Bombing of Voice of Tigers Radio Station that killed  5 staff

Dear  Mr.Matsuura 

We wish to congratulate you for condemning without mincing words  the bombing of Voice of Tigers radio station that killed five  of the station staff .  For far too long the GoSL has been let off the hook by the international community for violating with impunity basic human rights and freedoms.  Undoubtedly,  the GoSL under Mahinda Rajapakse is steadily sliding into anarchy and the rule of law is breaking down fast.  Being a rogue state that cares little  for public opinion,  it has launched a vilification campaign against you and the UNESCO. This is not surprising since senior Ministers of the GoSL have vilified high ranking UN diplomats critical of the human rights record of GoSL in recent times. UN diplomats like Allen Rock, Special Advisor to the UN Special Representative for Children and Armed Conflict, were subject to innuendos by Minister Keheliya Rambukwella who questioned un-ashamedly his personal character.  (Transcurrents -November 18th, 2006)

 

The same fate fell on John Holmes, U.N. Undersecretary-General for humanitarian affairs.  Jeyaraj Fernandopulle, the government's chief whip in Parliament and a senior Cabinet minister branded Holmes a "terrorist" who is in the pocket of the Liberation Tigers of Tamil Eelam (LTTE) rebel group. "I think the LTTE has bribed Holmes. Otherwise he would not have done such a wrong thing," Fernandopulle said.  (The Associated Press - Wednesday, August 15, 2007)

 

A few weeks back Gotabhaya Rajapakse, Defence Secretary and Presidential sibling in an interview to BBC (Sinhala Service) justified the expulsion of over three-hundred North-East Thamils from Colombo. He told the non-Asian world that Sri Lanka can do without it and did his best to sound belligerent and unaccommodating, not only towards the LTTE but also towards Lankan Thamils and the international community. The  outpouring  devoid of commonsense and circumspection of a  senior and responsible official  is simply beyond  belief.  

 

Commenting about abductions for ransom and involuntary disappearances  Defence Secretary Rajapakse dismissively said “I’m talking about terrorists. Anything is fair. When the US does operations, they say covert operations. When something is (done) in Sri Lanka, they call it abductions…This is playing with  words” (Khaleej Times – 12.6.2007).  It is indeed true the CIA abducts and incarcerates people illegally in the name of war against terrorism.  Guantanamo prison camp and other secret CIA installations hold hundreds of   illegally abducted terror suspects.  CIA arranges secret flights transferring such suspects from one location to another.  Such actions are morally wrong and politically counterproductive to win the war against terror.  International human rights groups such as the Human Rights Watch and Amnesty International have criticized US human rights violations.

 

Regrettably   instead of  condemning  violations committed by US,  the Defence Secretary is invoking  those very violations to justify GoSL violations. To cite US abductions to justify Sri Lanka’s abductions is simply dim-witted and unfair. Both are abductions; both are illegal and both deserve to be condemned. What is worrying is Rajapakse’s implicit admission of GoSL’s complicity in the abductions by calling  them American style covert operations. His comments serve to confirm  the charge that the regime is either directly or indirectly responsible for the abductions.

 

UNESCO should continue to take Sri Lanka to task for gross violations of human rights and freedoms and not whittled down under pressure or threat by the GoSL. As the upholder of universal respect for justice, for the rule of law and for  human rights and fundamental freedoms without distinction of race, sex, language or religion under  the Charter of the United Nations,  the UNESCO is the last hope of victims of STATE TERRORISM. Thamil People Suffer Racial Discrimination Because They Do Not Have An Independent State

 

We are appalled at the use of  tear gas and water cannon  by the Malaysian police to break-up a peaceful procession taken  by Malaysian Thamils. They were  protesting  race-based discrimination in  Malaysia and  planned  to go in a procession to the British Embassy.   It was very unfortunate the Malaysian  police resorted to force against Thamils who were marching peacefully.

 

It is a fact of life that those Thamils who were taken as indentured labour by the British government continue to be treated as second or third class citizens in countries they settled in. Neither India or British bother about them.

 

More than a million Thamils were taken to Ceylon (now Sri Lanka) from 1837 onwards as cheap labour for the large scale coffee and rubber plantations opened up by the British. They were paid a pittance of a wage and housed in barrack like ghettos not fit for even animals.  Nearly all of them were poor and illiterate and often  accustomed to social inferiority, discrimination and oppression. To the Sinhalese they were a slaving Thamil community.  

 

Immediately after independence Thamils of Indian origin  were deprived of their citizenship and franchise rights by a government dominated by Sinhalese.  Though they form the backbone of Sri Lanka’s economy they remain the wretched of the wretched on earth, exploited  and marginalised.  After 59 years of independence they are at the bottom of the ladder in every sector of life subjected to severe discrimination by successive Sinhalese-dominated governments.  The Cinderella treatment accorded to the Hill country Indian community was in a way linked to the name "Indian Tamils". Their leaders like Arumugam Thondaman have woefully failed to improve their living conditions.

 

The woes of Thamils of Indian origin whether in Malaysia, Sri Lanka or Mauritius is entirely due to the step motherly attitude of the Indian government which is dominated by Hindi speaking politicians. It is no secret that North Indian politicians treat Thamilians as people  born to lesser gods!

 

The refusal of the centre to allow shipment of foodstuffs collected by Thiru Pazha Nedumaran  through Red Cross to the starving Thamils in  Jaffna is a case in point. Or the total indifference shown by Delhi when Thamil Nadu fishermen are shot like dogs and their boats and nets destroyed by a trigger happy Sri Lanka navy.  And this takes place  under the nose of a Chief Minister who is revered as the leader of the Thamil race.

The discrimination of Thamils in Malaysia and Sri Lanka has a striking similarity – both have governments dominated by extremists who claim racial and religious superiority.   

Thamils would not face this situation if the 80 million Thamils living all over the globe have a country of their own. It is only the creation of an independent Thamil Eelam that will provide the necessary  political insurance  for all the Thamils scattered through out the world.

We ask the governments of India to take immediate steps to ensure that Thamils of Indian origin in Malaysia are treated equally and justly on par with other citizens.  The acid test of democracy is the equal treatment of its citizens.

UN should take Mahinda Rajapakse’s government to task

We write in continuation of our letter dated November 22, 2007  on the above subject. 

 

We have since come to know that the actual number of aid workers killed were 61 - NOT 24 – 21 in  2006 and 3 in 2007 -  during the years 2006 and 2007. To substantiate this figure we attach herewith a list showing “Abductions and killings of humanitarian workers during 2005-2007 (September)” compiled by the Law & Society Trust (Sri Lanka) and the Tamil Rehabilitation Organization (TRO).

 

This list is an indication of the grave and dangerous situation faced by aid workers operating in the Northeast of the country. The Government of Sri Lanka (GoSL)  has failed to take any meaningful steps to halt the spree of killings and abductions of aid workers.  And the government continues to drag its feet in investigating   and prosecuting those involved in the murder of 17 aid workers attached to the French charity Action Contre le Faim.

 

The government of Mahinda Rajapakse is callously disregarding the appeal by human rights organizations like Amnesty International (AI) Human Rights Watch (HRW) etc. to bring an end to extra-judicial killings and abductions for ransom. The number of people killed by bombing and shelling by the armed forces are on the increase. The Sri Lanka Monitoring Mission (SLMM) in  a statement while expressing grave concern said  that 49 civilians  have been killed  and 60 injured  in 4 days from  25 to 28 November (The Hindu -  Nov 30).   Alarmed at the escalation of civilian casualties SLMM on Thursday (November 29) said the violence witnessed now was similar to what was seen prior to the signing of the Ceasefire Agreement (CFA) in 2002.

 

To add fuel to fire and in a naked display of political arrogance the hard lined Sinhala – Buddhist Prime Minister Ratnasiri Wickremanayake told parliament  the aerial strikes  of Vanni will continue unabated!  He was responding to  minority Tamil parties appeal to  the government to stop air raids in rebel-held areas as civilians were getting  killed by the strikes. Such bellicose statement by a Prime Minister steeped in Sinhala – Buddhist chauvinism is proof that his government wants to  stoke the flames of war irrespective of the serious  consequences. A human tragedy of giant proportions will result if a full blown war is to break out  any time soon. 

 

UN ought to take concrete measures as opposed to pious appeals to halt the horrendous human rights and humanitarian law  violations taking place in Sri Lanka in a climate of total impunity.

We are pleased Your Excellency has issued another report that states "In the past 14 months, 24 aid workers were killed in Sri Lanka - 21 in 2006 and 3 in 2007."

To this list we must add the young male worker attached to the demining agency Halo Trust in Jaffna who was shot and killed on November 18, 2007. As Your Excellency highlighted in your earlier statement there is no progress in the investigation into the murders of the 17 local aid workers attached to the French charity Action Contre le Faim.

The human rights abuses and security far from showing any progress is deteriorating daily. A climate of impunity from prosecution prevails all round. What is worse the perpetrators of human rights violations are none other than the armed forces or those Para military groups operating with them.

On November 19, Pillaiyan Paramilitary group in the east abducted S.Sajitharan, son-in-law of Tamil National Alliance (TNA) MP T. Kanagasabai and threatened to kill him if the MP voted against the budget. The abduction took place despite police security posted to the MP's house. Family members of 2 more Thamil parliamentarians in Batticaloa were also threatened by the same armed group after their police protection was withdrawn. Government Whip and senior Cabinet Minister Jeyaraj Fernandopulle brazenly told parliament that government will not provide security to families of TNA MPs. (Daily Mirror – Nov 20, 2007)

According to ICRC the military incursion into LTTE front lines in Muhamalai south of Jaffna and along the Vavuniya-Mannar line of control has displaced 22,000 Thamils since September, 2007. Over 100 resettled Thamils in Eachilampathai, Trincomalee district are once again leaving their villages to Batticaloa after the arrest of 30 villagers by the Sinhala army. Apparently they do not feel safe in their villages.

Yesterday about 15 armed men carrying T 56 rifles forced themselves into the Sunday Leader printing press situated in Ratmalana and set fire to it after threatening the employees to kneel down. Ironically, the press was located in a high security zone outside Colombo. Obviously, the government and the armed forces are complicit in this heinous crime and assault on press freedom.

Reporters without Borders has condemned the arson attack on the printing press of the Sunday Leader media group. RWB said the attack must have had support within the security forces. This press was set on fire in 2005 in the run-up to the last Presidential Election but the perpetrators of the crime were never apprehended or brought to justice.

Such despicable acts and conduct are an absolute insult to the sublime philosophy of Buddhism which has universal relevance based on the four noble truths and the eightfold path. Buddhism has been afforded foremost place and state patronage by the GoSL.

There should be no doubt on anyone's mind that Sri Lanka under Mahinda Rajapakse is sliding into anarchy and the rule of law is breaking down fast.

We appeal again to the UN to take decisive steps to impose economic sanctions on the rogue state of Sri Lanka which is running riot. Unless the UN takes GoSL to task the security, law and order situation is bound to turn from bad to worse.

Kanagasabai and threatened to kill him if the MP voted against the budget.   The abduction took place despite police security posted to the MP’s house. Family members of  2 more Thamil parliamentarians in Batticaloa were also threatened by the same armed group after their police protection was withdrawn. Government Whip and senior Cabinet Minister Jeyaraj Fernandopulle brazenly told parliament that government will not provide security to families of TNA MPs. (Daily Mirror – Nov 20, 2007)  

According to ICRC the military incursion into LTTE front lines in Muhamalai south of Jaffna and along the Vavuniya-Mannar line of control has displaced 22,000 Thamils since September, 2007.  Over 100 resettled Thamils in Eachilampathai, Trincomalee district are once again leaving their villages to Batticaloa after the arrest of 30 villagers by the Sinhala army. Apparently they do not feel safe in their villages.

Yesterday about 15 armed men carrying T 56 rifles forced themselves into the Sunday Leader printing press situated in Ratmalana and set fire to it after threatening the employees to kneel down.  Ironically, the press was located in a high security zone outside Colombo.   Obviously, the government and the armed forces are complicit in this heinous crime and assault on press freedom.

Reporters without Borders has condemned the arson attack on the printing press of the Sunday Leader media group. RWB said the attack must have had support within the security forces. This press was set on fire in 2005 in the run-up to the last Presidential Election but the perpetrators of the crime were never apprehended or brought to justice.

Such despicable acts and conduct are an absolute insult to the sublime philosophy of Buddhism which has universal relevance based on the four noble truths and the eightfold path. Buddhism has been afforded foremost place and state patronage by the GoSL.

There should be no doubt on anyone’s mind that Sri Lanka under Mahinda Rajapakse is sliding into anarchy and the rule of law is breaking down fast.    

We appeal again to the UN to take decisive steps to impose economic sanctions on the rogue state of Sri Lanka which is running riot. Unless the UN takes  GoSL to task the security, law and order situation is bound to turn from  bad to worse,

UN should impose economic sanctions even on a limited scale on GoSL  

Dear Hon. Ban Ki-Moon,

We welcome your report to the UN General assembly saying that very little progress has been made  by the Government of Sri Lanka (GoSL) to stem the tide of large scale  human rights violations taking place. You have called  for “greater protection of civilians affected by conflict in Sri Lanka.”  While you have identified the problems plaguing  Sri Lanka,  you have not spelled out any concrete measures to remedy or reverse the deteriorating human rights situation.   

It is more than one year since the appointment of the Commission of Inquiry (CoI) and the Government established commission investigating human rights abuses, including the killing of 17 staff members of Action Contre La Faim in August 2006,  have made little or no progress.  The same goes to other high profile killings that include three prominent parliamentarians of the Tamil National Alliance (TNA)  by the Sri Lankan military intelligence. 

In fact the IIGEP has said it has no confidence on the work of the COI. In the meantime human rights violations that include killings, abductions, forced disappearances etc  have increased by leaps and bounds. A letter written by  Human Right Watch  to members of the U.S. Congress that "there has been a significant jump in abuses by government forces such as indiscriminate shelling, extrajudicial executions and forced disappearances,"

The GoSL while paying lip service to peace talks is engaged in waging total war against the Liberation Tigers of Thamil Eelam (LTTE).  President Mahinda Rajapakse has turned his back on Northeast being the traditional habitat of the Thamil people, merger of Northeast as a single unit, sharing of power under a federal constitution and the right of self-determination of the Thamil people. In short he has put the clock back by 60 years and the ethnic conflict is back to square one.

That the GoSL is hell-bent on a military solution is confirmed by the planned increase in defence expenditure by 20% to 166.4bn rupees ($1.48bn) from 139.6bn ($1.3bn) in 2007.

Despite several reports by high ranking UN diplomats officials critical of the human rights record of GoSL little or nothing has been done to arrest the worsening situation. Instead UN diplomats like Allen Rock, Special Advisor to the UN Special Representative for Children and Armed Conflict, were subject to innuendos by Minister Keheliya  Rambukwella who questioned un-ashamedly his personal character.  (Transcurrents -November 18th, 2006)

The same fate fell on John Holmes — the U.N. undersecretary-general for humanitarian affairs.  Jeyaraj Fernandopulle, the government's chief whip in Parliament and a Cabinet minister branded Holmes a "terrorist" who is in the pocket of the Liberation Tigers of Tamil Eelam rebel group. "I think the LTTE has bribed Holmes. Otherwise he would not have done such a wrong thing," Fernandopulle said.  (The Associated Press Wednesday, August 15, 2007)

Strangely, but not surprisingly this is the same regime  that  protests  loudly about child conscription by the LTTE and urging the international community  to penalise the LTTE.

Even peace envoy and the Norwegian International Development Minister, Erik Solheim, was the focus of Colombo's ire. Dissatisfied with Solheim's approach to peace process, Sinhala nationalists accused him of bias, labelled him a "White Tiger" and called for his ouster.  State-run media accused Solheim of joining LTTE rallies in Norway, of accepting money from Tigers and in turn providing material assistance to Tigers.  

Thamil people continue to face aerial bombardments, artillery shellings, economic sanctions and other   horrors and indignities of the war.

The second submission by the Law and Society Trust (LST) to the Presidential Commission of Inquiry into Serious Human Rights Violations, states that five persons are either killed or disappear each day in Sri Lanka. “14 humanitarian and religious leaders have been killed and nine humanitarian workers have disappeared between January 1 and August 31, 2007. Three media personnel have been killed and five media personnel have disappeared.  662 persons have been killed and 540 persons have disappeared between January 1 and August 31, 2007. Twenty-five children have been killed and 43 have disappeared during this period,” says the report. 

Sri Lanka’s Army Commander Sarath Fonseka has admitted to killings and abductions of Thamils in an interview  to British investigative reporters. Asked about human rights abuses in the newly captured Eastern he confessed  to the fact that the abductions and disappearances will go on implying the army (intelligence wing) is responsible for the current spate of abductions and forced disappearances. Defence Secretary (brother of President Mahinda Rajapakse)  Gothabaya Rajapakse  told reporters that abductions and  killings are “fair means” to fight “terrorism” and attacked the international community of practicing double standards.  

We, therefore, urge  you to take concrete steps that will compel the GoSL to opt for a negotiated settlement of the conflict instead of a bloody and costly war.  Simply barking at the GoSL will not suffice. The UNO should do some biting as well. Economic sanctions even on a limited scale is the way to knock some sanity into head of President Mahinda Rajapakse to make him see reason.

We wish to draw your attention to the 30 years armed conflict in the island of Ceylon (Sri Lanka) between the Liberation Tigers of Thamil Eelam (LTTE) and the Sri Lanka. The war has taken a turn for the worse after the cowardly and brutal killing of Brigadier S.P.Thamilchelvan and six of his comrades by bombing his residence in Kilinochchi.

 

As Your Excellency may be aware Brigadier Thamilchelvan was Head of the Political Division of Thamil Tigers of Thamil Eelam (LTTE) since 1993. He was a leading member of the LTTE negotiating team at the peace talks between the GoSl) during 2002 -2006. After the demise of Dr.Anton Balasingham in 2006 he led the peace talks held in Geneva.

  

We are sad to mention the fact that the plane that dropped the bomb which killed Brigadier Thamilchelvan was none other than Israeli manufactured Kfir supersonic bomber.

 

Unfortunately, the Israel has a long of record of selling arms, ammunition, fighter planes,   Gun boats and other military hardware to the racist GoSL for a considerable number of years.

 

During WW2, the Nazis sent 5 million Jews to the gas chambers merely because of their ethnicity. It was ethnic cleansing and outright genocide by Nazis.

 

Thanks are due to the allied forces for defeating the Nazi army and freeing the remaining Jews from concentration camps run by Nazis.
 

GoSL is exactly following the Nazi supremacist racist philosophy to ethnically cleanse Thamils.  Sinhala occupation army is engaged in execution style killings, abductions for ransom, involuntary disappearances, torture etc.
