irrelevant.  

But if one looks at the wider picture, this has not been the approach of West to all freedom struggles.  Didn’t they change their stance, for example, vis-a-vis South Africa and Bosnia, at some stage, and even help people there achieve peace with justice?  They did, but only when they realised that the freedom struggles in those countries could not be defeated, and that further

escalation of conflict would jeopardise their own interests in those regions. Until the inevitable victory of a freedom struggle becomes crystal clear, they tend to find ways of helping ruling oppressors to crush the struggles of the weak and the down-trodden oppressed (unless of course the ruler himself, like Saddam Hussein, constitutes a threat to their own interests.) people.  The same logic is being applied to Sri Lanka. As long as the West thinks the possibility of crushing the LTTE exists, and as long as the Sinhalese government’s determination to murder Tamils persists, the West will find ways of backing it, in word and deed.  

Finally your claim that “ Any attempt to solve the troubles is Sri Lanka must be premised on the assumption that the country is indivisible and the realization that dividing it would mean rivers of blood” is pure fantasy. You are mistaking the symptoms for the disease. You seem to be under the illusion that a "united” Sri Lanka is now flowing with milk and honey and not rivers of blood! Sri Lanka is already flowing with rivers of blood, mostly that of the Tamils, because Sinhala-Buddhist chauvinists want to keep the WHOLE country to themselves. The only sensible way to stop the hemorrhage and stop the rivers of blood flowing is to revert to the boundaries that existed before 1833. The LTTE is engaged in a national liberation struggle, which is recognized as a legitimate mode of struggle under international law. Equally the Tamil people of Tamil Eelam are entitled to the right of self-determination under the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights, and the two major international human rights treaties (Sri Lanka has ratified these Covenants and treaties).   

The Universal Declaration of Human Rights states

Whereas it is essential, if mankind is not to be compelled to have recourse, as a last resort, to rebellion against tyranny
and oppression, that human rights should be protected by the rule of law .....’(UDHR 3rd preambular paragraph).

But what happened to killer of Rajiv Gandhi i.e Mr.Prabaharan..You hail him as a leader, unless or untill he is hanged dont expect any help from India. You talked about IPKF killing.? I know what happened during those time..LTTE will throw bomb and run/hide into hospital so that when IPKF attacks common people will be called..as for as know LTTEs and back biters and coward people. Please tell what you have achieved in eelam after 16 years of death of Rajiv Gandhi..? Did you get any better deal from anybody than what Rajiv suggested.. In more than one sense Stanley is speaking through his hat. Those who shed tears over the death of Rajiv Gandhi should also mourn the death of thousands of innocent Thamils killed and scores of women raped by the IPKF. I will like to cite two incidents that stand out.

1)THE JAFFNA HOSPITAL MASSACRE 1987

Twenty-one persons including medical specialists, nurses, attendants, patients and members of public were massacred inside Jaffna Teaching Hospital (JTH) by Indian Peace Keeping Force (IPKF) troops stationed in Jaffna Fort opened fire on 21st October, 1987. The shooting was unprovoked. It was carried out by frightened and illiterate soldiers who simply went berserk.  The victims of the massacre included three leading medical specialists at that time, Dr.A.Sivapathasuntharam, Dr.K.Parimelalahar and Dr.K.Ganesharatnam, three nurses and fifteen other employees.

2) INDIA'S MY LAI - THE VALVETTITURAI MASSACRE 1989

"...this massacre is worse than My Lai. Then American troops simply ran amok. In the Sri Lankan village, the Indians seem to have been more systematic; the victims being forced to lie down, and then shot in thE back..". London Daily Telegraph quoted by George Fernandez M.P.

    On 2 August 1989, the so called Indian Peace Keeping Force deliberately killed 63 Tamil civilians       in    Valvettiturai in the Jaffna Peninsula in a massacre that was later described as India's Mylai.

As for the query "what you have achieved in eelam after 16 years of death of Rajiv Gandhi..? Did you get any better deal from anybody than what Rajiv suggested"  may I tell you that the LTTE has established a de facto state with all the paraphernalia associated with states like Judiciary, courts, police, education centres, banks etc.! This is not a mean achievement by any standards.

Rajiv Gandhi got killed because of his folly of sending the Indian  army to disarm the LTTE. This was none of his business! No wonder Vaiko, General Secretary, MDMK  described Rajiv Gandhi as the greatest fool the world has ever seen!


 

Dear Hon. Minister,

 

We welcome the declaration by the Hon. Minister Bill Graham“hailing the deal as an absolutely wonderful breakthrough and Canada could give plenty of advice on future constitutional arrangements and how to foster better understanding between peoples.” However, the Foreign Ministry has in the past followed a sterile, unprincipled and  unproductive policy in regard to the ethnic conflict in Sri Lanka. Its repeated assertions that  it is willing to mediate between the government and the LTTE if both sides  made a joint request  sounded hypocritical.  

Canada was the first Western country to brand  the Liberation Tigers of Tamil Eelam as “ an organization engaged in terrorism” without taking into account the causes that led to the armed struggle. Such myopic character assassination only  helped to  embolden  the  fascist Sri Lankan government to spurn all efforts to find a peaceful solution to the conflict. Till now it  sought a military solution through its  infamous  “War for Peace” subterfuge spending billions of rupees.  

The Hon. Minister will agree that war is not the  first choice of the oppressed people, but it is the last resort after exhausting  peaceful methods of struggle. Again it is the oppressor and not the oppressed who decides the mode of resistance. The struggle of the Tamil people against military oppression has similarities with the struggle of the South African black people against the  now extinct apartheid white regime.  

In 1994 Canada was invited to serve as a member of the monitoring committee supervising the cease-fire agreement between the LTTE and Sri Lanka. But this time around Canada has been left in the cold because of  the hostile attitude of the Canadian  government towards the LTTE.  

As Canadian Tamils we like the Canadian government to play an active role in resolving the conflict on an equitable basis. But this cannot be done as long as Canada treats the LTTE as a “terrorist organization.”  Even a seemingly innocent Non-profit organization like the Tamil Rehabilitation Organization (TRO) Canada has been denied tax-exempt status  simply because the Minister of Revenue  considers it as  a front organization of another organization that is in turn a front organization of the LTTE!  But the same Minister has no qualms in collecting taxes from Tamil Canadians who are supporters (90%) of the same  LTTE. 

We are hopeful the new Minister of Foreign Affairs will take steps to usher in a more dynamic, pragmatic  and principled foreign policy that will respect the dignity and self-respect of the Tamil people.  Canadian government should address the causes of  the armed struggle rather than the symptoms of it. The wrongs of the past in branding an  entire community as “terrorists supporters” should be righted if the Canadian government wish to play a role in “the future constitutional arrangements and foster better understanding between the people.”  The government can make a beginning by abandoning its obsession  to deport Manickavasagam Suresh to Sri Lanka at all costs, a country he fled fearing persecution on grounds of ethnicity and religion.

Dear editor,

The incredible capacity of  some spineless Tamils to lick the boots of those who kick them never ceases to amuse me.  

Your  “Thank you very much,  Canada” editorial ( World Mirror – April 11-24) which expressed “deep debt of gratitude  to this great country and its fair minded and progressive policies” is one such classic example.   

It is true that Marie Gervais- Vidricaire head of delegation of Canada had taken the Sri Lankan government to task when she told the UN Session that  “members of the security forces who have committed human rights violations continue to benefit from  delayed judicial action and perceived impunity. In this regard we  find instances, such as the multiple killings of Tamil youth while in  the care of government authorities near Bindunuwewa, to be particularly distressing.”  

But she also at the same breath found fault with both the government and the LTTE when she declared “In Sri Lanka, the conflict continues as the root cause of most  serious human rights violations, as well as breaches of international  humanitarian law, both by the government AND THE  LTTE.” (emphasis mine). Why the editor chose to over-look or  bury this part of her speech is not understood. 

We should judge Canadian government  not  by what it says but by what it does. Long before the USA or UK labelled the LTTE  as a ”terrorist organization”, Canada did it as far back as 1995. Two cabinet Ministers, the Solicitor General and the Minister of Immigration dutifully signed Section 40.1 certificate which resulted in the arrest, incarceration  and prosecution of Manickavasagam Suresh, Co-ordinator, WTM. After conviction the Canadian government despite being a signatory to the Convention Against Torture  left no stones unturned to deport Suresh to Sri Lanka, a country from where he initially fled fearing persecution.  

The government lawyers have argued before the Provincial as well as the Federal Courts that Suresh should be deported to Sri Lanka EVEN IF HIS LIFE IS AT RISK. (emphasis mine) Since the Federal Court of Appeal ruled in favour of the government, Suresh’s  lawyer has now appealed to the  Supreme Court. It is a  fait-accompli  that government lawyers will argue  before the  SC in support of  the judgement of the Federal Court of Appeal. 

Therefore, in many ways the speech delivered by the Canadian representative at the UN Session rings hollow and borders on hypocrisy. I suspect it  was empty rhetoric  just meant to humour the Tamil  Canadians.

In fact the labelling of the LTTE as an “organization engaged in terrorist acts”  by Canada and prosecution of Suresh only helped to  embolden  the  fascist Sri Lankan government to spurn all efforts to find a peaceful solution to the conflict. Instead  it sought a military solution through its  infamous  “War for Peace” subterfuge spending billions of rupees on sophisticated military hardware and weaponry.   

Apparently the editor of World Mirror is either  ignorant of these facts or he is feigning  ignorance in his anxiety to white wash the sins of  the Canadian government. 

If the Canadian government is indeed  serious and interested   “to facilitate peace talks between the belligerents” and  bring  an end to the bloody war between the Tamil Nation and the Sinhala Nation,  then it should remove the “terrorist” label it had attached to the LTTE. Otherwise Canada cannot be perceived as an “honest broker” between the warring parties.  

Under international law LTTE is a national liberation organization having signed  the Geneva Conventions and Protocols as far back as 1988.  

It should be remembered that Canada never considered the KLA as a “terrorist organization" although it too took up arms like the LTTE in almost identical circumstances to fight the racist Serbian government. The NATO countries, including Canada,  adoringly described members of the KLA as “freedom fighters” and rightly so.  

It was pathetic to see some mis-guided politically naive Tamil Canadians voting for Liberal party candidates at the last general elections, including those like Mr. Derek Lee, MP (Scarborough-Rough River)  who vigorously supported and continues to justify the deportation of Manickavasagam Suresh.  

By all means say “Thank you very much ”, but only  to those who really deserve and merit such accolade  like Norway. Never lick the boots of those who kick you.

This refers to your piece "Listen mighty brothers, listen"  (The Sunday Leader - April 03, 2005) which is a cry of  a drowning man to catch a straw! The straw in this case  is Anandasangari whose one leg is already inside the grave! Once in a blue moon he rises from his deep  slumber and pens a letter just to tell others he is still alive!  He is a frustrated and desperate man and in the evening of his life  engaged in puerile politics by issuing press releases or writing letters! He perforce has to do this since he still styles himself as the President of the TULF minus its members! 

You never ceases to amuse me. Racists like you, if living in  the West, will be put behind bars for fanning communal tension and hatred. 

Anadasangari is a loner. He is like the fox which said the grapes are sour! He contested the last election and lost ignomiously-polling fewer than 6000 votes in 2 districts. He could not find enough candidates  to contest the elections in the balance  districts in the Northeast.  Of course he cried foul when he lost miserably. He said the elections were rigged. But when he won the previous elections  (2001) with a thumping majority of  preference votes he did not complain. The elections are rigged when he loses! But is perfect when he wins! This then is his skewed logic! As already said it is a case of sour grapes. 

If the Thamil people under   the 'fascist' LTTE rule  are living like slaves even after the abolition of slavery world wide, how come Anandasangari is unable to hold a public meeting in any of the Western countries? Surely you cannot  claim that Thamil Diaspora is also living as slaves in these countries without freedom of speech or association?  

DBS Jeyaraj, the spin doctor of no mean fame used his pen to portray Anandasangari  before his fall from the thrown as a great and fearless leader. But whoever Jeyaraj projects as a champion horse turns out finally to be a donkey!  It happened to Anandasangari and renegade Karuna. When renegade  Karuna fled  from Batticaloa with his tails between his legs, ace  spin doctor claimed he did so after striking a settlement with the Vanni leadership using fax! 

Any fool who now and then criticises the LTTE becomes heroes to Sinhala racists like you! Anandasangari a puny politician living in the past and nursing old wounds suddenly metamorphoses into a 'giant' among Thamils. This is the same way persons like  you made show case leaders out of people of clay legs. Remember Prof. Sunderalingam, Nalliah, Devanayagam,  Kumarasooriyar, Alfred Duraiyapah? They were portrayed as  heroes by racists like you. 

You are shedding crocodile tears for the Thamil people who live as slaves under LTTE rule. Let it be so. But what rights do the Thamil people living in government controlled areas enjoy? The fishermen living in the North have  no freedom of movement in the seas. They  cannot go out to sea without an army pass which they have to pick up every morning and then surrender on returning. Normally it is the duty of the government to provide security to its citizens. But in the North, the Sinhala army has created HSZs on the plea the army needs security! Is this not hilarious if not outright stupidity?  

I ask you whether your government is prepared to hold a referendum under international supervision among the Thamil people  to find out their aspirations? And whether you will abide by the results of such referendum? 

In Canada the  government not once but twice gave the people of Quebec the choice  to  separate from the rest of Canada. All they have to do is to vote yes in a simple majority of 50 plus! Is the Sinhala government  prepared to emulate the fine democratic precedent of Canada? What is interesting is that Quebec people still have the freedom to vote at a referendum if they do want to separate!

The Supreme Court of  Canada ruled (1998 August) that  there is no right to unilateral secession in international law except for colonies and oppressed people, but if a clear majority of the people in Quebec want to secede, Canada would be obliged to negotiate the terms of secession as though it were an amendment to the constitution.

Thus the  people of Quebec have always had, have now and will continue to have the inalienable right to decide democratically and without interference their own self-determination.  

LTTE which has sacrificed more than 18,000 martyrs in fighting a foreign  army of occupation doe the last 25 years. Therefore, they are righly looked upon by the Thamil people as heroes and saviours. Anyone even with an ounce of brain will readily admit to this fact. If any one denies this cardinal truth that person lives in fools paradise like you! 

The pity is the editor of The Sunday Leader is giving space to charlatans like you and Jeyaraj in his otherwise worthy newspaper.
