The International Secretariat of OMCT has received new information of the following situation in Sri Lanka.
Brief description of the situation:
The International Secretariat was informed by reliable sources of the rape and murder of Ms Fahreen Ida Carmelitta Laila or Ida Caremelitta, a 21 year old woman, by 5 soldiers on the night of July 12th 1999 in Pallimunai village on Mannar Island.
According to the information received, five masked men, heavily armed, entered the house of Ida Caremelitta and while the family was sleeping took her out of the house and violently raped and killed her. The post mortem report submitted by Dr Emmanuel Pieries (the district medical officer of Mannar) observed that Ida Caremelitta had been repeatedly raped. Her lips and breast had been bitten off and she had received gunshots through her genitals.
In an identification parade, two people, one of which was the brother of Ida Caremelitta, positively identified two individuals as the offenders. They were arrested and taken to Anuradhapura Jail (See case LKA 100899. VAW).
New information: The International Secretariat of OMCT has received new information concerning the case from the High Commission for Sri Lanka in Australia (representing the Sri Lankan Government). This information has been received through a reliable intermediary. According to the information, the rape and murder of Ida Carmelitta has been brought to the notice of the Secretary/Defence by the IGP and that the former has instructed DIG/CID to proceed immediately with investigations into this crime.
According to the information received, two out of the eleven soldiers attached to the Army Camp Pallemunai were positively identified: Dayantha Upul Gunasinghe and Raja Somaratne. This case is presently pending before the Magistrate's Court of Mannar (Case N?13/195/99).
The International Secretariat of OMCT would like to thank all the members of the network and all other organisations and individuals for the action undertaken following our appeals. However, the International Secretariat expresses its grave concern over the continued reports of torture, including rape of both women and young girls by Sri Lankan soldiers during the ongoing conflict in Sri Lanka. Previous cases suggest that many rapes often go unpunished and without any remedies and reparations.
Action requested:
Please write to the authorities of Sri Lanka urging them to:
i. guarantee an impartial and exhaustive inquiry into the rape and killing of Ida Carmelitta, bring those responsible before a competent and impartial tribunal and apply the penal, civil and administrative sanctions provided by law;
ii. guarantee the physical and psychological integrity of the family of Ms Ida Caremelitta and ensure them the right to adequate remedies and reparations;
iii. adopt immediate measures to put an end to these acts of torture and killings;
iv. ensure in all circumstances respect for human rights and fundamental freedoms in accordance with national laws and international human rights standards.
RECOMMENDED ACTION
AHRC condemns the torture, rape and killing of Ida Carmelitta. We encourage you to write letters, faxes, and emails expressing your strong concern on this case.
1. Expressing deep concern that Ida Carmelitta was tortured, raped and killed by the military;
2. An impartial inquiry be conducted into the July 12th torture, rape and killing of Ida Carmelitta;
3. Perpetrators of this heinous act to be brought to justice;
4. The government to take measures to prevent such heinous acts from happening again.
