We condemn India for putting profit before people by building a Coal-Fired Power plant at ethnically cleansed Sampur

India’s state owned National Thermal Power Corporation (NTPC) has signed an agreement recently with the government of sri Lanka (GoSL) to build a 500 MW Coal-Fired Power Plant at Sampur in Trincomalee district despite protests from Thamil Parliamentarians and Sampur people evicted from their homes and farms.

Following Sri Lankan army’s major military offensive in the east in 2006 more than 500, 000 Thamils were forced to flee their homes to become refugees. While a section of the people evicted have returned to their homes, 17, 000 Thamils living in 23 villages in east Muthur have been prevented from re-settling by the GoSL 

The racist GoSL issued an Extraordinary Gazette notification on June 16, 2007 declaring Muthur East and Sampur as High Security Zone. Through the same Gazette notification a Special Economic Zone (SEZ) under the Board of Investment Law was created. The SEZ consists of a land area of 675 sq. kms (260.5 sq.mls) that would effectively prevent Thamils who fled Muthur East and Sampur in 2006 returning to their homes. This is ethnic cleansing by decree!

It may be recalled a similar Extraordinary Gazette notification was issued by the GoSL on April 16, 1988 to evict 13,288 Tamil families in 42 villages in Manal Aru. Manal Aru was then re-named as Weli Oya and a total of 9,289 Sinhalese families from south were brought in and settled in villages previously belonging to Thamils.

The Indian government decision now to build a Coal-Fired Power Plant in the very land that belonged to the people of Sampur for centuries is an act of injustice and supreme insult to the Thamil people in general and Sampur villagers in particular.

The Indian government should know that the building up of the Coal-Fired Power Plant project in Sampur has a hidden political agenda by the GoSL to ethnically cleanse Thamils from Muthur east. Already the demographic composition of the eastern province has been drastically changed  through  planned state sponsored Sinhalese colonization  by successive GoSL. Emptying Sampur of Thamils is another aggressive  phase of   ethnic cleansing of the east.

Article 17 of Protocol II of the Geneva Conventions, which deals with non-international armed conflicts, explicitly prohibits displacement of people except for the safety of the civilians themselves or for imperative military reasons. The same Article further adds, "Civilians shall not be compelled to leave their own territory for reasons connected with the conflict."

We can understand the utter contempt for Geneva Conventions and Protocols on the part of the GoSL,  but not India. Obviously the Indian government is more interested in lucrative money spinning business ventures than  Thamil  people’s basic human rights.

We, therefore, condemn strongly the Indian government’s ill-advised decision to build a coal fired power plant in Sampur. India should re-think about the wisdom of putting profit before Thamil people’s rights and freedom.

13th Amendment - India  Repeating The Same Historical Mistake 

Dear Hon. Minister,

Recently the Hon.Minister told parliament, inter  alia,  “The  interests of ethnic Thamils in Sri Lanka as well as in Malaysia mattered to Delhi. The way forward lies in a peacefully negotiated settlement within the framework of a united Sri Lanka acceptable to all communities, including the Thamils. India was concerned about the recent violence in that nation and was "closely monitoring" the developments. India has welcomed the "declared intention" of Sri Lanka to fully implement the 13th Amendment, a move that could give a degree of autonomy to Thamil-dominated regions in that country.” 

While we appreciate your sentiments, the fact remains the 13th Amendment is a ploy by President Mahinda Rajapakse to hoodwink the international community that pressed for political proposals to solve the conflict. Faced with a deadline (January 23rd, 2008) Mahinda Rajapakse forced the Chairman of the APRC to  immediately submit   the 13th Amendment as demanded by him. A humiliated Chairman then said “I as  chairman, together with the rest of the APRC, had little option but to accede to his request."

The Chairman, APRC further confessed “I could have acted differently. But under the circumstances I hope the people of Sri Lanka as well as those abroad who are interested in the future of our country will understand the circumstances which have led me to follow the course that the APRC has now taken."

So, APRC proposals were an “imposition”   by the President Mahinda Rajapakse and the Chairman, APRC simply  caved in.  Understandably,  he could not  stand up to a powerful executive President.

Twenty years ago the TULF stated in writing to the then Indian Prime Minister that “These proposals do not meet the aspirations of the Thamil people nor are in anyway, commensurate with the loss of life, sufferings and privations suffered by the Thamil people. Since 1983, the TULF has always negotiated with the GoSL directly, utilising the good offices of the Government of India, and through the GoI in the hope of evolving a comprehensive scheme of devolution which the TULF could commend to the Thamil people. The TULF regrets it cannot recommend the contents of these Bills to the Thamil people as being satisfactory, just and durable.”  Because   the 13th  Amendment is not workable and will never be a success, the TULF did not contest the provincial council elections  .

Twenty years later the TNA leader R.Sampanthan, MP speaking in parliament declared    “they will not touch the 13th Amendment even with the wrong end of a barge pole.”

He asked the government to “stop this game of playing dirty tricks, come clean, be candid, be honest, be genuine, be straightforward - come up with a solution that would really be a solution to this conflict which has caused much human suffering to all people in this country.”

Therefore, the decision of your government  welcoming the 13th Amendment as a first step “that could give a degree of autonomy to Thamil-dominated regions in that country” is unwise and misplaced.  India is repeating  the same historical mistake.  This  has only helped President Mahinda Rajapakse to gain plenty of breathing space to prosecute total  war against the Thamil people under the cloak of eliminating terrorism. With  India on Rajapaksa’s side, there will not be much International pressure, even on   human rights violations, beyond  pious statements. In effect India has thrown a life-line to Mahinda Rajapakse who  is under attack for gross human rights abuses, corruption, subversion of the rule of law and democratic norms.  No wonder India kept aloof  even at the time when abductions, disappearances and extortions in Colombo were at a peak with Thamil businessmen of Indian origin falling victim.

The GoSL  has  reversed the Northeast merger, a key element in the Indo – Ceylon pact,   taking cover under the Supreme Court verdict that the executive fiat is null and void. When Opposition UNP made an offer to support an amendment to the constitution to re-merge the two provinces the government spurned it.  

The 13th Amendment enacted  in 1987 has been truncated subsequently by withdrawal of police powers and powers over land alienation from the Provincial Councils.

The Thamil people since 1956 have historically given mandates at every election where they have stood for genuine autonomy, genuine self rule in the areas of their historical habitation. 

Mr. Richard Boucher, the Under-Secretary of the United States for South Asia has called for radical changes in the structure of Government, genuine autonomy, which would give the Thamils and the Muslims the right of self rule. Self rule is not possible under the present highly centralized unitary constitution. 

Therefore, the 13th Amendment is no where close to what the international community has contemplated. Mr. Rajmohan Gandhi, a very distinguished. journalist and author when asked in the course of a recent interview   "What lessons do you think Sri Lanka can learn from the asymmetrical devolution model now in place in India?" he replied "If autonomy is genuine it will work. But if an offer of autonomy is mainly a facade it will not work, but if the majority groups and now I'm speaking globally of all countries, if governments are willing to give genuine autonomy to distinct groups that can go a long way, but it has to be a genuine offer, and it has to be an offer supported by the people of the majority group as well, not just the political parties." Your colleague Hon.  P. Chidambaram, Minister of Finance for India has expressed similar views.  He told BBC "India  has emphasised that the ethnic conflict in Sri Lanka, arising out of a sense of discrimination and a sense of negation of cultural, linguistic and human rights should be resolved through a negotiated political settlement that includes a credible devolution of powers".(BBC Sinhala Service – Nov 17, 2007)

India should understand the nature of the Sri Lankan state which  is theocratic, despotic, un –democratic and unitary while India is secular and quasi-federal with 28 linguistic - based States and 7 Union Territories. 

Unfortunately,  India has remained a silent spectator to the horrendous human rights violations committed in the Northeast of Ceylon.

Aerial bombardment of heavily built residential areas, enforced disappearances, abductions for ransom and execution style killings by the military have become everyday routine.   The rule of law continues to be undermined and the culture of impunity persists at all levels of government.  GoSL has consistently failed to conduct credible investigations to bring violators to justice. On the contrary, the GoSL  had deliberately obstructed course of justice and   shown not so much the lack of capacity but the requisite will to safeguard the rights of all its citizens. It   is justifying  extra-judicial killings and disappearances as part of a brutal and counterproductive counter-insurgency campaign.

Human Rights Watch (HRW) has dubbed  the  Sri Lanka's government as one of the world's worst perpetrators of enforced disappearances.  In its report HRW  has accused the security forces and pro-government militias of abducting and "disappearing" hundreds of people - mostly Thamils - since 2006. HRW said  the majority of cases "indicate the involvement of government security forces - army, navy or police". (BBC - March 06, 2008)

According to  Red Cross (ICRC)  the number of civilians killed and injured in Sri Lanka has reached "appalling levels". A total  of 180 civilians died in the first six weeks of 2008 and nearly 270 more were injured. More than 1,000 people have been killed since the government withdrew from the ceasefire according to the military. (BBC - March 06, 2008)

The International Independent Group of Eminent Persons (IIGEP)  invited by Mahinda Rajapakse

to monitor a government commission investigating human rights abuses  has resigned on Thursday (March 06, 2008)  in frustration over the government's lack of support.  Among the 16  cases under investigation were the execution-style slaying of 17 aid workers in 2006 in Mutur, an air strike that  killed 61 school girls between the ages of 16 and 18 .and the shooting  of 5 students by Sri Lanka Special Forces in Trincomalee on January 02, 2006. Incidentally the IIGEP was chaired by Mr. Justice P N Bhagwati, Retired Chief Justice of India. (AP - March 06, 2008)

Opposition leader Wickremasinghe told  a media briefing on Wednesday (March 05) " that armed Thamil groups  Pilliayan group, EPDP, and a Muslim group mobilised by the government are in operation in the East". Last month alone 48 Thamils have been killed, 29 abducted and 253 arrested by the armed forces.

As we write news reports say  that Jaffna District TNA  parliamentarian, K. Sivanesan  was killed today in a claymore attack carried out by the Sri Lanka Army Deep Penetration Unit on A-9 road, 30 minutes after he crossed into Vanni through Omanthai / Puliyangkulam entry point. 

Sri Lanka is being perennially ruled under Emergency Regulations that  vests sweeping powers to the armed forces to detain without charge anyone suspected of terror activity. These Regulations have been used almost exclusively against Thamils.  

GoSL is refusing to investigate, prosecute and punish human rights violators. The many ad hoc commissions of inquiry of the past two years have accomplished nothing, while disappearances and political killings continue, especially in the Jaffna peninsula.  The military offensives launched by the government first in the East and now in the North have caused heavy loss of lives, social oppression, political subjugation and economic deprivation.  (AP - March 06, 2008)

Despite the damning evidence and  charges of human rights abuses against the Sri Lankan government, India unashamedly continues to defend Sri Lanka at the United Nations Commission on Human Rights sessions held in Geneva.

President Mahinda Rajapakse has buried the CFA and made the APRC dysfunctional. The mindless withdrawal from the CFA, at the behest of the JVP, has opened the floodgates of civilian killings both in the North and the South.

All this is proof that predators are masquerading as liberators. Mahinda Rajapakse has no stomach “for a peacefully negotiated settlement.” He opposed the 13th Amendment tooth and nail while in the opposition.

We appeal to the government of India to re-think, re-view, re-orientate  and re-shape its foreign policy options vis-à-vis Sri Lanka at the earliest opportunity.

Dear comrade,

We wish to convey our appreciation and thanks on your decision not to invite Janatha Vimukthi Peramuna (JVP- People's Liberation Front) to the forthcoming party Congress in Coimbatore.

The JVP is an extreme Sinhala – Buddhist supremacist outfit masquerading as a Marxist party. It enjoys the dubious distinction of being the only “Marxist Party” in the world to propound the racial and religious superiority of the majority Sinhalese, oppose political solution to resolve the ethnic conflict and insist on militarily defeating the Liberation Tigers of Thamil Eelam(LTTE).   

The JVP has consistently mounted racially motivated campaigns in support of the war launched by President Mahinda Rajapakse and his government.  It is opposed to any form of devolution, including devolution under the 13th Amendment, and insists in preserving the present unitary constitution intact. Paradoxically, its stand on the national question is more rightist and reactionary than that of traditional rightist parties like the United National Party (UNP) or the ruling Sri Lanka Freedom Party (SLFP).

It would have been a national disgrace and an insult to progressive forces if the JVP would have been invited to the Congress like last year.

We also  hope the CPI will follow CPM’s example and withdraw  invitation to JVP for its Congress to be held in Hyderabad.

February 4th, 1948 – The  Black Day Thamils Lost Their Freedom

February 4th is again a grim reminder to the Thamils that they lost their political freedom on this Black Day 60 years ago. It is the day Sinhala hegemonic rule was imposed on the unsuspecting Thamils by ungrateful Sinhalese leaders.  

The hopes of the Thamil people that they will be treated on equal terms within a multi-ethnic, multi-linguistic, multi-religious and multi-cultural polity in which they will find the political space to live in freedom and dignity have been rudely shattered. Over the years, Thamils have been brutally reduced to the status of third class citizens by depriving them of their basic human rights. A million Hill country Thamils lost their citizenship and franchise rights in 1948/49.

Through systematic state- sponsored Sinhalese colonization of our traditional Thamil homeland, the demographic composition of the Northeast has been drastically altered in favour of the Sinhalese.  This process has been accelerated now as never before. Recent de-merger of Northeast and demarcation of Trincomalee district as a separate unit to be administered direct from Colombo are covert moves to complete the process of Sinhalization of Northeast and nullify Thamils of the concept of homeland.  

Thamils  in Northeast continue to be oppressed under the jackboot of an occupation army. Aerial bombing, artillery shelling, abductions, assassinations, involuntary disappearances, arrests, cordon and search operations are taking place routinely.

On January 16, 2008 the 6 year- old CFA signed between the LTTE and the GOSL was unceremoniously buried by President Mahinda Rajapakse in keeping with his pan Sinhala - Buddhist “Mahinda Chinthanaya.”   The unilateral abrogation of the CFA has shut the door for peace and escalated the ethnic war.

Since his assumption of power, Mahinda Rajapakse is working to an extremist military agenda formulated by the JVP and hawks in the defence establishment for mere political survival.  After “liberating” the East, Rajapakse  has now promised to liberate the North soon. 

Jaffna peninsula is an open prison for Thamils now.  More than 60,000 strong Sinhala army has imposed military rule over 350,000 Thamils.  On an average 5 civilians are killed daily by the Sinhala army and the Para-military squads operating along with it.

The Sinhala armed forces have mounted attacks from several fronts to capture Vanni before the year is out.  Aerial bombardment and artillery shelling have escalated causing loss of lives and destruction of property.  Several thousand families have been displaced.

More than 150, 000 Thamils displaced in the East during army military operations are still waiting re-settlement.  Thamil families in Sampur and adjoining villages have been driven out permanently from their homes to create HSZ.

GoSL uses or rather misuses a myriad of draconian laws in its armory to harass, bully and incarcerate Thamils merely on grounds of ethnicity. The price the nation is paying at the altar of political expedience, ethnic fanaticism, and religious and language frenzy is colossal. 

Unfortunately, the international community including Canada, apart from issuing pious press releases is practically remaining dumb, deaf and blind to the attack on rule of law and threat to media freedom.  

Mahinda Rajapakse has left no one in doubt in regard to his intention to seek a military solution to the ethnic conflict while occasionally mouthing peace to hoodwink others! The escalation of  defence expenditure is  clear confirmations of an all out war against Thamils.  Thamil people should be under no illusion that Rajapakse’s regime is hell-bent to impose Sinhala hegemony over them. 

Mahinda Rajapakse to fool the international community wants to implement the 13th amendment enacted in 1987 which was rejected by the Thamil people.

On this Black Day, Thamils should firmly resolve to  help create the state Thamil Eelam in which our people will live in freedom, liberty and security.

Dear Ambassador,  

 

Your Excellency lost no time in condemning the attack on a bus at Buttala, Uva Province because in your opinion "it bears all the hallmarks of the Liberation Tigers of Tamil Eelam." But, Your Excellency remained dumb and deaf when Sri Lankan air-force supersonic Kfir fighter planes (fitted with engines manufactured by GEC, US) bombed, killed and maimed Thamil people, including schoolchildren, in Vanni every day.  Apparently, Your Excellency wishes the war to be confined to Northeast and not South!  Such attitude will no doubt embolden the GoSL to pursue the military option with more vigour!

 

As Your Excellency is aware the GoSL after burying the CFA.  has declared 2008 as War Year.  Army Chief General Fonseka promises to kill 10 LTTE cadres a day and 3000 by the end of August.  Defence Secretary Gotabhaya Rajapakse had vowed to kill the LTTE leader and his deputies before the year is out.   He arrogantly declared that the army knew their hideouts and they will be taken one by one.  He has also proclaimed publicly that civilians suspected of LTTE supporters will be killed or abducted and executed.  In justification, he quoted the example of US itself.  This is what he told the Khaleej Times    on the spate of abductions for ransom and involuntary disappearances “I’m talking about terrorists.  Anything is fair.  When the US does operations, they say covert operations.  When something is (done) in Sri Lanka, they call it abductions…This is playing with words” (Khaleej Times – 12.6.2007).

 

Incidentaly Gotabhaya Rajapakse is a US citizen. Obviously, Mahinda Rajapakse's regime's imperviousness to human rights violations and the culture of impunity has now become legend.

 

In the backdrop of Mahinda Rajapakse and his cohorts beating the war drums what chance is there for your expectation that Only a political solution to the country’s conflict offers a way out of the current cycle of escalating violence?”  The ground reality belies the gap between wish and pious hope. 

 

Mahinda Rajapkse has already diluted and derailed the APRC to retain parliamentary support of the ultra racist out- fits like JVP and HU.  In fact, the JVP has demanded the dissolution of the APRC itself as a condition for such support!

 

More than once GoSL  has thumped its nose at the Co-Chairs, EU  and the international community (barring Pakistan, Israel (US allies)  and China)  dismissing the plea for a political solution and brazenly opting for a military solution.  But, Your  Excellency  continue to parrot  ad nauseam the mantra "Only a political solution to the country’s conflict offers a way out of the current cycle of escalating violence." It is like asking the dog to give up the bone.   Worse, the US is neither an honest broker nor a neutral party in the conflict between the Thamil Nation and the Sinhala Nation.

 

In an interview to Rupavahini on November 30, 2006 Your Excellency declared “We do support the Government, and as Under Secretary Burns said during the Co-Chairs' press conference last week, the US is not neutral in this particular conflict.  We have always been a strong supporter of the Government and we consider the LTTE as a terrorist organisation.”  True to form  US is  providing arms, ammunition, boats, radars,  training, surveillance and intelligence to the Sinhala army despite the fact the Head of the UNHCR accuses the GoSL of gross human rights violations and warning  human rights violators, including by those in positions of command,  of  criminal responsibility under international criminal law  for  war crimes and crimes against humanity.

 

There is only way to stop the war and stop the blood shed. The international community, especially the Co-Chairs, should stop the sale of arms and military hardware, cut off all aid, impose economic sanctions, and send UNHCR to monitor human rights violations in Sri Lanka. 

 

Finally, we like to remind Your Excellency the fact  87% of Sinhalese support the war, where as 95% of Thamils (and Muslims) oppose the war.  This clearly demonstrates who wants war and who needs peace.

BOLD AND DECISIVE  STEPS ARE NEEDED TO SAVE  THAMILS FROM GENOCIDE

Dear Hon. Minister,

Wide spread regret and unease have been expressed by UN Secretary-General, US, Britain, Canada,  Nordic countries, Japan, India, Australia, Norway and others over the decision by the Government of Sri Lanka (GoSL) to dump  the 2002 ceasefire agreement with the LTTE. This single act of the GoSL is an open declaration of war.  

Foreign Minister of Canada has said “Canada deeply regrets the decision of the government of Sri Lanka to withdraw from the 2002 Ceasefire Agreement."  But it is the marginalization of the Tamils by the international community, including Canada, the primary cause for the demise of the CFA. Singular inability of the international community to reign in Mahinda Rajapakse made it easy for him to dump the CFA and press ahead with the military option.  CFA was dealt a body blow after President Rajapakse wriggled out of the peace talks and ordered  the armed forces in 2006/2007  to “liberate” the east from the LTTE.  President Mahinda Rajapakse resorted to war in total defiance of the call by the international community to go for a negotiated settlement to resolve the conflict.  In unison they said there cannot be a military solution to the conflict.  However, President Mahinda Rajapakse refused to listen to such advice. And that won him plaudits from the Sinhalese constituency which perceived him as a “leader” standing up to the West.

During 2006/2007 the armed forces mounted a series of military operations that saw hundreds and thousands of Thamils displaced. There were abductions for ransom, execution style killings and cordon off and arrest of thousands of Thamils. In Jaffna, more than hundred Thamils sought voluntary imprisonment citing threat to their lives by the armed forces and government sponsored gunmen. Media freedom was curbed and journalists, both Thamils and Sinhalese, were killed.

T. Maheswaran, MP   in a TV talk show just a day before he was gunned down charged that “EPDP cadres kill at least six people on a daily basis in Jaffna and that a paramilitary outfit operating along with the armed forces is responsible for the killings. He threatened to expose Douglas Devananda, a Minister in Mahinda Rajapakse’s cabinet as the villain behind the killings. But the Co-Chairs and the rest of the world observed stoic silence to all these blatant human rights violations by President Rajapakse.  Canada was no exception and the bureaucrats of the Foreign Ministry remain unmoved like stones. They are oblivious to the fact that in Sri Lanka there is a genocidal and militaristic regime which is targeting Thamils irrespective of their political affiliation.

Canadian government whether Liberal or Conservative never took a proactive stand on the conflict. It is always a case of reacting to violent deaths lawmakers and civilians.   Press releases couched in pious language were issued as a matter of ritual and then everything forgotten till another disaster took place.

The single most factors that encouraged the Sri Lankan government to end the CFA and opt for all out war is the banning of the LTTE by the Conservative government in 2006. This unwise step gave the excuse to the GoSL to eliminate the Thamils under the cloak of eliminating “terrorism.”   President Rajapakse’s sibling Defence Secretary Gotabhaya commenting on the spate of abductions for ransom and involuntary disappearances dismissively said “I’m talking about terrorists. Anything is fair. When the US does operations, they say covert operations. When something is (done) in Sri Lanka, they call it abductions…This is playing with  words” (Khaleej Times – 12.6.2007). He has also vowed publicly to kill LTTE leader Prabhakaran and his comrades  one by one. He has also vowed to militarily defeat the LTTE and declared 2008 a war year.

The fighting in Sri Lanka is not a civil war. It is an ethnic war between people of  different race,  faith,  language and culture.  A whopping 87% of the Sinhalese people support the war. Conversely 95% of Thamils (also Muslims) oppose the war.  This reveals the great divide between the two nations.  Unable to free itself from a racially based majoritarian mindset GoSL has adopted Sinhala - Buddhist chauvinistic goals as its dominant national philosophy. This mind-set is preventing the Sinhala nation from seeking a solution to the Tamil national question based on justice and fairness.  Hence, the continued political subjugation, social oppression and economic deprivation of the Thamil people.

The Conservative government’s perception of “terrorism” is highly flawed. To label anyone who takes arms as a terrorist flies in the face of cold logic.  Thamil Canadians have been denied even offering humanitarian and medical help to thousands of families in need of food, shelter and cloth in the Northeast.  

In an interview to British Guardian newspaper (October 23, 2007) the Democratic presidential candidate Ms Hillary Clinton has called for a more nuanced approach to armed non-state actors fighting for liberation.  She explained “the bottom line is you can't lump all terrorists together.  I mean, what the Tamil Tigers are fighting for in Sri Lanka, or the Basque separatists in Spain, or the insurgents in al-Anbar province may only be connected by tactics. They may not share all that much in terms of what is the philosophical or ideological underpinning.”

When asked “do you think that the terrorists hate us for our freedoms, or do you think they have specific geopolitical objectives?”  She replied “Well, I believe that terrorism is a tool that has been utilized throughout history to achieve certain objectives. Some have been ideological, others territorial. There are personality-driven terroristic objectives.”

There is no comparison between the secular LTTE which is fighting for the restoration of status quo ante of a state they lost to the Western colonists and the fanatical religious armed groups like the Al - Qaeda!  Philosophically and ideologically they stand poles apart.

The ethnic conflict is one which had defied a political solution for over six decades since independence in 1948. The enmity between the protagonists is deep seated and historical. Canadian government should not remain complacent after issuing innocuous statements without follow up action.  De-listing of LTTE, recognizing the sovereignty  of the Thamil people, imposing economic sanctions and cutting off all aid will send a powerful message to the hawkish  President Mahinda Rajapakse to come to his senses.  Bold  and decisive steps are needed urgently to save the Thamil people from genocide.
